To any of the Constables of the Town of Tewksbury, in said County: Greeting:


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Tewksbury, qualified to vote in town affairs, to meet and assemble at Town Hall in said Tewksbury on Wednesday, March 5, 1958 at 7:30 P. M. o'clock to act on the following articles, except Article 1, and you are also hereby further required and directed to notify and warn the said inhabitants of the Town of Tewksbury, who are qualified to vote on elections and town affairs therein, to assemble subsequently and meet in town meeting at the polling places in said Town of Tewksbury, on Wednesday, March 12, 1958 at 10:00 A. M. then and there to act on the following Article 1.

The annual Town Meeting was called to order at 7:30 P. M. by Alfred N. Shamas, Moderator, assisted by John F. Gleason as assistant Moderator in the lower hall. Rev. Carroll Word, pastor of the Con- gregational Church offered a prayer after which the assembly stood in silence in memory of the late Dr. Herbert M. Larrabee.


Tellers, John J. Kelley, Joseph A. Aubut, Leroy Curseaden and William H. Bennett were duly sworn by the Moderator.


Reading of the articles by the Moderator was waived by the as- sembly.


ART. 1-To choose all necessary Town Officers, to choose by ballot two Selectmen for three years, one member for Board of Health for three years, two members for Board of Public Welfare for three years, one Assessor for three years, two members for the School Committee for three years, one member for the School Committee for one year, one Water Commissioner for three years, two Trustees for the Public Library for three years, one Road Commissioner for three years, one Park Commissioner for three years, one Trust Fund Commissioner for three years, one Moderator for one year, one member of the Planning Board for five years, one member of the Planning Board for one year and one Auditor for three years.


ART. 2-To hear and act upon the reports of the various town officers. Voted to adopt.


ART. 3-To fix the salary of the Building Inspector and the several elective officers of the town and determine whether such salaries shall be retroactive to January 1st. (Refer to Salary Schedule).

Adjourned meeting was called to order by the Moderator at 7:30 but was postponed until 8 o'clock when a quorum was ascertained. John J. Kelley and Joseph A. Aubut acted as tellers.


ART. 5-To determine what sum the town will authorize and direct the Assessors to take from available funds to reduce the tax levy for the current year, or take any other action relative thereto.


Voted to transfer $45,000 from E and D to reduce the tax rate.

ART. 6-To see what sum of money the town will vote to raise and appropriate and or transfer from Overlay Reserve for a reserve fund, pursuant to the provisions of Chapter 40, Section 6.


Voted to raise and appropriate $20,000 under this article.


ART. 7-To see if the town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1958, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, of the General Laws.


Voted to adopt.


ART. 8-To see if the town will authorize the Selectmen to institute. suits on behalf of the town or defend any suits that are, or may be brought against the town, and to sign any contracts or agree- ments in behalf of the town.


Voted to adopt.


ART. 9-To see if the town will vote to authorize the Board of Select- men and the Treasurer to foreclose, either through the land court or by affidavit of the Commissioner of Corporations and Taxation, any tax title held by the Town for more than two years, and see what sum of money the Town will vote to raise and appropriate therefor.


Voted to adopt.


ART. 10-To see if the Town will vote to authorize the Selectmen to sell, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town at least fourteen days before the sale, property taken by the Town under tax title procedure, provided that the Selectmen or whomsoever they may authorize to hold such public auction may reject any bid which they deem inadequate, or take any action relative thereto.

ART. 11-To see if the Town will vote the money arising from licens- ing dogs for the ensuing year to aid in support of the Public Li- brary.

ART. 12-To see what sum of money the Town will vote to raise and appropriate for the construction of a sidewalk on Main Street, said money to be spent in conjunction with the Dept. of Public Works, or take any other action relative thereto.


Voted to raise and appropriate the sum of $1,000 for this purpose.


ART. 13-To see if the Town will vote to raise and appropriate or transfer from available funds the sum of $1,500 for the purchase of a portable pump for pumping out cellars and streets in emer- gencies, or take any other action relative thereto.


Voted to raise and appropriate the sum of $750 to be used with matching funds from Civil Defense.


ART. 14-To see if the Town will vote to raise and appropriate the sum of $3,000 to be spent in conjunction with the Mass. Dept. of Public Works to develop the intersection, and install automatic traffic lights at the intersection of Shawsheen Street and Route 38, or take any other action relative thereto.


Voted to raise and appropriate $3,000 for this purpose.


ART. 15-To see if the Town will vote to raise and appropriate the sum of $500 for the extermination of Termites which have infested the Town Hall, or take any other action relative thereto.


Voted to raise and appropriate the sum of $500 for this purpose.


ART. 16-To see if the Town will vote to raise and appropriate the sum of $300 for the purchase of 100 chairs for the Town Hall, or take any other action relative thereto.


Voted to raise and appropriate the sum of $300 for this purpose.


ART. 17-To see if the Town will vote to amend the Town By-Laws by changing the time of the Annual Town Meeting to 10:00 A. M. on the first Saturday in March.


Voted to adopt this article. This by-law was approved by the At- torney General on April 24, 1958.


ART. 18-To see if the Town will vote to raise and appropriate or transfer from E and D the sum of $5,000 for a survey by a recog- nized public water system engineer, for the purpose of locating new well fields and to make a report at the next annual town

meeting. Said sum to be expended by the Water Commissioners.

ART. 19-To see if the Town will vote to raise and appropriate the sum of $50,000 for the purpose of new installations of water ser- vices to dwellings or other buildings, and including sub-divisions, and provided that the cost of said installations has been first deposited with the Town Treasurer and applied to estimated re- ceipts and to authorize the Water Department to do such work and expend such money and in the event said entire sum is not re- quired for said installations any unexpended balance shall like- wise be credited to estimated receipts, or take any action in relation thereto.
