In spite of all the dire forecasts of higher taxes and governmental expenses on the rise we are hoping and work- ing toward keeping the Tax rate in Eastham at its present level, and at this point it looks as though this can be accom- plished, and this without cutting any of the items which tend to keep a Town growing.


At this time thanks are expressed to all elected and appointed officials for their cooperation, and as has been said before we are always at your service.

Annual Town Meeting, February 20, 1950


The Annual Town Meeting was called to order at 10:00 o'clock by the Town Clerk. Call of the meeting read by the Town Clerk, together with the return of the officer who served the Warrant. Tellers appointed to serve at this meet- ing were: Charles W. Chase, Daniel Sparrow, Jr., Charles Hollis, James J. Johnston, Jr., and they were duly sworn in by the Town Clerk.


Article 1. To act on the Annual Report, including recommendations of the Selectmen and other Town officers and Committees and see if the Town will vote to raise and appropriate or transfer from available funds in the Treas- ury, sums of money for the same or take any action relative thereto.


Voted : First to allow Mr. Eugene Zack to use a black- board to show the effect of appropriations as reflected in the tax rate. Voted to accept the budget as submitted by the heads of departments, Item 27 to read : "To be spent in conjunction with Federal Funds." Total Appropriations $77,898.05. Unanimous vote.

Article 2. To see if the Town will vote to fix the salary and compensation of all elective officers of the Town as provided by Section 108 of Chapter 41, General Laws as amended and raise and appropriate sums of money for same.


Voted : To raise and appropriate the sum of $6,525 for officers' salaries for the ensuing year. Unanimous vote.


Article 3. To see if the Town will vote to elect a Town Director for the Cape Cod Extension Service.


Voted : To elect a Town Director for the Cape Cod Ex- tension Service. Elected : Joseph H. Putnam, Director. Unanimous vote.


Article 4. To see in what manner the Town will vote to dispose of its refunded Dog Tax.


Voted : That the refunded Dog Tax be turned over to the Public Library Account. Unanimous vote.


Article 5. To see if the Town will vote to authorize the Treasurer with the approval of the Selectmen, to bor- row money from time to time in anticipation of the revenue of the financial year beginning January 1, 1950, and issue a note or notes therefore, payable in one year and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17 Chapter 44, General Laws.


Voted : To authorize the Treasurer, with the approval of the Selectmen to borrow money from time to time in antici- pation of revenue of the financial year beginning January 1, 1950 and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws. Unanimous vote.


Article 6. To see if the Town will vote to raise and appropriate a sum of money not to exceed $1,000.00 for the

establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass., for the care and treatment of persons certified by the Selectmen to be residents of the Town and unable to pay for such care and treatment, in accordance with Chapter 111, Section 74, General Laws, or take any action relative thereto.


Voted : To raise and appropriate the sum of $400.00 for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass. Unanimous vote.


Article 7. To see if the Town will vote to raise and appropriate a sum of money for the protection and propa- gation of shellfish, or take any action relative thereto and act fully thereon.


Voted: To raise and appropriate the sum of $1200.00 for the protection and propagation of shellfish. Unanimous vote.


Article 8. To see if the Town will vote to authorize the Selectmen to sell property taken under Tax Title procedure by the Town, and raise and appropriate the sum of $500.00 for this purpose, or take any action relative thereto.


Voted : To raise and appropriate the sum of $500.00 and to authorize the Selectmen to sell property taken under Tax Title procedure by the Town. Unanimous vote.


Article 9. To see if the Town will vote to pay a bounty of fifty cents each for woodchucks killed within its bound- aries during the ensuing year and raise and appropriate the sum of $20.00 for this purpose, or take any action rela- tive thereto.


Voted : To raise and appropriate the sum of $20.00 for the purpose of paying a bounty of 50 cents for each wood- chuck killed within the boundaries of the Town.

Article 10. To see if the Town will vote to raise and appropriate the sum of $25.00 to be used for the suppres- sion of tent caterpillars under the direction of Local Boy Scout leaders or take any action relative thereto.


