Section 5. Whenever any vacancy shall occur in said committee by any cause, said vacancy shall be filled by the Moderator. Five members of the Com- mittee shall constitute a quorum for the transaction of business and if any member is absent from five consecutive meetings of said Committee, except in cases of illness, said Committee may consider his position vacant and report such vacancy to the Moderator who shall proceed to fill the same. The term of office of any person appointed as aforesaid to fill a vacancy shall be for the unexpired term of the person whom he succeeds.


Section 6. The Advisory Board heretofore established by vote of the Townl is discharged upon qualification of the new Committee hereby established. -Advisory Board.

ARTICLE 14


Will the Town vote to rescind Article 4 of the Special Town meeting January 4, 1908 which reads as follows: Voted to accept Section 339 of Chapter 11 of the revised laws. Beginning at the annual meeting to be held March, 1908, to elect a Selectman and Overseer of the Poor, one for three years, one for two years, and one for one year, and at each annual meeting thereafter elect one for three years? -James H. To see if the Town will raise and appropriate $20,000.00 to be administered by the Selectmen as a general unemployment relief fund for the Town's share of materials, trucking, and other necessary expenses in connection with Federal

ARTICLE 20


To see if the Town will raise and appropriate the sum of $4000.00 to be used in conjunction with such sum as the Department of Public Works shall authorize for General Shore protection. ARTICLE 21


To see if the Town will assume liability in the manner provided by section 29 of Chapter 91 of the General Laws for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, development, maintenance and protection of rivers, harbors, tide waters and foreshores, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Selectmen to execute and deliver a bond of in- demnity therefor to the Commonwealth. -Selectmen.

ARTICLE 27


To see if the Town will raise and appropriate $6500.00 for the purchase of land at the Sand Hills so-called for a public bathing beach, playground, and re- creational center, and provide for the administration of said bathing beach, play- ground, and recreational center under the provisions of G. L., Ch. 45, s. 14; said land being bounded and described as follows:


Being the land described in deed dated April 22, 1937 and recorded in the Plymouth County Registry of Deeds, Book 1725, page 138, excepting that portion on the land side of the sea wall adjoining Lots 1 to 30 inclusive, and excepting the Dumping Ground so-called and described therein, said latter parcel to be deeded to the Town by the grantor free of charge, to be used as a parking space for the benefit of the inhabitants of Scituate, and so restricted by said grantor in deed given to Town of Scituate. ARTICLE 28


. Will the Town authorize the Selectmen to contract for the part time services of a Public Health Nurse to be employed under the direction of the Board of Health, Board of Public Welfare and the School Committee, and raise and ap- propriate the sum of $1,600.00 for payment of said employment and the sum of $1,280.00 to cover the cost of clerical assistance and transportation necessary in connection with said service, or act thereon? -Selectmen.

ARTICLE 29


To see if the Town will vote to authorize the School Committee to secure detailed plans and specifications for an addition or additions to the present high school building, such an addition or additions to increase the floor space of said building, and to raise and appropriate the sum of two thousand dollars ($2,000.00) for the expense of the School Committee for this purpose, or act thereon.

ARTICLE 30


To see if the Town will raise and appropriate the sum of $500.00 to meet the cost of operation of the Federal Commodities office or act thereon. -Board of Public Welfare.

ARTICLE 31


To see if the Town will vote to transfer the Dog Fund received from the County to either the Schools or Libraries, or act thereon. -Selectmen.


VOTED: That the proceeds of the Dog Fund be divided equally between the Pierce Memorial Library and the Allen Memorial Library.


ARTICLE 32


To see if the Town will appropriate from funds in the Treasury the amount earned by or appropriated for the Water Department, and a sum of money equal to but not exceeding the amount of water revenue, to meet the payments for bonds, interest, operation and improvement of the Water Department for the ensuing year, or take action relative thereto. -Water Commissioners.


VOTED: That the Town appropriate from funds in the Treasury, the amount earned by or appropriated for the Water Department, and a sum of money equal to, but not exceeding the amount of water revenue for the ensuing year, for the use of the Water Department as follows: For payment of bonds, $33,000.00; for interest on water bonds, $22,701.25; for maintenance, operation and improvement of the Water Department, the actual balance of the water revenue to be received, now estimated to be $35,104.72. -Unanimous vote.


It was voted to accept the following resolution:


Resolved that our Selectmen look into the telephone situation regarding the enlarging of the present area for amount paid.


