In the name of the Commonwealth aforesaid, you are hereby re- quested to notify and warn the legal voters of the Town of Chelmsford to meet in the High School Gymnasium at Chelmsford, on the 27th day of March, 1961, at 8:30 o'clock in the evening, then and there to act upon the following articles, viz:

SPECIAL TOWN MEETING March 27, 1961


Moderator, Daniel J. Coughlin, Jr., called a special Town Meeting to order at 8:40 P.M. He declared a quorum present.


Edgar P. George moved waiving the reading of the Warrant. It was so voted.


ARTICLE 1. To see if the Town will vote to accept a deed of land from D & B Construction Co., Inc., said land being shown as "play- ground" on a plan of land entitled "Kings Grant Estates (Section II) Subdivision Plan of Land in Chelmsford, Mass., owned by D & B Con- struction Co., Inc., 25 Acorn St., Malden, Mass. February 25, 1961, Joseph W. Moore, Inc., 324 Great Rd., Reg. Land Surveyors, Bedford, Mass." which said plan is to be recorded in Middlesex North District Registry of Deeds and being thus bounded: Westerly by Parcel "R" as shown on said plan, 168.55 feet; southeasterly by Town of Chelmsford Forest 249.44 feet; northeasterly by a street as shown on said plan, 174.44 feet; northeasterly in a curved line by said street and Forest Park Drive as shown on said plan 34.90 feet; northwesterly by said Forest Park Drive 190.41 feet; or act in relation thereto.


UNDER ARTICLE 1:


Mr. Martin K. Bovey moved that the Town vote to accept a deed of land from D & B Construction Co., Inc., said land being shown as "play- ground" on a plan of land entitled "Kings Grant Estates (Section II) Subdivision Plan of Land in Chelmsford, Mass., owned by D & B Con- struction Co., Inc., 25 Acorn St., Malden, Mass. easement 12 feet in width from its property shown on the plan referred to in Article 1, to the Town Forest, the westerly boundary of which shall be a stone wall shown as the easterly boundary of Parcel "S" as shown on the plan referred to in Article 1, and shall prepare the said easement in accordance with the specifications of the Town Forest Committee, and to do any and all things necessary in the premises; or act in relation thereto.


UNDER ARTICLE 2:


Mr. Martin K. Bovey moved that the Town vote to authorize and empower the Town Forest Committee to enter into such contracts and agreements with D & B Construction Co., Inc., as it deems necessary and proper to effect the following results: D & B Construction Co., Inc., will construct on land of the Town Forest at the westerly end of Forest Park Drive as shown on the plan referred to in Article 1, a turn around and parking area in accordance with specifications of the Town Forest Committee. Hodges, et als to Daniel Gage, dated October 21, 1895 and recorded in Middlesex North District Registry of Deeds in Book 268, Page 493, insofar as the said right of way is situated on land of Hubert C. and Carolyn M. VanTrease, now or formerly, and land of Charles and Anna Freeman, said conveyance to be contingent upon the performance by D & B Construction Co., Inc., of the acts set forth in Article 1 and Article 2; or act in relation thereto.


UNDER ARTICLE 3:


Mr. Martin K. Bovey moved that the Town vote to authorize the Selectmen to convey by appropriate instrument or deed to D & B Con- struction Co., Inc., all its right, title and interest in a right of way described in a deed from Julia A. Hodges, et als to Daniel Gage, dated October 21, 1895 and recorded in Middlesex North District Registry of Deeds in Book 268, Page 493, insofar as the said right of way is situated on land of Hubert C. and Carolyn M. June 5, 1961


The meeting was called to order at 8:10 P.M. by Moderator Daniel J. Coughlin, Jr., who declared a quorum was present. Town Counsel, Vernon R. Fletcher, moved that the reading of the Warrant be waived. It was so voted.


ARTICLE 1. To see if the Town will vote to transfer from the Sale Of Graves And Lots Account, the sum of One Thousand Dollars ($1,000.00) for the purpose of drainage and road work in the Pine Ridge Cemetery; or act in relation thereto.


