Article 49. To see if the town will vote to accept the lay-out of a Town Way in Pleasant Lake, known as First Avenue, beginning at a point on the easterly side of N. Y. N. H. & Hartford R. R. at the intersection of a Town Way

and First Avenue, so-called; thence running easterly over said First Avenue, as shown on said lay-out, to a point op- posite the residence of Mrs. Jennie B. Moody, approximately a distance of about one thousand (1,000) feet, with the boundaries and measurements as reported and recommended by the Selectmen under date of January 13, 1936; and in- struct the Selectmen to take by purchase, or by eminent do- main, the lands, or interest in the lands, within the lines or said lay-out for said Town Way, and for this purpose raise and appropriate a sufficient sum of money.


The Finance Committee recommend that this article be accepted and adopted, and the sum of $100.00 raised and appropriated therefor.

Article 50. To see if the town will vote to accept the lay-out of a Town Way in Harwichport, with the boundaries as reported and recommended by the Selectmen under date of January 13, 1936, and instruct the Selectmen to take pur- chase, in behalf of the Town, the land, or interest in land, within lines of said lay-out, to wit: A thirty (30) foot lay- out extending from Bank Street, near property of Walter Keach, to the Cross Street Extension, so-called; provided the owners of said land will donate the same to the town without cost.

Article 51 To see if the town will vote to accept the lay-out of a Town Way, in that part of Harwich called Har- wichport, with the boundaries and measurements as reported and recommended by the Selectmen under date of January 13, 1936, and will authorize and instruct the Selectmen to take by purchase or eminent domain, in behalf of the Town, the lands or the interest in the lands, within the lines of said lay-out, to wit : beginning at the point opposite Cross Street, so-called and extending in a southerly direction to the shore,

for said Town Way, and act fully thereon.

Article 52. To see if the Town will vote to use Twen- ty Thousand ($20,000.) Dollars from the Surplus Fund to re- duce the tax levy for the year 1936, and act fully thereon.


The Finance Committee recommend that $10,000.00 be taken from the Surplus Funds in the Treasury to reduce the tax levy for the year 1936.

Article 53. To see if the Town will vote to author- ize the Selectmen to sell, after first giving notice of the time and place of sale by posting such notice of sale in some con- venient and public place in the town fourteen days at least before the sale, property taken by the town under tax title procedure provided that the selectmen or whomsoever they may authorize to hold such public auction may reject any bid which they deem inadequate, or take any action relative thereto.

Article 54. To see what action the town will take in regard to its Herring Fisheries.

Article 55. To see if the town will authorize its Sel. ectmen to sell the boiler at Harwich Depot, which has been used in the past to heat oil for roads.

Article 56. To see if the town will vote to erect and maintain two (2) electric street lights on Lower County Road, between Ben Bee's Corner and Hiawatha Road. By request.

Article 58. To see if the town will vote to raise and appropriate the sum of One Thousand ($1,000.) Dollars to be expended in connection with W. P. A. work, said money to be expended under the supervision of the Selectmen.

SPECIAL TOWN MEETING WARRANT AND ACTION Friday, May 22, 1936


Article 1. To hear the report of the Building Com- mittee on the various sites suggested upon which to build the new Senior-Junior High School Building.

Article 2. To see if the town will vote to raise and appropriate, or otherwise provide a sum of money for the purpose of purchasing or taking by eminent domain under Chapter 79 of the General Laws Ter. Ed. and acts or amend- ments thereto, and authorize the Treasurer with the approv- al of the Selectmen, to borrow such sums as may be necessary to meet any appropriation made and to issue bonds or notes of the town therefor, or take any action relative thereto.


The Finance Committee recommend that Article 2 be laid on the table until Article 3 has been disposed of.

Article 3. To proceed to vote by ballot for the choice of a site for the new Senior-Junior High School Build- ing.

Article 4. If Brooks Park is the lot chosen as the site on which to build the new Senior-Junior High School, to determine what portion of it the town will authorize to be used for school and school grounds purposes in accordance with Chapter 85 of the Acts of 1936.

Article 5. To see if the town will raise and appro- priate or otherwise provide a sum of money not to exceed $1,000.00 to be used for clearing, grading and landscaping the new school site which has been chosen.

Article 7. It being impossible to present to this meeting completed and fixed, and detailed plans and speci- fications without having had a site upon which to build, to see if the town will approve such general sketches and plans and descriptions of the Building as are presented at this meeting and vote to authorize the Committee to proceed to the construction of the building when complete details are effected without further vote of the town.

