On motion by Eugene J. Sullivan:


Voted: To authorize the Municipal Light Board to pur- chase and install lighting equipment on the playground at the intersection of Church Street and North Avenue for the purpose of illuminating the playground, and to use a sum not exceeding $750.00 from its construction account therefor.


ARTICLE 3


To see if the Town will vote to appropriate the sum of $124.71, the same to be transferred from a fund created under Article 6 of the warrant for the Town Meeting of April 29th, 1937, to foreclose certain tax titles, to a fund to be used for the purpose of repairing property acquired by the Town through foreclosure of tax titles, the same to be spent under the jurisdiction of the Select- men .- Board of Selectmen.


On motion by Finance Committee:


Voted: That the Town appropriate the sum of $124.71 for the purpose of repairing property acquired by the town through foreclosure of tax titles, this sum to be transferred from the balance of the appropriation under Article 6 of the warrant for the town meeting of April 29th, 1937 for foreclosure of tax titles; to be expended under the jurisdiction of the Board of Selectmen.


ARTICLE 4


To hear and act upon the report of the Committee appointed by the Moderator under Article 21 of the war. rant for the Town Meeting held March 18, 1940, to in- vestigate and report on the advisability of building an addition to the High School which will provide full accommodation for all pupils, including a seat for each one .- Special Investigating Committee, Christopher B. Dinan, Secretary.


The report of the committee of seven, appointed by the Moderator under Article 21 of the warrant for the Annual Town Meeting, at the adjourned session on March 18, was read by Christopher B. Dinan, the secretary of the committee. The report, somewhat lengthy, re- commended favorable action under Article 5, for excavat- ing; Articles 6 and 9, for alterations; and further con- sideration of design of stairs under Article 7; and repairing of seats instead of the purchase of new ones under Article 8.

ARTICLE 5


To see if the Town will authorize the School Committee. under a W. P. A. project, to excavate under the present High School building and make other alterations in the basement of said building, and raise and appropriate a sufficient sum of money to carry out the purposes of this article .- School Committee.


Motion by Harry Marshall for the Finance Committee:


That the Town raise and appropriate the sum of $10,617.00 to carry out the purposes of Article 5, of which amount a sum not exceeding $2,040.00 shall be expended by the School Committee for supervision and private contract for shoring and underpinning.


Amendment by Patrick H. Tenney:


That the Town raise and appropriate the sum of $10,617, to carry out the purposes of this Article and authorize the proper town officials to make necessary contracts to carry out the purposes of this Article.


Admendment accepted by Mr. Marshall.


Motion by William G. Dill:


That Articles 5, 6, 7, 8, 9 be indefinitely postponed.


The Moderator ruled the motion out of order.


Motion by Mr. Dill:


That Article 5 be indefinitely postponed.


After a lengthy discussion, the Moderator called for a vote, and appointed the following tellers to act: Orrin Hale and William R. Lindsay on the south, Charles C. Cox and Sydney Watts in the centre, and Theodore Eaton and John T. Stringer on the north section.


Result of the vote:


There were 86 votes in the affirmative, and 119 votes in the negative, and the moderator declared the motion not carried.


The original motion by the Finance Committee, as amended by Mr. Tenney, was then voted in the affirmative.


ARTICLE 6


To see if the Town will authorize the School Committee to erect certain partitions, and make other alterations on the second floor of the High School building to convert

two locker rooms into two classrooms and to equip these two classrooms, and raise and appropriate a sufficient sum of money to carry out the purposes of this Article .- School Committee.


On motion by Finance Committee:


Voted: That the Town raise and appropriate the sum of $2,013.00 to carry out the purposes of Article 6.


ARTICLE 7


To see if the Town will authorize the School Committee to install two stairways at the High School, running from the first floor to the second floor, and make such altera- tions necessary for the installation of these stairways, and raise and appropriate a sufficient sum of money to carry out the purposes of this article .- School Committee.


On motion by Finance Committee:


Voted: That the Town raise and appropriate the sum of $5,000 to carry out the purposes of Article 7.


