Annual Town Meeting Monday, March 3, 1941 WARRANT


COMMONWEALTH OF MASSACHUSETTS MIDDLESEX, ss.


To either of the Constables of the Town of Lincoln in said County: GREETING:


In the name of the Commonwealth of Massachusetts, you are hereby required to notify the legal voters of said Town of Lincoln, qualified to vote in Town Meeting for the transaction of Town affairs, to meet in the Town Hall in said Lincoln, on Monday, the third day of March next, at 7.30 o'clock P.M., then and there to act on the following Articles, except Article 1, and also to meet in said Town Hall on Saturday, the eighth day of March next, at 12 o'clock Noon, then and there to act on the following Article 1, by posting a copy of this Warrant, by you attested, in each of the Post Offices, and in some other public place in said Town seven days at least before the third day of March next: The polls for voting the Australian ballot on Saturday, March eighth, will be open at 12 o'clock Noon, and may be closed at 7 o'clock P.M.


Article 1. To bring in their votes for the following Town Officers, and any other Officers required by law, to be elected by Australian Ballot, viz .:


One Moderator for one year.


One Town Clerk for one year.


One member of the Board of Selectmen for three years.


One member of the Board of Assessors for three years. One Treasurer for one year.


One Collector of Taxes for one year.


One Auditor for one year.

Article 2. To bring in their votes for any Committees, Commissioners, Trustees, and other Officers, required by law to be elected by ballot or otherwise.


Article 3. To hear and act upon the reports of Town Officers, Committees, Commissioners and Trustees.


Article 4. To fix the salaries and compensation of the several elective Officers of the Town and to determine whether any Department, Board or Committee shall be authorized to employ for additional compensation any of its members and to fix the additional compensation of such members.


Article 5. To appropriate money for the necessary and expedient purposes of the Town, and enact anything in relation to the same.


Article 6. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1941, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Article 7. To see if the Town will appropriate the sum of $830.30 to pay the County of Middlesex, as required by law, the Town's share of the net cost of the care, maintenance

and repair of the Middlesex County Tuberculosis Hospital, as assessed in accordance with the provisions of Chapter 111 of the General Laws and Acts in amendment thereof and in addition thereto and including Chapter 400, Section 25 G. (6) (a) of the Acts of 1936, or take any action in relation there- to.


Article 8. To see if the Town will authorize the Water Commissioners to renew approximately 2,000 ft. of 4-inch water pipe on Concord Road with an 8-inch main, starting at Gateley's corner, so called, and proceeding in the direction of Wayland, or take any action relative thereto.


Article 9. To see if the Town will vote to purchase a new truck for the Highway Department, appropriate therefor the sum of $2,500.00 from the Machinery Fund, or take any action relative thereto.


Article 10. To see if the Town will vote to appropriate the sum of $2,000.00 to renew the water pipe to the DeCordova Museum and install a hydrant for adequate fire protection, or take any action relative thereto.


Article 11. To see if the Town will appropriate the sum of $4,000.00 for the construction of two tennis courts at the Ball Field, appoint a Committee with full authority to carry out said construction, or take any action relative thereto.


Article 12. To see if the Town will vote to replace the drain on Old Cambridge Turnpike taken out when new Pike was built.


Article 13. To see if the Town will vote to increase the Finance Board to nine members, to direct the Moderator to appoint this year three members for three years, two members for two years, and two members for one year, and three members each year thereafter, or take any action relative thereto.


Article 14. To see if the Town will authorize the Water Commissioners to replace approximately six thousand feet of four-inch water main with ten-inch water main, starting on the Concord Turnpike at Bedford Road, thence along the Old Cambridge Turnpike to Concord Turnpike to the Concord

line, at a cost of approximately $21,000.00, or take any action thereto.


Article 15. To see if the Town will vote to divide the Town into four districts, namely Lincoln Centre, East Lincoln, North Lincoln and South Lincoln, and to elect five Selectmen, at least one Selectman to be elected from each district to serve the Town for a term of three years.


