Report of the Planning Board


April 17, 1935.


After due advertisement in the Saugus Herald of April 12, 1935, the Planning Board held a public hearing on Article 7 of the Town Warrant of April 17.


After hearing all evidence, the Board unanimously decided not to recommend the passage of the article.

Voted: That the Zoning By-laws and Zoning Map of the Town be and they are hereby changed so that the land of Yvonne Porter at 718 Broadway shown as lot A-267 on Plan 2027 on file in the Assessors' Office and containing approxi- mately 10039 square feet of land shall hereafter be zoned for business purposes. Dear Sir:


I am returning herewith the by-laws of the Town of Saugus submitted by you April 30 with the action of the Attorney General noted thereon.


The town has no authority to pass a by-law of this nature in the absence of an enabling statute. The licensing and keeping of dogs is wholly controlled by statute, see General Laws Chapter 140, Sections 137 to 175. This chapter imposes a mandatory duty upon an owner or a keeper of a dog three months of age to cause it to be registered, numbered, describ- ed, licensed and collared. The power of the cities and towns is apparently limited to requiring dogs to be restrained or muzzled, see Section 167. There is no law authorizing towns to require dogs to be vaccinated against rabies as a condition precedent to obtaining a license.

To see if the Town will vote that the sum of $800 included in appropriation made at the annual Town Meeting of 1935 for the Water Maintenance account to be expended for the purchase of a truck be transferred and appropriated for general Water Maintenance, or to see what action the Town will take in the matter.


ART. 5. To see if the Town will vote to appropriate a sum of $1,029.49 for expenses of the Fire Department, same to be raised by transfer from Fire Chief's Salary account, or to see what action the Town will take in the matter.


ART. 6. To see if the Town will appropriate the sum of $60 for expenses of the Public Works Department, $2750 for Water Maintenance and $400 for Collection of Ashes, same to be raised by transfer from any and all of the unexpended bal- ances of the following accounts :


Water Purchase Unpaid Bills, Water Gates, Electric Work High School, Fire Loss Receipts, Interest on Temporary Loans Account,


or from any other available unexpended balances, or to see what action the Town will take in the matters.


ART. 7. To see if the Town will vote to appropriate and raise by borrowing $20,000.00 for Public Welfare (including Mothers Aid and Old Age Assistance) ; $7500.00 for Public Welfare Unpaid Bills; $300.00 for Town Infirmary; $250.00 for Infirmary Unpaid Bills; $5,000.00 for Soldiers' Relief, and $15,000.00 for the Town's share of the cost of any Federal Works Progress Administration projects (including adminis- tration expenses and services), and to authorize the Treasurer with the approval of the Selectmen, to borrow under authority of and in accordance with the provisions of Chapter 188 of the Acts of 1935, as amended, or take any action relative thereto.

not exceeding $6000.00 to indemnify firemen or members of the fire department for expenses or damages sustained as a result of the explosion and fire at the Town Garage on July 29, 1935, including loss of pay, and for fire department ex- penses, or to see what action the Town will take in the matters.


ART. 9. To see if the Town will appropriate the sum of $750.00 for Street Lighting, or to see what action the Town will take in the matter.


ART. 10. To see if the Town will appropriate the sum of $350.00 for Public Works Dept., Highway and Snow and Ice Unpaid Bills, or to see what action the Town will take in the matters.


ART. 11. To see if the Town will appropriate $500 for town hall account, or to see what action the Town will take in the matter.


ART. 12. To see if the Town will appropriate and raise by borrowing or otherwise the sum of $40,000 for the pur- chase and installation of a fire and police signal system, or to see what action the Town will take in the matter, agree- able to petition of the Board of Fire Engineers.

To see if the Town will authorize the Selectmen, or a committee to be chosen as the meeting; may determine, to have full powers in all matters relating to the purchase and installation of a fire and police signal system, or to see what action the Town will take in the matter, agreeable to the petition of the Board of Fire Engineers.

To see if the Town will vote to appropriate and raise by borrowing the sum of $25,000 for the Town's share of the cost of any Works Progress Administration project for a fire and police signal system and, to meet any appropriation so made, to authorize the treasurer with the approval of the Selectmen, to borrow under authority of and in accordance with the provisions of Chapter 188 of the Acts of 1935 as amended, or take any action relative thereto, agreeable to the petition of the Board of Fire Engineers.

