Town Counsel's Report


During the year ten claims for personal injuries and property damage were settled without court actions having been commenced against the Town.


The breach of contract suit by R. J. Berke & Company against the Town was dismissed after a trial in the Superior Court in Cambridge.


One claim brought by the Town on a welfare matter was heard in the Superior Court in Worcester and we await the judge's finding.


There are six petitions for abatement of real estate taxes on Main Street property still pending in the Appellate Tax Board in Boston.


There are nine claims for personal injuries allegedly arising out of sidewalk or highway defects still outstanding.


Two suits are pending against the Welfare Board, one each by the City of Worcester and Boston.


The Archer Rubber Company land damage suit against the Town, arising out of the flood control project on lower Central Street,

is pending in the Superior Court in Worcester. The Town has demanded a jury trial.


During the course of the year I have had many conferences with people serving the Town. I have given advice and legal opin- ions as requested by officials and by citizens seeking information on municipal matters.

Dr. Nicholas J. Capece was re-elected Chairman of the Board of Health for the year 1961. Other members of the Board are Frank Calzone and Harris Tredeau.


Appointments made as follows: Clerk, Agent, Sanitary In spector, Adam F. Diorio; Nurse, Alice Fitzpatrick; Physician, Dr Eugene E. Allen; Dentist, Dr. Joseph C. Mclellan; Plumbing In spector, Charles J. Ferrante and John F. Power; Burial Agent Oscar Ayotte; Meat Inspector and Slaughtering, Philip Roy; Assist ant Meat and Slaughtering Inspector, Alexander Iannitelli; person to receive and report contagious diseases, Adam F. Diorio.


The rat control program was extended to the entire town and the results are very satisfactory. An expert exterminator conducts this program under the supervision of the Board Agent.


The mosquito control program was conducted by the Town Tree Warden, Joseph Graziano under the supervision of the Health Agent. Due to the small appropriation of $2,000.00 the result of this program is considered very good.

DOCTOR'S AND NURSE'S REPORT

Spaced physical examinations were given to the students by the Board of Health Physician, Eugene E. Allen, M.D. Notices of defects found were sent home to the parents or guardians, for cor- rections to be made by the family physician.


The Massachusetts Vision Test and the Audiometer Hearing tests were given during the school year and follow-up work done to be sure corrections had been made.


The Dental Health Clinic is held each week-day morning for students in all the schools up to the fifth grade. Joseph MacLellan, D.M.D., is the attending physician.


Any children with special health problems are referred to the Boston or Worcester Health Clinics.


CLINICS


A Double and Triple Antigen Clinic was held at the Memorial School for the pre-primary and first grade pupils in all the schools. Booster doses were given to all who had requested it. Eugene E. Allen, M.D., Health Physician, is in attendance at all the clinics.


A Double Antigen Clinic was held at the Memorial School for all the students in the Junior classes and the sixth grades. Booster doses were given to all who had signed the requests.


A Vaccination Clinic was held at the Memorial Clinic for babies and pre-school children.


A Tuberculin Clinic was held at the Memorial School for all the school children from pre-primary to grade twelve. Approxi- mately all pupils received the Mantoux Tuberculin skin test. Heinz J. Lorge, M.D. and three other doctors from the Worcester County Sanatorium assisted him in giving the tests. Students who had a positive test, and members of their family were later on given chest X-rays. No active cases of tuberculosis were found.
