CONSTRUCTION OF BUILDINGS

CITY OF NEW YORK.


AS AMENDED TO 1892.


CHAPTER 275.


AN ACT to create a department of buildings in the city of New York and to amend chapter four hundred and ten of the laws of eighteen hundred and eighty-two, entitled " An act to consolidate into one act and to declare the special and local laws affecting public interests in the city of New York," in so far as the same relates to the fire and building departments of said city, and by adding a new section thereto, creating a bureau to be known as "the bureau of fire alarm, telegraph and electrical appliances."


Approved by the Governor April 9, 1892. Passed, three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows :


SECTION 1. Department of buildings-superintendent .- In addition to the departments in the city of New York provided for by section thirty-four of chapter four hundred and ten of the laws of eighteen hundred and eighty-two, together with the acts supplemental to and amendatory thereof, there is hereby created a "department of build- ings," which shall have exclusive charge of all the matters and things set forth in section five hundred and four of chapter four hundred and ten of the laws of eighteen hundred and eighty-two, and of any and of all acts amendatory thereof or supplementary thereto, and of any and all other pro- visions of law relating to such matters which were heretofore under the jurisdiction and cognizance of the fire department of the city of New York or the bureau thereof known as the " bureau of inspection of buildings," as enumerated in section four hundred and twenty-seven of said chapter four . hundred and fifty of the laws of eighteen hundred and eighty-two, and all

acts amendatory thereof or supplementary thereto. The head of the de- partment of buildings shall be called " the superintendent of buildings." He shall be appointed by the mayor. He shall be subject to removal by the mayor after written charges have been preferred against him, and he has had a hearing thereon subject, however, to the approval of the governor, expressed in writing. He shall be paid a salary of five thousand dollars per annum, payable monthly, and shall hold his office for six years and until his successor be appointed, unless sooner removed.


§ 2. General powers and duties .- Such department of buildings shall have power and authority to do, and is hereby charged with the duty of doing the several matters and things heretofore provided to be done by the fire department of the city of New York, or the "bureau of inspection of buildings," or the "inspector of buildings," or the "super- intendent of buildings," as the head of such bureau has been by such laws described, also all matters under control of the board of health in regard to light, ventilation, plumbing and drainage. The ex- penses of said department of buildings shall be provided for in the same manner as the expenses of other departments under chapter four hun- dred and ten of the laws of eighteen hundred and eighty-two, and the acts supplemental and amendatory thereof ; but in no case shall the amount expended by the said department of buildings exceed the amount appro- priated for said department by the board of estimate and apportionment ; said department of buildings shall file with the comptroller of said city monthly a statement under the oath of its superintendent showing the num- ber and names of all persons employed by it during the preceding month, and the amount paid to each of them and the particular kind of work in which each of them shall have been employed during such month.


§ 3. Subordinate officers and employes .- Said superintendent shall have power to engage, in behalf of such department buildings, and in his discre- tion to discharge, from time to time, such officers and employes thereof, subject to the provisions hereinafter stated, and to fix their compensation, as shall be necessary and proper in executing the duties hereby imposed, and may make, from time to time, rules and regulations for their govern- ment.


§ 4. Transfer of property .- Upon the organization of the department hereby created and notice thereof from said superintendent to the fire depart- ment and board of health of the said city, all books, papers, records, property, leases, moneys, accounts, claims and things of every kind and description belonging to or in the custody of said fire department and board of health, and used by those departments in connection with the bureau of the fire department known as the " bureau of inspection of buildings," as it hereto- fore existed ; also all matters now in the board of health referring to light ventilation, plumbing and drainage, shall be transferred by the said fire department and board of health to the department of buildings hereby cre-

ated, and until such transfer takes place the said fire department and board of health shall remain charged with all the duties of said departments. At the same time that the aforementioned transfer takes place the comptroller of said city shall transfer to the credit of said department of buildings any unexpended balances heretofore appropriated for the purposes of said " bureau of inspection of buildings" that may be at that time standing to the credit of the fire department in excess of liabilities incurred by said fire department for those purposes, and shall also transfer to the credit of said department of buildings any unexpended balances heretofore appropriated for the division of plumbing and ventilation in the sanitary bureau of the board of health that may be at that time standing to the credit of the board of health in excess of the liabilities incurred by the said board of health for those purposes. The superintendent of buildings, with the approval of the commissioners of the sinking fund, shall provide such offi- cers and business accommodation as may be requisite for the transaction of the business of the department of buildings and that of its subordinates. The department may adopt a common seal and direct its use.


