ADJOURNED TOWN MEETING, MARCH 21, 1945

The adjourned meeting was called to order by Mod- erator John F. Curran at 8 P.M.


The Monitors checked the lists and found that there were only 109 members present. It was then voted to re- cess for fifteen minutes. Joseph L. DeLuca, Monitor of Precinct 2 was absent and Marco A. Balzarini, Jr. was ap- pointed to take his place and duly sworn in.


The second check showed 121 members present, a suf- ficient number to constitute a quorum and the meeting proceeded.


The Town Clerk was absent and the Moderator called for nominations for a Temporary Clerk. It was moved and seconded that Katherine E. Cullinan be appointed Temporary Clerk. No other names being submitted the nominations were closed, and, one ballot was cast by the Chairman of Selectmen, Adam F. Diorio.

The following Committee was appointed by the Mod- erator to draw up rules for use at Town Meetings:


Precinct 1. Paul R. Raftery.


Precinct 2. Joseph L. DeLuca.


Precinct 3. Judge Chester F. Williams.


Precinct 4. James E. Birmingham.


Precinct 5. Walter E. Corbett.


At Large: Cyril F. Kellett, Judge William A. Mur- ray, Town Counsel, and Catherine L. Coyne, Town Clerk.


Mr. Birmingham was appointed Chairman of the rules committee.


It was voted to take up Article 34.


A motion was made that the Town of Milford adopt and accept G. L. Chapter 31, Sec. 4, as amended by 1929, Acts, Chapter 134, which provides that the following may be included within the classified Civil Service by Rules of the Commission, as follows:


"Janitors of School Buildings in certain Towns- Janitors of School buildings in cities and in such towns of over twelve thousand inhabitants as accept this para- graph."


It was moved and seconded that this motion be with- drawn.


A motion was made that the town accept the provi- sions of G. L. (Ter. Ed.) Chap. 31, Sec. 4, relative to plac- ing Janitors in the Town of Milford of School Buildings under provisions of said Chapter, and it was

Voted: That the sum of Nineteen thousand Eight Hundred ($19,800.00) dollars be raised and appropriated for the purpose of providing a special compensation ad- justment of One Hundred and Fifty ($150.00) Dollars for the year 1945 for all full-time appointive employees of the Town, including school teachers, and including those school teachers who received a step raise in pay and those who received an increase in pay resulting from promotion to a higher salaried position, and the elected office of the Tax Collector, except; those employees receiving increases over and above the recommendation of the Finance Com- mittee. This adjustment shall be in lieu of any other in- creases in pay until December 31, 1945 and an acceptance of this adjustment shall constitute a waiver by any De- partment and such emplyees of granting or receiving any other increases in pay until December 31, 1945.


The payment of said compensation adjustment to be retroactive to January 1, 1945 and is to be made as follows:


Thirty-seven dollars and fifty ($37.50) cents payable April 1, 1945, if said employees are in the employ of the Town on April 1, 1945, and the sum of $12.50 on the last pay day of each month beginning with April to said em- ployees who are in the employ of the Town of Milford on respective payment dates.


Voted: To pass over the remainder of the article.


Article 5. Voted: That the salary of the Collector of Taxes for the ensuing year be set at Thirty-five hundred ($3,500.00) dollars.

Article 6. Voted: That the Town vote to appro- priate the Dog Tax of Sixteen hundred sixty ($1,660.96) dollars and ninety-six cents for Town Library.

Article 7. Voted: That the Town vote to choose Mrs. Lillian Luby as Director of County Aid to Agricul- ture in accordance with Provisions of Chapter 128 of the G. L.

Article 8. Voted: That the Town authorize the Se- lectmen to sell any or all real estate owned by the Town by reason of the foreclosure of tax titles thereon, and to execute, acknowledge and deliver a proper deed or deeds therefor authority to terminate March 1, 1946.

Article 9. Voted: That the Town appropriate from available funds under the Excess and Deficiency Account the sum not to exceed Fifty thousand ($50,000.00) dollars for use by the Board of Assessors in fixing the Tax Rate for 1945.

Article 11. Voted: That the Town vote to establish the Annual Salary of each Selectman at Five hundred ($500.00) dollars.

Article 13. Voted: That the Town vote to accept and allow the report of the Selectmen on the laying out of a public way a private way known as So. Cemetery Street from Depot Street.

Article 14. Voted: That the Town vote to rescind action taken under Article 7 of the Special Town Meet- ing held September 6, 1944 wherein the Selectmen were authorized to sell the Braggville School Property.

Article 16. Voted: £ That the Town vote to raise and appropriate the sum of Three thousand ($3,000.00) dollars for the purpose of constructing additional drainage on Central Street from the Charles River westerly towards Depot Street.

Article 17. Voted: That the Town vote to transfer from available funds the sum of Thirty thousand ($30,000.00) dollars to be used for the purpose of purchas- ing new equipment for the Highway Department, money to be expended under the Supervision of the Finance Com- mission and Highway Surveyor.