Article 8. In the event that the town votes to take the Killdee Hill location, so-called, for a schoolhouse site, to see if the town will authorize the Selectmen, provided the approval of the Federal Government can be obtained, to change the stand pipe location to the Emery lot, so-called,

and to raise and appropriate or otherwise provide the sum of $4,500.00 to defray the expenses of making such change and to authorize the Treasurer, with the approval of the Selectmen, to borrow the said sum of $4,500.00 and to issue bonds or notes of the town therefor, or take any action rela- tive thereto.

Article 9. To see if the town will vote to accept Sections 21 to 25 inclusive of Chapter 136 of the General Laws, Ter. Ed. and acts and amendments thereto, which per- mit Sunday Baseball between the hours of 1:30 and 6:30 in the afternoon, and to act fully thereon.

SPECIAL TOWN MEETING WARRANT AND ACTION


Friday, September 18, 1936


Article 1. To see if the Town will vote to rescind the action taken at the Special Town Meeting of July thirty- first, 1936 whereby the Town voted to accept the so-called Chester Snow property as a site for the proposed Senior- Junior High School Building.


Voted to rescind.


Article 2. To see if the Town will vote to rescind the further action of the above mentioned meeting whereby the Town voted to provide means of raising Six Thousand Five Hundred Dollars ($6,500.) to purchase the afore-men- tioned site.


Rescinded.


Article 3. To see if the Town will proceed to the selection of a site for the proposed new Senior-Junior High School Building and act fully thereon.


Sisson Road site selected.


Article 4. To see if the Town will raise and appro- priate or otherwise provide for raising a sufficient sum of money to meet the purchase price of the site chosen and authorize the Treasurer with the approval of the Selectmen to issue notes or bonds of the Town to the amount of the purchase price.

Article 5. To see if the Town will vote to transfer from the Reserve Fund the sum of Three Hundred Fifty Dollars ($350.) for the purpose of completing the improve- ments at the Brook's Library. By request.

To see if the Town will vote to appro- priate the sum of $675.00 for seal-coating Bank and Main Street, under Chapter 90, whereby the State pays one-half, the County one quarter, and the Town one-quarter; and that said sum of $675.00 be transferred from the unexpended East Harwich-Orleans Road appropriation.

Article 7. To see if the Town will vote to raise and appropriate a sum of money for the purpose of financing the extension of the water mains in certain sections of the Har- wich Water System now in construction, provided the Town is successful in obtaining an additional Federal grant of money pursuant to the Emergency Relief Appropriation Act of 1935; and authorize and direct the Selectmen to re- quest and accept if forthcoming, on behalf of the Town a Federal grant from the PWA; and authorize the Selectmen to construct said project and contract with respect thereto ; and authorize the Treasurer, with the approval of the Select. men, to borrow such sums as may be necessary to meet any appropriation made; or take any action relative thereto.


The following, presented by Gershom D. Hall was ac- cepted by a 2/3 vote as follows-49 for and 2 against.


Motion "That for the purpose of financing the extension of the mains in the town water system now in con- struction, and to enable the Town of Harwich to secure the benefits of the Emergency Relief Appropriation Act of 1935 there be raised and appropriated the sum of $16,000.00, pro- vided the town is successful in obtaining a Federal Grant of money from the PWA and that the Treasurer, with the ap- proval of the Selectmen be and is hereby authorized to bor- row the sum of $9,000.00, and to issue bonds or notes of the Town therefor under authority of and in accordance with the provisions of Chapter 404 of the Acts of 1935; said bonds or notes to be payable in not more than twenty years, at

such terms and maximum rate of interest as may be fixed by the State Emergency Finance Board.


All money received by way of grant from the Federal Government on account of this project shall be ap- plied ; first to meet the cost of construction thereof and any balance thereof shall be applied to the payment of the loan berein authorized.


The Selectmen are hereby authorized and direct- ed to request and accept on behalf of the Town, for the use of carrying out such project a Federal Grant of Money pur- suant to the Emergency Relief Appropriation Act of 1935, and the Selectmen are authorized to proceed with the con- struction of said project and to enter into all necessary and proper contracts and agreements in respect thereto all sub- ject to applicable Federal regulations, and the Selectmen are authorized to do all other acts and things necessary or con- venient for obtaining said grant and for making said loan and for construction of said project.


$9,000.00 raised and appropriated.


SPECIAL TOWN MEETING WARRANT AND ACTION


Friday, December 18, 1936


Article 1. To see if the Town will vote to amend Article 7 of the Specal Town Meeting held on September 18, 1936, and the Motion thereunder, by inserting whereever the figures "1935" shall appear with reference to the "Emer- gency Relief Appropriation" the figures "1936", so that the Article and Motion shall read as follows :
