ARTICLE 6


To see if the Town will authorize the Town Treas- urer, with the approval of the Selectmen to borrow dur- ing the financial year beginning January 1, 1934 in an- ticipation of the collection of revenue of said year, such sums of money as may be necessary for the current ex- pense of the Town, but not exceeding the limit fixed by law, giving the note or notes of the Town therefor, pay- able within one year from the dates thereof, and to ienew such note or notes as may be given for a less pe- riod than one year, providing the limit of one year is not exceeded thereby. All debts incurred under this author- ity shall be paid from the revenue of the then current year.

ARTICLE 18


To see if the Town will adopt the following zoning by-law or act in any manner thereon.


ZONING BY-LAW


Section 1. The Town of Scituate is hereby divided into zones each of which shall be subject to the regula- tions hereinafter set forth as to the construction and use of buildings, structures and premises therein located.


Scc. 2. A. The following portions of the Town of Scituate are hereby respectively designated as zone "A".


(1) That portion of the Town of Scituate lying Fortherly and northeasterly of a red line as shown on a plan entitled Zoning Map. North Scituate Beach section of the Town of Scituate dated January 29, 1931. and filed with the Town Clerk, which plan is made a part hereof.


(2) That portion of the Town of Scituate lying within red lines on a plan entitled Zoning Map Egypt section of the Town of Scituate dated February, 1933.

and filed with the Town Clerk, which plan is made a part hereof.


B. The remaining portions of the Town of Scituate are hereby respectively designated as zone "B".


Sec. 3. In an "A" zone no building, structure or premises shall be erected, altered or used for any pur- pose except one or more of the following :


(1) A single family detached dwelling.


(2) A club house, except one whose chief use is for a service customarily carried on as a business.


(3) A church or school.


(4) A farm, garden, nursery, or green-house.


(5) Any accessory purpose customarily incidental to the foregoing purposes including a private garage for not more than three automobiles.


(6) A private garage for more than three automo- biles to be used in connection with and as an incident of one of the foregoing purposes, provided as to each such garage that after a public hearing by the Board of Select- men, fourteen days' notice of which shall be published in a local paper and mailed to the last known address of each owner of property within five hundred feet of the proposed garage location, the Selectmen shall rule that such garage will not be detrimental or injurious to the neighborhood.


(7) A purpose forbidden in an "A" zone, provided the same shall be incidental to use as a residence.


Sec. 4. Any building, structure or premises in an "A" zone which at the time of the adoption of this by- law is being used for a purpose not permitted hereunder, may be continued to the same extent in such use or in a

use not substantially different therefrom. Any building or structure in an "A" zone which at the time of the adop- tion of this by-law does not conform to the kinds of build- ings or structures permitted hereunder may be main- tained and may be structurally altered or enlarged to the extent of the entire contiguous premises owner on the date of the passage of this by-law by the then owner of said building or structure. Should any non-conform- ing building occupied by a non-conforming use be partial- ly or wholly destroyed by fire or other casualty it may be repaired or replaced by a building or structure sub- ctantially the same in character and used for the purpose for which it was formerly used or for a use not sub- stantially different therefrom, provided such repair or replacement is commenced within one year from the date of such destruction and work thereon prosecuted with reasonable dispatch.


Sec. 5. In a "B" zone there shall be no restriction as to the construction or use of the buildings, structures and premises therein located.


Sec. 6. Where a boundary line of an "A" zone divides a single lot at the time of the adoption of this by-law, if said lot does not extend more than twenty-five feet with- in said boundary line of an "A" zone, the regulations applicable to an "A" zone shall not apply to said lot, ex- cept that if said entire lot has no frontage on a street in 2. "B" zone said entire lot shall be subject to the regula- tions of an "A" zone.


Sec. 7. Whoever violates any provision of this by- law shall be punished by a fine of not more than Twenty Dollars ($20.) to be paid into the treasury of the Town of Scituate.


Sec. 8. The invalidity of any section or provision of this by-law shall not invalidate any other section or provision hereof.

Sec. 9. This by-law may be repealed or modified at a Town meeting after notice as provided by law and an opportunity to objectors to be heard, by a two-thirds vote of said Town Meeting.


Sec. 10. So much of this by-law as is approved by the Attorney General shall go into effect upon its pub- lication as required by law.

