SELECTMEN'S REPORT


REPORT OF THE BOARD OF SELECTMEN


To the Citizens of Scituate:


We are pleased to report that once again our Town is in a sound financial condition and this is clearly evidenced by the fact that we were able to borrow money at 13/4% for the construction of our new Grade School, having been given an AAl credit rating by the leading credit houses in the municipal field of finance.


The possible loss of train service to our Town through the abandonment of the Old Colony Railroad has caused great con- cern, not only to our commuters but to all the people. We have reason to believe that the Special Recess Commission, appointed by the Governor to investigate this problem will find an equitable solution and consider ourselves fortunate in having our own Rep- resentative, Mr. Tilden, serving on that Commission.


The Selectmen held a conference with Mr. Gerry, of the State Reclamation Board, and at that time protested the mosquito con- trol nuisance. Mr. Gerry has promised that we can expect better results in the future from the $4,000 the Town raises for this pur- pose. We also had Mr. Gerry make a survey regarding Greenhead flys and gnat pest nuisance and as a result of such survey have created a special article in the Warrant which we strongly rec- ommend.


Your Board was fortunate in securing the services of the newly appointed State Biologist, Director of Marine Fisheries re our clam flats and we respectfully refer you to the report of our new Clam Warden for further details.

REPORT OF THE TOWN CLERK


ANNUAL TOWN MEETING


March 1, 1948


At a legal meeting of the inhabitants of the Town of Scituate, qualified to vote in Elections and Town Affairs, held at the High School Auditorium in said Scituate on Monday, the 1st day of March, 1948, at 7 o'clock P.M .; order was called by Nathaniel Tilden, Moderator.


The warrant was read by Town Clerk William M. Wade.


Tellers appointed by the Moderator and sworn by the Town Clerk were: John G. Vollmer, Edmund J. Corrigan, Fred S. Gilley, Edward P. Breen, John T. Barry.


ARTICLE 1


To choose all the necessary Town Officers other than those elected by ballot, viz: Surveyor of Lumber, Measurer of Wood and Bark, two or more Field Drivers, one Pound Keeper.


VOTED: Surveyor of Lumber and Measurer of Wood and Bark: Russell L. Fish.


Field Drivers: Ernest M. Damon, Lawson C. Vickery.


Pound Keeper: Augustus L. Abbott.


ARTICLE 2


To hear the report of the Selectmen or other Town Officers and Standing Committees, and act thereon.


VOTED: To accept reports of Town Officers and Standing Committees as printed in Town Report, excepting the committee appointed by the Town in Annual Town Meeting of March 3, 1947 to study salaries of Town Officials and Employees. Unanimous vote.


RESOLUTION


Be it resolved that a Committee of Mr. Roy E. Litchfield, Dr. Willis B. Parsons, and three World War II Veterans, to be ap- pointed by the Moderator, be authorized to disburse the balance of the Scituate Citizens U. S. War Service Fund now on deposit at the Rockland Trust Company. Unanimous vote.

ARTICLE 3


Will the Town vote to establish salaries and compensation of all elected Town Officers, or act thereon.


VOTED: That the Town establish the salaries and pay of all Town Employees as recommended by the Committee excepting those salaries already voted upon, and that we extend to the com- mittee a vote of thanks. Unanimous vote.


Selectmen: Chairman, $3,000.00 and legitimate expenses. Other members $700.00 each and legitimate expenses.


Board of Public Welfare: Chairman $600.00 and legitimate expenses. Other members $200.00 each and legitimate expenses. This sum shall include their charges for all services performed by them or either of them.


Assessors: Chairman $2,500.00 and legitimate expenses. Other members $750.00 each and legitimate expenses.


Highway Surveyor: $3,600.00.


Town Collector: $2,800.00 and legitimate expenses. All de- mand fees to accrue to the Town.


Town Treasurer: $2,520.00 and legitimate expenses.


Tree Warden: $400.00.


Town Clerk: $1,500.00 and legitimate expenses.


Board of Health: Divided as follows: Secretary $700.00 and legitimate expenses. Other two members $400.00 each and legiti- mate expenses. This sum shall include their charges for all services performed by them or either of them, other than the inspection of meat, plumbing or cattle.


Park Commissioners: Each member shall be paid the amount per hour for work actually performed as is paid laborers in the Highway Department.


Water Commissioners: Chairman $350.00 and legitimate ex- penses. Other members $300.00 each and legitimate expenses.