Article 16. To see if the Town will vote to appropriate the sum of two hundred dollars to celebrate the Fourth of July, or take any action relative thereto.


Article 17. To see if the Town will vote to instruct the Selectmen to select a suitable site for public skating in Lincoln, determine upon a means of clearing and flooding such a site regularly, appropriate any money therefor or take any action relative thereto.


Article 18. To see if the Town will vote to authorize the Selectmen to confer with the Department of Public Works in regard to making certain changes in the traffic lights now installed at the intersection of Bedford Road and the Concord Turnpike, or take any action relative thereto.


Article 19. To see if the Town will vote to include certain employees not within the terms "laborers, workmen and mechanics" among those entitled to Workmen's Compensa- tion payment as provided by Section 69, of Chapter 152, General Laws, as amended by Chapter 403, Acts of 1936, or take any action relative thereto.

TOWN CLERK'S REPORT


ANNUAL TOWN MEETING Monday, March 3, 1941


In accordance with the Warrant the meeting was called to order by the Moderator at 7.30 o'clock P.M., the return of the Warrant was read by the Town Clerk, and the Moderator called attention to Article 1 of the Warrant.


Article 2. Voted: That Hermon T. Wheeler and Harold S. Cousins be elected Measurers of Wood and Bark for the ensuing year.


Article 3. Voted: That all reports be accepted with the exception of the following: Finance Committee, Treasurer, School Committee, Building Inspector and Treasurer of Library, after explanation of the printer's error on page 47 relative to the recommendation for the Fire Department, which should read $2,350.00 not $3,350.00 the Finance Com- mittee's report was accepted. After information was requested as to the amount of Free Cash in the Treasury as of today's date, the Treasurer's report was accepted. After a long dis- cussion re. the appropriation of $2,625.00 for heating equip- ment in the South School, estimated under Financial Summary on Page 131 of the Town Report, the report of the School Committee was accepted. The report of the Building In- spector was accepted following a lengthy discussion relative to the granting of a permit for a business building on Cam- bridge Turnpike. The Treasurer of the Library explained the difference in the Librarian's salary on Pages 77 and 110, follow- ing which the report was accepted.


Article 4. Voted: That the salaries of the elective officers of the Town for the current year be fixed at the following amounts respectively :

Voted: That for the appropriations $10,000.00 be taken from Free Cash, $1,000.00 be taken from Overlay Reserve, and $300.00 from Cemetery General Fund, and for Water Works $2,900.00 be taken from the Water Works Treasury, and $13,225.00 from the current years receipts.


Article 6. Voted: That the Town Treasurer, with the approval of the Selectmen, be authorized to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1941, and to issue a note or notes therefor payable within one year, and to renew any note or notes that may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.


Article 7. Voted: That the sum of $830.30, this being the Town's share of the net cost of care, maintenance and repair of the Middlesex County Hospital including interest on tem- porary notes issued therefor and including Chapter 400, Section 25 G (6) (a) of the Acts of 1936, be and the said sum is hereby appropriated.


At this time it was voted to take up Article 19.


Article 19. Voted: That the Superintendent of Streets, Superintendent of Moth and Tree Department, Superin- tendent of the Water Department, Superintendent of Schools, School Teachers, and Clerk of the Board of Selectmen, all the aforesaid being of the Town of Lincoln, be entitled to Workmen's Compensation as provided by Section 69, Chapter 152, General Laws as amended by Chapter 403, Acts of 1936.


At this time it was voted to take up Article 14.


Article 14. A motion that the Town authorize the Water Commissioners to replace approximately 6,000 feet of four- inch water main with ten-inch water main starting on the Concord Turnpike at Bedford Road thence along the Old Cambridge Turnpike to Concord Turnpike to the Concord Line at a cost of approximately $21,000.00, with an amendment added: "and that of this amount the sum of $10,500.00 be taken from Free Cash and the sum of $10,500.00 be raised by bonds," was lost.

