At a meeting of the County Commissioners for the County of Middlesex, holden at Lowell, within and for said County, on the first Tuesday of September in the year of our Lord one thousand nine hundred and eight. The inhabitants of Wayland in said County by their petition to said Commissioners - among other matters - pray that a new road be laid out closely following the route of an old road running between the Framingham and Boston road near the house of James F. Thomas northwesterly about one half mile to the Natick and Concord road near the former residence of Joseph Bullard as will more fully appear referen being had to the petition filed of record in the case. The petition was presented to the County Commissioners at their meeting holden at, Cambridge, within and for said County on the first Tuesday of January A. D. 1908, when and where said Commissioners caused notice to be given to all persons and Corporations interested therein of the time, and place, when and where they would meet for the purpose of viewing the premises and hearing the parties, as by the notice on file and of record will more fully appear.
And at an adjourned meeting said laying out was adjudged to be of common convenience and necessity and thence said petition has been continued to this time.
And now the said Commissioners make return of their proceedings in the premises, as follows: said Commissioners having given notice as the law directs, met at the Selectmen's room in the Town Hall, in said Wayland, on the eighteenth day of June, in the year nineteen hundred and eight, when and where the parties appeared, to wit, the petitioners by W. A. Bullard and others and the respondents by Francis P. White and others.
And the premises having been examined, and all parties fully heard, said Commissioners proceeded to lay out a new highway as prayed for in said petition and the following description is a true description of said road as hereby laid out and ordered :-

The Westerly line begins at a point on the Easterly Side of Main Street, thence on a curve of 29.0 feet radius bearing to the right 60.16 feet to a point, thence south 29º24' East 96.86 feet to a point, said point being opposite and 40 feet distant from a point in the above described easterly line marking the terminus of a course bearing south 39024' East 157.0 feet, and the beginning of a curve of 649.54 feet radius; thence from said point to said Westerly line the line runs parallel and 40 feet distant from the above described Easterly line to a point opposite and 40 feet distant from a point in the above described Easterly line marking the terminus of a curve, of a radius of 350.37 feet bearing to the left 235.84 feet to a point, and the begin- ning of a curve of 522.11 feet radius; thence from said point in said Westerly line the line bears to the right on a curve of 437.1 foot radius 153.26 feet to a point thence South 21°18' East 74.97 feet to a point, said point being opposite and 30 feet distant from a point in the above described easterly line marking the terminus of a course bearing South 21°18' East 22.05 feet, and the beginning of a curve of 183.26 feet radius; thence from said point in said Westerly line the line runs parallel and 30 feet distant from the above described easterly line to a point opposite and 50 feet distant from a point in the above described easterly line making the terminus of a course bearing South 52º25'30" East 93.88 feet, and the beginning of a curve of 70.29 feet radius; thence from said point in said Westerly line the line runs South 52º25'30" East 63.33 feet to a point, thence south 83º18' East 29.75 feet to a stone bound thence North 56°31' East 137.37 feet to a point thence North 32º91'30" East 118.33 feet to a point, said point being opposite and 50 feet distant from a point in the above described Easterly marking the terminus of a course bearing North 32000'30" East 68.09 feet to a point, and the beginning of a curve of 82.71 feet radius; thence from said point in said Westerly the line bears to the right on a curve of 45.05 feet radius 62.13 feet to a point being 40 feet distant from the above described easterly line; thence South 68º54'30" East 362.0 feet to a point said point being opposite and 40 feet distant from a point in the above described easterly line marking the terminus of a course bearing South 68054'30" East 374.1 feet and the beginning of a curve of 444.84 feet radius; thence from said point in said Westerly line the line runs parallel and forty feet distant from the above described easterly line to a point, opposite and 40 feet distant from point in the above described easterly line marking the terminus of a curve of 351.73 feet radius bearing to the right 131.81 feet to a point, and the beginning of a curve of 159.03 feet radius; thence from said point in said Easterly line the line bears to the right with a curve of 11.43 feet radius 26.40 feet to a point on the northwesterly side of the Framingham road.
The above described lines are reckoned from the magnetic meridian and a description is intended to conform to a plan of said road dated 1908 on which the above described lines are shown in red.
The road as laid out crosses an aqueduct of the Metropolitan water system. The Metropolitan Water and Sewerage Board has voted to permit the construction of the road over the aqueduct as appears by a vote of that board and in accordance with a communication received by the County Commissioners, a copy of said communication appearing as follows :-

County Commissioners for the County of Middlesex, East Cambridge, Massachusetts.
Gentlemen :- Your favor of the 18th inst. relative to the construction of a road in Wayland over the Weston Aqueduct, has been considered by the Board and they have voted to permit the County Commissioners for the County of Middlesex to construct a road over the aqueduct, as shown on a plan submitted, on condition that any expense that may be necessary to strengthen the aqueduct at the point where the same is crossed by the road shall be borne by the County.

The County Commissioners therefore lay out said road subject to said permit and requirements of the Metropolitan Water and Sewerage Board, any expense required because of said permit and requirements to be borne by the town as part of the expense of these proceedings.
The above points marking the termini of the various described courses are marked on the ground by stakes, and the Commissioners hereby order that stone bounds be set to permanently mark the said points.
And said Commissioners determine and order that the inhabitants of the said town of Wayland shall, on or before the first day of July, which shall be in the year 1909, lay open, construct, and complete this said highway, so that 16 feet in width thereof throughout the whole, exclusive of gutters on the sides, shall be safe and convenient for the passage of teams of every description with customary loads. The form and manner of construction shall be as follows :-
The work of said road shall be in accordance with a profile of said road prepared under the direction of the Commissioners. The sub-grade under- neath the gravel surfacing shall be suitable material free from vegetable matter within two feet of the finished surface. No stumps, roots or tree branches shall be allowed in making fills. The road bed shall be graded evenly with suitable material properly compacted before applying the surfacing gravel. The gravel surfacing for at least a depth of six inches shall be good, binding road gravel and the finished road bed shall present a hard smooth surface free from inequalities, crowned eight inches. Guard rails shall be erected at all steep and dangerous places, drainage carefully attended to, and the whole done on a workman-like manner to the acceptance of the Commissioners.

And the proprietors or occupants of the land over which said highway is thus laid out, are allowed until the first day of April next to remove there- from any wood, timber, trees or other property. And said Commissioners having heard the proprietors of said lands by themselves or their agents on the subject of damages, by them sustained by reason of laying out said highway, have estimated that no damages are sustained and none are awarded.
And said Commissioners further order that the sum of one hundred (100) dollars is a fair and just proportion of the expenses of said proceedings to be paid by the County treasury into the town treasury of Wayland whenever the Select- men of said town shall present a certificate certifying that all claims by reason of said proceedings have been settled and said road shall be completed to the acceptance of said Commissioners. And the said Commissioners further determine and order that the said town of Wayland shall pay all damages, costs and expenses, if any, except the County's share of the expense set forth above, that any party may by legal process obtain in consequence of said proceedings throughout the whole of said highway, as hereby established; that the highway described in said return be, and the same is hereby established as and for a public highway, and that the same may hereafter be known as such.
In Witness Whereof, we, the said County Commissioners, have hereunto set our hands this 15 day of December in the year of our Lord one thousand nine hundred and eight.
