To Harvey T. Moore, Constable of the Town of Eastham in the County of Barnstable :


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and Town affairs, to meet at the Town Hall in said Town on Monday, the Twenty-first day of February next, at ten o'clock in the forenoon, then and there to act on the following articles in this Warrant and to meet in the Town Hall in said Town at 12:00 o'clock noon on Wednesday, the Twenty-third day of February next, then and there to elect all necessary Town officers.


Polls to be open at 12:00 noon and closed at 6:00 P.M.


Article 1. To act on the Annual Report, including rec- ommendations of the Selectmen and other Town officers and Committees and see if the Town will vote to raise and appro- priate or transfer from available funds in the Treasury sums of money for the same or take any action relative thereto.

Article 2. To see if the Town will vote to fix the salary and compensation of all elective officers of the Town as pro- vided by Section 108 of Chapter 41, G. L. as amended, and raise and appropriate sums of money for said salary.

Article 3. To see if the Town will vote to elect a Town Director for the Cape Cod Extension Service.

Article 4. To see in what manner the Town will dispose of its refunded Dog Tax.


Recommend that the Town place the refunded dog tax at the disposal of the Library. (Unanimous vote.)

Article 5. To see if the Town will vote to authorize the Town Treasurer with the approval of the Selectmen to bor- row money from time to time in anticipation of the revenue of the financial year, beginning January 1, 1949, and to issue a note or notes therefor, payable in one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, G. L.


Recommend that the Treasurer be so authorized. (Unan- imous.)


Article 6. To see if the Town will vote to raise and ap- propriate a sum of money not to exceed $1,000.00 for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass., for the care and treatment of persons certified by the Selectmen to be residents of the Town and unable to pay for such care and treatment, in ac- cordance with Chapter 111, Section 74, G. L., or take any action relative thereto and act fully thereon.


Recommend the appropriation of $400.00. (Unanimous vote.)


Article 7. To see if the Town will vote to raise and ap- propriate a sum of money for the protection and propaga- tion of shellfish or take any action relative thereto and act fully thereon.


Recommend that the Town appropriate the sum of $1,200.00. (Unanimous vote.)


Article 8. To see if the Town will vote to authorize the Selectmen to sell property taken by the Town under Tax Title procedure, and raise and appropriate a sum of money for this purpose or take any action relative thereto.


Recommend the appropriation of $500.00. (Unanimous vote.)

Article 9. To see if the Town will vote to pay a bounty of fifty cents each for woodchucks killed within its boundaries during the ensuing year and raise and appropriate a sum of money for this purpose or take any action relative thereto.


Recommend that $30.00 be appropriated for this pur- pose. (Unanimous vote.)


Article 10. To see if the Town will vote to raise and ap- propriate a sum of money to be used for the suppression of tent caterpillars under the direction of local 4 H Club leaders or take any action relative thereto.


Recommend the appropriation of $50.00. (Unanimous vote. )


Article 11. To see if the Town will vote to transfer a sum of money from the Road Machinery Fund to the Road Machinery Operation Account or take any action relative thereto.


Recommend the transfer of $150.00. (Unanimous vote.)


Article 12. To see if the Town will vote to raise and ap- propriate or transfer from unappropriated funds in the Treasury a sum of money for Chapter 81 Highways or take any action relative thereto.


Recommend the appropriation of $3,225.00 as the Town's share and $9,675.00 to be transferred from available funds to cover the state's share which will be reimbursed to the Town later. (Unanimous vote.)


Article 13. To see if the Town will vote to raise and ap- propriate a sum of money for the care and improvement of the Windmill lot or take any action relative thereto.


Recommend the sum of $400.00 for this purpose. (Unan- imous vote.)

Article 14. To see if the Town will vote to appropriate a sum of money for aerial spraying, and designate that the money be used to defray the County Tax which may be levied for aerial spraying or to defray a contract for cooperative aerial spraying, or take any action relative thereto. (By request.)


Recommend the sum of $1,200.00 be voted. (Unanimous vote.)


Article 15. To see if the Town will vote to raise and ap- propriate a sum of money to purchase and maintain a blower type mist sprayer or take any action relative thereto. (By request.)


It is recommended that this be indefinitely postponed. (Vote 5-2.)


Article 16. To see if the Town will vote to change the term of office of the Tree Warden to three years, instead of one year as at present. (By request.)


Recommend that the term' be changed to three years. (Unanimous vote.)


Article 17. To see if the Town will vote to adopt the following amendment to the Building By-Laws :


No person shall alter or add to the existing wiring in any building without first having notified the Wiring Inspector before work is done ; and hav- ing said work inspected after completion. (By request. )


Recommend that this be indefinitely postponed. (Vote 4-3.)


Article 18. To see if the Town will vote to raise and ap- propriate a sum of money for the purpose of enlarging the

Town Hall auditorium, or do or act anything thereon. (By request. )


No recommendation at this time. Report will be made at Town Meeting. (Vote 7-1.)


Article 19. To see if the Town will vote to amend Sec- tion 1 of the by-laws pertaining to the opening of the Annual Town Meeting to read : "meeting shall be called to order at 7 :00 o'clock in the evening, instead of 10:00 o'clock in the forenoon" as the by-law now reads. (By request.)


It is recommended that this amendment not be accepted. (Vote 5-1.)


Article 20. To see if the Town will vote to accept Section 6A of Chapter 40 and all amendments thereto of the General Laws, pertaining to advertising the town.


It is recommended that the Town so accept. (Unanimous vote.)


Article 21. To see if the Town will vote to raise and ap- propriate a sum of money to advertise the Town under Chap- ter 40, Sec. 6A of the General Laws. (By request.)