ART. 16. To see if the Town will vote to authorize the treasurer with the approval of the Selectmen to borrow money for general municipal purposes under authority of and in ac- cordance with the provisions of Chapter 49 of the Acts of 1933 as amended, or take any action relative thereto.


ART. 17. To see if the Town will vote to authorize the Selectmen on behalf of the Town to acquire an easement and right of way for water extension purposes approximately 40 ft. wide over land now or formerly of Metcalf lying between two unconnected portions of Golden Hills Road, or take any action in relation thereto.


ART. 18. To see if the Town will vote to transfer to the control of the School Committee to be used for school play- ground or athletic purposes a portion of the land owned by the town on the easterly side of the Newburyport Turnpike at present used for Town Infirmary purposes, or to see what action the Town will take in the matter, agreeable to the peti- tion of the School Committee.


ART. 19. To see if the Town will vote to ratify the action of the Selectmen in accepting a deed from Carmen Cogliano et ux. to the Town conveying without consideration a parcel of land containing about 19,354 square feet of land, shown as Lot B on a plan by John Dyer, Engr. dated July 25, 1935, duly recorded and will vote that said land be used for public playground purposes, or to see what action the Town will take in the matter.

The meeting was called to order at 8:26 P. M. by the Moderator, Honorable Frank P. Bennett.

Unanimous consent was granted Fire Engineer Ernest W. Homan to offer a resolution.


"Whereas Chief Mellon R. Joy of the Saugus Fire Depart- ment died on Wednesday, July 31, 1935 as the result of in- juries received at a fire and explosion which occurred in the Public Works Department Garage on Monday, July 29, 1935;


"Therefore be it resolved that there be written into the records of this meeting a page of sorrow and regret for the untimely loss of Chief Joy, and in memory of the man who gave 49 years of his life in the Fire Departments of Boston and Saugus. We deeply regret that this unexpected and un- foreseen accident prevented the fulfillment of Chief Joy's ambition which was to serve 50 years as a fireman.


"Chief Joy's code of life was a rigid one, he was exacting in discipline, and in the enforcement of fire laws, yet respected

by all. He was a man of courage, never hesitating to be the first one in at a fire, and it was this characteristic that brought about the circumstance that caused his death. That he stood high in the Organization of Fire Chiefs of New England, was attested to by the great number of Fire Chiefs from all over New England who attended his funeral.


"Chief Mellon R. Joy was a trustworthy, honorable man.


"His life and character will always be an enduring example of a good Fireman.


"Well done good and faithful servant.

Voted : That the following sums be and the same are hereby appropriated: $18,000.00 for Public Welfare, including Mothers' Aid and Old Age Assistance; $6500.00 for Public Welfare unpaid bills; $250.00 for expenses of the town infirm- ary ; $250 for town infirmary unpaid bills ; $5,000. for Soldiers' Relief; $15,000 for the town's share of the cost of any Federal Works Progress Administration projects including admin- istration expenses and services, said sum of $15,000 to be ex- pended under the direction of the Board of Selectmen, be and to meet the appropriations hereby made that the Treasurer with the approval of the Selectmen, be and hereby is author- ized to borrow under authority of and in accordance with the provisions of Chapter 188 of the Acts of 1935 the sum of $45,000.00 and to issue bonds or notes of the town therefor, said bonds or notes to be paid in not more than ten years or at such times as may be directed by the Emergency Finance Board named in Chapter 49 of the Acts of 1935. ARTICLE 8.


Voted: That the sum of $2500 be and the same hereby is appropriated for Fire Department expenses and the further sum of $3500 to indemnify firemen or members of the Fire Department for expenses or damages sustained by them while acting as such including loss of pay, as a result of the ex- plosion and fire at the town garage on July 29, 1935, provided that there shall not be payable out of such appropriation to any such firemen or member of the Fire Department or to the widow of Mellon Joy, deceased, a sum in excess of such amount as shall be recommended by the Board of Fire En- gineers in accordance with the provisions of General Laws Chapter 41, Section 100 as amended, said sums to be raised under Article 16 of this warrant. 10:24 P.