Voted: To pass over the remainder of the article.


Article 18. Voted: That the town vote to authorize the Selectmen to sell a certain piece of land located on Greene Street.


Voted: To pass over the remainder of the article.


Article 19. Voted: That the Town vote to raise and appropriate the sum of Seventy-eight hundred sixty-five ($7,865.00) dollars for the purpose of meeting the cost of painting and repairing the exterior of the Town Hall Building.


Voted: To pass over the remainder of the article.


Article 20. A motion was made to see if the Town will vote to raise and appropriate the sum of Twenty-five hundred eighteen dollars and fifty ($2,518.50) cents, for the purpose of constructing a drainage project on John Street.


An amendment was made changing the amount of money to be expended to Twenty-one hundred fifty-eight dollars and fifty ($2,158.50) cents and said money to be spent under the supervision of the Highway Surveyor.


Voted: That the town vote to raise and appropriate the sum of Twenty-one hundred fifty-eight dollars and fifty ($2,158.50) cents for the purpose of constructing a drainage project on John Street, said money to be spent under the supervision of the Highway Surveyor.

Article 21. Voted: That the Town vote to raise and appropriate the sum of Fifteen hundred ninety-three ($1,593.00) dollars for the purpose of meeting the cost of the construction of a drainage project on Highland Street.

Article 22. Voted: That the Town vote to raise and appropriate the sum of One hundred ($100.00) dollars for use of the Zoning Board to consist of Five Members, one from each precinct to be appointed by the Selectmen un- der the Provisions of G. L. (Ter. Ed.) Chap. 40, Sec. 25-30A as amended.

Article 23. Voted: That the town vote to raise and appropriate the sum of One hundred fifty ($150.00) dollars for the purpose of constructing cement retaining walls at or near the entrances to the foot bridge over Cedar Swamp Pond.

Article 24. Voted: That the Town fix the annual salary of the Superintendent of Sewers at the rate of Two thousand twenty-four ($2,024.00) dollars per annum, said salary to be appropriated from the Sewer Appropriation for Salaries and Wages for the year in which said office is created.

Article 25. Voted: That the Town vote to raise and appropriate the sum of One thousand ($1,000.00) dollars for improvements to Fisk Mill Road Bridge, said money to be used in conjunction with any money which may be allotted by the Town of Upton, the County of Worcester or Commonwealth of Massachusetts, or either of them for this purpose, the same to be expended under the super- vision of the Selectmen and Highway Surveyor.

Article 26: Voted: That the Town vote to raise and appropriate the sum of Thirty-seven hundred seventy-five ($3,775.00) dollars for the purpose of installing a sewer.on Florence Street.

Article 27. Voted: That the Town vote to raise and appropriate the sum of Six hundred ($600.00) dollars to install emergency lighting in the Town Hall as required by the State Building Inspection Department.

Article 28. Voted: That the Town vote to accept and allow the report of the Selectmen on the laying out of a public way a private way known as Finley Court.


Voted: To pass over the remainder of the article.


Article 29. Voted: That the Town accept the report of the Committee appointed at the Annual Town Meeting of 1944 to investigate the advisability of the Town estab- lishing a Town Forest.


Voted: To pass over the remainder of the article.


Article 30. Voted: That the town of Milford estab- lish a Town Forest and provide the necessary manage- ment.


That a special Town Forest Committee be appointed by the Selectmen to be composed of three members, who shall choose their own chairman and shall serve without compensation.


One member of said committee shall be appointed each year for a term of three years, except that, when first ap- pointed one shall be appointed for a term of three years, one for a term of two years, one for a term of one year.

Article 31. Voted: That the town vote to accept G. L. (Ter. Ed.) Chap. 48, Sec. 58A whereby the hours of duty of permanent members of the uniformed fire fighting force in the Fire Department of the Town of Milford shall not exceed seventy (70), average weekly hours of duty in any year.


Voted: To pass over the remainder of the article.


Article 32. Voted: That the Town proceed to elect a recreation commission for the purpose of exercising the powers conferred by G. L. (Ter. Ed.) Chap. 45, Sec. 14, re- lative to the establishment of a recreation center.


John F. Maher submitted the name of the Select- men, Adam F. Diorio, Patrick Carroll and John H. Hen- derson. As no other names were submitted the nomina- tions were declared closed.


A motion was made and seconded that one ballot be cast by the Temporary Clerk bearing the name of the three Selectmen and it was Voted: That the Selectmen be elected as a recreation commission for the purpose of exercising the powers conferred by G. L. (Ter. Ed.) Chap. 45, Sec. 14, relative to the establishment of a recreation center.


Voted: That the sum of Five hundred ($500.00) dol- lars be transferred from the Civilian Defense Account to be used for the benefit of a recreation center to be known as the Teen Age Canteen, said money to be spent under the supervision of the Selectmen acting as a recreation commission.


Voted: To pass over the remainder of the article.


