Article 65. ON PETITION. To see if the Town will vote to raise and appropriate $1,500.00 to replace the inadequate heating system in the Town-owned Legion Building.

To see if the Town will adopt, and' memorialize other Towns and Cities within the Commonwealth of Massachusetts, and the Great and General Court, urging them to adopt the substance of the following resolutions, or to see what action the' Town will take with reference thereto :--


RESOLVED: That in the methods to be used in constructing and repairing our individual properties, those methods be adopted which will employ men, rather than utilize machinery to the exclusion of manual labor.


BE IT FURTHER RESOLVED: That in all contemplated projects of larger proportions to be done under contract, a stipulation be in- cluded in each contract which shall specify that work is to be done by hand labor, and what is permitted to be done by machinery :-


BE IT FURTHER RESOLVED: That in the performance of Public Works, such methods be used more consistently as will first utilize the primary power for commerce and add means to the support for the machines.


Article 73. To see if the Town will vote to raise and appropriate a sum of money for the salary of FISH AND GAME WARDEN, or take any action relative thereto.


Article 74. To see if the Town will vote to accept the Joseph S. Miller Fund; the income from said fund to be used for the care of the Miller lot in the Plain Street Cemetery.


Article 75. To see what sums of money the Town will vote to raise and appropriate for Land Damages and costs or expenses in settling suits and claims brought against the Norfolk County Commissioners, for which the Town of Braintree will be held liable.


Article 76. To see if the Town will vote to appoint an Adminis- trator of Public Welfare, and to raise and appropriate the sum of $2,500.00 for a salary for said Administrator, or take any action relative thereto.


Article 77. To see what sums of money the Town will vote to raise or borrow and appropriate for the expenses of the Planning Board, or take any action relative thereto.


Article 78. To see if the Town will vote to accept the provisions of Chapter 211 of the Acts of 1936 relating to an improved method of Municipal Planning, or take any action relative thereto.


Article 79. To see if the Town will vote to accept as and for a Town Way, B. V. FRENCH STREET, so-called, as laid out by the Town Engineer, and raise and appropriate a sum of money for the improvement of the said way, or take any action relative thereto.


You are directed to serve this Warrant by posting true and at- tested copies thereof in three public places in each Voting Precinct. in said Town of Braintree, ten days at least before said seventh day of March, 1938, and by publishing the same once each week for two successive weeks in the Braintree Citizen, the first publication to be at least eight days before said meeting.


Hereof fail not, and make due return of this Warrant with your doings thereon, to the Town Clerk, before said meeting.

The Annual Town Meeting was called to order at 7:48 P.M. by Moderator William F. Rogers. The voters were checked on entering building-905 present. Amplifiers were installed throughout the hall.


ARTICLE 1.


Voted: To elect three Measurers of Wood and Weighers of Hay: Willard P. Sheppard, Wilford F. Woodsum and R. Allen Gage elected.


Voted: To elect three Measurers of Lumber: Herbert W. Borden, Shelley A. Neal and Charles O. Miller elected.


ARTICLE 2.


Voted: That Article 2 be taken up in conjunction with other articles in the warrant.


ARTICLE 3.


Voted: That the Town Treasurer, with the approval of the Select- men, be and hereby is authorized to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1,

1938, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws .- Unanimous vote.


ARTICLE 4.


Voted: That the Town Treasurer, with the approval of the Select- men, be and hereby is authorized to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1939, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws .- Unanimous Vote.


ARTICLE 5.


Voted: That the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow for ordinary maintenance expenses of the Town the sum of $50,000.00, but in no event a sum in excess of the amount of tax titles taken or held by the Town, and to issue a note or notes of the Town therefor, all in accordance with the provisions of Chapter 49 of the Acts of 1933, as most recently amended by Chapter - 281 of the Acts of 1936 .- Unanimous Vote.


ARTICLE 6.


Voted: That the Town will hold its Treasurer harmless on his bond for any loss which may arise from the failure of any National Bank or Trust Company in which the funds of the Town may be on deposit, said Bank or Trust Company being designated by the Selectmen.


ARTICLE 7.


Voted: That the Town will hold its Collector harmless on his bond for any loss which may arise from the failure of any National Bank or Trust Company in which the funds of the Town may be on deposit, said Bank or Trust Company being designated by the Selectmen.


UNDER ARTICLE 2.


Voted: That a committee of three be appointed by the Moderator to ascertain the facts surrounding any overdrafts made during the year 1937, said committee or its agents to have access to all the records of the Town, and said committees be and hereby is authorized to employ legal counsel and such other assistance as in its opinion may be necessary to carry out the purposes of this vote, any expense incurred by the committee to be paid for out of the appropriation for Selectmen's Ex- penses. The committee is instructed to report back to an adjournment of this Town Meeting with its recommendation for any action which should be taken by the Town relative to overdrafts .- 8:16 P.M.


Mr. Ira Young moved: That the Town Counsel is hereby appointed a committee of one to have a bill entered at the State House (under suspension of the Rules if possible) which will change Section 31 of Chapter 44 of the General Laws to read in such a way, that in towns having Finance Committees or committees having similar duties, the authorization of two-thirds of the membership of such committee shall be necessary before any department can incur obligations in excess of their appropriations. So voted-8:21 P.M.


Mr. Ira Young moved: That the Moderator shall appoint a com- mittee consisting of the Town Counsel and two voters to take the neces-

sary steps to have our new representative form of Town government changed as soon as possible in the following respects :


1. Strike out the words "as a special appropriation" in the first sentence of Section 9.


2. Change the words "two hundred and forty" in Section 3 to "six hundred".


3. Change the words "six" and "nine" in the first paragraph of Section 2 to "ten" and "fifteen".

Voted: That there be appropriated the sum of $5,000.00 for a Re- serve Fund for extraordinary and unforeseen expenditures during the current year.

Voted: That the Town instruct the Selectmen to establish a rule governing "leave of absence with pay for sickness" as applied to the Police Department, to the effect that no member of the Police Department shall receive such sick leave payment for more than fourteen days during the calendar year.
