common drunkards, 51; vagrancy, 63; disturbing the peace, 64; larceny, 87; assault and battery, 134; drunk- enness, 158. Of which number, 271 were against persons claiming a residence out of the city ; the balance, 424, claiming to be residents in this city.


Food and lodgings have been furnished during the year to 2,098 poor persons, mostly traveling in search of em- ployment. These, with the prisoners confined in the watch house, number during the year 2,974 which have been fur- nished with food at a cost of $144.99; and although a large part of this sum should be charged to the Pauper account, it has been charged as in former years to the Po- lice department.


The appropriation for the Police department the current year was $6,000. The amount earned by the department, accruing to the city, during the year, is $198, making the amount earned together with the appropriation, $6,198.

propriation for the department of two hundred and sixty- nine dollars and eighty-five cents.


In my quarterly reports I have credited the city with the fees earned by the Marshal as complainant before the Police Court. But at the last term of the Superior Court for the trial of criminal causes it was ruled that the law " restoring fees to officers" did not apply to the City Mar- shal ; therefore the city becomes the loser to the amount of about two hundred dollars. I would therefore recom- mend that the City Council authorize the Mayor to petition the legislature to so amend the law as will restore the fees to the Marshal; as it was evidently the intent of the legis- lature, when the law was enacted, not to so frame it that the city should be the loser by withholding the Marshal's fees as complainant.


The department consists of thirteen active men. Of these, nine are employed as night watchmen, and four as an active day police, upon whose vigilance has depended, in a great measure, the preservation of the peace and the protection of the lives and property of our citizens.


During the year large gatherings of military have been in our midst, bringing together large assemblages of our own people, together with visitors from other places, such as the city has never before witnessed ; yet I cannot but congratulate myself that quiet and good order has generally prevailed throughout the city during the current year.


I have had the honor of holding the office of City Marshal for one year, it being now near its close. I as- sumed its responsibilities and entered upon its duties with an almost insurmountable reluctance, having a full appre- ciation of the labors and trials incident to a faithful, im- partial, and honest discharge of its functions. And when the time arrives at which I shall retire from those duties,

it will be with cheerfulness ; nor shall I retire without mingled feelings of gratitude and respect for those that have bestowed their confidence in my appointment and confirmation. And to such of my fellow citizens as have given me their countenance and support I shall ever feel grateful.


The office is one which, in a proper and judicious dis- charge of its duties, is encumbered with difficulties and trials which have no parallel in the range of public offices under our government. Every act of omission, every com- mission of error, indiscretion, or neglect of duty of the Police, is charged upon the Marshal. If anything is over- done, poorly done, or not done at all ; any act affecting the rights of citizens, or their comfort or convenience, or that causes discomfort or inconvenience ; it is laid at his door, as if he were and must be omnipresent and possessed of all power.


Honest intentions, a judicious, intelligent and conscien- tious discharge of duty, with the purest and highest mo- tive that can control human action, with the most earnest desire to do right only, and as far as possible to render un- biassed justice to all under the circumstances of each case, will not exempt the incumbent from unjust criticism and sometimes reproach.


To claim that I have not committed errors or mistakes, would be claiming to be more than human ; for to err is human. But I shall retire with a consciousness of hav- ing honestly and faithfully regarded and discharged the duties of the office which I have the honor to hold ; and of having been governed by those principles and motives which commend themselves to the conscience in the hour of retrospection.


May the Police, the executive arm of the municipal gov- ernment, never have its strength weakened by party influ-

ences and dissensions ; and may its unity of action never be dissevered by elements of incompatibility, or the alloy of party factions ; - but may it be perpetuated, an arm of strength, for the protection of the lives, liberty and prop- erty of all our citizens, and for the promotion and con- tinuance of the highest interest and best good and fair fame of our beloved city.
