To see if the Town will raise and appropriate the sum of $500.00 to provide a Life Guard for Sand Hills Beach, or act thereon.

ARTICLE 34
Will the Town vote to adopt the following Building By-Laws under authority of Section 3 of Chapter 143 of the General Laws:
By-Laws Regulating the Erection, Alteration and Repair of Buildings in the Town of Scituate.
ARTICLE I General Provisions
Except as hereinafter provided, no person shall erect, alter or repair any building except in conformity with the provisons of these By-Laws, or without having first obtained a permit for the same from the building commissioner. Plans and specifications shall be submitted to the building commissioner together with such structural detail as he may require.

These By-Laws shall be deemed to present minimum require- ments for residential construction. In the case of apartment build- ings. stores, places of assembly and industrial buildings the build- ing commissioner may make such requirements in addition to these regulations as may be deemed necessary to the public safety.
ARTICLE II Exemptions
a. All repairs to buildings which do not include the removal or replacement of any wall, column or post which would tend to weaken the structure.
b. Farm buildings and other non-residential buildings permit- ted under the zoning by-laws in residential areas.
c. Buildings owned or occupied by the United States or the Commonwealth of Massachusetts.
d. Bridges, quays, wharfs.
ARTICLE III General Requirements
Section 1.
It is not the intent of this By-Law to prohibit new or uncon- ventional methods of construction which are not detrimental to the public safety.
Section 2. Foundations
Buildings having finished interior walls shall rest on solid foundations. Concrete foundations to be not less than eight inches thick. Stone foundations laid in mortar to be not less than twenty inches thick. Posts or piers supporting buildings shall be of con- crete. or masonry, and not more than eight feet apart. Lally col- umns may be used for interior supports. Space between sills and ground to be enclosed. Foundations to extend at least three and one-half feet below grade unless they rest on ledge.
Scetion 3. Chimneys
No title or metal chimneys shall be allowed. All masonry chimneys shall rest on a concrete footing six inches thick, and except those with solid brick walls eight inches or more thick shall be hued throughout with vitreous flue lining, and shall be topped at least three feet above the highest point of contact with the roof. No chimney shall be supported on wood. No floor timbers o. subflooring shall be closer than 2 inches and no stud- ding or rafters or other wood closer than 1 inch to any chimney. Space between chimneys and floor joists to be firestopped with metal of wire lath and cement plaster. Every smoke pipe hole into a chimney shall be provided with a metal thimble. No wood

work shall be within six inches of any smoke pipe. Masonry walls at the back and sides of every fireplace shall be at least eight inches thick if of brick and twelve inches thick if of stone. If of stone they shall be lined with at least four inches of brick. All fireplaces shall have dampers. Hearths shall be at least twenty inches wide in front of fireplace openings, and at least eight inches wider than the fireplace opening. Wood centers under fireplace and hearth arches shall be removed before finishing thereunder.
Section 4. Framing
All lumber sizes given herein are nominal dimension.
House sills shall not be less than 4 x 6 inches except on plat- form frames. On these a horizontal member not less than 2 x 6 may be used. This member shall be thoroughly spiked to a vertical member the same depth as the floor timbers. Girts shall be not less than 6 x 8 inches and shall be joined only over a support. Floor joists shall be not less than 2 x 6 up to eight foot span, 2 x 8 up to fourteen foot span, or material of equal strength. Where these maximum spans are used joists shall be set not more than 16 inches on centers. Spans of more than eight feet shall be bridged once. of more than twelve feet twice. Joists under partitions running parallel to them shall be doubled. All house floors shall be double boarded. All walls and partitions going through floors shall be firestopped with masonry or with wood not less than 2 inches thick nominal dimension. Studding on outside walls and bearing parti- tions shall be not less than 2 x 4, not over 16 inches on centers. Studding in non-bearing partitions shall rest on a shoe not less than 2 inches thick. Corner posts shall be not less than 4 x 6 and may be built up. All corners shall be braced with diagonal braces ex- tending out at least two bays of studding. All exterior walls and roofs shall be sheathed. Rafters, except porch rafters, shall be not less than 2 x 6 inches placed no more than 24 inches on centers. Balloon frame shall not be used on walls more than fourteen feet high, measured from the sill. Balloon frame shall have ledger boards not less than 1 x 6 inches set into the studs, and shall be thoroughly firestopped at each floor level. Section 5. Area Regulation
Minimum residential lot size shall be 10,000 feet in area with a minimum of 100 feet frontage.
Section 6. Setback
Setback shall be 30 feet from the street line where no building line is already established. No building shall be erected nearer than 10 feet to the side or rear lot lines.

