VOTED ARTICLE 24. To accept the report of the Finance Committee, as amended, and adopt their recommendations as follows:

Town of Swampscott
SWAMPSCOTT HARBOR BY-LAW
Section I. In construing this by-law the following words shall have the mean- ings herein given unless a contrary intention clearly appears:
"Swampscott Harbor" is bounded as follows: Beginning at the end of Lincoln House Point and running West by Southwest One Thousand Five Hundred (1,500) feet to a point; thence turning and running North by Northwest to the shore; thence by the shore to the point of beginning.
"Harbor Master" shall include assistant harbor masters duly appointed by the Board of Selectmen.
"Boat" shall include ship, vessel, steamer or any other type of water craft.
"Swampscott Waters" are those lying off the town's shores.
Section II. No person shall moor or permanently anchor any boat within the limits of Swampscott Harbor, or in any waters under the jurisdiction of the harbor master, without first obtaining from him a permit to anchor or moor such boat. The harbor master shall approve the anchorage or place of mooring for such boat. No person carrying passengers for hire shall embark or disembark such pas- sengers at the town pier or float except by permission of the harbor master and Board of Selectmen in writing.
Section III. No boat shall exceed the speed of five (5) knots or cause a dis- turbing wake within the confines of Swampscott Harbor.
Section IV. Any person skin-diving in Swampscott Harbor shall:
(a) display a diver's flag, consisting of a red field and a white diagonal stripe, not less than twelve (12) inches square.
(b) display said flag on a float or similar device holding such flag upright at a height sufficient to be visible to passing boats.
(c) tow such float and flag with him while he is submerged in water unless permission in writing is granted by the harbor master to otherwise display flags for the protection of divers in Swampscott Harbor.
Section V. No person shall tow water skiers or aqua-planes or similar devices in Swampscott Harbor, except in connection with water carnivals and exhibitions authorized by the harbor master or during the period from November 1st to April 1st.
Section VI. No person shall tow water skiers or aqua-planes or similar devices in Swampscott waters within three hundred (300) feet of any public bathing beach, except during the period from November 1st to April 1st.
Section VII. All motorboats must (except when prevented by a narrow chan- nel or when approaching or leaving the shore or other boats or rounding sharp bends) keep one hundred fifty (150) feet distant from anchored or moored boats, piers, rafts, floats, lines of floats outlining swimming areas, skin divers' flags, or the shore. In all such exceptions the speed of such motorboats shall be reduced to headway speed, so as to provide full visibility and control, and prevent their wash from being thrown into, or causing excessive rocking to, other boats. The operator of a towing boat shall be responsible for compliance herewith.
Section VIII. The invalidity of any section or provision of this by-law shall not invalidate any other section or provision thereof.
Section IX. Whoever violates any section or provision of this by-law shall be liable to a penalty not exceeding twenty ($20.00) dollars for each offense.

The removal of soil, loam, sand, or gravel from land not in public use in any of the residential districts of the Town, as defined and shown on the Town zoning map, is prohibited, except in cases of excavation preparatory to immediate con- struction or alteration of residential property, and then only upon application to and express permission from the Board of Appeals. Any person violating the pro- visions of this By-Law shall be subject to a penalty of payment to the Town of a $50.00 fine for the first offense, $100.00 fine for the second offense and $200.00 fine for each subsequent offense.
VOTED ARTICLE 34. That this article, as amended, be adopted as follows:
That the period after the word "firearm" at the end of the first sentence thereof be deleted and that a semi-colon be substituted therefor, and that follow- ing the substituted semi-colon the following words be added "provided, however, that this By-Law shall not apply to the action of any law enforcement officer in the execution of his duties", so that said By-Law shall read as follows:
"No person while on private property shall lawfully discharge a firearm with- out consent of the owner unless the use and discharge of such firearm is for the lawful defense of the life or property of the person so using and discharging such firearm; provided, however, that this By-Law shall not apply to the action of any law enforcement officer in the execution of his duties. Any person violating this By-Law shall be subject to a fine not to exceed $20.00 for each such offense."
ARTICLE 35. That the report of the Planning Board be accepted and their recommendations be adopted as follows :

VOTED ARTICLE 40. To accept the report of the Finance Committee, as amended, and adopt their recommendations as follows:
That the Town, in accordance with Chapter 737 of the Acts of 1960, instruct ithe Board designated in the statute, and if no board is so designated, the Board of Health, to appoint an Inspector of Gas Piping and Gas Appliances whose duties are designated in Chapter 25, Section 12-H of the Massachusetts General Laws, and that the Board appoint the Plumbing Inspector.
VOTED ARTICLE 41. To accept the report of the Finance Committee and adopt their recommendations as follows:
That the Town purchase two new motorcycles for the use of the Police De- partment, one solo type and one servi-car type, and that the Selectmen be author- ized to sell or trade in one 1958 motorcycle and one 1959 motorcycle now being used by the Police Department. The appropriation is included under the recom- mendation of Article 42.