Moderator: $110.00 per annum.

To hear the report of any committee heretoforc chosen, or act thereon.


Kilby P. Smith reported for the Railroad Committee and it was unanimously voted to give him a rising vote of thanks for his untiring efforts in behalf of the citizens of Scituate.


ARTICLE 6


To see if the Town will authorize the Board of Public Welfare to contract at their discretion for support of the Town's poor, or act thereon.


VOTED: To so authorize.


ARTICLE 7


To see if the Town will authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year, beginning January 1, 1949 and to issue a note or notes therefor, payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


VOTED: To authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipa- tion of the revenue of the financial year beginning January 1, 1949 and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws. Will the Town vote to raise and appropriate the sum of $10,000.00 to the Reserve Fund or transfer the whole or any part thereof from any available funds, or act thereon?

To see if the Town will vote to transfer the proceeds of the Dog Fund received from the County to Libraries and that the amount be equally divided between the Peirce Memorial at North Scituate and the Allen Memorial at Scituate, or act thereon.

ARTICLE 17


To see if the Town will raise and appropriate the sum of $700.00 for the care of soldiers' neglected graves in accordance with the provisions of the General Laws, Chapter 115 (Ter. Ed.) or act thereon.

ARTICLE 19


To see if the Town will raise and appropriate $100.00 for County Aid to Agriculture, and choose a Town Director as pro- vided in Sections 41 and 45 of Revised Chapter 128 of the General Laws, or act thereon.

To see if the Town will raise and appropriate the sum of $4,000.00 to be used in conjunction with such sums of money as may be allotted by the Department of Public Works of the Com- monwealth of Massachusetts and County of Plymouth, or either one of them, for the continuation of new construction on Gannett Road and First Parish Road under Chapter 90, or act thereon.

To see if the Town will assume liability in the manner pro- vided by Sec. 29 of Ch. 91 of the General Laws for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, develop- ment, maintenance and protection of rivers, harbors, tidewaters and foreshores, in accordance with Sec. 11 of Ch. 91 of the Gen- eral Laws, and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth.

Will the Town raise and appropriate $2,000.00 to cover the incidental costs pertaining to advertising, printing, etc. connected with the bidding on the proposed new Elementary School?

Will the Town vote to authorize the Selectmen to request of the State Legislature an act permitting the Town of Scituate to borrow $700,000.00 over and above its debt limit for school building purposes ?

ARTICLE 27


Will the Town raise and appropriate the sum of $579.50 to buy a resuscitator, complete with attachments, to be placed in the Fire Station at Humarock for the benefit of the Humarock citizens, or act thereon?

ARTICLE 28


Will the Town raise and appropriate the sum of twenty-four hundred dollars ($2400.00) for the purchase of 1,000 feet of 21/2" hose and 2,000 feet of 1" hose?

It shall be the duty of the Town Building Commissioner to enforce the Town's Zoning By-Laws, and he may insti- tute appropriate civil or criminal proceedings or both in the fulfillment of said duty.


This section shall not preclude an action being brought by the Selectmen or any other Board or official, or resi- dent, taxpayer or other interested person or persons ag- grieved by a violation of said By-Laws; provided, however, that anyone acting as aforesaid shall first notify the alleged violator in writing of his objection to the act or use being or proposed to be made of the premises in question, and then if he deems it necessary or expedient, he may apply to the Zoning Board of Appeals for a hearing.


The said Zoning Board may then treat the case as one in which an application for a variance has been sought and may proceed to determine whether there is or has been or may be a violation of the terms of the Town's Zoning By-Laws as alleged.


Said Zoning Board shall then make a decision upon the facts and may in its sound discretion grant relief in the nature of a variance upon such terms as meet and proper.


VOTED: That the Town's Zoning By-Laws shall be and are hereby amended by the addition of the following section entitled: Section 11-ENFORCEMENT. It shall be the duty of the Town Building Commissioner to enforce the Town's Zoning By-Laws, and he may institute appropriate civil or criminal proceedings or both in the fulfillment of said duty.

ARTICLE 34


To see if the Town will vote to raise and appropriate a sum of money for the construction of a standpipe, on land known as the Town Forest, and to lay a main of not less than 16 inches in diameter from the standpipe to and connecting with the mains in the Scituate Water System; determine whether the money shall be provided by the issuance of a loan for a term not exceeding twenty (20) years, by taxation, or by the transfer from available funds in the treasury, or act thereon.