Article 8. Voted: That the Water Commissioners be authorized to renew approximately 2,000 feet of four-inch water pipe on Concord Road with an eight-inch main, starting at Gateley's Corner, so called, and proceeding in the direction of Wayland.


Article 9. Voted: That the sum of $2,500.00 be and hereby is appropriated for the purchase of a new truck for the High- way Department, said sum to be taken from the Highway Machinery Fund.


Article 10. Voted: That the sum of $2,000.00 be and hereby is appropriated for the purpose of renewing the water pipe to the DeCordova Museum and installing a hydrant for adequate fire protection, said sum to be taken from Free Cash in the Town Treasury.


Article 11. Voted: That the sum of $4,000.00 be and hereby is appropriated for the construction of two tennis courts at the Ball Field, that the Moderator appoint a com- mittee of three within fourteen days from the date of this meeting with full power to enter contract and do all things necessary and proper within the limits of said $4,000.00 to construct said courts, that the committee make reasonable effort to break ground before June 1, 1941, and any balance left of this appropriation after construction has been com- pleted, be used for the maintenance of said courts under the direction of the Selectmen, said sum of $4,000.00 to be taken from Free Cash in the Town Treasury.


Article 12. A motion "That the Town vote to replace the drain on the Old Cambridge Turnpike taken out when the new Turnpike was built, was withdrawn, it was then Voted: That the Selectmen look further into the situation caused by the present drain pipe on Old Cambridge Turnpike. and take whatever action they may deem reasonable to correct this situation.


Article 13. A motion that the By-Laws be amended by striking out the first three sentences of Section 10, Article 2, and substituting therefor, "We do hereby direct the

Moderator to increase the Finance Board to nine members by appointing within thirty days three members for three years, two members for two years and two members for one year, and three members each year thereafter who shall be residents of the Town and shall hold no other elective Town office," was lost, after an amendment "That the vote be taken by ballot" was lost by Yes 10, No 137.


Article 14. See preceding Article 8.


Article 15. A motion to postpone indefinitely was lost. A motion "That the Town amend the By-Laws by dividing the Town into four districts namely Lincoln Centre, East Lincoln, North Lincoln and South Lincoln and electing five Selectmen at least one Selectman from each district and that the Moderator appoint a committee of nine members to make the division," was withdrawn. A motion "That the Moderator appoint a committee of nine members to look into the matter of districting the Town so that a Selectman can be appointed from a district roughly coinciding with North Lincoln, South Lincoln, East Lincoln and Lincoln Centre, and report at the next Town Meeting," was lost.


Article 16. Voted: That the Town appropriate the sum of $300.00 to celebrate the Fourth of July, and that the Moderator appoint a committee of fifteen for that purpose.


Article 17. Voted: That the Lincoln Planning Board be authorized to work with the School Committee on the problem of public skating in Lincoln, that they select a suitable site, determine upon a means of clearing and flooding such site regularly, and present an estimate of costs to the Town.


At this time Mr. Smith asked for, and obtained the consent of the meeting to take the floor for a few minutes, and spoke of Bill Board Legislation introduced in 1941 by the Massachu- setts Federation of Planning Boards, at the conclusion of his remarks it was


Resolved: That it is the sense of this meeting that the Town will request its Senator and Representative in General Court

to favor the enactment of House Bills 435, 436, 437, and 438 for the further regulating of Outdoor (Billboard) advertising.


Article 18. Voted: To postpone indefinitely.

ANNUAL TOWN ELECTION Saturday, March 8th, 1941


In accordance with Article 1 of the Warrant the meeting was called to order by the Moderator, the ballot box was inspected, and the following Ballot Clerks were duly sworn, Manley B. Boyce, Helena A. Dee, William E. Costello, Bertha V. Bowles, Willis N. Cousins, and William O. Causer, the Polls were declared open at 12 o'clock Noon by the Moderator. At 7 o'clock P.M., the Polls were declared closed. Total num- ber of votes cast, 317, resulting as follows:
