3.06 The Board, subject to the approval of the Town at a regular or special Town Meeting, shall establish and amend from time to time as it deems necessary a Classification and Compensation. Plan in which all town positions, subject to the provisions of the plan, shall be classified and in which the maximum wage or salary for each position and the wage or salary for each grade of the position shall be prescribed.


3.07 Except as hereinafter provided, no person shall be appointed or employed in any position under any title other than that appearing in the Classification and Compensation Plan or under any title other than that of job, the duties of which are actually performed or at any wage or salary other than that established in Wage and Salary Schedule.


3.08 In case of urgent necessity the appointing authority with the approval of the Personnel Board and the Civil Service Director when required by law, may anticipate formal action by the Town Meeting by establishing new positions or new classes of positions and compensation therefor, subject to subsequent early ratification by the Town at Town Meeting.


3.09 No wage or salary shall be reduced as a result of the installa- tion of this plan. Wages and salaries above the maximum established in the schedule shall become "Personal Rates" and shall apply only to the present incumbents. Such wages and salaries shall not be subject to increases until the maximum

rate for the position becomes higher than the Personal Rate.


3.10 The starting rate shall be the minimum of the rate range for the position as classified. In special cases, and upon the recommendation of the appointing authority and the approval of the Personnel Board, such a person may start at a higher rate than the minimum but not in excess of the maximum.


3.11 The position titles appearing in the Classification and Com- pensation Plan shall be the official titles for all purposes having to do with the position and shall be used to designate the position in all payrolls, budget estimates and official reports and in every other connection involving personnel and fiscal processes.


3.12 Department Heads, Boards or Commissions having Town employees, not otherwise exempted from this plan, under its jurisdiction shall be responsible for seeing that the wages or salaries, benefits and privileges received by those employees are in accordance with and only in accordance with the Classi- fication Plan.


3.13 All employees who are rendering satisfactory service, in the opinion of their Department Head, and who are under the maximum wage or salary rate for the positions in which they are employed shall be advanced to the next grade annually, (one year from the date of employment or date of advance- ment to present grade ).


3.14 An employee transferred to a higher rated position shall enter at the minimum of the rate range or the next rate above his present salary, whichever is the higher. If an employee should be transferred to a lower rated position he may be transferred at his present rate with the approval of the Personnel Board, otherwise he shall be transferred at his present rate or the maximum rate for the position, whichever is the lower.


3.15 The Personnel Board shall establish, maintain and amend from time to time, as it deems necessary, written definitions or job descriptions for all positions appearing in the Classification and Compensation Plan. Such definitions or descriptions shall describe the essential nature of the work characteristics of the position which distinguishes it from other positions. The description of any position shall be construed solely as a

means to identification and not as prescribing what the duties or responsibilities of any position shall be.


3.16 Any and all questions relative to the interpretation of this By-Law shall be settled by the Personnel Board.


Voted: That the Town vote to accept the By-Law entitled "Personnel, Wage and Salary Administration Plan" which is pre- sented to the Town by the Personnel Board pursuant to the pro- visions of the General Laws, Chapter 41, Section 108A as amended.


Article 2. Voted: That the Town will authorize the Personnel Board to pay one of its members, namely the Executive Director of the Board, the sum of Five hundred ($500.00) dollars from its appropriation for research and clerical work in preparing the Personnel, Wage and Salary Administration Plan and the Classi- fication and Compensation Plan.


Voted: That the Town authorize the sum of $500.00 be trans- ferred from the existing Personnel Expense Account to the Salary and Wages Account of the Personnel Board.


Article 3. Voted: That the Town vote to appropriate the sum of Three thousand fifty ( $3,050.00) dollars to dismantle and raze the South Grammar School and Claflin School; Twenty hundred seventy- five ($2,075.00) dollars to be transferred from the Dismantling and Razing the Plains School Account and the sum of Nine hundred seventy-five ($975.00) dollars to be transferred from the Excess & Deficiency Account and to remove from the premises materials and contents, to provide for filling of the excavation or the building site, and to authorize the Board of Selectmen to enter into all contracts and agreements to accomplish the above.


Article 4. Voted: That the Town vote to appropriate the sum of Twenty dollars and sixty-three ($20.63) cents from the Excess & Deficiency Account to pay an unpaid bill in the Memorial Hall Ex- pense Account for the year 1959.


Voice vote unanimous.


Article 5. Voted: That the Town vote to transfer from the Excess & Deficiency Account the sum of $257.21 to the Band Concert Expense Account.


Article 6. Voted: That the Town vote to amend the By-Laws of the Town of Milford by adding the following: "Any committee,

board or officer in charge of a department may with the approval of the Selectmen, sell or trade any personal property of the town within the possession or control of the department which has become obsolete or is not required for further use by the department.


Article 7. Voted: That the sum of $2,880.00 be appropriated from the Excess & Deficiency Account to the General Expense Ac- count of the Sewer Commissioners.


Article 8. Voted: That the sum of $5,000.00 be appropriated from the Excess & Deficiency Account for the construction of a pumping station on Birch Street said sum to be expended by the Sewer Commissioners.


Article 9. Voted: To pass over the article.


Article 10. Voted: That the sum of $1,000.00 be transferred from the elevator account of the Milford Public Medical Home & Infirmary, to be used to construct a fire escape at the Milford Public Medical Home & Infirmary.


Article 11. Voted: That the Town authorize the Board of Selectmen to accept an easement from Consigli Construction Com- pany said easement to be used for the purpose of laying, operating, and maintaining a drain from the easterly line of land of the Milford Housing Authority to Sumner Street, said easement and right being further bounded and described as follows:


Beginning at a point in a wall at the easterly boundary of land of the Milford, Housing Authority, said point being 12.56 feet southerly from the northeasterly corner of land of the Milford Hous- ing Authority; thence N. 86 degrees 23' 40" E. 394.83 feet to the westerly line of Sumner Street; thence N. 01 degree 28' 30" W. along the westerly line of Sumner Street, 10.01 feet to a point; thence S. 86 degrees 23' 40" W. along other land of the Consigli Construction Company. 394.84 feet to the easterly line of land of the Milford Housing Authority, thence S. 01 degree 32' 40" E., 10 feet in the point of beginning.

Article 12. Voted: That the Town transfer from Excess & Deficiency Account $3,580.00 to construct a drain from the easterly line of land of the Milford Housing Authority to Sumner Street; said sum to be expended under the direction of the Highway Surveyor.

Voted: That the Town of Milford, Massachusetts hereby approves construction of a new housing project, namely a project for the housing of elderly persons, consisting of not more than 40 dwelling units pursuant to Chapter 667 of Massachusetts Acts of 1954, and Acts in amendment thereof and in addition thereto, to be known as State-Aided Housing Project 667-3.
