The polls will be opened at five forty-five o'clock in the forenoon and will be closed at eight o'clock in the evening.


You are further directed to notify and warn the said inhabitants qualified to vote as aforesaid, to meet at the Town Hall in said Braintree on Monday, the thirteenth day of March, 1939, at seven forty-five o'clock in the evening, then and there to act upon the following articles, namely:


Article 1. To choose all Town Officers, except those elected by ballot.


Article 2. To hear and act upon the report of the several boards of Town Officers, and committees, and choose any committee the Town may think proper.

Article 3. To see if the Town will vote to authorize the Town Treas- urer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning Janu- ary 1, 1939, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.


Article 4. To see if the Town will vote to authorize the Town Treas- urer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning Janu- ary 1, 1940, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with the provisions of Section 17, Chapter 44, General Laws.


Article 5. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow money for general munici- pal purposes under the authority of and in accordance with the provi- sions of Chapter 49 of the Acts of 1933, as amended, or take any action relative thereto.


Article 6. To see if the Town will hold its Treasurer harmless on his bond for any loss which may arise from the failure of any National Bank or Trust Company in which the funds of the Town may be on deposit, said Bank or Trust Company being designated by the Selectmen.


Article 7. To see if the Town will hold its Collector harmless on his bond for any loss which may arise from the failure of any National Bank or Trust Company in which the funds of the Town may be on deposit, said Bank or Trust Company being designated by the Selectmen.


Article 8. To see if the Town will vote to raise or borrow and ap- propriate a sum of money for a Reserve Fund for extraordinary and unforeseen expenditures during the current year.


Article 9. To see what sums of money the Town will vote to raise or borrow and appropriate for Interest and Maturing Debt the present year, or take any action relative thereto.


Article 10. To see what sums of money the Town will vote to raise or borrow and appropriate for Insurance on Town property and Work- ingmen's Compensation, or take any action relative thereto.


Article 11. To see what sum of money the Town will vote to raise or borrow and appropriate for the Norfolk County Hospital Assessment, for maintenance and repairs.


Article 12. To see what sums of money the Town will vote to raise or borrow and appropriate for Street Lighting, to wit-$12,500.00.


Article 13. To see if the Town will vote to raise or borrow and ap- propriate a sum of money for the payment of printing and distribution of the Annual Report of the Town of Braintree for 1938.


Article 14. To see what distribution the Town will vote to make of the income of the Thayer Fund.


Article 15. To see what sums of money, in addition to that appro- priated under any other article, the Town will vote to raise or borrow and appropriate for Land Damages.


SCHOOLS AND LIBRARIES


Article 16. To see what sums of money the Town will vote to raise or borrow and appropriate for the support of the Public Schools for the present year, or take any other action relative thereto.

Article 17. To see if the Town will vote to raise or borrow and appropriate a sum of money for the purpose of purchasing, or taking, land in Precinct Three; said land being Lot 8 on Assessors' Plan, Num- ber 2031, Plot 24, consisting of 5394 square feet, on Weston Avenue, or take any other action relative thereto.


Article 18. To see if the Town will vote to raise or borrow and appropriate sums of money for the purpose of constructing, furnishing, and equipping an addition to the High School, and for the making of additions, alterations, and repairs to the present building, and to author- ize the Treasurer, with the approval of the Selectmen, to borrow all, or any part of said sums and to authorize the proper officers to take any steps which may be necessary to secure an allotment of Federal funds under P.W.A. or other Federal agency, to supplement any appropriation made by the Town; or take any other action relative thereto.


Article 19. To see what sums of money the Town will vote to raise or borrow and appropriate for the Public Library, the present year, or take any action relative thereto.


GENERAL GOVERNMENT


Article 20. To see what sums of money the Town will vote to raise or borrow and appropriate for General Government for salaries and ex- penses for the following departments and other purposes, the present year, or take any action relative thereto.

Article 21. To see if the Town will vote to raise and appropriate a sum of money in addition to sums of money already appropriated to cover the Town's share for materials, trucking and other necessary expendi- tures in connection with W.P.A. activities or other Special Aid projects in conjunction with State or Federal Government as may be approved by the Finance Committee, or take any action relative thereto.