It is recommended that the Town appropriate $100.00. (Unanimous vote.)


Article 22. To see if the Town will vote Chapter 282, Acts of 1947 of the General Laws, pertaining to the suppres- sion and eradication of Poison Ivy.


Recommend the Town so vote. (Unanimous vote.)


Article 23. To see if the Town will vote to appropriate the sum of $200.00 to suppress Poison Ivy within the limits of the Town and designate the Tree Warden as the Depart- ment Head under whose direction any sums voted for this

purpose shall be expended, as authorized under Chapter 282, General Laws, or do anything else thereto. (By request.)


Recommend the Town so vote. (Unanimous vote.)


Article 24. To see if the Town will appropriate from available funds a sum of money for the purpose of protect- ing the Town's interest in the continuance of Railroad Trans- portation facilities and to appoint a committee of not less than three members with authority to approve the disburse- ment of such funds, said committee to be appointed by the Moderator.


Recommend the appropriation of $36.00 as this Town's share. (Unanimous vote.)


Article 25. To see if the Town will vote to instruct the Selectmen to petition the County Commissioners to lay out the cut-off from Boat Meadow Bridge through land of Leigh Wentworth and others, and vote to raise and appropriate, or transfer from unappropriated available funds in the Treas- ury a sum of money for Chapter 90 Highway Construction for said lay-out or take any action relative thereto.


Recommend the Town so vote. (Unanimous vote.)


Article 26. To see if the Town will vote to accept the lay- out for an extension of the Town Landing or Common Land- ing Place, the land being the site of the Old Coast Guard Surf Station as laid out by the Selectmen and filed with the Town Clerk and to see if the Town will instruct the Select- men to take by eminent domain, purchase, or gift said land- ing and vote to raise and appropriate a sum of money for this purpose or take any action relative thereto.


Recommend the Town so accept and appropriate $100.00 for this purpose. (Unanimous vote.)


Article 27. To see if the Town will vote to raise and ap-

propriate a sum of money to extend the present road (Bay Road), so-called, from its terminus to Boat Meadow Creek or take any action relative thereto.


No recommendation at this time. Report will be made at Town Meeting. (Unanimous vote.)


Article 28. To see if the Town will vote to accept the lay- out of a road from Camp Ground Road to Thumpertown through land of Carlton Shurtleff and others; as laid out by the Selectmen and filed with the Town Clerk; and to see if the Town will vote to instruct the Selectmen to take by emi- nent domain, purchase, or gift, land within this lay-out, and to vote to raise and appropriate a sum of money for this purpose, and construction of said road, or take any action relative thereto.


Recommend the appropriation of $1,200.00. (Unanimous vote.)


Article 29. To see if the Town will vote to accept lay-out of Sunset and Bayberry Land through land of Charles B. Durling, and Frederick Sherry as laid out by the Selectmen and filed with the Town Clerk; and to see if the Town will vote to instruct the Selectmen to take by purchase or gift, land within said lay-out and to vote to raise and appropriate a sum of money for this purpose, and construction of said road, or take any action relative thereto.


Recommend the appropriation of $1,000.00. (Vote 5-2.)


Article 30. To see if the Town will vote to accept as a gift, a piece of land from Mr. Clayton Eldredge for the pur- pose of improving the corner of Dyer Prince Road and Bridge Road.


Recommend the Town so vote. (Unanimous vote.)


Article 31. To see if the Town will vote to raise and ap-

propriate a sum of money to purchase 2 gas masks, life gun and life net for use of the Fire Department, or take any ac- tion relative thereto.


No recommendation. (Unanimous vote.)


Article 32. To see if the Town will vote to raise and ap- propriate a sum of money to pay the Unpaid Bills of 1948.


Recommend that a sum of money necessary to pay 1948 bills be appropriated. (Unanimous vote.)


Article 33. To see if the Town will vote to appoint a committee to form plans in commemoration of the 300th an- niversary of the Town's Incorporation in 1951.


Recommend the Town so vote. (Unanimous vote.)


Article 34. To see if the Town will vote to take from unappropriated available funds the sum of $600.00 for the purpose of equipping all town landings with life rings, rub- bish containers, appropriate signs and establish a rubbish collection for the beaches or do or act thereon.


Recommend the Town so vote. (Unanimous vote.)


Article 35. To see if the Town will vote to take by gift, purchase, or eminent domain, land north of Steele Road at Cooks Brook, consisting of lots shown on Assessors map. 7-C Lots 1A, 1, 2, 3, in block #37, approximately 65'x240' and land adjacent and north of said lots, approximately 200'x240' and vote to take from unappropriated available funds in the treasury a sum of money for this purpose and construction or take any action relative thereto.


Recommend that this article be accepted as written. The amount to be appropriated will be recommended at Town Meeting. (Unanimous vote.)

Article 36. To see if the Town will vote to raise and ap- propriate a sum of money for the construction and original equipping of a gymnasium to be known as World War II Memorial on the School House lot, determine how the same shall be raised, select a committee to carry out any vote of the Town, or take any action relative thereto.


Recommendations of the Finance Committee will be submitted at the Town Meeting. (Unanimous vote.)


Article 37. To see if the Town will vote to accept Sec- tions 21 to 25 inclusive of Chapter 136 of the General Laws and any amendments thereto, relative to playing baseball on the Lord's Day.


And you are directed to serve this Warrant by posting attested copies thereof at the Packing House of Bernard C. Collins in South Eastham; at the Post-office in North East- ham and at the Post-office in Eastham, seven days at least before the time of holding said meeting as aforesaid.


Hereof, fail not and make due return of this Warrant with your doings thereon to the Town Clerk at the time and place of holding said meeting.
