WARRANT FOR SPECIAL TOWN MEETING Tuesday, October 16, 1956


Article 1. To see if the Town will vote to purchase additional departmental equipment for the use of the Public Works Department, and appropriate money therefor, to be provided by appropriation from available funds or by borrowing under Chapter 44 of the General Laws of Massachusetts, or both; or take any action relative thereto.

Article 2. To see if the Town will vote to appropriate the sum of $4224.84, or any other sum, to supplement the appropriation made under Article 43 of the Warrant for the Annual Town Meeting of 1955 to extend sewers in any or all of the following streets: Banks Terrace, Pleasant Street, Essex Street and to install a relief sewer system at the junction of Grant and Farragut Roads; and to provide said sum by appropriation from available funds or take any action relative thereto.

Article 3. To see if the Town will vote to accept the provisions of Section 59 of Chapter 33 of the General Laws as amended as fellows: "Any person in the service of the commonwealth, or of a county, city or town which, by vote of its county commissioners or city council or of its inhabitants at a town meeting, accepts this section, or has accepted similar provisions of earlier laws, shall be entitled, during the time of his service in the armed forces of the commonwealth, under section thirty-eight, forty, forty-one, forty-two or sixty, or during his annual tour of duty of not exceeding fifteen days as a member of a reserve component of the armed forces of the United States, to receive pay therefor, without loss of his ordinary remuneration as an employee or official of the commonwealth, or of such county, city or town, and shall also be entitled to the same leaves of absence or vacation with pay given to other like employees or officials."

Article 4. To see if the Town will authorize the Board of Public Works to prepare, execute, and deliver deeds for certain lots in the Swampscott Cemetery, without consideration therefor, to those persons who have previously paid for same, upon being furnished evidence of said payments satisfactory to the Board of Public Works; or take any action relative thereto.

Article 5. To see if the Town will accept two bequests of $3,000 each as provided in the will of Granville Ingalls, late of Swampscott, Massachusetts for the use of the Swampscott Public Library; said bequests to be known as "The Benjamin G. Ingalls Fund" and "The Clara F. Ingalls Fund" respectively; or take any action relative thereto.

Article 6. To see if the Town will authorize the Board of Selectmen to compromise and settle either or both of the claims against the Town brought by Justina R. Cassidy and Joseph A. Cassidy for damages arising from an allegedly defective condition of a public sidewalk on Humphrey Street; both of said claims now pending in the Superior Court of the County of Essex at Salem being numbered 100800 and 100879 respectively; and appropriate a sum or sums of money therefor, to be provided by appropriation from available funds in the treasury; or take any action relative thereto.

Article 7. To hear and act on the report of the Post Office Building Committee.

Article 8. To see if the Town will authorize the Board of Selectmen to execute and deliver to the Postmaster General of the United States and his assigns an irrevocable option to purchase the following described parcel of land, for the sum of one dollar, said land to be used solely for the purpose of erecting a building thereon to be operated, maintained and used as a Post Office; and authorize said Board to do any and all things necessary to accomplish this purpose; or take any action relative thereto.


"A certain parcel of land situated in Swampscott, County of Essex and Commonwealth of Massachusetts, and bounded and described as follows: Beginning on the southwesterly side of Elmwood Road at a point which is seventy-five and thirteen one-hundredths (75.13) feet southeasterly from a stone bound marking the beginning of a curve to Thomas Road, said curve having a radius of twenty- three and sixteen one-hundredths (23.16) feet; thence running in a general southeasterly direction by said Elmwood Road on a curved line having a radius of nineteen hundred thirty-five and eight one-hundredths (1935.08) feet a distance of one hundred (100) feet; thence turning and running S 46° - 06' - 40" W by other land of The Town of Swampscott a distance of one hundred eighty-seven and sixty- seven one-hundredths (187.67) feet; thence turning and running by land of the Swampscott Universalist Society and land of John M. and Lida J. Nelson N 54° - 57' - 30" W a distance of one hundred and one and eighty-seven one hundredths (101.87) feet; thence turning and running by land of Warren J. and Mary Doherty, William R. and Lillian M. Atkinson, Abraham A. Zletz, and Michael F. McGrath N 46° - 06' - 40" E a distance of two hundred eight and eighty one-hundredths (208.80) feet to the point of beginning.

LOT A. NORTHERLY by the Swampscott Branch of the Boston & Maine Railroad by three (3) courses measuring, respectively, 128.87 feet, 104.45 feet and 275.60 feet;


EASTERLY by land of the Town of Swampscott, 159.94 feet;


SOUTHERLY and SOUTHEASTERLY by the Northerly and northwesterly line of Forest Avenue by two (2) courses measuring, respectively, 253.23 feet and 15 feet ; and


SOUTHWESTERLY by land now or formerly of the Whitney Estate, 336.27 feet.

In accordance with the warrant the Town Meeting Members were called to order by the Moderator, Richard B. Johnson at 8:02 P.M., the necessary quorum being present (159).


The warrant with the return thereon was read by Malcolm F. Maclean, Jr., Town Clerk.


Voted: To extend sincere and cordial good wishes to Dr. and Mrs. Ralph E. Bicknell on their Golden Jubilee.


Voted: Article 1. To accept the report of the Finance Committee, as amended, and adopt their recommendations as follows:

Voted: Article 2. To accept the report of the Finance Committee and adopt their recommendations as follows:
