Annual Town Meeting Monday, March 2, 1942 WARRANT


COMMONWEALTH OF MASSACHUSETTS MIDDLESEX, ss.


To either of the Constables of the Town of Lincoln in said County: GREETING:


In the name of the Commonwealth of Massachusetts, you are hereby required to notify the legal voters of said Town of Lincoln, qualified to vote in Town Meeting for the transaction of Town affairs, to meet in the Town Hall in said Lincoln on Monday, the second day of March next at 7.30 o'clock P.M., then and there to act on the following Articles, except Article 1, and also to meet in said Town Hall on Saturday the seventh day of March next, at 12 o'clock Noon, then and there to act on the following Article 1, by posting a copy of this Warrant by you attested, in each of the Post Offices, and in some other public place in said Town seven days at least before the second day of March next. The polls for voting the Aus- tralian ballot on Saturday March seventh, will be open at 12 o'clock Noon, and may be closed at 7 o'clock P.M.


Article 1. To bring in their votes for the following Town Officers, and any other Officers required by law, to be elected by Australian Ballot, viz:


One Moderator for one year.


One Town Clerk for one year.


One member of the Board of Selectmen for three years.


One member of the board of Assessors for three years.


One Treasurer for one year.


One Collector of Taxes for one year.


One Auditor for one year.

Article 2. To bring in their votes for any committees, commissioners, trustees and other officers required by law to be elected by ballot or otherwise.


Article 3. To hear and act upon the report of the Town Officers, Committees, Commissioners and Trustees.


Article 4. To fix the salaries and compensation of the several elective officers of the Town, and to determine whether any departments, Board or Committees shall be authorized to employ for additional compensation any of its members, and to fix the additional compensation of such members.


Article 5. To appropriate money for the necessary and expedient purposes of the Town and enact anything in rela- tion to the same.


Article 6. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1942, and to issue a note or notes therefore, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance Section 17, Chapter 44, General Laws.


Article 7. To see if the Town will appropriate the sum of $963.14 to pay the County of Middlesex, as required by law

the Town's share of the net cost of care, maintenance and repair of the Middlesex County Tuberculosis Hospital in- curred in the year 1941, or take any action relative thereto.


Article 8. To see if the Town will appropriate the sum of $600.00 from the Machinery Fund for the purchase of a pick-up truck for the Highway Department or take any action relative thereto.


Article 9. To see if the Town will appropriate the sum of $1,000.00 for expenses of the Lincoln Committee on Public Safety, the expenditure of this appropriation to be under the direction of the Board of Selectmen, or take any action rela- tive thereto.


Article 10. To see if the Town will appropriate the sum. of seventy-five dollars or some other sum to be used for clear- ing an area for an ice skating rink and maintaining the rink during the year 1942 or take any action relative thereto.


Article 11. To see if the Town will authorize the School Committee to make necessary repairs to the heating and ventilating equipment at the Center School, appropriate money therefor or take any action relative thereto.


Article 12. To see if the Town will vote to raise and appropriate a sum of money for the purpose of establishing an additional system for supplying the Town of Lincoln and its inhabitants with water, authorize the Water Commissioners to acquire water sources, necessary land and water flowage rights and to construct pumping station, install pumping equipment and lay necessary water mains, enter into contract for the construction of said system, and to authorize the Treasurer, with the approval of the Selectmen, to borrow such sums as may be necessary to meet any appropriation made and to use any other available funds that may be raised by taxation or appropriated for that purpose or take any action relative thereto.


Article 13. To see if the Town will vote to appropriate the sum of four hundred and fifty dollars to provide summer playground activities in the Town this year or take any action relative thereto.

Article 14. To see if the Town will accept as a public way the private road known as Beaver Pond Road as shown on map dated June 16th, 1941, prepared by Everett Brooks, Civil Engineer, Newtonville, and approved by the Town of Lincoln, Planning Board on July 26th, 1941, or take any action relative thereto.


Article 15. To see if the Town will vote that the Select- men be authorized to appoint one or more Constables each year instead of electing two Constables each year by ballot as at present, or take any action relative thereto.


Article 16. To see if the Town will vote to investigate the used car business of Thomas T. Giles on Concord Road with respect its legality under the Zoning By-Laws of the Town, appoint a Committee, appropriate money, or take any other action on the matter.


Article 17. To see if the Town will appropriate two hundred and fifty dollars for the proper observance of Me- morial Day, to be expended by Lincoln Post No. 84 American Legion, Inc.


Article 18. To see if the Town will vote to celebrate the Fourth of July, appropriate money therefor, appoint a Com- mittee or take any action relative thereto.