Article 22. To see what further sums the Town will vote to raise by taxation and appropriate to meet certain incidental and miscellaneous expenses not otherwise provided for, namely, General Government Inci- dentals, the same to be in addition to any sums previously appropriated for said purposes.

Article 23. To see what sums of money the Town will vote to raise or borrow and appropriate for the protection of persons and property the present year, or take any action relative thereto.

HEALTH AND SANITATION


Article 24. To see what sums of money the Town will vote to raise or borrow and appropriate for Health and Sanitation the present year, or take any action relative thereto.


Article 25. To see what sums of money the Town will vote to raise or borrow and appropriate for the maintenance and operation of the Water Department, including interest and debt on Water Loans, the same to be taken from the revenue of the Department, and the unex- pended balance of 1938, or take any action relative thereto.


Article 26. To see if the Town will vote to appropriate from the income of the Water Department, the sum of $300.00, for the salaries of the Water Commissioners.


Article 27. To see if the Town will vote to appropriate from the income of the Electric Light Department, the sum of $300.00, for salaries of the Electric Light Commissioners.


Article 28. To see if the Town will vote to include in the Tax Levy for electricity used for street lighting the sum of $12,500.00 as appropri- ated under Article 12 of the Warrant for the 1939 Annual Town Meeting, and that said sum together with the income from sales of electricity to private consumers, or for current supplied to Municipal Building or for Municipal Power, and from sales of appliances and jobbing during the current fiscal year, to be appropriated for the use of the Municipal Light Plant, the whole to be expended under the direction and control of the Municipal Light Board for repairs, renewals, new construction and op- erating expenses of the plant for the present fiscal year, as defined in Section 57 of Chapter 164 of the General Laws, and that, if said income shall exceed the expense for the fiscal year, such excess shall be trans- ferred to the construction fund of said plant and appropriated and shall be used for such additions to the plant as may thereafter be authorized by the Municipal Light Board.


Article 29. To see what sum or sums of money the Town will vote to raise and appropriate for the purposes of the Sewer Department, to be expended by the Board of Sewer Commissioners, or take any action relative thereto.


Article 30. To see if the Town will vote to raise and appropriate the sum of $300.00 for salaries of the Board of Sewer Commissioners.


RECREATION


Article 31. To see what sums of money the Town will vote to raise or borrow and appropriate for the general uses of the Board of Park Commissioners the coming year, or take any action relative thereto.

CEMETERIES


Article 32. To see what sums of money the Town will vote to raise or borrow and appropriate for the improvement of the Cemetery the present year, or take any action relative thereto.


Article 33. On Petition. To see if the Town in accordance with Chapter 114, Section 34 of the General Laws, will authorize the use of the following parcel of land for burial purposes as an extension of the present Blue Hill Cemetery. A certain parcel of land situated in said Braintree, bounded and described as follows: Westerly by a Way forty feet wide, shown on the plan hereinafter referred to twelve hundred forty-six and 71/100 (1246.71) feet; Northeasterly, six hundred seven and 44/100 (607.44) feet; and Northerly twelve hundred sixty-six and 42/100 (1266.42) feet by land now or formerly of Robert L. Ryder; Northeasterly by land now or formerly of Peter Cahill, two hundred fifty- six feet; Southeasterly by land now or formerly of Blue Hill Cemetery, four hundred sixty-six and 70/100 (466.70) feet; and Southerly by land of said Blue Hill Cemetery, twenty-one hundred fifty-two and 15/100 (2152.15) feet. Said parcel is shown as lot A on a plan drawn by Roland H. Barnes and Henry F. Beal, Civil Engineers, dated February, 1938, filed in the Norfolk Registry District of the Land Court as plan number 11973-B with Certificate of Title No. 21843.


SOLDIERS' BENEFITS


Article 34. To see what sums of money the Town will vote to raise or borrow and appropriate for Soldiers' Relief, State Aid and Military Aid the present year, or take any action relative thereto.


