Murphy had had trouble with the Town because of keeping pigs, but that he wanted water for men, horses and hens. The Town's water supply had for several years been inadequate for farm irrigation purposes, and in May, 1941, the water commissioners ordered that all irrigation be limited to one specified hour per day and public notice thereof was given. The notice has not been revoked, or the restriction on the use of water for irrigation lifted. One of the commissioners in- spected Halloran's premises after the hearing of July 28, and found over twelve hundred hogs thereon. The commissioners thereupon notified Halloran that his application for water was denied. Their action was not arbitrary or unreasonable, but was warranted and was taken in good faith and in per- formance of their duty to the inhabitants of the Town.
On the above facts and all the evidence I find that Halloran 1 in July, 1944, established and has ever since conducted on that part of the thirty-five acre tract of land, with the build- ings and structures thereon located in Lincoln, the trade or business of raising hogs; that he is not conducting a farm thereon, or on any other land controlled by him in Lincoln ; and that the business of raising hogs on his land as con- ducted by him is not such an accessory use as is customarily incidental to a farm. (By-Law, Sec. 5(f) (m).) As above re- cited, Murphy's predecessor in title, Connors, was using the land in Lincoln for the conduct of a piggery or raising hogs as a business, and not as a farm, when the by-law became effective July 8, 1929. This was a non-conforming use, and could be continued, if the right to do. so were not lost by dis- continuance for one year (by-law, Sec. 15(d)). In July, 1935, the board of health issued an order prohibiting Connors from carrying on the trade or business of keeping swine on the premises, and he at once filed a petition for trial by jury under G.L. (Ter.Ed.) ch. 111, §§ 143 and 147. On January 21, 1937, the petition for jury was dismissed by consent, Connors having agreed to reduce the number of hogs on the premises to such number as the board of health permitted him to keep. Thereafter, as a result of this proceeding, and of the loss of a contract for the garbage of a city, and of the Federal Government's policy of paying farmers not to raise hogs, Connors reduced his herd until in 1939, it numbered less than twenty. As a permit from the board of health to

keep hogs was not required unless the number to be kept was over twenty-five (Regulation 39) Connors did not, in 1939 or thereafter, apply for a permit, because, as he testified, "I was out of the business." He did not thereafter re-enter it. Connors sold the Lincoln real estate to Murphy in 1941. I find on all the evidence that the non-conforming use made of the premises by Connors was discontinued for over a year beginning in 1939, and that Halloran therefore had no right to reestablish it (by-law, Sec. 15(d)).
Let a decree be entered in accordance with these findings, in the Halloran case, enjoining Halloran, his agents or servants against carrying on in Lincoln, on the premises described in the bill of complaint, the trade or business of raising hogs, and that the defendant pay the plaintiff taxable costs.
Facts established by the evidence of the petitioner in the contempt proceeding are as follows: -
Halloran and Murphy have been acquainted for ten years. They had some business dealings with one another before Halloran bought the Lincoln real estate, and the nine hundred eighty-two hogs from Murphy in June and July, 1944. At Murphy's suggestion, Halloran employed the same lawyer whom Murphy employed, in the sale and purchase transac- tions. (He was not the lawyer who represented Murphy in the Murphy case.) Murphy has received part, and is to re- ceive all, of the payments made or to be made for the real estate and the nine hundred eighty-two hogs. The latter were sold under a conditional bill of sale which requires that the hogs be stabled on the land in Lincoln that Halloran bought of Murphy, and by which title to the hogs remains in Murphy until they are paid for. The bill of sale also provides that if payments are not made as required, or if any of the terms of the sale are not kept, Murphy may enter the premises and repossess the hogs sold, or any acquired thereafter to replace them. Murphy knew that it was Halloran's intention to en- gage in the same kind of business on the same premises, that he had been enjoined against carrying on. He knew that by selling Halloran nine hundred eighty-two hogs, he was aid- ing Halloran in establishing a business that would violate the decree against him. He has a heavy financial stake in the business, which cannot be saved if Halloran were only to

keep pigs as incidental to a farm. Halloran knew when he bought the real estate and the hogs, and engaged in the hog raising business, that that business on those premises had been prohibited by a court order entered against Murphy. Both Murphy and Halloran are guilty of contempt in violating the final decree in the Murphy case, and I so adjudicate. It was admitted that the evidence does not warrant a finding that the corporate respondent is in contempt. The petition against it is ordered dismissed. The petition for attachment for con- tempt is a civil proceeding. On this finding an adjudication that the respondents Halloran and Murphy are in contempt is to be entered. The proceedings in contempt are continued for final disposition until such time as may be fixed by order of court.

A hearing was held before Judge Broadhurst, December 15, 1944, on the contempt issue, referred to in last paragraph above and the defendants were each ordered to pay the Town $500.00 toward costs, which they did. This amount covers the attorney's costs to date. As the case now stands the defendants must remove all pigs from this location by April 1, 1945.

REPORT OF THE FINANCE COMMITTEE
The over-all picture of our finances is much the same as last year. Assets continue to increase because normal ex- penditures are still curtailed through shortages of labor and material. We recommend that the Town continue the policy of maintaining what would be a low peace-time tax-rate and of placing part of its accumulated surplus in a post-war re- habilitation fund. Our budget recommendations are based on this policy and we have placed in the warrant an article for the appropriation of $40,000 of surplus for this purpose.
It is particularly difficult accurately to estimate the tax- rate for 1945 at this time. The budget recommendations and taxation program of the Governor include broad changes in the previous fiscal policy of the Commonwealth. Our esti- mate of a slightly lowered tax-rate is based entirely on the Governor's budget message, and any change in its recommen- dations will be reflected in local tax-rates, up or down as the case may be.
We recommend that the bonus of $2.00 weekly which was voted last year to be paid to our lower salaried employees be $4.00 this year, and we have inserted a budget item computed on that basis.

Cemetery: An increase of $400 made necessary by the re- quirements of the Division of Accounts that receipts on ac- count of work in the cemetery be turned in to the Town Treas- urer instead of being applied directly to the cost of such work.

During the year 1944, four new cases were approved for Old Age Assistance. Two cases were closed. One because of death, one because of support from a relative.