Voted: That the Town Treasurer with the approval of the Selectmen, be authorized to borrow money from time to time, in anticipation of the revenue of the finan- cial year beginning January 1, 1942, and to issue a note or notes therefor payable within one year and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17 Chapter 44, General Laws.

Article 9. Voted: That the sum of $1,000.00 be appro- priated for the expenses of the Lincoln Public Safety Com- mittee, the expenditure of this appropriation to be under the direction of the Board of Selectmen.


Article 10. Voted: That the sum of $75.00 be appro- priated for the clearing of an area for an ice skating rink and maintaining the rink during the year 1942, said sum to be expended under the direction of the Board of Selectmen.


Article 11. Voted: That the sum of $4,600.00 be appro- priated for the repairs of the heating and ventilating system at the Center School.


Article 12. Voted: That the sum of $1,000.00 be appro- priated to be expended under the direction of the Water Commissioners for the further exploration of the advantages and possible use of Wellhead Brook, and the South Lincoln site back of Mr. P. Lennon's, as a source of water for the Town.


Article 13. Voted: That the Town appropriate the sum of $450.00 to carry on summer playground activities in the Town during the coming year, and that the Moderator ap- point a Committee of three with full authority to expend said sum, and plan and supervise such activities during the coming year.


Article 14. Voted: That the Town accept as a public way the private road known as Beaver Pond Road as shown on plan dated June 16, 1941, prepared by Everett Brooks, Civil Engineer, Newtonville, on file with the Town Clerk, and that a certified check in the amount of $500.00 be de- posited.


Article 15. Voted: That beginning with the year 1943 the Selectmen be authorized to appoint one or more Con- stables each year instead of electing two Constables each year by ballot.

Article 16. Voted: That the Selectmen be instructed to investigate the subject matter of the Article to enforce the Zoning By-laws and that the sum of $250.00 be appropriated for that purpose.


Article 17. A motion to appropriate $250.00 was lost.


Article 18. Voted: That the sum of $75.00 be appropri- ated to celebrate the Fourth of July, and that the Moderator appoint a committee.

A meeting of the officers qualified to elect a Selectman to fill the unexpired term of John Todd, he having entered the U. S. Army, was held on the above date, present Sumner Smith, Herbert G. Farrar, Donald P. Donaldson, Warwick V. Harris and William H. Davis. Five ballots were cast all for Albert A. Schaal of Concord Road, South Lincoln. Mr. Schaal qualified April 27th, 1942.

Article 2. To see if the Town will appropriate the sum of $4,604.04 to pay to the County of Middlesex, as required by law, the amount of the judgment obtained by Edward F. Flint for damages caused by the laying-out of Lexington Road.


Article 3. To see if the Town will appropriate a sum of money to the Miscellaneous Account to be expended for (1) Expenses incurred in connection with the trial of the case of Edward F. Flint vs. The County of Middlesex (2) Equipment and supplies required by the Rationing Board and (3) Sup- plies for the several Town Officers.

Rooney if and when the Selectmen shall receive such properly executed in- struments as may be necessary to release the Town, its Offi- cers, agents and servants from any and all liability growing out of said accident, and $360.00 to be expended for legal fees and expenses incurred by the Town in this case.

treatment or prescription given to married persons for pro- tection of life or health by or under the direction of registered physicians nor to teaching in chartered medical schools nor to publication or sale of medical treatises or journals, which was disapproved in the House of Representatives by a vote of 77 in the affirmative and 133 in the negative, and in the Senate by a vote of 16 in the affirmative and 18 in the nega- tive, be approved?

To obtain a full expression of opinion, voters should vote on all three of the following questions: (a) If a voter desires to permit the sale in this Town of any and all alcoholic bev- erages to be drunk on and off the premises where sold he will vote "yes" on all three questions. (b) If he desires to permit the sale herein of wine and malt beverages only to be drunk on and off the premises where sold he will vote "No" on question one, "Yes" on question two and "No" on question three. (c) If he desires to permit the sale herein of all alco- holic beverages, but only in packages, so called, not to be drunk on the premises where sold, he will vote "No" on ques- tions one and two and "Yes" on question three. (d) If he desires to permit the sale herein of wines and malt beverages to be drunk on and off the premises where sold and in addi- tion other alcoholic beverages but only in packages, so called, not to be drunk on the premises where sold, he will vote "No" on question one, and "Yes" on questions two and three. (e) If he desires to prohibit the sale herein of any and all alcoholic beverages whether to be drunk on or off the premises where sold, he will vote "No" on all three questions.
