ARTICLE 69


To see what sum the Town will vote to return to the town treasury from the balance in the Operating Fund of the Municipal Light Department as of December 31, 1961, and authorize the Assessors to use said sum in computing the tax rate for 1962, and also to see what sum the Town will authorize the Municipal Light Department to transfer from the balance in its Operating Fund as of December 31, 1961, to the Construction Fund of the Municipal Light Department.


-Municipal Light Department.


On motion by Finance Committee:


Voted: That the sum of $90,000, being part of the balance of the Operating Fund of the Municipal Light Department as of December 31, 1961, be returned to the Town Treasury and the Assessors be hereby author- ized to use the same in computing the tax rate for 1962, and authorize the Municipal Light Department to transfer from its Operating Fund $86,- 564.82 to its Construction Fund, the latter sum being the remainder of the balance in its Operating Fund as of December 31, 1961.

To see if the Town will vote to authorize the Board of Assessors to use such free cash as may be in the treasury, or any part thereof, in com- puting the tax rate for the current year.

To see if the Town will vote to raise and appropriate and/or appropriate by transfer from available funds a sufficient sum of money to supplement the appropriation made under Article #15 of the Warrant for the Annual Town Meeting of the year 1962, or to take any other action with relation thereto.


-Greenwood Fire-station and Library Building Committee. On motion by Finance Committee:


Voted: That the Town vote to supplement the appropriation made under Article 15 of the warrant for the Annual Town Meeting of the year 1962 and, to provide therefor, the sum of $15,140.00 be appropriated by transfer from the Excess and Deficiency Account.


ARTICLE 2


To see if the Town will vote to raise and appropriate and/or appropri- ate by transfer from available balances a sufficient sum of money to the Police Department Personnel Services Account and to the Non-Contribu- tory Veterans Pension Account.

ARTICLE 6


To see if the Town will vote to raise and appropriate a sufficient sum of money for the construction of storm drains in the Town, and to author- ize the Board of Public Works to acquire by purchase or by eminent domain proceedings rights and easements necessary in connection therewith for construction, maintenance and repair, across private land and in or across Harding Road and to extend an existing drain about 70 feet to an existing drain near No. 12 Harding Road, and to authorize and instruct the treasurer, with the approval of the Selectmen, to borrow and issue notes or bonds of the Town therefor, and/or by transfer from other avail- able funds.

On motion by Finance Committee:


Voted Unanimously: To appropriate the sum of $350 by transfer from the Excess and Deficiency Account to carry out the purposes of Article 6.


ARTICLE 7


To see if the Town will vote to amend its Zoning Bylaws by striking out paragraph (a) of Section 3., General Residence Districts, and adopting in place thereof the following:


(a) No building or premises shall be erected, altered, or used for any other purpose than (1) Any use permitted in a Single Residence District; (2) Two family detached dwelling; (3) Club, social or recreational use, except one the chief activity of which is a service customarily carried on as a business; (4) Funeral home; (5) Multiple family dwellings (more than two family), if permitted by the Board of Appeals, after notice and a pub- lic hearing, and if the Board finds that the public need and convenience will be served and that such use will not adversely affect the health, safety, convenience, character, and welfare of the neighborhood or of the Town; (6) Accessory use customarily incident to any of the above uses and not detrimental to a residential neighborhood.


-Planning Board.


Chairman Kenneth W. Thomson read the report of the Planning Board stating that a hearing, duly advertised, was held on September 6, 1962, and the Planning Board, unanimously, recommended favorable action.


On motion by Mr. Thomson:


Voted: To amend the Zoning Bylaws by striking out paragraph (A) of Section 3, General Residence Districts, and adopting in place thereof the new paragraph (A) as set forth in Article 7.


The vote in the affirmative was: Yes, 215 - No, 65, and, having received the necessary two-thirds vote, the Moderator declared the motion carried.

To see if the Town will vote to amend Chapter VI of the bylaws of the Town, being the Zoning Bylaw thereof, by adding to Section 8, sub-

section (d), the following new second paragraph: "Associate members of the Board of Appeals may be appointed by the Board of Selectmen."


-Planning Board. On motion by Chairman Kenneth W. Thomson of the Planning Board:


Voted: To amend Chapter VI of the bylaws of the Town, being the Zoning Bylaws thereof, by adding to Section 8, subsection "D," the follow- ing new paragraph: "Associate members of the Board of Appeals may be appointed by the Board of Selectmen."


The vote in the affirmative was unanimous.


ARTICLE 9


To see if the Town will vote to authorize and instruct the Board of Selectmen to grant a forty foot permanent easement and a ten foot tempor- ary construction easement over land of the Town known and described as Lot 10 on Plat 14B of the Assessors' Plans for the Town of Wakefield; said easement to be for all purposes for which highways are used in Wakefield and for the installation of public utilities and storm drains.

On motion by Miss Ruth Woodbury of the Planning Board:

Voted: To amend Chapter VI of the bylaws of the Town, being the zoning bylaw thereof, by adding to the first paragraph of Section 2, Single Residence Districts, the following: "9, Lawyers' offices"; and by changing "9" to "10" immediately preceding the provision for accessory use.


The vote in the affirmative was: Yes, 192 - No, 80, and the Moderator declared that, having received the necessary two-thirds vote, the motion was carried.


ARTICLE 11


To see if the Town will vote to amend its zoning bylaws and zoning map by changing from a General Residence District to a Single Residence District the area between Preston Street and Butler Avenue described as

follows: Beginning at a point in the easterly side line of Preston Street at the southerly line of the present Single Residence District, thence running southerly along the easterly side line of Preston Street to a point 100 feet southerly of the southerly side line of Catalpa Street as extended, thence running easterly by a line 100 feet southerly of and parallel to the southerly side line of Catalpa Street extended to the present Single Residence District on the westerly side of Butler Avenue, thence northeasterly and southwest- erly by the present Single Residence District to the point of beginning. -Henry Rufo and Others.

ARTICLE 12


To see if the Town will vote to accept a deed from the Metropolitan District Commission conveying to the Town the premises described in Article 24 of the Annual Town Meeting of 1961 and to raise and appropri- ate a sufficient sum of money to carry out the purposes of this article.

To see if the Town will vote to authorize and instruct the Board of Selectmen to lease to the Wakefield Little League Association, for a nomi- nal consideration, and upon terms acceptable to the Board of Selectmen a certain parcel of land containing approximately 70,400 square feet, being Lots 74F, and 74K as shown on Plat 31 of the Wakefield Assessors' plats and lying westerly of Del Carmine Street.