UNDER ARTICLE 1:


Mr. Archie Jordan moved that the Town vote to transfer from the Sale of Graves and Lots Account, the sum of One Thousand Dollars ($1,000.00) for the purpose of drainage and road work in the Pine Ridge Cemetery. It was so voted.


ARTICLE 2. To see if the Town will vote to adopt the following by-law: The Board of Selectmen shall annually appoint an inspector of gas piping and gas appliances in buildings, whose duty shall be the enforcement of the rules and regulations adopted by the Board, estab- lished under Section 12 H of Chapter 25 of the Massachusetts General Laws; or act in relation thereto.


UNDER ARTICLE 2:


Mr. Edgar P. George moved that the Town vote to adopt the follow- ing by-law: The Board of Selectmen shall annually appoint an inspector of gas piping and gas appliances in buildings, whose duty shall be the enforcement of the rules and regulations adopted by the Board, estab- lished under Section 12 H of Chapter 25 of the Massachusetts General Laws. It was so voted.


ARTICLE 3. To see if the Town will vote to transfer from available funds, a certain sum of money for the purpose of paying the compensa- tion of an inspector of gas piping and gas appliances; or act in relation thereto.


UNDER ARTICLE 3.


Mr. Raymond J. Greenwood moved that the Town vote to transfer from the Excess and Deficiency Fund the sum of One Thousand Dollars ($1,000.00) for the purpose of paying the salary and expenses of an inspector of gas piping and gas appliances. It was voted unanimously.


ARTICLE 4. To see if the Town will vote to allow the construction of a permanent bandstand on the common, in that part of Chelmsford called Chelmsford Center, in memory of Bernard Larkin; or act in rela- tion thereto.

UNDER ARTICLE 4.


Mr. Leon P. Schnepper moved that the Town vote to allow the con- struction of a permanent bandstand on the Common, in that part of Chelmsford called Chelmsford Center, in memory of Bernard Larkin. It was so voted.


ARTICLE 5. To see if the Town will take whatever action is neces- sary to validate the action taken under Article 34 of the Annual Town Meeting held on March 6, 1961, in authorizing the Selectmen to appoint a Recreation Commission; or act in relation thereto.


UNDER ARTICLE 5.


Mr. Raymond J. Greenwood moved that the Town vote to ratify the action taken under Article 34 at the Annual Town Meeting held on March 6, 1961, in authorizing the Selectmen to appoint a Recreation Commission; said Recreation Commission to study, conduct and promote recreation, play, sports and physical education within the Town. It was so voted.


ARTICLE 6. To see if the Town will vote to amend Section 1B (6) of the Zoning By-Law and the map accompanying said section and on file with the Clerk of the Town of Chelmsford, entitled "Chelmsford, Massachusetts-Zoning District Map-1956," by removing from General Business District (GB) that part of East Chelmsford shown, defined and bounded on said map and including the following described premises, and amend Section 1B (4) of the Zoning By-Law and said map by in- cluding as General Residence District (GR) that part of East Chelmsford shown, defined and bounded on said map and including the following described premises: Beginning at the Southeasterly side of Brick Kiln Road and the Southwesterly side of Gorham St .; thence Southeasterly along Gorham St. 200 ft. more or less; thence Southwesterly 200 ft. more or less in a line parallel to Brick Kiln Road; thence Northwesterly crossing Brick Kiln Road a distance of 700 ft. more or less to Biltmore Ave .; thence Westerly 400 ft. more or less to the East side of Carlisle St .; thence Easterly crossing Gorham St. a distance of 500 ft. more or less which point is 200 ft. more or less easterly from the East side of Gorham St .; thence nearly southerly in a line parallel to and 200 ft. more or less Easterly from the East side of Gorham St. a distance of 800 ft. more or less; thence southwesterly 200 ft. more or less to the East side of Gorham St .; thence Northerly 200 ft. more or less on the East side of Gorham St. to a point; thence Southwesterly 60 ft. more or less crossing Gorham St. to the point of beginning.


