SELECTMEN'S REPORT


REPORT OF THE BOARD OF SELECTMEN FOR 1940


Your Selectmen have thought that a report of the major accomplishments achieved during the decade just passed might be of interest to the taxpayers and citizens of the Town, for these accomplishments represent your investments in the Civic and Physical well being of this municipality.


Ten years ago, although we did not fully realize it, we were entering upon the longest period of depression our Country has ever known, and whatever has been achieved during this period has been the more difficult because of these conditions. We would record the following items as those most worthy of note:


The building and equipment of the new High School, construction of Edward Foster Bridge, building of the new Town Pier, development of the Harbor Parking Space into one of the finest in any Town of comparable size in the State; purchase and construction of Peggotty Beach Parking Space, and purchase of the Sand Hills bathing Beach and parking space. Improvements through collaboration with the State and Federal Governments of Scituate Harbor which has resulted in increasing the available anchorage area by more than three hundred percent, with greatly added safety offered by the construction of a new jetty and repair of the old one; construction of shore protective measure through State cooperation; improvement of our Fire Department by the building of the Brook Street Fire Station, the purchase of the Seagrave Ladder Truck, a Forest Fire Truck and many additional miles of Fire Alarm Circuits. The building of over six miles of new roads, construction of a Recreational Field at North Scituate and the inauguration of a garbage collection service. The purchase and maintenance of a public am- bulance, and the purchase and improvement of the Road Barns at Egypt. The total cost of these improvements amount to approximately $800,000.00 of which about half was supplied by the Town of Scituate and half by the Federal Govern- ment, Commonwealth of Massachusetts and the County of Plymouth.


Another matter which should afford us much gratification is that during this decade, while many other cities and towns increased their indebtedness to meet exceptional Welfare costs, Scituate has reduced its funded debt, other than the Water Debt, from $165,000.00 in 1930 to $23,300.00 as of December 31st, 1940.


Perhaps the most important event of the past decade was the purchase by the Town of the Scituate Water Company in 1931 at an approximate cost of $750,000.00 and for which the Town gave its Bonds in payment therefor, the same to be paid for with interest within thirty years from date of purchase. We believe this action of the Town to have been the greatest single step in our Municipal History. Under Municipal ownership since 1931 and operated by a Board of Water Commissioners this Department has not only increased its value by extension and improvement by over $200,000.00, paid all interest charges and retired $264,590.00 of its bonded indebtedness and paid all operating expense,

but has actually reduced its domestic rates over those in effect at the time of purchase to the extent of an annual saving to the water consumers of Scituate of $36,075.00 and a reduction in hydrant rental of twenty-eight dollars per hydrant.


We hope this resume of the major investments which you as citizens and taxpayers of Scituate have made has been of interest to those who may read this report, and as your Selectmen, congratulate you on the broad and unselfish spirit of civic pride and sacrifice on your part that has made this program possible.

REPORT OF THE TOWN CLERK ANNUAL TOWN MEETING March 4, 1940


At a legal meeting of the inhabitants of the Town of Scituate qualified to vote in Elections and Town Affairs held at the High School Auditorium in said Scituate on Monday the fourth day of March, 1940 at seven o'clock P. M .; order was called by Moderator Dennis H. Shea.


The warrant was read by Town Clerk William M. Wade.


Tellers appointed by the Moderator and sworn to their duties by the Town Clerk: C. Harry Driscoll, George F. Dwyer, Ernest B. Nord, J. George Vollmer, Eugene H. Lane, Kenmure W. Moffatt, Frank W. Clapp, George W. Murphy, Thomas W. Macy.


ARTICLE I


To choose all the necessary Town Officers other than those elected by ballot, viz: Surveyor of Lumber, Measurer of Wood and Bark, two or more Field Drivers, one Pound Keeper.

ARTICLE 2


To hear the report of the Selectmen or other Town Officers and standing Committees, and act thereon.


VOTED: To accept reports of Town Officers as printed in the Town Report.


ARTICLE 3


Will the Town vote to establish salaries and compensation of all elected Town Officers, or act thereon. The following salaries are recommended:


Selectmen: Chairman $1800.00 and legitimate expenses. Other members $540.00 each and legitimate expenses.


Public Welfare: Chairman $450.00 and legitimate expenses. Other members


$100.00 each and legitimate expenses.


Assessors: Chairman, $1800.00 and legitimate expenses. Other members $450.00 each and legitimate expenses.


Highway Surveyor: $2200.00 he to furnish his own conveyance in the per- formance of his duties and to receive $250.00 to cover expense of same.


Town Collector: $2000.00 and legitimate expenses. All fees to accrue to the benefit of the Town.