Article 33. Voted: That the Town accept the provi- sions of Gen. Laws (Ter. Ed.) Chap. 94, Sec. 120A as amended (inserted by Chapter 496 Acts of 1924 and amended by Sec. 4 of Chap. 332 of the Acts of 1943.)

Article 35. Voted: That the Town vote that with the election of 1946, the Tax Collector shall be elected for a term of three years instead of for one year as at present.

Article 37. A motion was made that the Town vote to raise and appropriate the sum of Twenty-five hundred ($2,500.00) dollars for the reconstruction of Camp Street, said money to be spent under the supervision of the Select- men and the Highway Surveyor.

In the name of the Commonwealth aforesaid, you are hereby required to notify and warn the inhabitants of the Town of Milford qualified by law to vote in Town Affairs, to meet in the Town Hall in said Town on the seventh day of September A.D. 1945 at eight o'clock in the evening, then and there to act upon the following articles:


Article 1. To see if the Town will vote to appropriate from available funds a sum of money to the Old Age As- sistance Account under the jurisdiction of the Board of Public Welfare, or take any action in relation thereto.


Article 2. To see if the Town will vote to appro- priate from available funds a sum of money to the Aid to Dependent Children Account under the jurisdiction of the Board of Public Welfare, or take any action in relation thereto.


Article 3. To see if the Town will vote to appro- priate from available funds a sum of money to the Gen- eral Welfare Account under the jurisdiction of the Board of Public Welfare, or take any action in relation thereto.


Article 4. To see if the Town will vote to accept the recommendations of the Zoning Board appointed by the Selectmen under Article 22 of the Annual Town Meeting of 1945 in accordance with G. L. (Ter. Ed.) Chapter 40, Sec. 25 to 30B inclusive for the purpose of originally establish- ing the boundaries of the districts and the regulations and restrictions to be enforced therein, and adopt such or- dinances or by-laws with respect thereto as may be con- tained in said recommendations; or take any action in relation thereto.


Article 5. To see if the Town will vote to appropriate from available funds the sum of Twelve hundred twenty- seven dollars and forty-six cents ($1,227.46) for the pur- pose of paying the balance due for repairing the Town Hall Tower, or take any action in relation thereto.


Article 6. To see if the Town will vote to appro- priate from available funds the sum of Six hundred sev- enty-five ($675.00) dollars to the Selectmen's Salary and Wages Account, or take any action in relation thereto.

Article 7. To see if the Town will vote to appro- priate from available funds the sum of Five hundred ninety-four dollars and fifty-four cents ($594.54) to the Election, Registration and Town Meeting Salary and Wages Account, or take any action in relation thereto.


Article 8. To see if the Town will vote to appropriate from available funds the sum of Two Thousand fifty ($2,050.00) dollars to the account of Pay of Members in the Fire Department, or take any action in relation thereto.


Article 9. To see if the Town will vote to authorize the Park Commissioners to legally give a name to the Hayward Field Playground so-called, or take any action in relation thereto.


Article 10. To see if the Town will vote to authorize the Selectmen to legally give a name to the Athletic Field located on the Cedar Swamp Pond Property, or take any action in relation thereto.


Article 11. To see if the Town will vote to appro- priate from available funds a sum of money for the pur- pose of constructing a sewer on Dilla Street, or take any action in relation thereto.


Article 12. To see if the Town will vote to appro- priate from available funds the sum of Two thousand ($2,000.00) dollars for the purpose of repairing additional gutters, roof on vent and miscellaneous repairs to the ex- terior of the Town Hall, or take any action in relation thereto.


Article 13. To see if the Town will vote to transfer the sum of Two hundred seventy-five ($275.00) dollars . from the appropriation for Interest, to the Salary and Wages Account-Treasury Department, or take any action in relation thereto.


Article 14. To see if the Town will vote to appro- priate from the Fire Damage Account to the Highway Department, such sum of money as may be paid to the Town for fire damage to the snow loader, to the snow removal appropriation of the Highway Department, or take any action in relation thereto.

Article 15. To see if the Town will vote to extend to the Highway Surveyor the provisions of the article enact- ed at the last Annual Town Meeting whereby it was voted to provide a special compensation adjustment for certain appointed Town employees, and elected Town Officers, and appropriate One hundred and fifty ($150.00) dollars from available funds for the purpose of paying said ad- justed compensation, or take any action in relation thereto.


Article 16. To see if the Town will vote to appro- priate from available funds a sum of money to meet a deficiency in the cost of providing the Special Compensa- tion Adjustment voted under Article 15 at the Annual Town Meeting of 1945, or take any action in relation thereto.


And you are hereby directed to serve this Warrant by publishing at least seven days before said meeting an at- tested copy of this warrant in the Milford Daily News, a newspaper published and having a general circulation in the Town of Milford, and by posting at least seven days before said meeting attested copies of this warrant in five or more public places located in said Milford.


Hereof Fail Not, and make due return of this Warrant with your doings thereon to the Clerk of said Town at the time of said meeting aforesaid.