Section 7. Electric Wiring
All electrie installations shall be in accordance with the Na- tional Electrical Code and amendments thereto, and no installation of electrical equipment shall be made except in conformity thereto.
ARTICLE IV Building Commissioner
The Board of Selectmen shall appoint a Building Commis- sioner to serve for a term of one year, and shall fix his compensa- tion. The Building Commissioner shall be charged with the en- forcement of these By-Laws. He shall issue permits, collect the fees for them, and inspect all building operations within the town. He shall have the right of entry at reasonable hours. In case of vio- lation of these By-Laws he shall order, in writng, the suspension of the work.
ARTICLE V Board of Appeals
A Board of Appeals consisting of three voters of the town who shall serve without pay, shall be appointed by the selectmen. One of these shall be an architect, construction engineer or master builder of ten years or more experience in building construction. No member shall act in any case in which he has a personal or financial interest, an alternate in such case to be chosen by the other members of the board. Any person aggrieved by a decision of the building commissioner may appeal to the Board, who shall grant a hearing to the aggrieved and shall render a decision within seven days from the date of the appeal. Decisions shall require the assent of two members. The Board of Appeals may, in cases where mani- fest injustice is done or in cases which appear to them not to have been contemplated by the By-Laws, suspend or vary them. The de- cision shall specify the variations allowed.
The Board of Appeals may make special exception to the pro- visions of this section by authorizing, upon appeal, the granting of permits for the erection or placing of dwelling houses on lots of land contaning less area than is hereby prescribed or, upon written request of the owner of a parcel of land, by authorizing the Build- ing Inspector to grant permits from time to time for the erection or placing of dwelling houses upon subdivisions or any or all of the lots thereof, although containing less area than is hereby pre- scribed. subject to such limitations of time and other conditions as it may impose, wherever, after a public hearing, it shall find that :
(a) Adjoining areas have been previously developed by the construction of houses on lots generally smaller than is prescribed by this section and the standard of the neighborhood so established does not reasonably require a subdivision of the applicants' land into lots as large as is hereby prescribed.

ARTICLE VI Fees
For each building permit issued there shall be paid to the Building Commissioner, for the use of the Town, a fee according to the following schedule:
1. For dwellings of six rooms or less $3.00
2. For dwellings of more than six rooms $5.00
3. Alterations to dwellings $1.00
4. Private Garages $1.00
5. Other building projects $1.00 per $1,000.00 or fraction thereof of the estimated cost of the project.
ARTICLE VII Penalties
Whoever violates any of the provisions of this by-law shall pay a fine not exceeding $50.00.
VOTED: To adopt with amendment as follows: "Providing that the invalidity of any section or provision shall not affect the validity of the remaining sections or provisions of these by-laws." ARTICLE 35
Will the Town raise and appropriate a sum of money for the remuneration and expense of a building commissioner to be ap- pointed under the Building By-Laws adopted at this meeting, or take any action relative thereto.

ARTICLE 36
To see if the Town will vote to accept Chapter 723 of the Acts of the Legislature (1945) and establish and maintain a department for the purpose of furnishing information, advice and assistance to veterans, and authorize and instruct the Selectmen to appoint a Director of Veterans' Services and raise and appropriate a sum of money for the salary and expenses of said director and department.
VOTED: To raise and appropriate $1,200.00, and to accept Chapter 723 of the Acts of the Legislature (1945). Unanimously voted to give a rising vote of thanks to Mrs. Mary W. Murrill for her untiring efforts in behalf of the service men and women.