§ 5. Application of certain terms .- Whenever in any act applicable to the city of New York and relating to the subject matter of this act, the words " fire department," "bureau of inspection of buildings," "superin- tendent of buildings," "inspector of buildings," " board of health," or " health department," shall occur, the same shall be taken to mean the de- partment of buildings and superintendent of buildings herein authorized.


§ 6. Appropriations for 1892 .- Upon requisition of the superintendent of buildings setting forth the necessity of any such appropriations, and the specific purpose to which it is to be applied, the board of estimate and apportionment may, in its discretion, at any time appropriate money for the purpose of carrying out the provisions of this act for the remainder of the year eighteen hundred and ninety-two. Any appropriation, or appropria- tion so made, shall be added to the amount appropriated in the final esti- mate for the year eighteen hundred and ninety-two, and revenue bonds shall be issued therefor in like manner as for the expenditures of the city govern- ment during said year, and the amount so appropriated shall be added to the tax levy for the year eighteen hundred and ninety-two.


§ 7. Consolidation act amended .- Section four hundred and seventy-one of chapter four hundred and ten of the laws of eighteen hundred and eighty- two, is hereby amended to read as follows :


§ 471. Construction and alteration of buildings .- No wall, structure, building, or part thereof, shall hereafter be built, constructed, altered or repaired, in the city of New York, except in conformity with the provisions of this title. No building already erected, or hereafter to be built, in said city, shall be raised, altered or built upon, in such manner, that were such building wholly built or constructed after the passage of this act, it would be in violation of any of the provisions of this title.

§ 8. Section four hundred and seventy-two of chapter four hundred and ten of the laws of eighteen hundred and eighty-two, as heretofore amended, is further amended to read as follows :


§ 472. Materials used .- The walls of all buildings, other than frame or wooden buildings, shall be constructed of stone, brick, iron or other hard incombustible material, and the several component parts of such buildings shall be as herein provided.


$ 9. Section four hundred and seventy-three of chapter four hundred and ten of the laws of eighteen hundred and eighty-two, as heretofore amended, is further amended to read as follows :


§ 473. Excavations-adjoining walls .- All excavations shall be properly guarded and protected so as to prevent the same from becoming dangerous to life or limb and shall be sheet-piled where necessary to prevent the adjoining earth from caving in, by the person or persons cansing the exca- vations to be made. Whenever an examination of either earth or rock for building or other purposes, shall be intended to be, or shall be carried to the depth of more than ten feet below the curb, the person or persons caus- ing snch excavation to be made shall at all times, from the commencement until the completion thereof, if afforded the necessary license to enter on the adjoining land and not otherwise, at his or their own expense, preserve any adjoining or contignous wall or walls from injury, and support the same by proper foundations, so that the said wall or walls shall be and remain practically as safe as before such excavation was commenced, whether the said adjoining or contiguous wall or walls are down more or less than ten feet below the curb. If such excavation shall not be intended to be, or shall not be, carried to a depth of more than ten feet below the curb, the owner or owners of such adjoining or contiguons wall or walls shall preserve the same from injury, and so support the same by proper foundations that it or they shall be and remain practically as safe as before such excavation was commenced, and shall be permitted to enter npon the premises where snch excavation is being made for that purpose, when necessary. In case an adjoining party wall is intended to be used by the person or persons causing the excavation to be made, and such party wall is in good condition and sufficient for the uses of the adjoining building, then and in such case the person or persons causing the excavations to be made shall, at his or their own expense, preserve such party wall from injury and support the same by proper foundations, so that said party wall shall be and remain practi- cally as safe as before the excavation was commenced. If the person or persons whose duty it shall be to preserve or protect any wall or walls from injury shall neglect or fail so to do after having had a notice of twenty-four hours from the superintendent of buildings, then the superintendent of buildings may enter upon the premises and employ such labor, and furnish such materials, and take such steps as, in his judgment, may be necessary to make the same safe and secure, or to prevent the same from becoming unsafe or dangerons, at the expense of the person or persons last herein
