Annual Report of the Board of Selectmen


On March 7, 1950 the board organized and chose John J. Casey as Chairman.


The first few months of the administration were especially busy and required many decisions of great importance to the townspeople. The Police Force was augmented by the appointment of new, regular and re- serve patrolmen to bring it up to its authorized strength. A new Sergeant was appointed so that there would be one Sergeant on duty at all times. It was hoped that thereby it would be possible to keep the Police Station open 24 hours a day.


With regard to the demolition of the old Washing- ton Block, and the construction of a new building in its place, the Board was adamant in its stand that the owners comply with the towns Zoning Laws and By- Laws. In view of this fact a two story building now stands on the site of the former Washington Block.

We completed the purchase of the Stone Property at 1-3-5-7 Main Street for their appraised value of $9800.00 in compliance with the vote of the last two town meetings. We immediately caused the buildings to be in- sured for the appraised value of $3600.00. Shortly there- after and within one week of each other, both buildings were damaged by fire. For the damage to the property the insurance company paid the town the sum of $1900.00 which was more than it cost the town to demolish the buildings.


This administration has continued several of the policies of previous administrations. It has extended the street lighting program in residential areas and has also studied the matter of extending "the White Way" on Cen- tral Street and have made provision for same in the bud- get submitted to the Finance Committee for 1951.


In furtherance of the precedent previously estab- lished the Board sponsored a Hallowe'en Party for the youth of the town.


On October 31, 1950 John J. Moloney having reached the compulsory retirement age concluded 26 years of faithful service as Chief of Police. Sergeant William F. Fitzpatrick who ranked number one in a competitive ex- amination, was first temporarily and then permanently appointed to fill his position.


This administration has inaugurated a policy of re- quiring all persons who are constructing or repairing highways for the town, or who receive special permits to obstruct highways, to obtain adequate public liability insurance in which the town is named as the insured.


In compliance with the vote of the Town Meeting the Board of Selectmen had Mr. Wendell Phillips draw plans for the conversion of the present Court Room into two separate Court Rooms. In the early part of next year both court rooms should be ready for occupancy.

Since we feel that the town should be adequately recom- pensed for the cost of renovating the court room, we have increased the rental 50% and the County Commis- sioners have agreed to this increase.


In compliance with the request of the Civilian De- fense Director, we established a Civilian Defense Author- ity naming Elmer C. Nelson, Chairman.

Town Counsel's Report


December 31, 1950.


Honorable Board of Selectmen, Milford, Massachusetts


Gentlemen :


There is submitted herewith my report as Town Counsel during the year ending December 31, 1950.


At the commencement of my term of office on March 15, 1950, there were eleven (11) claims outstand- ing against the Town in the classification of "Damage to Persons and Property." Of this total five (5) were in suit-four (4) before the Worcester County Superior Court, and one (1) before the Third District Court of Southern Worcester. During the period eight (8) new

claims were received, and no new actions were instituted. Of this total of nineteen (19) claims, twelve (12) were settled for amounts considered to be for the best interests of the Town. The number of cases settled includes settle- ment of three (3) of the actions pending before the Court. Since it is not likely that a settlement favorable to the best interests of the Town can be arrived at, it is believed that the action pending before the Superior Court will be tried early in 1951. Of the remaining five (5) claims outstanding, three (3) arose prior to 1950 and two (2) in 1950. It does not appear that settlement of these claims is likely.


During the period it was necessary to appear before the Superior Court on four occasions for the purpose of pre-trying actions, answering the call of the list, and for the start of trial of one of the actions. This latter action was continued by the Court due to the absence of one of the Plaintiff's principal witnesses.


The long-pending appeals of the Archer Rubber Company to the Appellate Tax Board, and relating to the refusal of the Board of Assessors to grant certain abatements requested by that Company during the years 1947, 1948 and 1949, were finally assigned for hearing in Boston. The undersigned conducted the defense raised by the Board of Assessors, and established by the testi- mony of two expert witnesses, on April 13, 17, 18, 20, 24 and 25, 1950. The Tax Board came to Milford for the purpose of examining the buildings in question on April 13th, and again on December 15, 1950. Despite the fact that all testimony was completed on April 25th, no deci- sion had been announced by the Board on the date of this report.


On March 4, 1950, the Town Treasurer was served with a summons in an action instituted by the City of Boston in the Suffolk County Superior Court, arising out of a claim of the City of Boston in the amount of $244.00 for aid furnished individuals alleged to have a legal settle-

ment in Milford. The Town's answer and other necessary pleading's have been filed and the action is still pending in Court.


Suit was instituted in the Worcester Superior Court on July 18, 1950, on behalf of the Town against the Town of Natick, to recover the sum of $370.32, expended by the Welfare Department for the benefit of an individual claimed to have a legal settlement in Natick. Since it is evident that the Natick officials are desirous of obtaining a definite interpretation of the General Laws pertaining to the question it is expected that it will be necessary to prosecute this action to a final conclusion before the Court.


On July 3, 1950, a Petition or a Declaratory Judgment was filed by an individual who formerly conducted a poul- try slaughterhouse on lower Main Street, against the Board of Health, seeking a declaration by the Superior Court in Equity that he is authorized to continue his poultry-slaughtering business under General Laws per- taining to the public health. An answer to this Petition has been filed on behalf of the Board, and an early hearing is expected.


During the year numerous opinions, both written and oral, were prepared for the various Department heads, and numerous conferences with Town Departments and Committees were held relative to questions relating to the conduct of their affairs.

Recommendation is respectfully made, after consider- able study, to install a traffic light, pedestrian controlled, at the corner of Main and Fruit Streets, and Cedar Street at East Main.


Under Sgt. E. A. Lombardi, the auxiliary police are being reorganized, consisting of three officers and fifty men. The response to this call by the citizens has been most gratifying.

Report of the Tree Warden and Gypsy Moth Superintendent


I hereby submit my annual report on the care and renewal of trees and brush and planting of new trees.


During the year I have removed 27 trees in various sections of the town, and during the week of April 15th I bought and planted 40 new trees.


Brush was removed from most of the back roads.


On May 15th and 16th I sprayed for the Spring Tent Caterpiller using 2400 gallons of spray. On June 6th, 7th, 9th, and 10th I did my regular spraying using 17,760 gallons of spray. On June 1st and 2nd I also had the outskirts of the town sprayed by airplane ..


On August 11th and 12th we sprayed for Fall Webb Worm and Second Generation of Elm Leaf Beetle using 9600 gallons of spray. During the year one elm sapling was reported infected with the Dutch Elm Disease. This tree was located in the Braggville district on the state road and was not under my jurisdiction. The elms in town under my jurisdiction are all O.K. as yet.
