southerly line of First Parish Road, then turning easterly at right angle and running one hundred seventy-five (175) feet, thence turning a right angle and running northerly to the southerly line of the oval driveway; thence turning to the left and following the westerly and northerly and westerly side of the driveway to the intersection with the southerly line to point of beginning.


Also Parcel B, as shown on said plan, containing the old Cudworth house; beginning on the easterly side of the main driveway entrance at First Parish Road and running with the curve of the oval driveway southerly and southeasterly to the point where the said oval intersects with the easterly drive- way, thence following the northerly line of said easterly drive- way to its point of intersection with First Parish Road, thence westerly with the southerly line of First Parish Road to point of beginning.


All the remaining portion of the Civic Centre Grounds is hereby designated as under the jurisdiction, care and custody of the School Committee.


Voted, That the Town raise and appropriate the sum of $1,825 for the care of the Civic Center, of which sum $1,525 shall be expended under the direction of the School Committee, and $300, under the direction of the Selectmen.

Park Commission :


Voted, That each member be paid 65 cents per hour for work actually performed; this in accordance with vote of the special meeting of June 11, 1930.

ARTICLE 61

ZONING BY-LAW PRESENTED BY THE COMMITTEE OF FIFTY


Section 1. The town of Scituate is hereby divided into zones known as Zones A and Zones B, each of which shall be subject to the regulations hereinafter set forth as to construction and use of buildings, structures and premises therein located.


Sect. 2. In an "A" zone no building, structure or premises shall be erected, altered or used for any purpose except one or more of the following :


(1) A single family or a two-family detached dwelling.


(2) A club house, except one whose chief use is for a ser- vice customarily carried on as a business.


(3) A church or school.


(4) A farm, garden, nursery or green house.


(5) Any accessory purpose customarily incidental to the foregoing purposes, including a private garage for not more than three automobiles.


(6) · A private garage for more than three automobiles to be used in connection with and as an incident to one of the foregoing purposes, provided as to each gar- age that after a public hearing by the board of select- men fourteen days' notice of which shall be published in a local paper and mailed to the last known address of each owner of property within five hundred feet of the proposed garage location, the Selectmen shall rule that such garage will not be detrimental or injurious to the neighborhood.


(7) A purpose forbidden in an "A" zone, provided the same shall be incidental to use as a residence.


Any building, structure or premises in an "a" zone which at the time of the adoption of this by-law is being used for a purpose not permitted hereunder, may be continued to the same extent in such use or in a use not substantially different there- from. Any building or structure in an "a" zone which at the time of the adoption of this by-law does not conform to the kinds of buildings or structures permitted hereunder may be main-

tained and may be structurally altered or enlarged to the extent of the entire contiguous premises owned on the date of the pas- sage of this by-law by the then owner of said building or struc- ture. Should any non-conforming building occupied by a non- conforming use be partially or wholly destroyed by a fire or other casualty it may be repaired or replaced by a building or structure substantially the same in character and used for the purpose for which it was formerly used or for a use not substan- tially different therefrom, provided such repair or replacement is commenced within one year from the date of such destruction and the work thereon prosecuted with reasonable dispatch.


Sect. 3. In a "B" zone there shall be no restriction as to the construction or use of the buildings, structures and premises therein located.


Sect. 4. Where a boundary line of an "A" zone divides a single lot at the time of the adoption of this by-law, if said lot does not extend more than twenty-five feet within said boundary line of an "A" zone it shall not apply to said lot, except that if said entire lot has no frontage on a street in a "B" Zone said entire lot shall be subject to the restrictions of an "A" zone.


Sect. 5. The following sections of portions of the town of Scituate are hereby respectively designated as "Zone A."


Description of portions of the Town of Scituate in which only approval as Residential, "Zone A" areas was expressed


at the Regional meetings held by the Committee,


there being no one opposed.


1. That portion of the town of Scituate known as North Scituate Beach and Farm Neck, described as follows:


Beginning at the ocean at the southerly boundary of land of Frank H. Torrey on Surfside Road, thence westerly in a straight line across Musquashcut pond to the Musquashcut brook, thence following the northerly side of the brook in a general westerly direction across Gannet Road and continu- ing along the northerly bank to the Gulph and as far as the boundary line between Scituate and Cohasset. Thence north- easterly with said boundary line to Bailey's Creek and follow-

ing the shore of said Creek northerly and westerly to Cohasset Harbor. Thence along the ocean line to and around the Glades, and in a general southeasterly direction with the ocean line to the first mentioned point.