An amendment by Mr. Round that $2,000 be added to the appropriation for a staircase was withdrawn.


ARTICLE 8


To see if the Town will authorize the School Committee to replace the present seats in the Wakefield High School auditorium by purchasing new seats and installing same, and disposing of seats now in said auditorium, and raise and appropriate a sum of money sufficient to carry out the purposes of this Article .- School Committee.


On motion by Finance Committee:


Voted: That the subject matter of this Article be in- definitely postponed.


ARTICLE 9


To see if the Town will authorize the School Committee to remove certain partitions, and make other alterations on the first floor of the High School building to provide additional classroom space, and raise and appropriate a sufficient sum of money to carry out the purposes of this Article .- Special Investigating Committee, Christopher B. Dinan, Secretary.


Motion by Finance Committee:


That the Town raise and appropriate the sum of $200 to carry out the purposes of Article 9.


Amendment by James Henderson:


To strike out the words two hundred and insert two thousand in the place thereof.

The population of Wakefield, County of Middlesex, State of Massachusetts, as shown by a preliminary count of the returns of the Sixteenth Census, taken as of April 1, 1940, is 16,179, as compared with 16,318 on April 1, 1930. SPECIAL TOWN MEETING - JULY 22, 1940


Meeting called to order at 7:40 P. M. by Moderator Thomas G. O'Connell, who announced that all non-voters should retire to the balcony.


The Moderator read the case for the meeting.


On motion by Patrick H. Tenney:


Voted: That reading of the balance of warrant be dispensed with, with the exception of the constable's return.


Constable's return read.


ARTICLE 1


To see if the Town will vote to approve the appointment of two police officers to the permanent police force of the Town, and provide the necessary funds to pay said officers by voting to transfer the sum of $1,600 from the balance of the fund appropriated under Article 6 of the Annual Town Meeting .- Board of Selectmen.


Motion by Harry Marshall, for the Finance Committee:


That the subject matter of Article 1 be referred to a committee of seven to be appointed by the Moderator to report at the next Annual Town Meeting, providing further that a copy of the said report shall be filed with the Town Clerk, for public inspection, on or before February 15, 1941.


After considerable debate, participated in by Messrs. Marshall, Taylor, Dill, Gardner, Hale, Heywood, Gates, Piazza, Fazio, Lindsay, and Woodhull, the motion was put by the Moderator, and the vote was in the negative.


Motion by Harry Marshall:


That the sum of $800.00 be transferred to the Police appropriation "all other" account from the balance of the fund appropriated under Article 6 of the warrant for the Annual Town Meeting, to be used for the em- ployment of substitute police officers.


Amendment by William G. Dill:


That the motion be amended by offering the following substitute motion: That the Town vote to approve the appointment of two police officers to the permanent police force of the Town and appropriate the sum of $1600 therefor, and provide the necessary funds by trans- ferring to the police department budget, "salaries of regular patrolmen," the sum of $1600 from the unex- pended balance of the funds appropriated under Article 6 of the warrant for the 1940 Annual Town Meeting.


Amendment by Leonard De Marco:


That the Town appropriate $800, by transferring from the balance of the fund appropriated under Article 6 of

the Annual Town Meeting, for the appointment of one additional patrolman to the Police Department.


The vote on the De Marco amendment was in the negative.


The vote on the Dill amendment was in the affirmative.


The Moderator then called for a vote on the original motion by Mr. Marshall, as amended by Mr. Dill, and the vote was in the affirmative.


ARTICLE 2


To see if the Town will authorize the School Com- mittee to replace the present seats in the Wakefield High School Auditorium by purchasing new seats and installing the same and disposing of seats now in said auditorium and transfer sufficient sums of money from money previously appropriated under Articles 5, 6, 7, 9, of the special town meeting dated April 22, 1940, to pay for said installation .- School Committee.


