1958 Annual Report


(b) RULE OF UNQUESTIONED RECOMMENDATIONS


Sub-section 1. The report of the Finance Committee to the Annual Town Meeting shall consist of two parts. Part one shall contain a list of recom- mendations as to what sum of sums of money the Town shall raise and ap- propriate to defray the expenses of the Town for the ensuing year. Each recommendation in part one shall bear a serial number or letter and shall be considered as a separate appropriation within the meaning of Chapter 44, Section 31 of the General Laws. The Finance Committe may set forth in its report such sub-totals making up each appropriation as it deems nec- essary or advisable. Part two of the report shall contain, in the order in which the articles appear in the Warrant, a list of recommendations, bv ar- ticles, as to what action, or actions, if any, the Town shall take with respect to each article. The Town Clerk shall mail a copy of the report of the Fi- nance Committee to each Town Meeting Member in time to reach each mem- ber at least five days prior to a Town Meeting. Any duly elected member not in receipt of this report five days prior to the meeting may, by appli- cation to the Town Clerk, obtain a copy. The provisions of this sub-section are directory and not mandatory. and action taken by the Annual Town Meeting shall be valid notwithstanding any lack of compliance therewith.


Sub-section 2. The order of business at the Annual Town Meeting shall be as follows:


First: To hear the reports of committees other than the Finance com- mittee and take action on the same.


Second: Unless it is voted to dispense with the reading of it, to hear the report of the Finance Committee.


Third: To allow questioning of the report of the Finance Committte as described in subsection 3 of this section.


Fourth: To act on a blanket motion as provided in subsection 3.


Fifth: To take up in the usual manner, in the order in which they ap- pear, all recommendations of the Finance Committee which have been brought into question, all recommendations which require more than a maj- ority vote, and all recommendations not set forth in the report mailed to the members as provided in subsection 1.


Subsection 3. During the period allowed for questioning of the recom- mendations of the Finance Committee there shall be neither debate nor dis- cussion. The procedure for this period shall be as follows:


First: If a member is of the opinion that a recommendation of the Fi- nance Committee ought not to pass or that a recommendation ought not to pass without dicussion, he shall address the chair and, after stating his name, state the serial number or letter of the recommendation which he questions if it be under part one of the report, or the number of the article to which the recommendation applies if it be under part two of the report.


Second: At the conclusion of the questioning period the Moderator shall read, or have read, the identifying letters or numbers of the recom- mendations of the Finance Committee which have not been questioned.


Third: If there be no further questions the Moderator shall entertain a blanket Motion: (a) That all unquestioned recommendations of the Finance Committee be each and severally adopted, (b.) That any and all unquestioned sums which they have recommended be raised and appropriated and (c) That any and all unquestioned actions that they have recommended be each and severally taken. A blanket motion shall not, however, contain any question which requires either recorded vote or more than a majority vote, and all questions shall be voted on in their proper order.


Subsection 4. Any item passed under blanket motion mav be subse- quently reconsidered independently of the other items covered by the said blanket motion.

SPECIAL TOWN MEETING Tuesday, June 17, 1958


In accordance with the warrant the Town Meeting Members were called to order at 8:09 P.M., the necessary quorum being present. (167)


The warrant with the return thereon was read by Daniel W. Worm- wood, Jr., Town Clerk.


VOTED ARTICLE 1. To accept the reports of the Junior High School Building Committee and the School Committee.


VOTED ARTICLE 2. To accept the report of the Finance Committee and adopt their recommendations as follows:


That the Town vote to construct, originally equip and furnish a new Junior High School substantially in accordance with the preliminary plans and specifications proposed by John M. Gray, Architect, on land taken for school purposes by votes at the Special Town Meetings of December 12th, 1955, and October 16th, 1956, and that the sum of $1,649,621.75 be raised and appropriated for constructing, originally equipping, and furnishing said new Junior High School as follows: That the sum of $19,621.75 be appro- priated from the unexpended balance of the appropriation voted under Article 2 of the Warrant for the Special Town Meeting of January 21, 1958, and that the Treasurer, with the approval of the Board of Selectmen, be author- ized to borrow a sum not to exceed the remainder, namely $1,630,000.00 under Chapter 645) of the Acts of 1948, and to issue bonds or notes of the Town therefor payable in accordance with the provisions of Chapter 44 of Gen- eral Laws (Ter. Ed.) as amended.


