B. The remaining portions of the Town of Scituate are hereby respectively designated as zone "B."
Sect. 3. In an "A" zone no building, structure or prem- ises shall be erected, altered or used for any purpose except one or more of the following :
(1) A single family detached dwelling.
(2) A club house, except one whose chief use is for a service customarily carried on as a business.
(3) A church or school.
(4) A farm, garden, nursery or green-house.
(5) Any accessory purpose customarily incidental to the foregoing purposes including a private garage for not more than three automobiles.
(6) A private garage for more than three automobiles to be used in connection with and as an incident of

one of the foregoing purposes provided as to each such garage that after a public hearing by the Board of Selectmen, fourteen days notice of which shall be published in a local paper and mailed to the last known address of each owner of property within five hundred feet of the proposed garage location, the Selectmen shall rule that such garage will not be detrimental or injurious to the neighborhood.
(7) A purpose forbidden in an "A" zone, provided the same shall be incidental to use as a residence.
Sect. 4. Any building, structure or premises in an "A" zone which at the time of the adoption of this by-law is being used for a purpose not permitted hereunder, may be continued to the same extent in such use or in a use not substantially different therefrom. Any building or structure in an "A" zone which at the time of the adoption of this by-law does not con- form to the kinds of buildings or structures permitted here- under may be maintained and may be structurally altered or enlarged to the extent of the entire contiguous premises owned on the date of the passage of this by-law by the then owner of said building or structure. Should any non-conforming building occupied by a non-conforming use be partially or wholly destroyed by fire or other casualty it may be repaired or replaced by a building or structure substantially the same in character and used for the purpose for which it was form- erly used or for a use not substantially different therefrom, provided such repair or replacement is commenced within one year from the date of such destruction and work thereon prose- cuted with reasonable dispatch.
Sect. 5. In a "B" zone there shall be no restriction as to the construction or use of the buildings, structures and prem- ises therein located.
Sect. 6. Where a boundary line of an "A" zone divides a single lot at the time of the adoption of this by-law, if said lot does not extend more than twenty-five feet within said boundary line of an "A" zone, the regulations applicable to an "A" zone shall not apply to said lot, except that if said

entire lot has no fontage on a street in a "B" zone said en- tire lot shall be subject to the regulations of an "A" zone.
Sect. 7. Whoever violates any provision of this by-law shall be punished by a fine of not more than Twenty Dollars ($20) to be paid into the treasury of the Town of Scituate.
Sect. 8. The invalidity of any section or provision of this by-law shall not invalidate any other section or provision hereof.
Sect. 9. This by-law may be repealed or modified at a town meeting after notice as provided by law and an oppor- tunity to objectors to be heard, by a two-thirds vote of said town meeting.
Sect. 10. So much of this by-law as is approved by the Attorney General shall go into effect upon its publication as required by law.

ZONING BY-LAW
Section. 1. The Town of Scituate is hereby divided into zones each of which shall be subject to the regulations herein- after set forth as to the construction and use of buildings, structures and premises therein located.
Sect. 2. A. The following portions of the Town of Scitu- ate are hereby respectively designated as zone "A."
(1) That portion of the Town of Scituate lying north- erly and northeasterly of a red line as shown on a plan en- titled Zoning Map, North Scituate Beach section of the Town of Scituate dated January 29, 1931 and filed with the Town Clerk, and which plan is made a part thereof.
(2) That portion of the Town of Scituate lying within red lines on a plan entitled Zoning Map, Egypt section of the

B. The remaining portions of the Town of Scituate are hereby respectively designated as zone "B."

To hear the report of the Committee appointed at the Special Town Meeting held on November 12, 1930 "to make a thorough investigation as to the costs of operation and esti- mated value of the Scituate Water Company within the con- fines of Scituate, and make a study of operating costs and value of a water system under Town ownership" and take any action thereon. Water Committee.
Voted, To hear the report which was read by Vernon W. Marr, a member of the Committee.
Voted, To accept the report of the Water Committee, which report was then filed with the Town Clerk.
ARTICLE 2
To see what sums the Town will raise and appropriate and the manner of raising the same for the purpose of taking by purchase or eminent domain, the franchise, corporate prop- erty, and all the rights and privileges of the Scituate Water Company under the provisions of the Acts of the Massachu- setts Legislature of 1893, Chapter 391 and amendments thereto and any enabling provisions of the Laws of Massachusetts, or act thereon. Selectmen.
Voted, That the Town do raise and appropriate the sum of $750,000, for the purpose of acquiring by purchase or taking by right of eminent domain the franchise, corporate property, and all the rights and privileges of the Scituate Water Co. as authorized by the provisions of Chapter 391 of the Acts of 1893 and amendments thereto, and to meet said appropriation the treasurer with the approval of the Selectmen be and here- by is authorized to borrow said sum, and to issue bonds or notes of the Town therefor, said bonds or notes to be issued under the authority of Section 8, Clause 3, Chapter 44, Gen- eral Laws and the bonds or notes issued shall be payable in accordance with the provisions of said Section 8, and of Section 19 of said Chapter 44, so the whole loan shall be paid in not more than thirty years from the date of issue of the first bond

or note, or at such earlier dates as the Treasurer and Select- men may determine.

ARTICLE 3
Will the Town accept the provisions of Chapter 424 of the Acts of 1931 and raise and appropriate under authority of said Act and in accordance therewith, and for the purpose therein set forth, namely, the Extension of certain Sea Walls and other Shore Protection in the Town of Scituate, the sum of $18,500, and determine the way and manner in which said sum shall be raised or act thereon? Selectmen.
Voted, That the Town do accept the provisions of Chap- ter 424 of the Acts of 1931, and raise and appropriate under authority of said Act, the sum of $18,500; and to meet said appropriation that there be raised in the tax levy of the cur- rent year the sum of $8,500; and the Treasurer with the ap- proval of the Selectmen be and hereby is authorized to borrow the sum of $10,000; and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Chapter 424 of the Acts of 1931, and Chapter 44, General Laws, so the whole loan shall be paid in not more than five years, or at such earlier dates as the Treasurer and Selectmen may determine.

ARTICLE 13
Will the Town authorize and instruct the Selectmen to make mutual conveyances with the Minot Village Associates of the premises herein referred to or take such other steps as may be necessary to enable the Town to prevent those of the public who are not residents of said town from parking their vehicles upon the real estate located north of Baileys Cause- way which real estate was conveyed to the said town by the Minot Village Associates by deed dated February 16, 1921, and recorded with Plymouth Registry of Deeds, Book 1402, pages 458-9 and by later confirmatory deed.
