B BY-LAWS AND LAND USE
ARTICLE 22. To see whether the Town will vote to accept the provisions of Chapter 40, of the General Laws, Section 8C, authorizing the Board of Selectmen to appoint a conservation commission; and the provisions of said Chapter 40, Sections 5, clauses (51) and (50), providing for the operation and maintenance of said conservation commission; and the Board of Selectmen are hereby directed, within thirty days of the acceptance of this Article, by vote of the Town Meeting, to appoint a Conservation Commission composed of seven members: and the Conservation Commission so established are hereby authorized to expend the sum of $150.00 for the purposes of the law.

ARTICLE 23. To see if the Town will vote to amend the Town By-Laws relating to Town Meetings to include the following: "A record available for public inspection shall be kept by the Town Clerk of the Attendance of town meetings members at each town meeting or adjourned town meeting thereafter and that a complete attendance record of all town meeting members be pre- sented promptly after the dissolution of the warrant by the Town Clerk to a newspaper of general distribution in the town and that such attendance record be published in their news columns."

ARTICLE 25. To see if the Town will vote to adopt the following By-Law or take any action relative thereto:
SWAMPSCOTT HARBOR BY-LAW
SECTION I. In construing this by-law the following words shall have the meanings herein given unless a contrary intention clearly appears:
'Swampscott Harbor' - includes the waters between Blaney Beach, Lincoln House Point and the point approximately 1500 feet West by Southwest, thence to shore North by Northwest.
'Harbor Master' - shall include assistant harbor masters duly appointed by the Board of Selectmen.
'Boat' - shall include ship, vessel, steamer or any other type of water craft.
'Person' - shall include individuals, corporations, societies, associations and partnerships.
'Swampscott Waters' - are those lying off the town's shores.
SECTION II. No master, or person acting as master, owner, custodian or other person shall moor or anchor any boat within the limits of Swampscott Harbor, or in any waters under the jurisdiction of the harbor master, without first obtaining from him a permit to anchor or moor said boat. The harbor- master shall approve the anchorage or a place of mooring for said boat. No person carrying passengers for hire shall embark or disembark such passengers at the town pier or float except by permission of the harbor master and Board of Selectmen in writing.
SECTION III. No boat shall exceed the speed of five (5) knots or cause a disturbing wake within the confines of Swampscott Harbor.
SECTION IV. Any person skin-diving in Swampscott Harbor shall:
(a) display a diver's flag consisting of a red field and a white diagonal stripe of sufficient size not less than twelve (12) inches square.
(b) display said flag on a float or other similar device holding said flag upright at a height sufficient to be visible to passing boats.
(c) tow the aforesaid float and flag with him while he is submerged in water and surface thereunder, unless for commercial purposes, permission in writing is granted by the harbor master to otherwise display flags for the pro- tection of divers in Swampscott Harbor.
SECTION V. No person shall operate a boat in Swampscott Harbor while towing water skiers, aqua-planes, or other similar devices except in connection with water carnivals and exhibitions authorized by the harbor master or during the period from November 1st to April 1st of each year.
SECTION VI. No person shall operate a boat in Swampscott waters within three hundred (300) feet of any public bathing beach while towing water skiers, aqua-planes, or similar devices except during the period from November 1st to April 1st of each year.
SECTION VII. All motorboats must (except when prevented by a narrow channel or when approaching or leaving the shore or other boats or rounding sharp bends) keep one hundred fifty (150) feet distant from anchored or

moored boats, piers, rafts, floats, a line of floats outlining swimming areas, skin divers flags, or the shore. In all such cases the speed of such motorboats shall be reduced to headway speed, so as to provide full visibility and control, and prevent their wash from being thrown into, or causing excessive rocking to other boats, barges, aquaplanes or other devices being towed by power. The operator of a towing boat shall be responsible for compliance therewith.
SECTION VIII. The invalidity of any section or provision of this by-law shall not invalidate any other section or provision thereof.
SECTION IX. Whoever violates any section or provision of this by-law shall be liable to a penalty not exceeding twenty ($20.00) dollars for each offense.

ARTICLE 26. To see if the Town will vote to change the zoning of the hereinafter described area so that it shall be included as Business B-1 District, or take any action relative thereto.
The land bounded Southeasterly by Paradise Road, and Northwesterly by Essex Street, containing approximately forty-one (41) acres, and shown as Lots A and B on plan entitled "Plan of Land Belonging to Lillian A. Littlc Trust, situated in Swampscott, Mass., November 19, 1960, Bradford & Weed, Civil Engineers," recorded or to be recorded with Essex South District Registry of Deeds.

ARTICLE 27. To see if the Town will vote to amend the Zoning By-Laws, Article 3, entitled "Use Regulations," Section 4, Business B-1 District, Sub- section 2 by adding after the words "Personal Service Establishment," the words "Bowling Alleys," so that said Sub-section 2 reads as follows:
2. Retail store, personal service establishment, bowling alleys, hotel, restaurant, theatre, moving picture house, refreshment stand, bank, office, studio or funeral parlor, provided permission is obtained from the Board of Appeals as provided in Article 6, Section 5.", or take any action relative thereto.