The said school building shall be constructed by the Junior High School Building Committee, appointed under said Article 2 of the Warrant of the Special Town Meeting of January 21, 1958, which committee shall have the power to engage an architect, enter into contracts and do all things necess- ary to construct, originally equip, and furnish said new Junior High School for a sum of money not to exceed said appropriation. Unanimous.


VOTED ARTICLE 3. To accept the report of the Finance Committee, as amended, and adopt their recommendations as follows:


The Finance Committee recommends that the Town vote to authorize the Board of Public Works to extend and install water mains, not less than ten inches in diameter on Forest Avenue from Walnut Road into the proposed new Junior High School site connected to the water main existing therein. and that the sum of $25,000.00 be raised and appropriated for such purposes as follows: That the Treasurer, with the approval of the Board of Select- men, be authorized to borrow the sum not to exceed $25,000.00, and to issue bonds and notes therefor payable in accordance with the provisions of Chap- ter 44 of the General Laws, (ter. ed.) as amended. Unanimous.


VOTED ARTICLE 4. To accept the report of the Finance Committee, as amended, and adopt their recommendations as follows:


That the Town vote to authorize the Board of Selectmen to purchase a new fire engine pumper of 750 gallon capacity for the Fire Department and that the sum of $12,500.00 be raised and appropriated for such pur- poses as follows: That the sum of $2,500.00 be appropriated from the tax levy and that the Treasurer, with the approval of the Board of Selectmen, be authorized to borrow the remainder, viz., the sum of $10,000.00 and to issue bonds and notes therefor payable in accordance with the provisions of Chapter 44 of the General Laws, (Ter. Ed.) as amended. Unanimous.

VOTED ARTICLE 5. To accept the report of the Finance Committte, as amended, and adopt their recommendations as follows:


That the Town grant a permanent increase in the wages of all regular fulltime employees of the town including the Janitorial and Secretarial em- ployees of the School Department, but excluding all employees who re- ceived a raise at the annual town meeting of 4% or more and excluding all other employees under the direction and control of the School Committee, by 4% effective July 1, 1958, and to further grant a temporary increase of 4% to the same employees commencing July 1, 1958 and terminating Dec- ember 31, 1958, and that the sum of $1,636.02 be transferred from the Water Available Surplus Account, and the sum of $25,203.02 be appropriated from the current tax levy therefor.

VOTED ARTICLE 6. To accept the report of the Finance Committee, as amended, and adopt their recommendations as follows:


That the Town vote to change Article IV, Section 10. of the By-Laws, by inserting after the end of the first sentence, these two sentences, "All full time employees of the Town of Swampscott who have completed fif- teen years of service shall be granted an annual vacation of not less than four weeks. Such vacations shall be granted by the heads of the respective Departments of the Town, at such times as in their opinion will cause the least interference with the performance of the regular work of the Town." VOTED ARTICLE 7. To accept the report of the Finance Committee and adopt, their recommendations as follows:


That the Town vote to authorize the Board of Public Works to install a drain in Ryan Place, and that the sum of $8,200.00 be appropriated there- for.

SUMMARY


The proposed measure provides that every former public employee, other than a judge, who is pensioned or retired for disability, shall report to his retirement authority, annually, his earnings from gainful occupation during the preceding year; and that, if such earnings, plus the pension, exceed the regular compensation of the position formerly held, the pensioner shall re- fund that portion of his pension equal to such excess or the entire pension if such excess is greater than the pension. A refund, if required, shall not in- clude any part of a pension represented by salary deductions from or special purchase by the former employee. The requirement of a refund is not ap- plicable to income received in or prior to 1958.

On August 26, 1958, Mr. Harold C. Hudson, Chairman of the Board, re- tired from public office after 20 years, serving on the Water & Sewerage Board for 17 years and then on the Board of Public Works for approximately 21/2 years.