That the Town authorize the Board of Public Works to purchase four (4) 1961 trucks, one (1) 1961 station wagon, one (1) aerifier, and to sell or trade in two (2) 1954 trucks, two (2) 1956 trucks and one (1) 1957 station wagon and that the sum of $19,500.00 be transferred from the Stabilization Fund for the purposes of this article.

That the Town authorize the Machon School Study Committee to engage an architect to prepare preliminary plans, specifications, and engineering data together with estimates of the approximate costs for the necessary remodeling for complete construction of a kindergarten facility, all-purpose room, kitchen, administrative jand health unit for the elementary Machon School and report back to the next Annual or Special Town Meeting and that the sum of $5,000.00 be appropriated therefor.
It was voted not to accept Article 58, but a motion to reconsider was carried 89 to 70, and the article was then accepted.
VOTED ARTICLE 58. To accept the report of the Finance Committee and adopt their recommendations as follows:
That the Town authorize the School Committee to engage the services of an architect for the purpose of making a survey of the High School building and to prepare recommendations for renovation, re-construction, addition or alternate pro- posals that will provide the educational space and facilities required to meet present and future needs of increased High School enrollments and that the sum of $2,000.00 be appropriated therefor. VOTED ARTICLE 59. To accept the report of the Finance Committee and adopt their recommendations as follows:
That the Town acquire or take by eminent domain the following parcels of land and buildings thereon to be used as a playground for the Hadley Elementary School and for neighborhood play purposes: Lots No. 24 and 25 adjacent to the Hadley Elementary School, as shown on the Town Assessor's Plate No. 2, and an access strip eight feet wide extending across Lot No. 2 from the north boundary of Lot No. 25 to Elmwood Road, and that the sum of One Dollar ($1.00) be appropriated therefor. VOTED ARTICLE 60. To accept the report of the Finance Committee, as amended, and adopt their recommendations as follows:
That the Town petition the General Court to amend Section 1 of Chapter 119 of the Acts of 1949 by striking out the word "ten" and substituting therefor the word "twenty" so that as amended the section will read:

The Town of Swampscott is hereby authorized to raise and ap- propriate the sum of twenty thousand dollars to provide a scholarship fund the income of which may be used for the higher education of high school or prepara- tory school graduates who are residents of said town, and said fund shall be dedicated as a memorial to veterans of World War II.

The Board of Appeals of the Town of Swampscott, herewith submits its Annual Report for the year 1961.
The Board reviewed thirty-three public hearings, and five re-hearings, of which fifteen were for Variance and eighteen for Use and Business permits.
Four hundred ninety-five dollars ($495) in fees were collected and paid to the Town of Swampscott.
We are grateful for the willing services of Mr. Warren C. Hutchins during his tenure as Associate Member, and we wish to thank the various Departments and the Town Counsel for their help and cooperation throughout the year.

I. MURRAY ADAMS, Accountant
New methods are being devised to solve many troublesome problems, but there has been a notable increase in business activity, though unemployment con- tinues at too high a level. Automation continues to challenge the nation; means of using displaced workers are under study. The Common Market, with the possibility of a "tariff wall" to shut out products of the United States, is an issue which demands immediate solution. For without our foreign trade the nation will suffer drastically. Internationally, there appears to be a new crisis every month, but the situation now appears more hopeful.
Increasing tax burdens are predicated upon increasing business activity. Yet there remains the problem of to what extent the state should aid the municipalities in easing their real estate taxes.
Despite the many and complex problems, there is an air of optimism.
In accordance with the provisions of Section 61, Chapter 41, of the General Laws, the following report is submitted. It is arranged in accordance with rules prescribed by the Director of the Division of Accounts. A detailed report of receipts and expenditures for the year ending December 31, 1961, is available in this office.