PUBLIC WELFARE


Article 35. To see what sums of money the Town will vote to raise or borrow and appropriate for the Public Welfare Department, including Aid for Dependent Children, and Adequate Assistance to Certain Aged Persons under the provisions of Chapter 118A, Acts of 1931, or take any action relative thereto.


HIGHWAYS


Article 36. To see what sums of money the Town will vote to raise or borrow and appropriate for the support of the Highway Department, including labor, repairs to highways, Town ways and Bridges; also, for repairs and building sidewalks, stone roads and removal of Snow, Oiling and Tarring of Streets; purchase of equipment for said department, or take any action relative thereto.


Article 37. On Petition. To see if the Town will vote to accept as and for a Town Way, Argyle Road, so-called, from Pleasant View Ave- nue to Glenrose Avenue, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way; or take any action relative thereto.


Article 38. On Petition. To see if the Town will vote to accept as and for a Town Way, Putnam Avenue, so-called, from Cleveland Avenue 292 feet easterly as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way under a W.P.A. Project; or take any action relative thereto.

Article 39. On Petition. To see if the Town will vote to accept as and for a Town Way, Wayne Avenue, so-called, from Pond Street to Logan Road; and Logan Road from Wayne Avenue to Hoover Road; and Hoover Road from Logan Road to St. Michael Road as laid out by the Selectmen, and raise and appropriate a sum of money for the improve- ment of said way under a W.P.A. Project; or take any action relative thereto.


Article 40. On Petition. To see if the Town will vote to reconstruc Hayward Street from Howard Street easterly to Quincy Avenue, and raise or borrow and appropriate a sum of money for the same, or take any action relative thereto.


Article 41. On Petition. To see if the Town will vote to accept as and for a Town Way, Spencer Street, so-called, from Trefton Drive to Arborway Drive, as laid out by the Selectmen; and raise and appropri- ate a sum of money for the improvement of said way, or take any other action relative thereto.


Article 42. On Petition. To see if the Town will vote to accept as and for a Town Way, Faulkner Place, so-called, 730 feet westerly from Washington Street as laid out by the Selectmen, and raise and appro- priate a sum of money for the improvement of the said way under a W.P.A. Project; or take any action relative thereto.


Article 43. On Petition. To see if the Town will vote to accept as and for a Town Way, Perry Road, so-called, from Burroughs Road to Bower Road, a distance of approximately 172 feet, as laid out by the Selectmen; and raise and appropriate a sum of money for the improve- ment of the said way under a W.P.A. Project; or take any action rela- tive thereto.


Article 44. On Petition. To see if the Town will vote to widen Common Street from Washington Street to Sunnyside Avenue, so that it may have a uniform width of forty feet; or take any action relative thereto.


Article 45. On Petition. To see if the Town will vote to accept as and for a Town Way, Sunnyside Avenue, so-called, from the end of Common Street, so-called, approximately 1000 feet westerly, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way, or take any action relative thereto.


Article 46. On Petition. To see if the Town will vote to widen Hobart Avenue, from Washington Street westerly to Tremont Street and Tremont Street southerly to Central Avenue, beginning at Hobart Avenue; and raise and appropriate a sum of money for the same or take any action relative thereto.


Article 47. On Petition. To see if the Town will vote to accept as and for a Town Way, Wilkins Road, so-called, from present line of ac- ceptance to North Bowditch Street, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way, or take any action relative thereto.


Article 48. On Petition. To see if the Town will vote to accept as and for a Town Way, North Bowditch Street, so-called, from Wilkins Road to May Street, as laid out by the Selectmen, and raise and appro- priate a sum of money for the improvement of the said way, or take any action relative thereto.


Article 49. On Petition. To see if the Town will vote to accept as : and for a Town Way, Atlas Road, so-called, between Cedarcliff Road and Thayer Road, as laid out by the Selectmen, and raise and appropriate a

sum of money for the improvement of the said way under a W.P.A. Project; or take any action relative thereto.


