During the year 1958 our case load showed a slight increase from the previous year. Our total expenditures for assistance increased from $165,- 252.77 in 1957 to $183,231.10 in 1958, an increase of $17,978.33. However the net cost to the Town for the operation of the department increased only $1,076.97 over the year 1957 due to increased reimbursements from the State and Federal governments.
Our increased case load, liberal exemptions for children of recipients, and continually climbing medical costs account for this increase of more than 10% in our total expenditures for assistance. The coming year also prom- ises further increase in medical costs. Nursing home care and hospitalization costs are to be increased effective January, 1959.
We wish to express our appreciation to the Swampscott Visiting Nurse Association who made 320 visits during 1958 to recipients of public assist- ance, and to the Police Department for their prompt and considerate service in moving recipients to and from hospitals and nursing homes.

Assets, as of December 31, 1958, were $390,945.00, an increase of over $40,000.00. For 1958 pension payments were $39,962.00, compared with $37,- 738.00 for 1957. Included in this figure are death benefits to widows whose husbands died as a result of injuries incurred while working, consequently are not pensions, but death benefits.

The eighth annual report of the Trustees follows:
Two regular meetings of the Trustees were held at the New Ocean House, on the invitation of Colonel Clement Kennedy. At the annual meeting, Ern- est Manchin was elected chairman and Philip H. Stafford was elected secret- ary for the coming year.
The eighth annual scholarship, in the amount of $300.00, was awarded to Tom F. Lindsey, who enrolled at Northeastern University.

S. Treasury Department, states, "Contributions made to the Fund are deductible by the donors in computing their taxable net income. etc."

Town Counsel
RICHARD COUGHLIN, Town Counsel
During the year 1958 as Town Counsel I have attended the regular, weekly, and special meetings of the Board of Selectmen, various meetings with the Board of Public Works, Public hearings with the Board of Appeals and meetings with the committees appointed jointly by the Board of Select- men and the Moderator who have accomplished many of the reforms in land use, increase tax revenue, important traffic study changes, and other con- structive changes.
One of the more important matters which arose during the year involved the new Shopping Center. The well planned Restrictive Agreement which had been previously executed by reason of changes in ownership of the property required an extensive Supplemental Agreement relating to the use of the property, guarantees as to time for performance, and protection of the interests of the Town against expensive costs of betterments, utilities, refuse and garbage collection, and police protection which for the present and future will be handled by the owners of the property and will not be absorbed by the Town.
Another important matter was the new Junior High School, which re- quired editing of documents and preparation of contracts. Subsequently, it was necessary to prepare articles during the years 1958 and 1959 for the Town meetings for drain, water and sewer installations, street acceptances, and a reconstruction program for Forest Avenue.
Other important matters requiring legal assistance and attention included the preparation of documents and arrangements, legal advice and conferences relative to establishment of the Post Office, the Blaney Beach dredging, pier construction work, Central Fire Station Building Committee, Central Fire Station Study Committee, Public Library addition, and the newly established Election Commission Office.
Litigation involved full trial, for several days, before Judge Good, Essex Superior Court on an appeal from the decision of the Planning Board on the Hamilton Edwards sub-division application of property located on Atlantic Avenue. Defense of this litigation was successful and a dismissal of appeal to the Supreme Court. There have been several personal injury claims and law suits instituted, arising out of alleged defects in the ways of the Town, now pending in the Essex Superior Court.
I instituted suit for damage on behalf of the Town in the Essex Superior Court for extensive property damage to the Clarke School, as a result of a motor vehicle accident. One personal injury claim has been settled as au- thorized by the Board of Selectmen, and two minor claims were disposed of with funds transferred from the Reserve Account to the Law Expense Ac- count. There are several cases pending before the Appellate Tax Board against the Town, two cases have been withdrawn.
