GENERAL STATISTICS


Arlington is situated six miles northwest of Boston, in latitude 42 deg., 25 min. north; longitude 71 deg., 09 min. west, at an elevation above mean tide of from 4 to 377 feet.


Massachuseets Avenue at Cambridge line, elevation 10 feet. Massachusetts Avenue at Pleasant Street, elevation 48 feet. Massachusetts Avenue at Park Avenue, elevation 155 feet. Park Circle at Eastern Avenue (base of standpipe), elevation 377 feet. Crescent Hill Avenue at Park Place, elevation 281 feet.


The Town and a part of what is now Belmont were set off from Cambridge and incorporated as West Cambridge in 1807. The name was changed from West Cambridge to Arlington in 1867.

Report of the Town Counsel

Gentlemen:


I herewith submit my report for the year 1951 in compliance with Section 3 of Chapter 3 of the By-Laws of the Town.


There have been twenty-four accident claims against the Town this year. Two have been settled as authorized by the Selectmen, seven have brought suit, and fifteen are in abeyance. Of the previous years' claims and suits, ten were abandoned by the claimants without suit, two at the time they were reached for trial, and two were settled as authorized by the Selectmen. There were no verdicts against the Town, and one case which was tried before a Jury and which resulted in a verdict for the Town was appealed by the plaintiff to the Supreme Judicial Court, and there the verdict in favor of the Town was upheld.


The exceptions of Lillian Y. Rubin taken in the trial of her case for the taking of her land (the so-called Pierce and Winn property) was successfully argued before the Supreme Judicial Court, whereby her exceptions were overruled, resulting in the perfecting of the Town's interest in said property. In this connction, I desire to express my ap- preciation to your Board and the Townspeople for the steadfast con- sideration and confidence accorded me during these protracted pro- ceedings.


Three contract claims against the Town were successfully defended. A petition for Writ of Mandamus was brought by John H. O'Brien and William H. O'Brien against the Board of Registrars which, after hear- ing, was dismissed in favor of the Registrars. A Bill in Equity was brought by Marie DiNapoli against the Town to restrain the laying of a storm drain which was dismissed in favor of the Town. The City of Boston brought suit involving aid given certain persons alleged to have settlement in Arlington (some of which were admitted and some denied by Arlington) which was successfully defended by Arlington paying only its just share.


The position of the Board of Assessors before the Board of Tax Appeals, the Arlington Board of Appeals before the Emergency Housing Commission, and the Inspector of Buildings and Board of Selectmen before the Outdoor Advertising Authority, has been defended.


Substantial amounts of money for aid rendered by the Board of Health and by the Symmes Arlington Hospital have been collected and turned over to the Town Collector.

The Town Counsel has been available at regular meetings of the Board of Selectmen and the Board of Public Works, has rendered opinions as requested by other boards, departments, committees and officers, has attended hearings at State Boards and Commissions, and has been vigilant in all other matters affecting the interests of the Town.


For the kind consideration and cooperation extended to me by all the officials of the Town during the past year, and especially to the Board of Selectmen and Board of Public Works, I desire to record my sincere appreciation.

52 families were aided under this category of relief, including 171 persons, 103 children under 16 and 21 children between 16 and 18 years of age.


1951 will long be remembered by Public Assistance Administrators as the year which ushered in a new category known as "Assistance to Persons WHO ARE DISABLED", Chapter 118D of the General Laws. Chapter 741 of the Acts of 1951, enacted October 30, 1951, established this new category which became effective November 1, 1951.


The basic pattern now followed in other State-supervised Categories of assistance will apply in this program. There is three (3) way finan- cial participation by the Federal, State, and Local agencies with Federal and State combining to pay 75% of both aid and administration, leaving 25% to be borne by the local agency. The settlement provisions do not operate under this new law and residence requirements are substituted instead.


All local agencies are in the process of transferring cases from General Relief (or Welfare Aid) to Disability Assistance on a presump- tive eligibility basis. Since no community had an appropriation in 1951 for this new category the law provided that payment could be made from the regular Welfare Aid appropriation. Wherever reference has been made in the statistical portion of this report to Welfare Aid, it should be understood that the 18 persons who received this form of assistance in December, retroactive to November 1, 1951, were paid from the Welfare Aid appropriation. A separate appropriation has been re- quested for 1952.


It is too early to estimate what saving Disability Assistance will bring about in Massachusetts communities. It does appear likely that in Arlington 33 1/3% to 50% of the Welfare Aid case load will eventually qualify for Disability Assistance. This could result in a net benefit of $15,000.00 to $20,000.00 annually after Federal and State reimbursements are established on a regular basis.


We also wish to call attention to the many changes which have been made in the Old Age Assistance Law, Chapter 118A. The follow- ing five amendments went into effect January 1, 1952, as provided by Chapter 801, Acts of 1951:


(1) Provision requiring the State Department of Public Welfare to increase budgetary requirements to maintain adequate standards of assistance.

(2) Creation of legal minimum rates of $75.00 monthly for persons who live outside a family group, and $55.00 monthly for persons who live in a family group. Leisure Time Activity Allowance of $4.00 monthly is to be paid in addition to the above minima.


(3) Statutory exemptions for children increased by $500 per annum.


(4) Mandatory provision that lien be filed against the property of any applicant or recipient of Old Age Assist- ance.


(5) Elimination of the present requirement under which the full cost of the $4.00 monthly Leisure Time Activity item is reimbursed by the Commonwealth.


We wish to state that while the property lien will tend to reduce case loads and eventually effect greater recoveries than were possible under the previous bond and mortgage requirement, all the other amendments will increase the local costs to a marked degree. We will not be able to forecast the amount of this increase for another month but it currently appears that the new legal minimum rates alone will increase payments by $2,000 monthly or $24,000 annually.


Your Agent wishes to express his sincere appreciation to the Honor- able Board of Selectmen, Town Officials and employees, staff of the Public Welfare Department, private agencies, civic organizations and individuals for their friendly cooperation during the year. The ad- ministration of the public assistance programs is becoming more dif- ficult with each passing year. The Agency needs cooperation and under- standing from the public at large and stands ready at all times to in- terpret the programs to any interested groups.

1. A total of 153 animals in Arlington were examined and qua- rantined for biting during the past year.


2. There were no cases of rabies in Arlington in 1951.


3. One barn was inspected according to the instructions of the Director of Livestock Disease Control. There was one animal examined, and the animal and premises were found satisfactory.


4. The Inspector of Animals wishes to express his appreciation to the Board of Health and the Police Department for their excellent cooperation.