UNDER ARTICLE 6.


Miss Florence Kelly moved that the Town vote to amend Section 1B (6) of the Zoning By-Law and the map accompanying said section and on file with the Clerk of the Town of Chelmsford, entitled "Chelms- ford, Massachusetts-Zoning District Map-1956" by removing from

I submit herewith my report of an audit of the books and accounts of the town of Chelmsford for the period from March 1, 1959 to May 16, 1961, made in accordance with the provisions of Chapter 44, General Laws. This is in the form of a report made to me by Mr. William Schwartz, Assistant Director of Accounts.

In accordance with your instructions, I have made an audit of the books and accounts of the town of Chelmsford for the period from March 1, 1959, the date of the previous audit, to May 16, 1961, and report there- on as follows:


An examination and verification was made of the recorded financial transactions of the town, as shown on the books of the departments receiving or disbursing money or committing bills for collection.


The books and accounts in the town accountant's office were examined and checked, the recorded receipts being compared with the treasurer's books and with the records in the several departments col- lecting money for the town. The payments, as entered, were checked with the treasurer's books and with the treasury warrants, while the appro- priations, transfers, and loan authorizations were checked with the town clerk's records of town meeting proceedings and with the records of the finance committee.


The ledger accounts were analyzed, the necessary adjustments re- sulting from the audit were made, and a balance sheet, showing the financial condition of the town on May 16, 1961, was prepared and is appended to this report.


The books and accounts in the office of the town treasurer were examined and checked in detail. The receipts, as recorded, were analyzed and compared with the records of payments to the treasurer by the several departments and with other sources from which the town received money, while the recorded payments were compared with the treasury warrants and with the town accountant's books.


In the process of auditing the treasurer's records it was found that

numerous errors had occurred in the recording of and accounting for receipts and payments, in which connection it is urged that the treasurer reconcile his cash book balance with the cash in the banks and in the office at least weekly, that the bank statements be reconciled promptly upon their receipt, and that a permanent record be kept of such recon- ciliations.


The reconciliation of the treasurer's cash showed the sum of $1,020.12 as due from the treasurer, and this amount was deposited to the town's account by personal check of the treasurer prior to the completion of the audit.


The payments on account of maturing debt and interest were proved with the amounts falling due and were checked with the cancelled securities and coupons on file. The outstanding coupons on May 16, 1961 were listed and reconciled with the balance in the bond and coupon account as certified by the bank of deposit.


The records of payroll deductions for Federal and State taxes, the county retirement system, and group health insurance premiums were examined. The deductions were footed, the payments to the proper agencies were verified, and the balances on hand were reconciled with the respective controls in the town accountant's ledger.


The savings bank books and securities representing the investments of the several trust and investment funds in the custody of the town treasurer and the trustees were examined and listed. The income was proved, and all transactions and balances were verified and compared with the books of the town accountant.


The records of tax titles and tax possessions held by the town were examined and checked. The amounts transferred to the tax title account were checked with the collector's books, the reported redemptions were compared with the recorded receipts of the treasurer, the foreclosures were verified, and the tax titles and tax possessions on hand were listed, proved, and checked with the records at the Registry of Deeds.


The books and accounts of the town collector were examined and checked. The taxes, motor vehicle and trailer excise, and departmental accounts receivable outstanding at the time of the previous audit, as well as all subsequent commitments, were audited and proved. The re- corded collections were checked with the payments to the treasurer as shown by the treasurer's and the town accountant's books; the abate- ments, as entered, were compared with the assessors' and other depart- mental records of abatements granted; the transfers to the tax title account were proved; and the outstanding accounts were listed and reconciled with the respective controls in the accountant's ledger. Veri- fication of the collector's petty cash advance indicated a variance of $121.00 which amount is due from the collector.
