The Board of Harbor Commissioners, created by ordinance of July 8, 1879, consists of seven mem- bers, six appointed by the Presidents of Select and Common Councils respectively, the seventh being the Chief Engineer and Surveyor of the City.


The Harbor Commissioners duties are to devise and present plans for the preservation and permanent improvement of a harbor for the port of Philadelphia and increase its landing accomodations.

THE GAS WORKS LEASE.


Abstracts from the Ordinance of November 12th, 1897, Leasing the Philadelphia Gas Works to the United Gas Improvement Company.


Lease applies also to the successors of said Co. Term of and right to Lease.


The lease by the City to The U. G. I. Co. to be for 30 years (viz. until Dec. 31, 1927).


May be terminated at the end of 10 years from Jan- uary 1, 1898, by an ordinance passed on or before July 1, 1907.


The Company to exclusively supply the City and citizens, excepting that portion supplied by Northern Liberties Gas Company.

Lease to include all property owned by the City and heretofore employed in manufacture and distribution of gas.


Company to surrender to City the Market Street Works 2 years from date of lease.


Changes, alterations, repairs, etc., during lease to be made by the Company (or lessee) at its own cost.


Right to Sub-let.


Company to have right to sublet lease or privileges thereunder to "The Equitable Illuminating Gas Light Company."


Lease Can be Determined at end of Ten Years.


On termination of lease, whether at end of 10 years, Dec. 31, 1907, or at end of full term of lease. viz. Dec. 31, 1927, the City shall be privileged to purchase sup- plies then on hand.


$15,000,000 to be Expended.


Company to expend $5,000,000 in 3 years following execution of lease for alterations, improvements, ex- tensions and betterments, and $15,000,000 during the 30 years.


Pipe to be Furnished to Consumers.


When one or more consumers for every Ico feet of extension asked for shall first agree in writing to take gas at least one year ; or, a consumer contracting for each and every single building fitted with gas pipe, for which application for gas shall be made, such ex- tension of 100 feet so necessary shall be made accord- ingly. Pipes not to be laid while frost is in the ground.


Service Pipe.


Company, at its own expense, shall lay and furnish service pipe to inside of consumers' property line, supply meters without rent and place stop-cock inside of curb line.


Testing Candle Power of Gas.


Company shall furnish stations for testing candle power of gas, each not less than 1 mile from point of manufacture, and equip same for testing.


All records shall be open for inspection of City. Tests to be made by representative of City (who shall be Inspector of Meters, and Councils shall so provide) appointed by the Mayor.


22 Candle Power Gas to be Supplied.


Company, as soon as possible after obtaining con- trol of the works, shall supply gas of 22 candle power, daily tested average.


Should the Company fail to comply with the tests as to quality and candle power of gas, it shall pay penalty of $500 to City for each day of such failure,

the penalty to be repaid to Company if shown that the fault is beyond its control.


Free Gas for Public Buildings and Streets.


Company shall supply City, without charge, gas for illuminating, delivered to its public buildings along the mains.


Company shall, free of charge, supply gas for street lamps and public squares lighted at beginning of lease, and each succeeding year thereafter shall supply an additional 300 street lamps or in public squares along the line of its mains, and shall clean, extinguish and repair all lamps and posts during the lease.


Price of Gas to Consumers $1.00 per 1000.


The charge to consumers (except the City), shall be $1.00 per 1,000 cubic feet, unless reduced by the enact- ment of an ordinance.'

Price of Gas to City.


The price to the City cannot be below (until Decem- ber 31st, 1907,) 90c .; until December 31st, 1912, 85c. ; until December 31st, 1917, 80c. ; until December 31st, 1927, 75C.


Penalties and Tenants-Cannot Refuse to Serve.


The Company to have the right to charge consum- ers a penalty after 5 days for non-payment of gas bills, but are not privileged to lien for payment of bills.


Company cannot refuse to furnish gas to any subse- quent tenant by reason of prior tenant having failed to pay a bill due, nor will it be required to furnish gas to any person indebted for arrearages for gas theretofore supplied to them.


Disputes as to Bills to be Decided by Inspectors.


To amicably settle disputes, Company to provide convenient places where meters can be inspected as to accuracy of a bill (if disputed) may be demon- strated


On demand of a consumer in writing, made to the Inspector, the Company to remove meter, same to be returned in 24 hours thereafter, bearing report of the Inspector that the meter in question "is correct" or "incorrect."


Whenever a consumer desires a test of meter he shall deposit $t.oo with the Company ; in case meter is found to be false, the $1.00 to be returned to con- sumer, but, if on contrary to the City Treasury.


Meter Inspectors.


The Company at beginning of each year to pay the City $10,000 toward salaries of Inspector of Meters and assistants.

Prior to January 1, 1913, all in excess of 85c. per 1000 cubic feet.

Prior to January 1, 1928, all in excess of 75c. per 1000 cubic feet.


Payment to be made to City of all sums within 25 days after expiration of each year.


Indemnity Against Loss.


During lease Company to indemnify City from all loss or injury arising from the Company's manage- ment.


Disputes between City and Company shall not re- lieve latter from manufacture and sale of gas to citizens.


Company to furnish 21st Ward with gas at same price as other portions of the City.