2. That portion of the town of Scituate lying southerly of the first mentioned portion, and known as Egypt, Mann Hill and Scituate Center, bounded as follows :


Beginning in the most northerly part of said area at the ocean line at its junction with the southerly line of land of Frank H. Torrey, thence westerly across Musquashcut Pond to Musquishcut Brook, and continuing with the southerly side of said brook to a point 300 feet westerly of the center line of Hatherly Road, thence turning and running southerly in a straight line to the center of the crossing of Curtis Street and the tracks of the N. Y. N. H. & H R. R. Thence turning westerly and following said railroad to a point 300 feet westerly of the center line of Hollet Street. Thence in a line parallel to and 300 feet distant from said Hollet Street to its junction with Country Way. Thence in a straight line southerly to a point 300 feet southerly of the center line of First Parish Road. This last line passes 100 feet easterly of the house of Kap- lan. Thence turning and running easterly in a straight line to the property of the said Railroad at a point 1500 feet southerly of the center of the railroad crossing at First Par- ish Road. Thence following the said Railroad location north- erly to the center of the crossing at Beaver Dam Road. Thence westerly with the center of the Beaver Dam Road to a point 200 feet easterly of the insection of the center lines of First


Parish Road and Branch Street. Thence northerly in a straight line to a point 200 feet southeasterly of the inter- section of Tilden Road and Egypt Beach Road. Thence in a generally northerly direction parallel to and 200 feet easterly of the center of said Egypt Beach Road to the Ocean. Thence northwesterly with the ocean to point of beginning.


3. That portion of the town of Scituate known as Shore Acres, Hatherly Beach and Sandhills, bounded as follows :


Beginning at the ocean at a point 200 feet easterly of

Egypt Beach Road and following in a general southerly direc- tion in a line parallel to and 200 feet easterly of said Egypt Beach Road to a point in Tilden Road 200 feet southeasterly of the junction with said Tilden Road, thence running southerly in the easterly line of parcel No. 2 about 220 feet, and south- easterly in a line parallel with and 200 feet southwesterly of the center line of said Tilden Road to a point 200 feet south of its intersection with Turner Avenue. Thence running easterly and northeasterly in a line parallel with said Turner Avenue and 200 feet distant therefrom to a point 200 feet southwest- erly from the center line of said Hatherly Road. Thence run- ning southeasterly in a line parallel with Hatherly Road and 200 feet southwesterly therefrom to the Harbor. Thence fol- lowing the shore of the harbor northerly and easterly to the ocean, thence following the ocean line in a general northwest- erly direction to point of beginning.


That unplotted portion of the "Proving Grounds" lying on the northeasterly side of Hatherly Road between Sixth and Ninth Avenues, and that unplotted portion of said grounds lying on the southwesterly side of Hatherly Road between Second Avenue on the north and a line from Eleventh Avenue to the junction of Turner Avenue and Tilden Road on the South, lying within the above described portion, are not in- cluded in the residential district, but shall remain an unre- stricted area classed as Zone B.


4. That portion of the town of Scituate known as First Cliff, Second Cliff and Third Cliff, described as follows :


Beginning at the most northerly point of First Cliff, thence following the southerly shore line of the Harbor to a point easterly of the town Pier, thence in a general southerly direc- tion with the thread of the stream to the center of Edward Foster Bridge, thence following the westerly branch of the stream to its nearest approach to Kent St., thence in a straight line westerly to a point 200 feet easterly of the center line of said Kent Street, thence in a line generally southerly and paral- lel to said Kent Street and 200 feet easterly therefrom to its intersection with Driftway. Thence runinng S 20° W. eighteen

hundred feet, thence running in a general southeasterly direc- tion, passing 200 feet southerly of the extreme southerly line of Collier Road, to the ocean. Thence along the shore north- erly to the mouth of the harbor and point of beginning.


Nothing contained in items three and four shall be con- strued as affecting the Mossing industry.


All the above parcels or portions of land are shown on a plan filed herewith entitled "January 28, 1931, Zoning Map of the Town of Scituate, Plymouth County, Massachusetts, In- corporated 1636." Zoning Committee of Fifty.


Sect. 6. All the remaining portions of the town of Scitu- ate are hereby respectively designated as "Zone B."


Sect. 7. Whoever violates any provision of this by-law shall be punished by a fine of not more than twenty ($20.) dollars to be paid into the treasury of the town of Scituate.


Sect. 8. The invalidity of any section or provision of this by-law shall not invalidate any other section or provision hereof.


Sect. 9. This by-law may be repealed or modified at a town meeting after notice as provided by law and an oppor- tunity to objectors to be heard, by a two-thirds vote of said town meeting.


Sect. 10. So much of this by-law as is approved by the Attorney-General shall go into effect upon its publication as required by law.

Sect. 2. A. The following portions of the Town of Scitu- ate are hereby respectively designated as zone "A."


(1) That portion of the Town of Scituate lying northerly and northeasterly of a red line as shown on a plan entitled Zoning Map, North Scituate Beach Section of the Town of Scituate dated January 29, 1931 and filed with the Town Clerk, and which plan is made a part hereof.
