WARRANT FOR ANNUAL TOWN MEETING
Middlesex, ss:
To either of the Constables of the Town of Tewksbury, in said County:
Greeting:
In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Tewksbury, qualified to vote in town affairs, to meet and assemble at Town Hall in said Tewksbury on Wednesday, February 16, 1949 at 7:30 o'clock, P. M. to act on the following articles, except Article 1, and you are also hereby further required and directed to notify and warn the said inhabitants of the Town of Tewksbury, who are qualified to vote on elections and town affairs, to assemble subsequently and meet in town meeting at the polling places in said Town of Tewksbury, on Wednesday, February 23, 1949 at 10 o'clock A. M., then and there to act on the following:
Article 1.
The polls for the election of Town Officers to be opened at ten o'clock A. M. and to be closed at 8 P. M.
ART. 1. To choose all necessary Town Officers, to choose by ballot two Selectmen, two members of the Board of Public Welfare, a Moderator, an Auditor, and three Constables, all to serve one year. One member of the Board of Health, One Road Commissioner, two Trustees of the Public Library, One Park Commissioner, One Assessor, One member of the School Committee, One Commissioner of Trust Funds, all to serve three years. Five members of the Planning Board, one to serve one year, one to serve two years, one to serve three years, one to serve four years, and one to serve five years.
ART. 2. To hear reports of Town officers and committees and act thereon.

ART. 3. To see what sums of money the Town will vote to raise by taxation to defray necessary expenses for the current year, and make appropriations for the same.

ART. 4. To see if the Town will vote the money arising from licensing dogs, for the ensuing year to aid in support of the Public Library.

ART. 5. To see if the Town will vote to authorize the town treasurer, with the approval of the selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1949, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws. . VOTED: That the town treasurer, with the approval of the select- men, be and hereby is authorized to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1949 and to issue a note or notes there- for, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.

ART. 6. To see what sum of money the Town will vote to raise and appropriate for reserve fund under Section 6 of Chapter 40 of the General Laws, or take any other action on same.

ART. 7. To see if the Town will authorize the Selectmen to institute suits on behalf of the Town or defend any suits that are, or may be brought against the Town, and to sign any contracts or agreements in behalf of the Town.

ART. 8. To see if the Town will vote to authorize the Board of Selectmen and the Treasurer to foreclose either through the Land Court or by affidavit of the Commissioner of Corpora- tions and Taxation, any Tax Title held by the Town for more than two years, and to see what sum of money the Town will vote to raise and appropriate therefor or take any other action relative thereto. ART. 9. To see if the Town will vote to authorize the Selectmen to sell, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the town fourteen days at least before the sale, property

taken by the town under tax title procedure provided that the selectmen or whosoever they may authorize to hold such public auction may reject any bid which they deem inadequate, or take any action relative thereto. Board of Selectmen.
ART. 10. To see if the Town will vote to authorize the Town Treasurer with the approval of the Board of Selectmen to sell any parcel or parcels of land acquired by the Town through T'ax Title foreclosure proceedings whose Tax Title value is less than $100.00, for whatever sum it may be in their judg- ment to the best interest of the Town, or take any other action relative thereto. ART. 11. Shall the Town accept the provisions of Chapter 588 of the Acts of 1948 which authorizes increases of the amounts of pensions payable to certain public employees who have been retired and to beneficiaries of certain retired public em- ployees. Board of Selectmen.
ART. 12. To see if the Town will vote to abolish the new Town dump located in Cedar Swamp or take any other action relative thereto. John J. Nolan.
ART. 13. To see if the Town will raise and appropriate the sum of $200.00 to purchase a winch for the tree department. Harris M. Briggs.
ART. 14. To see if the Town will vote to raise and appropriate the sum of $1500.00 to regrade and fix up the old Town Cemetery on East St. and also the old South Cemetery at the corner of Shawsheen and Main St. or take any other action relative thereto. Leslie Collins.
ART. 15. To see if the Town will vote to provide that the Col- lector of Taxes shall collect under the title of Town Collector all accounts due the town. Board of Selectmen.

ART. 25. To see if the Town will vote to raise and appropriate the sum of $1,500.00 per year for the Town Treasurer for the balance of his term or until such time as he is able to resume his duties, at which time his former salary of $2,750.00 will prevail or act in any other way relative thereto.

ART. 26. To see if the Town will vote to raise and appropriate the sum of $1,500.00 per year for the salary of a temporary treasurer or act in any other way relative thereto.

ART. 27. To see if the Town will vote to accept the following amendment to Chapter 41 of the General Laws:
Chapter 41 of the General Laws is hereby amended by striking out section 97A, inserted by Chapter 540 of the acts of 1948, and inserting in place thereof the following section:
Section 97A. In any town which accepts this section there shall be a police department established by the selectmen, and such department shall be under the supervision of an officer to be known as the chief of police. The Selectmen of any such town shall appoint a chief of police and such other officers as they deem necessary, and fix their compensation, not exceed- ing, in the aggregate, the annual appropriation therefor.

In any such town in which such appointments are not subject to chapter thirty-one, they shall be made annually and the selectmen may remove such chief or other officers for cause at any time after a hearing. The chief of police in any such town shall from time to time make suitable regulations govern- ing the police department, and the officers thereof, subject to the approval of the selectmen; provided, that such regulations shall become effective without such approval upon the failure of the selectmen to take action thereon within thirty days after they have been submitted to them by the chief of police. The chief of police in any such town shall be in immediate control of all town property used by the department, and of the police officers, whom he shall assign to their respective duties and who shall obey his orders. Section ninety-seven shall not apply in any town which accepts the provisions of this section. Accep- tance of the provisions of this section shall be by a vote at an annual town meeting.

To see if the Town will vote to raise and appropriate the sum of $3,500.00 or any other sum for the improvement of Whipple Road; said money to be used in conjunction with any money which may be alloted by the State or County or both for this purpose, or take any other action relative thereto.

To see if the Town will vote to authorize the Board of Road Commissioners to purchase a parcel of land containing seven and one half acres (71/2) more or less on the easterly side of Foster Road: property now owned by John Belton. Payment for said land to be taken from our regular Highway appropriation or take any other action relative thereto.

To see if the Town will vote to continue the Highway Machinery Fund as established at the last annual Town Meeting and to appropriate an additional sum including the unexpended balance of the 1948 Highway Machinery account to be added to the amount already accredited to this fund, for Highway Machinery purposes or take any other action relative thereto. ART. 31. To see what sum the Town will vote to appropriate from the Highway Machinery Fund for the purchase, repair and maintenance of road machinery equipment for 1949 or take any other action relative thereto.

To see if the Town will vote to amend Sec. 3 of Article 4 of the Town By-Laws by striking out the words, "Unless such estimates are submitted at the time and in the form provided, no appropriation in excess of the appropriation for the pre- vious year of the department failing to file the estimates as above provided, shall be made at the annual town meeting," or take any other action relative thereto. ART. 48. To see what sum of money the Town will vote to raise and appropriate for the purpose of reimbursing the Chief of Police for legal expenses incurred by him in defending himself against legal actions brought by the present Board of Select- men, or take any other action relative thereto.

ART. 49. To see if the Town will vote that section 3 of Article IV of the Town By-Laws be amended by inserting after the words Chief of the Fire Department, the words Chief of the Police Department, or take any other action relative thereto.