To see if the Town will vote to pay Scituate Post 144 Incorporated, Department of Massachusetts, American Legion, the sum of $2,960.32, to reimburse this Post for expenditures in the repair and improvement of the Po- lice Headquarters Building under the authorization of the Acts of 1932, Chapter 24. Scituate Post 144, Incor- porated, Department or Massachusetts, American Legion.


Voted, That due to the general economic conditions throughout our country at this time and with the view of reducing the financial burdens of Scituate tax-payers this year, a moratorium of one year be granted under this article, and that the refund appropriation of $2,960.32 due Scituate Post, No. 144, Inc., Department of Massachusetts, American Legion, be deferred until the next Annual Town Meeting.

ARTICLE 20


Will the Town authorize and instruct the Highway Surveyor to construct a sidewalk on the Easterly side of Curtis Street from the corner of Branch Street to or near the junction of Lawson and Capt. Pierce Roads, using plans approved by the Town Engineer. Cost of construc- tion to be taken from the appropriation for the Care of Roads or act thereon? Arthur R. Merrit et als.

ARTICLE 21


To hear the report of the Water Commissioners and take any action thereon. Water Commissioners.

ARTICLE 22


Will the Town adopt the recommendations of the Water Commissioners for the improvement and enlarge- ment of its plant, and raise and appropriate money there- for, or take any action thereon. Water Commissioners.

ARTICLE 23


Will the Town accept the report of the Selectmen as filed with the Town Clerk, laying out a Town Way from a point on Country Way near the intersection of Captain Pierce Road and running westerly to intersect Mann Lot Road, and appropriate a sufficient sum for the purpose, or take any action thereon? Water Commis- sioners.

ARTICLE 24


Will the Town authorize its Water Commissioners to purchase a parcel of land near Hatchet Rock, so-called, for the location of a standpipe, and appropriate $100, therefor, from funds of the Water Department? Water Commissioners.

ARTICLE 25


Will the Town recommend that in carrying out the said recommendations by the Commissioners all work so far as is practical be done by Town labor, and that in the employment of such labor preference be given to names on a list to be provided by the Board of Selectmen? Water Commissioners.

ARTICLE 26


To see if the Town will appropriate from funds in the treasury, the amount earned by or appropriated for the Water Department and a sum of money equal to but not exceeding the amount of the water revenue, to meet the payments for bonds, interest, operation and im- provement of the Water Department for the ensuing year, or take any action relative thereto. Water Commis- sioners.


Voted, That the balance of Water Department funds in the treasury amounting to $4,886.07 on January first, and an amount equal to the revenue for the ensu- ing year, be appropriated for the use of the Water De- partment, as follows:

ARTICLE 27


To see if the Town will vote to accept the provisions of General Laws, (Tercentenary Edition) Chapter 148. ection 56, relative to the licensing of open-air parking spaces or in any way act thereon. North Scituate Beach improvement and Egypt Civic Association.

ARTICLE 28


To see if the Town will raise and appropriate a sum of money for the further protection of its shores, the ame to be expended by the Department of Public Works, in conjunction with appropriations and contributions to be provided by the County of Plymouth, the Department of Public Works, and individuals especially benefited, if, and as provided in legislation now pending, and determine the way and manner any sum of money voted hereunder shall be raised, or take any action hereon. Voted, To accept the following resolution : Resolved that the Town of Scituate in meeting here assembled en- dorse the legislation now pending which provides for the repair and further construction of shore protective struc- ture in said Town.

ARTICLE 29


To see if the Town will assume liability in the man- ner provided by Section 29 of Chapter 91 of the General Laws, for all damages that may be incurred by the repair . or extension of certain sea walls or other Shore Protection in the Town of Scituate under the provisions of legisla- tion now pending, which legislation provides for further protection of Fore Shores in the Town of Scituate, and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth, or act there- on. ARTICLE 30


Will the Town raise and appropriate the sum of $100 to construct a curb around the Southwest corner of the intersection of Ocean Avenue and Grasshopper Lane in order that it may conform to the other three corners and protect the traveling public. George Vollmer et als.

Will the Town vote to acquire by Right of Eminent Domain or otherwise, or act thereon, the land and water adjoining the Town Wharf Property, on the southerly side from channel, westerly on the Town property line to Front Street, then southerly on Front Street to within six or seven feet of the Edward H. Bonney Barn now known as the Severance Block, then easterly on a parallel line with the Town Wharf property to the channel? To become an addition to the Town Wharf property, and to be used in a similar manner by the Town for landing and anchorage purposes.