Article 50. On Petition. To see if the Town will vote to accept as and for a Town Way, Thayer Road, so-called, 800 feet westerly from Quincy Avenue, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way under a W.P.A. Project; or take any action relative thereto.


Article 51. On Petition. To see if the Town will vote to accept as and for a Town Way, Staten Road, so-called, from present line of accept- ance westerly to Abbott Street, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way under a W.P.A. Project; or take any action relative thereto.


Article 52. On Petition. To see if the Town will vote to accept as and for a Town Way, Garland Street, so-called, from Dickerman Lane southerly to Storrs Avenue, as laid out by the Selectmen, and raise and appropriate a sum of money for the improvement of the said way under a W.P.A. Project; or take any action relative thereto.


Article 53. On Petition. To see if the Town will vote to accept as and for a Town Way, Glenrose Avenue, so-called, from Quincy Avenue to Argyle Road, and raise and appropriate a sum of money for the im- provement of the said way under a W.P.A. Project; or take any action relative thereto.


Article 54. On Petition. To see if the Town will vote to accept as and for a Town Way, Newport Avenue, so-called, 510 feet westerly from Franklin Street, and raise and appropriate a sum of money for the improvement of the said way under a W.P.A. Project; or take any action relative thereto.


Article 55. On Petition. To see if the Town will vote to raise or borrow and appropriate a sum of money for the widening of the present Bridge on Jefferson Street, South Braintree, under a W.P.A. Project; or take any action relative thereto.


Article 56. On Petition. To see if the Town will vote to raise or borrow and appropriate a sum of money for the installation of Traffic Signal Lights on Quincy Avenue, East Braintree, near the Thomas Watson School, or take any action relative thereto.


Article 57. On Petition. To see if the Town will vote to raise or borrow and appropriate a sum of money for the installation of Traffic Signal Lights at the intersection of Commercial, Liberty and Union Streets, East Braintree, near the Jonas Perkins School, or take any action relative thereto.


Article 58. To see if the Town will vote to discontinue the practice of electing Constables by ballot and authorize the Selectmen to appoint such Constables as they may deem necessary under the provisions of Section 91A, Chapter 41, General Laws, or take any other action rela- tive thereto.


Article 59. To see if the Town will take any action by petition to the Legislature or otherwise to place any or all of the Town Employees under Civil Service Regulations, or take any other action relative thereto.


Article 60. To see if the Town will take any action by petition to the Legislature or otherwise, to establish a system of Tenure of Office for any or all of the Town Employees, or take any other action relative thereto.

Article 61. To see what sums of money the Town will vote to raise or borrow and appropriate to meet the payment of certain bills con- tracted in several departments prior to January 1st, 1939, or take any other action in the matter.


Article 62. To see if the Town will vote to amend Section 3 of Article 1 of the By-Laws by substituting for said Section 3 the following: "Article 1. Section 3. All business, except the election of officers and the determination of such matters as by law are required to be deter- mined by ballot, shall be considered at an adjournment thereof to the second Monday following at 7:45 P.M."


Article 63. To see if the Town will vote to raise and appropriate by transfer or otherwise the amount of $55,296.47 for overdrafts of the year 1937, or take any action relative thereto.


Article 64. To see if the Town will vote to raise and appropriate a sum of money for the purpose of making a survey of the Braintree School System, or take any action relative thereto.


Article 65. To see if the Town will vote to raise or borrow and appropriate sums of money for the purpose of constructing, furnishing and equipping a Fire Station in East Braintree, and authorize the Treas- urer, with the approval of the Selectmen, to borrow all, or any part of said sums, and to authorize the proper officers to take any steps which may be necessary to secure an allotment of Federal funds under P.W.A. or other Federal agency, to supplement any appropriation made by the Town; or take any other action relative thereto.


Article 66. To see if the Town will vote to authorize the Selectmen to sell property, title to which has been acquired by the Town under tax title foreclosure procedure, at public auction, provided notice of such auction sale be published in one or more newspapers published in the Town at least one week before the date of said sale, and to authorize the Selectmen to execute deeds conveying said land.