Voted to raise and appropriate the sum of $25.00 for the suppression of tent caterpillars to be expended under the direction of local Boy Scout leaders. Unanimous vote.


Article 11. To see if the Town will vote to raise and appropriate or transfer from unappropriated funds in the Treasury, a sum of money for Chapter 81 Highways, or take any action relative thereto.


Voted : To accept Article 11 as written to raise and ap- propriate the sum of $4100.00 for same. Unanimous vote.


Article 12. To see if the Town will vote to raise and appropriate the sum of $300.00 for the care and improve- ment of the Windmill and lot or take any action, relative thereto.


Voted : To raise and appropriate the sum of $300.00 for the care and improvement of the Old Windmill and lot. Unanimous vote.


Article 13. To see if the Town will vote to instruct the Selectmen to make arrangements to notify each qualified voter in the Town of Eastham, by mail, of all proposed Special Town Meetings at least seven (7) days prior to date same is held, incorporating within this notice a text of articles to be acted upon. Also to raise and appropriate a sum of money sufficient for this purpose or take any ac- tion relative thereto.


Voted : That a committee of three be appointed by the Moderator to investigate this article and to report at a later Town Meeting. Committee appointed as follows: Charles

Article 14. To see if the Town will vote to authorize the Planning Board to prepare a zoning by-law for the Town and submit it at a future Town Meeting and to raise and appropriate a sum of money for the expense thereof, or take any action relative thereto. (Requested by Planning Board.)


Voted : To accept Article 14 as read and to raise and appropriate the sum of $500.00.


Article 15. To see if the Town will vote to amend Section 1 of the By-Laws pertaining to the opening of the Annual Town Meeting to read : "meeting shall be called to order at 7:00 P. M. in the evening," instead of "10:00 o'clock in the forenoon," as the by-law now reads. (Re- quested by the Planning Board.)


Voted : To indefinitely postpone Article 15.


Article 16. To see if the Town will vote to raise and appropriate the sum of $100.00 for the purpose of pur- chasing, erecting and maintaining signs to be used on pub- lic roads and beaches and that a committee of three be appointed by the moderator for this purpose to function in co-operation with the Selectmen.


Voted : To accept this article as read and to raise and appropriate the sum of $100.00. Committee appointed as follows: Ralph L. Rogers, Daniel W. Sparrow, Jr., and Howard N. Walker. Unanimous vote.


Article 17. To see if the Town will vote to raise and ap- propriate the sum of $500.00 for Public Amusements and for Municipal advertising purposes or take any action relative thereto. (By request.)

Article 18. To see if the Town will vote to amend Article 11 of Section 1 of the by-laws regulating the con- struction, re-construction and location of buildings to read : 'if on land of single ownership, they shall not be nearer to each other than 50 ft., except as defined in Section 2", in- stead of reading "if on land of single ownership they shall not be nearer to each other than 25 ft." as the by-law now reads.


Voted to accept Article 18, Amendment By-law. 82 to 26.


Article 19. To see if the Town will vote to amend Sec- tion A, Article 15 of Section 1 of the by-laws regulating the construction, re-construction and location of buildings to read : : "A. Foundation. Foundation shall be of continuous masonry construction extending at least 12 inches below the finished grade with interior supports to the ground of masonry concrete or concrete filled columns", instead of reading: "Foundation shall be of continuous masonry construction extending at least 18 inches below finished grade with interior supports to the ground of masonry concrete or concrete filled steel columns," as the by-law now reads :


Voted : To accept amendment as read. Unanimous vote.


Article 20. To see if the Town will vote to amend the by-law regulating the construction, re-construction and loca- tion of buildings by striking out the existing Article 12, Sec. 1, pertaining to chimneys, and accept and insert the following Article 12, Sec. 1, of the Building By-Laws: All chimneys shall consist of masonry construction from the ground. No chimney shall be constructed without fire clay