ARTICLE 28. To see if the Town will vote to extend the zoning applicable to the premises numbered 149-153 Humphrey Street and 5 Cliffside Terrace for retail business purposes. Said land comprises approximately 11650 square feet - adjacent to and immediately to the rear of said numbered premises and being bounded on the North by 149-153 Humphrey Street; on the West and South- west by the Atlantic Ocean, and on the East by Cliffside Terrace, or take any action relative thereto.

Article IX entitled Job Classification and Salary Plan by striking out Section 6 therein and inserting in place thereof the following, or take any action relative thereto:
"SECTION 6 - Sick Leave and Vacation.
Sick leave allowance shall remain in its present status until reviewed by the Personnel Board.
All regular full-time employees except members of the Police, Fire and School Departments, classified in accordance with the provisions of this By-Law who have been regularly and continuously employed may be granted a vacation without loss of pay. Such vacation shall be computed in the following manner:
After the expiration of one (1) year service but for less than five (5) years, a vacation of two (2) weeks.
For five (5) years' service, but less than ten (10) years' service, a vacation of three (3) weeks.
For ten (10) years' service or more, a vacation of four (4) weeks." Sponsored by the Personnel Board.
ARTICLE 31. To see if the Town will vote to include all part-time em- ployees, not including such positions filled by popular election and those under the direction and control of the School Committee, within the provisions of the Job Classification and Salary Plan, or take any action relative thereto.

ARTICLE 32. To see if the Town will vote to adopt the following By-Law or take any action relative thereto:
"The owners of land which has been excavated shall erect barriers or take other suitable measures within five (5) days after the Selectmen have notified them in writing that in their opinion such excavation constitutes a hazard to the safety of the public. Any person violating this By-Law shall be subject to the payment to the town of a fine not to exceed $200 for each such offense."

ARTICLE 33. To see if the Town will vote to adopt the following By-Law or take any action relative thereto:
"The removal of soil, loam, sand, or gravel from land not in public use in any of the residential districts of the Town as defined and shown on the Town zoning map is prohibited except in cases of excavation preparatory and necessary for immediate building and/or construction thereon. The only excep- tion to this prohibition is upon application to the Board of Appeals for express permission. Any person violating the provisions of this By-Law shall be subject to a penalty of payment to the Town of a $50 fine for the first offense, $100.00 fine for the second offense and $200.00 fine for each subsequent offense."

ARTICLE 34. To see if the Town will vote to adopt the following By-Law or take any action relative thereto:
"No person while on private property shall lawfully discharge a firearm without consent of the owner unless the use and discharge of such firearm is

for the lawful defense of the life or property of the person so using and dis- charging such firearm. Any person violating this By-Law shall be subject to a fine not to exceed $20 for each such offense."

ARTICLE 35 . To see if the Town will vote to strike out Article III, Sec- tion 2, Part 4 of the Zoning By-Laws and insert therein the following or take any action relative thereto:
"4. Municipally owned incinerator, park, playground, receation building, fire station, police station, public library, town administration building, public museum and post office."

ARTICLE 36. ARTICLE 37. To see if the Town will vote to construct, originally equip and furnish a municipal incinerator on Lots 414-420 inclusive on Plate 11 of the Assessors Plan of the Town of Swampscott in accordance with plans and specifications prepared by Fay, Spofford & Thorndike, Inc. and raise and appro- priate the necessary money therefor by transferring from available funds, by borrowing, or otherwise, to take any action thereto.

ARTICLE 57. To see if the Town will vote to authorize the Machon School Study Committee to engage an architect to prepare preliminary plans, specifications, and engineering data together with estimates of the approximate costs for the necessary remodeling for complete construction of a kindergarten facility, all-purpose room, kitchen, administrative and health unit for the elementary Machon School and report back to the next Annual or Special Town Meeting and appropriate the necessary money therefor by transferring from available funds, by borrowing or otherwise, or take any action relative thereto.

ARTICLE 58. To see if the Town will vote to authorize the School Com- mittee to engage the services of an architect for the purpose of making a survey of the High School building and to prepare recommendations for renovation, reconstruction, addition or alternate proposals that will provide the educational space and facilities required to meet present and future needs of increased High School enrollments and appropriate the necessary money therefor or take any action relative thereto.

To see if the Town will vote to acquire or take by eminent domain (as the initial step in a suggested long-range plan to eventually obtain for general recreational purposes, and to preserve the character of the civic center of the town, the larger area extending from Humphry Street up the east side of Monument Avenue and around the corner to the south side of Elmwood Road, commonly known as the Chick Estate) the following parcels of land and buildings thereon to be used as a playground for the pupils of the Hadley Elementary School and for neighborhood play purposes: Lots No. 24 and No. 25 adjacent to the Hadley Elementary School, as shown on the Town Assessors Plate No. 2, and an access strip eight feet wide extending across Lot No. 2 from the north boundary of Lot No. 25 to Elmwood Road, and ap- propriate the necessary money therefor or take any action relative thereto.