Article 67. On Petition. To see if the Town will raise and appro- priate such sums as may be necessary for the purpose of purchasing or taking land in Precinct 4 and constructing, furnishing and equipping a grade school building thereon; and authorize the Treasurer, with the approval of the Selectmen, to borrow any part of such sum in accord- ance with the provisions of any act so authorizing; or take any action in relation thereto.


Article 68. On Petition. To see if the Town will vote to raise and appropriate a sum of money for the collection, transportation and dis- posal of rubbish and refuse from the private residences and stores or any other habitations in the Town of Braintree, by the Highway Depart- ment; or take any action relative thereto.


Article 69. On Petition. To see if the Town will authorize the. Board of Selectmen, to secure a suitable location, to be used as a Town Dump, or appropriate any money for same, or take any action relative. thereto.


Article 70. On Petition. To see if the Town will vote to raise and appropriate the sum of $1000.00 to assist Braintree Post No. 86, Ameri- can Legion, in the maintenance of its Headquarters in the Legion Build- ing, or take any other action relative thereto.


Article 71. On Petition. To see if the Town will vote to raise and appropriate the sum of $600.00 to assist Braintree Post No. 86, American Legion, Antietam Camp No. 3, Sons of Union Veterans, and Braintree

Post, Veterans of Foreign Wars, in defraying expenses of Memorial Day, or take any other action relative thereto.


Article 72. To see if the Town will vote to appropriate a sum of money from the Highway Fund provided by Chapter 2 of the Acts of 1939 for any of the purposes authorized by said Chapter.


Article 73. To see if the Town will vote to amend Article I of the By-Laws by adding a new section to said article, said section to read as follows :-


"Section 8. The following officials of the Town shall be members ex-officio of the Limited Town Meeting, in accordance with Section 3 of Chapter 17 of the Acts of 1937 :- Moderator, Town Clerk, Treasurer, Town Accountant, Tax Collector, Chairman of the Selectmen, Chairman of Assessors, Chairman of Water Commission, Chairman of School Com- mittee, Chairman of Municipal Light Board, Chairman of Park Com- mission, Chairman of Planning Board, Chairman of Board of Health, Chairman of Trustees of Public Library, Chairman of Sewer Commis- sion, Chairman of the Finance Committee, and Secretary to the Finance Committee."


Article 74. To see what sums of money the town will vote to raise or borrow and appropriate for the expenses of the Planning Board or take any action thereto.


Article 75. To see if the Town of Braintree will adopt a stan- dardized purchase order form as approved by the Finance Committee, and that this form be put into use in all Purchasing Departments of the Town not later than April 1st, 1939, and that the Selectmen shall be responsible for furnishing and distributing these forms to the various Departments and charging each Department with the quantities used, or take any action relative thereto.


Article 76. To see what sum of money the Town will vote to raise or borrow and appropriate to defray the expenses of the Three Hun- dredth Anniversary Celebration for Braintree, the same to be expended by the Special Committee appointed under Article 53 of the 1934 Annual Town Meeting, or take any action relative thereto.


Article 77. On Petition. To see if the town will adopt, and me- morialize other Towns and Cities within the Commonwealth and the Great and General Court, urging them to adopt the substance of the following resolutions, or to see what action the Town will take with reference thereto:


Resolved: That in the methods to be used in constructing and repair- ing our properties, those methods be adopted which will employ men, rather than utilize machinery to the exclusion of manual labor.


Be It Further Resolved: That in all contemplated projects of larger proportions to be done under contract, a stipulation be included in each contract which shall specify what work is to be done by hand labor, and what is permitted to be done by machinery:


Be It Further Resolved: That in the performance of public works, we attend primarily to the utilization of animate power to supply means for the machine's support.


You are directed to serve this Warrant by posting true and attested copies thereof in three public places in each Voting Precinct in said Town of Braintree, ten days at least before said sixth day of March, 1939, and by publishing the same once each week for two successive

weeks in the Braintree Observer, the first publication to be at least eight days before said meeting.


Hereof fail not, and make due return of this Warrant with your doings thereon, to the Town Clerk, before said meeting.