Town Treasurer: $1800.00 and legitimate expenses.

Park Commissioners: Recommended that each member be paid the same amount for work actually performed as is paid laborers in the Highway Department.


Water Commissioners: $180.00 each and legitimate expenses, to be taken from the Water Department Budget.


Moderator: $100 per annum.

ARTICLE 5


To see if the Town will vote to authorize the Town Treasurer, with the ap- proval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year, beginning January 1st, 1941, and to issue a note or notes therefor, payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws. -Selectmen.


VOTED: That the Town do authorize the Town Treasurer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year, beginning January 1, 1941, and to issue a note or notes therefor, payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws -Unanimous vote.


ARTICLE 6


To see if the Town will adopt the following by-law: The Board of Public Welfare may contract in their discretion for the relief, support and employment of the town's poor and indigent persons. -Public Welfare.

TOWN CLERK'S REPORT


The report of the committee authorized to make a survey of the medical, nursing and hospitalization costs of the Town of Scituate was accepted and it was voted to file with the Town Clerk; that the committee be discharged and that the Selectmen be directed to establish a Community Health Council with the membership, function and authority as recommended in this report.


The committee on the subject of Elementary Schools submitted its report and it was voted to accept and place on file, and the committee be discharged with thanks.


The committee on the subject of snow removal made a brief report. It was voted to accept and file with the Town Clerk and that the Committee be continued with instructions to report at a future meeting but not later than the 1941 Annual Meeting.


ARTICLE 8


To see what sum of money the Town will vote to transfer from the Excess and Deficiency Account to be used by the Assessors in reducing the taxes for the current year.

ARTICLE 11


To see if the Town will amend Section 5 of Article 1 of the Town By-Laws, so that as amended it will read as follows:


Section 5. All motions shall be submitted in writing at the discretion of the Moderator or Clerk. If a motion for reconsideration of a vote is made upon any question acted upon at a previous session of the same town meeting, a two- thirds vote shall be required to reopen the question.

ARTICLE 12


Will the Town add to Sections 1 and 2 of its Zoning By-Laws the following paragraph: The boundary lines between said Zones A and Zones B shall be as shown upon plans on file with the Town Clerk entitled: "Detail Plans of Zone B Areas, etc., January, 1939; Daniel Appleton, Town Engineer." -Town Counsel


VOTED: To accept the addition to Section 1 and 2 of its Zoning By-Laws. -Unanimous vote.

TOWN CLERK'S REPORT


ARTICLE 13


Will the Town vote to rescind its By-Laws establishing an Advisory Board and adopt the following By-Law in order to comply with the General Laws, Chapter 39, Section 16, Tercentenary Edition, or act thereon:


BY-LAW


Section 1. There shall be established an Advisory Committee for the Town, which shall perform duties as set forth in the following sections of this article and be governed by the provisions of General Laws. Said Committee shall consist of nine citizens of the Town, which committee shall be appointed as provided in the following section, and no person holding an elective or appointive town office or receiving a salary from the said Town shall be eligible to serve on said committee.


Section 2. Immediately upon taking effect of this by-law the Moderator shall appoint from the citizens of the Town three members whose term of office shall expire at the dissolution of the annual town meeting of 1943, three members whose term of office shall expire at the dissolution of the annual town meeting of 1942, three members whose term of office shall expire at the dissolution of the annual town meeting of 1941; and at each annual meeting thereafter the Moderator thereof shall fill vacancies occurring in this office. Said committee shall choose its own officers and serve without pay. Said committee shall cause to be kept a true record of its proceedings and annual file a copy in the office of the Town Clerk.


Section 3. To this committee shall be referred all articles in any warrant for town meeting hereafter issued. The Selectmen, after drawing any warrant for a town meeting, shall transmit immediately a copy thereof to the Advisory Committee, and said committee shall consider all articles therein and shall report thereon in print or otherwise, to the town meeting such recommendations as it deems to be for the best interest of the Town. Upon written request a reasonable time in advance the Advisory Committee shall grant a hearing to the petitioners for any articles, before making recommendations.


Section 4. The Advisory Committee shall require the Selectmen and otlier Town Officers, under whose direction, appropriations of money are expended, to submit to them, at least thirty days before the annual town meeting, an estimate of the appropriations necessary to be made for their various departments, and to come before them for consultation regarding the same, at such times and places as said committee shall determine. A public hearing may be held upon all ar- ticles due notice of which is to be given to the citizens. The Advisory Committee shall state the amounts which in its opinion shall be appropriated for the ensuing year, and sliall add thereto such explanations and suggestions in relation to the proposed appropriations as it deems expedient and report thereon as provided in section three.
