The peticoner setting forth in his peticon that whare as Halm wiltbank Recovered Judgment of this Court Agt him for Twenty Thousand pounds of Tobacco for the not giveing him the said Halm wiltbanck possession of the house plantacon Land and premisses that Cornelis Johnson Lives upon According to Contract; And the peticoner setts forth that the sd Halm Wiltbanck had no right at that time to Let the said Land to the peticoner; But that befor that time the said Halm Wiltbanck had sold and delivered the Land and premisses to one John Kurk; therefor the peticoner Craved a Rehearing of the said Cause the Court ordered that the Cause be Rehard the next day that the shreife doe give nooties thereof to the said Halm Wiltbanck that night; the next day upon the Request of the said Halm the Cause is Refered to be Tryd or Rehard the next Court; In december Court it was proved by the oath of Edward Southrin Cor Johnson and his wife; That the said Halm Wiltbanck had sold and delivered possession of the said Land and premisses by Tufe and Twig unto the sd John Kurk; befor the sd Halm Wiltbanck Let to the peticonr the Judg- ment of the Court therefor is that the said Halm Wiltbanck had no Right or power to Let the said Land to the peticoner; And there- fore doe order that the Judgment obtained formerly in this Court Agt the peticoner at the suit of the said Halm Wiltbanck be void and the peticoner sett at Libirty from his Imprisonment; and that the said Halm Wiltbanck doe pay the peticoner his damiages sus- tayned; with Cost of suit; Alias Executcion;

Upon the Complaint of Parritt the Indian Shackamacker Alleadg- ing that Henry Bowman and others takes his Lands and gives him no satisfacon for it; the Court doe therefor order that every person that seate any Land shall pay unto the Indian proprietor for every parcell of Land of six hundred Acres or under one Match Coote and if a bove six hundred Acres Two Match Cootes; And that at the time of the Indian Receiveing the Coote or Cootes to Convey the sd Land to the person that he receive the sd Coote or Cootes of; And if any person doe or shall refuse to pay the Indians for the Land as a forsaid; Executcon to be given out for the same directed to the shreife to Exe- cute and pay to the Indian.