On motion by Finance Committee :


Voted: That the Town appropriate the sum of $4,500 to carry out the purposes of Article 2 and authorize the School Committee to replace the present seats in the High School Auditorium and dispose of the old ones. The above appropriation to be taken from available balances of appropriations made under Articles 5, 6, 7 and 9 of the special Town Meeting of April 22, 1940, as follows:

ARTICLES 3 AND 4


Article 3. To hear and act upon a report of the Select- men laying out Lotus Avenue as a public way under the Betterment Act and raise and appropriate a sufficient sum of money for the purposes of this article .- Board of Selectmen.


Article 4. To hear and act upon a report of the Select- men laying out Clifton Avenue as a public way under the Betterment Act and raise and appropriate a sufficient sum of money for the purposes of this article .- Board of Selectmen.


The Selectmen's report on Lotus Avenue and Clifton Avenue were read by the Moderator.


Motion by Finance Committee:

That the subject matter of Articles 3 and 4 be indef- initely postponed.


The vote on this motion was in the negative.


Pending preparation by the Selectmen of a written motion, Theodore Eaton moved that Articles 3 and 4 be laid on the table, and the meeting so voted.


ARTICLE 5


To see if the Town will vote to authorize the Board of Selectmen to sell and transfer the present Town am- bulance for a nominal consideration to Stanley W. Heath, and authorize them to accept in place thereof, as a gift, from Mrs. Sarah E. Heath and Mr. and Mrs. Stanley W. Heath, a new ambulance for the use of the Town .- Board of Selectmen.


On motion by the Finance Committee:


Voted: That the Town authorize the Board of Select- men to sell the present Town ambulance for the sum of $1.00 to Stanley W. Heath and to further authorize the said board to accept in place thereof, with the ap- preciation of the Town, and as a gift, a new ambulance from Mrs. Sarah E. Heath and Mr. and Mrs. Stanley W. Heath.


ARTICLE 6


To see if the Town will vote to accept the bequest made to it by Sarah E. Bryant, deceased, late of Wakefield, by clause four of said will upon the terms therein set forth -said clause four being as follows: "Upon the death of said Mary E. Nichols the trustee holding said fund of four thousand dollars provided for in clause three thereof, shall pay two thousand dollars thereof to the Town of Wakefield to be by it, held in trust and invested and the income thereof shall be used for the purpose of acquiring additions to the Park System of said town or in providing additional facilities for the better enjoyment by the public of the present system but not for ordinary main- tenance, and care, and if said town shall so vote, said two thousand dollars may be used in acquiring either alone or with other funds, permanent additions or facilities to or for said Park System."-Town Treasurer.


On motion by the Finance Committee:


Voted: That the Town accept with appreciation the bequest made under the will of Sarah E. Bryant, late of Wakefield, the terms as set forth in clause four of said will being as follows:


"Upon the death of said Mary E. Nichols, the trustee holding said fund of four thousand dollars, provided for in clause three hereof, shall pay two thousand dollars

Voted: That the Town vote to accept and adopt the report of the Selectmen laying out Lotus Avenue and Clifton Avenue, the work to be done under a WPA project.


ARTICLE 7


To see if the Town will amend its Zoning By-laws by changing from a Business District to a General Residence District a strip of land 150 feet wide on the westerly side of Main Street running from Cooper Street to Han- son Street and a strip of land 150 feet wide on the east- erly side of Main Street, running from Greenwood Ave- nue to Grafton Street .- William G. Dill and others.


Edward Lee reported for the Planning Board that a public hearing was held on the question of amending the Zoning By-laws, as provided in Article 7, and that, after the hearing, a meeting of the Planning Board was held and the Board voted to approve the proposed amendment.


On motion by Mr. Lee:


Voted Unanimously: That the Zoning By-laws be amended by changing from a Business District to a General Residence District a strip of land 150 feet wide on the westerly side of Main Street, running from Cooper Street to Hanson Street, and a strip of land 150 feet wide on the easterly side of Main Street, running from Green- wood Avenue to Grafton Street.


On motion by Frank Wakefield:


Voted: That this meeting be now dissolved.