ARTICLE 37
Will the Town vote to authorize and instruct the Selectmen to sell to E. Wilson Blake a triangular strip of land in the rear of his premises on Jericho Road for the sum of one dollar and to purchase from said Blake for said sum of one dollar the triangular parcel on the easterly side of said Blake's premises bordering on said Jericho Road at its intersection with Turner Road, said parcel to be a part of the Town's parking space on Turner Road, all as shown on plan dated January 1, 1946 on file at the office of the Town Engineer and Town Clerk, or take any action relative thereto.
VOTED: To so authorize the Selectmen. Unanimous. Raised and appropriated $1.00.
ARTICLE 38
To see what sum of money the Town will raise and appropriate for shore protection, the Board of Selectmen being authorized to arrange for the expenditure of part or all of said sum in conjunc- tion with any sums already appropriated or to be appropriated by the County of Plymouth and Commonwealth, or either of them, and the Selectmen being empowered to give a bond with sureties as required under General Laws, Ch. 91, Sec. 29, or take any action relative thereto.
VOTED: That the Town appropriate $45,000.00 for seawalls and other shore protection in conjunction with any sums already appropriated or to be appropriated by the County of Plymouth and Commonwealth, or either of them; the Selectmen being em- powered to give bond with sureties as required by law: the sum of $: 0,000.00 of said total appropriation by the Town to be raised by taxation in the levy for the current year, and the balance of $25,000.00 to be borrowed by the Town and repaid in four equal annual payments beginning in the year 1947 and ending in the ycar 1950. ARTICLE 39
To see what sum the Town will raise and appropriate to erect a suitable Memorial Hall to commemorate the services and sacri- fices of persons who served in the military or naval service, all as provided in section 5 (clause 12) of Chapter 40 of the General Laws and to provide land for said purposes, or take any action relative thereto.
VOTED: To accept the following resolution: "Be it resolved that the voters of the Town of Scituate assembled in Town Meeting do recognize the sacrifices and services of all persons who served in the military or naval service of their country, and to dignify

this recognition it is honorable and just that the voters herein as- sembled unanimously vote to pledge the sum of $50,000.00 of the proceeds of securities held by the Town Treasurer in the Post War Rehabilitation Fund for the construction of a memorial building as outlined in Article 39 of Town Warrant.
"Be it further resolved that the plan submitted by the Memo- rial Building Committee be reproduced to a size not less than 8 x 12 inches and a description outline, together with other information regarding the site on which the building is to be constructed, be mailed to each and every veteran whether in active or incative service. A copy of Article 39 and a copy of this resolution be mailed to each veteran with a request that he or she make known to the Memorial Committee their decision, or likes or dislikes of the plan outlined in Article 39.

ARTICLE 53
To see if the Town will raise and appropriate a sum of money to replace the present police automobiles and authorize the Select- men in co-operation with the Chief of Police to sell the present police automobiles or use the same for a trade-in value on the pur- chase of new automobiles for the Police Department, or act thereon.

ARTICLE 54
To see if the Town will vote to authorize the Selectmen to give an easement to the Massachusetts Department of Public Works granting permission for this Department to construct, maintain and repair a drainage pipe on the Town owned land in proximity to the junction of Cornet Stetson Road and the State Highway, Route 3A, Greenbush, or act thereon.

ARTICLE 55
To see if the Town will vote to raise and appropriate, or pro- vide by borrowing, a sum of money for the purpose of purchasing the following equipment for the Fire Department: two pumping engines, Chief's car and an emergency truck and necessary equip- ment, and authorize the Selectmen, in co-operation with the Chief of the Fire Department, to sell the present Chief's automobile, a White Pumping Engine, Model 1545 and also a G.M.C. Hose Wagon, or use the same for a trade-in value on the purchase of new equipment for the Fire Department.
VOTED: That the sum of $22,800.00 be raised and appro- priated for the purchase of the following equipment: Two pump- ing engines, one Chief's automobile and one emergency truck and equipment, and to meet said appropriation there be raised in the tax levy of the current year the sum of $3,800.00, and the Treasurer with the approval of the Selectmen be, and hereby is, authorized to borrow the sum of $19,000.00 and to issue bonds or notes of the Town therefor, payable in not more than five years from the date

of issuing the first bond or note, or at such carlier time as the Select- men and Treasurer may determine, and authorize the Selectmen in co-operation with the Chief of the Fire Department to sell the present Chief's automobile, a White pumping engine, Model 1545, and also a G.M.C. hose wagon, or use same for a trade-in value on the purchase of new equipment for the Fire Department. ARTICLE 56
Will the Town vote to authorize and instruct the Selectmen to purchase or take by eminent domain and raise and appropriate a sum of money therefor the land between Jericho Road and Scituate Harbor bounded southerly by land now or formerly of Dwyer, northerly by the Scituate Yacht Club and easterly by mean low water, said premises comprising lands now or formerly of Young, Satuit Boat Club, Inc., and McGonigle, as shown on plans on file at the office of the Town Engineer and the Town Clerk, entitled "Plan of part of Jericho Beach proposed to be taken by eminent domain or purchased by the Town of Scituate, Scituate, Mass.," dated January 24, 1946 and drawn on a scale of 40 feet to an inch by John E.
