Annual Town Meeting Monday, March 5th, 1945 WARRANT


COMMONWEALTH OF MASSACHUSETTS MIDDLESEX, ss.


To either of the Constables of the Town of Lincoln in said County: GREETING:


In the name of the Commonwealth,of Massachusetts, you are hereby required to notify the legal voters of said Town of Lincoln, qualified to vote in Town Meeting for the transaction of Town affairs, to meet in the Town Hall in said Lincoln, on Monday, the fifth day of March next at 7.30 o'clock P.M., then and there to act on the following Articles, except Article 1, and also to meet in said Town Hall on Saturday, the tenth day of March, next at 12 o'clock Noon, then and there to act on the following Article 1, by posting a copy of this Warrant, by you attested in each of the Post Offices, and in some other public place in said Town seven days at least before the fifth day of March next. The polls for voting the Australian ballot on Saturday, March tenth, will be open at 12 o'clock Noon, and may be closed at 7 o'clock P.M.


Article 1. To bring in their votes for the following Town Officers and any other officers required by law, to be elected by Australian Ballot, viz .:


One Moderator for one year.


One Town Clerk for one year.


One member of the Board of Selectmen for three years.


One member of the Board of Assessors for three years.


One Treasurer for one year.


One Collector of Taxes for one year.


One Auditor for one year.


One member of the School Committee for three years.

Article 2. To bring in their votes for any committees, commissioners, trustees and other officers, required by law to be elected by ballot or otherwise.


Article 3. To hear and act upon the reports of Town Officers, Committees, Commissioners and Trustees.


Article 4. To fix the salaries and compensation of the several elective officers of the Town and to determine whether any Department, Board or Committee shall be authorized to employ for additional compensation any of its members and to fix the additional compensation of such members.


Article 5. To raise and appropriate money for the neces- sary and expedient purposes of the Town, and enact anything in relation to the same.


Article 6. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1945, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Article 7. To see if the Town will vote to appropriate the sum of $40,000 from free cash for the purchase of war bonds or

other bonds that are legal investments for savings banks, in order to establish a post-war rehabilitation fund, in accord- ance with the provisions of Chapter 5, Acts of 1943, or take any action relative thereto.


Article 8. To see if the Town will accept $12,000 as a gift from Julian DeCordova, Esq., $10,000 of the above sum to be turned over to the Trust Fund Commissioners under the following conditions:


This sum shall be invested and the income shall accumulate . and be invested from time to time. Upon and after my decease the Trust Fund Commissioners shall pay over such amount from the Fund out of income, principal or both, from time to time as the Selectmen in their sole judgment shall requisition for the purpose of making repairs or improvements to and for maintaining and operating the property heretofor conveyed by me to the Town (subject to a life interest in myself) for use of the Town as a Museum and Park, until the fund hereby created is exhausted.


The other $2,000 to be paid in to the General Funds of the Town.


Article 9. To see if the Town will vote to raise and appro- priate the sum of $1,250 due the Commonwealth of Massa- chusetts arising from the accidental death of William H. Ryan, or take any action relative thereto.


Article 10. To see if the Town will authorize the Select- men to repair the buildings on the Pierce property; cost to be defrayed by Robert Pierce under arrangements similar to those proposed under the rental agreement; or if necessary the cost to be defrayed from accumulated income of the John H. Pierce Fund, or take any action relative thereto.


Article 11. To see if the Town will accept as a public way the private road known as Cedar Road as shown on a plan on file in the Land Registration Office being plan numbered 1146 and approved by the Board of Survey of the Town of Lincoln, October 21, 1941, this acceptance being subject to the pay- ment to the Town of an amount sufficient to properly surface the road or take any action relative thereto.

In accordance with the above Warrant the meeting was called to order by the Moderator at 7.30 P.M. The return of the Warrant was read, and the Moderator called attention to Article 1.


Article 2. Voted: That Hermon T. Wheeler and Harold S. Cousins be elected Measurers of Wood and Bark for the ensuing year.


Article 3. Voted: That the reports of the Town Officers, Committees, Commissioners and Trustees be accepted, and that the report of the Committee appointed for studying the needs of the Lincoln schools regarding building facilities and equipment be accepted as an interim report and that the Committee be continued in effect for further consideration of the matter and shall report at the next regular Town meeting or to any earlier meeting called to consider the Committee report.

Article 6. Voted: That the Town Treasurer with the approval of the Selectmen be authorized to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1945, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.

REPORT OF SELECTMEN


REPORT OF BOARD OF SELECTMEN


The Board organized with Sumner Smith as Chairman. Appointments made by the Selectmen during the year are printed with the list of Town Officers.


Bedford and Virginia Roads


Nothing has resulted from this action to date.


The State Department of Public Works is holding a hear- ing on the State Highway Layout in the Towns of Lexington, Lincoln, and Bedford on February 6th.


Courts Cases Settled


The Giles case ended when the objects of violation were cleared away in July, 1945.


Murphy and Halloran removed all the pigs by April 1, 1945, and this case was ended.


Fire Chief Resigns


Matthew H. Doherty, who has given many years of valu- able and co-operative service to the Town as Chief of the Fire Department resigned the first of the year because he did not think it sensible for personal reasons to assume the responsi- bility longer, but generously agreed to act until a successor was appointed. The Selectmen appoint the fire engineers, and the latter in turn elect their Chief.


De Cordova Estate


Julian DeCordova gave his Lincoln land, buildings and contents to the Town on November 29, 1930, subject to his own life interest. Upon his death November 26th last, the Town came into actual possession of this property and the Selectmen immediately, but temporarily, covered the con- tents against fire for $250,000. The buildings have been in- sured for $100,000, but the insurance companies have been reluctant to cover the contents permanently without an accurately described inventory and expert appraisal. To ob- tain such an appraisal of the contents of thousands of pieces would cost high, how high no one will estimate, but probably over $10,000. Since the Selectmen have certain restricted

rights to sell the contents, and buy more specimens, the prin- ciple of screening the contents to keep the best pieces and dispose of the balance was considered. An art expert, who already was quite familiar with the property examined the contents and submitted the enclosed report.


The Selectmen fully realize the responsibility of trying to develop this gift into something useful, interesting, and val- uable and much consideration must be given even the slight- est move to prevent making a mistake that cannot be rectified. For this reason the Board will welcome communications and will be glad to hold meetings or give interviews to all who de- sire information or have constructive ideas to propose on this DeCordova and Dana Memorial.


The present market value of the collateral from which the Town will in time receive income for the benefit of the mu- seum, buildings, and grounds is about $1,800,000, from which will be deducted legacies and expenses. Maintenance of the property is now being charged to funds Mr. DeCordova gave the Town for that purpose.