ARTICLE 33


To see if the Town will raise and appropriate the sum of $1200.00 to provide payment of a pension of $100.00 per month from January 1, 1940 to December 31, 1940, to the widow and child of the late Officer Edward W. Carson as certified by the Selectmen and in accordance with the provisions of Chapter 32, Section 89 of General Laws as amended by Chapter 326, Acts of 1936, or act thereon.

ARTICLE 34


To see if the Town will appropriate the sum of $2000.00 for the purchase of a new ambulance, or act thereon. -Selectmen.

ARTICLE 36


To see if the Town will raise and appropriate the sum of five hundred dollars ($500.00) for a series of seven band concerts to be given during the months of July and August 1940 or act thereon. -Satuit Band, Louis O. Haartz, President.

ARTICLE 37


To see what sum the Town will appropriate or what action the Town will take in caring for the graves of veterans in the 'several cemeteries in the Town, in accordance with the provisions of the General Laws, Chapter 115 (Ter. Ed.) Section 22. -Samuel A. Agnew, Pres. Groveland Cemetery Corp.

ARTICLE 38


To see if the Town will raise and appropriate the sum of $350.00 for the purpose of providing quarters for the Satuit Post 3169 Veterans of Foreign Wars in accordance with the provisions of General Laws Chapter 40, (Ter. Ed.) Section 9, or act thereon. -Elmer F. Ramsdell, Adjutant.

ARTICLE 39


Will the Town raise and appropriate the sum of $250.00 for the annual clean up and appoint a committee to have charge of same, or act thereon? -Scituate Clean Up Committee.


VOTED: To raise and appropriate $250.00 for the annual clean-up and ap- point the following committee to have charge of the same: Rev. Allan D. Creelman, Louise J. Rothery, Philip L. Schuyler.


ARTICLE 40


Will the Town raise and appropriate the sum of One Thousand Dollars ($1,000.00) to be expended under the direction of the Board of Health to do ad- ditional work necessary for the eradication of a health menace in and around Musquashicut Pond, as recommended by the State Department of Health and the Department of Public Works, or act thereon? -Board of Health.


VOTED: To raise and appropriate $1,000.00.


ARTICLE 41


To see if the Town will raise and appropriate the sum of $2,400.00 to cover the cost of supervision and control of the clam flats within the Town of Scituate, or act thereon .. -Selectmen.

ARTICLE 42


To see if the Town will accept the layout of the Selectmen, widening the Country Way from a point near the residence of Frederica Wade to a point near the residence of Mrs. Frances S. Lincoln, said widening to be made on the westerly side of the Country Way as on file with the Town Clerk, and raise and appropriate a sum of money to pay the costs of land damage occasioned thereby, or act thereon. -Selectmen.

VOTED: That the Town accept the layout of the Selectmen widening the Country Way from a point near the residence of Frederica Wade to a point near the residence of Mrs. Frances Lincoln as described in plan on file with the Town Clerk and raise and appropriate the sum of $50.00 to cover the cost of land damage.


ARTICLE 43


To see if the Town will raise and appropriate the sum of $3,000.00 to be used in conjunction with such sums as the County of Plymouth and the Department of Public Works of the Commonwealth of Massachusetts may allocate for the purpose of reconstructing under provisions of Chapter 90 of the General Laws a section of the Country Way lying between the junction of said Country Way with Elm Street and a point near the residence of Frances S. Lincoln, or act thereon. -Selectmen.


VOTED: That the Town raise and appropriate the sum of $3,000.00 to be used in conjunction with such sums as the Department of Public Works and the Plymouth County Commissioners may allocate for the purpose of reconstructing under Chapter 90 of the General Laws a section of the Country Way lying between the junction of said Country Way and Elm Street and a point near the residence of Mrs. Frances Lincoln. -Unanimous vote.


ARTICLE 44


Will the Town raise and appropriate the sum of $1,000.00 to be used in conjunction with such sums as the County of Plymouth and the Department of Public Works of the Commonwealth of Massachusetts shall allocate in the further maintenance of Gannett Road. -Selectmen.


VOTED: That the Town raise and appropriate the sum of $1,000.00 to be used in conjunction with such sums as the Plymouth County Commissioners and the Department of Public Works of Massachusetts may allocate in the further maintenance of Gannett Road. -Unanimous vote.


ARTICLE 45


To see if the Town will accept the layout of the Selectmen, of Mary's Lane so called, and a part of Boardman Avenue as Town Ways, in accordance with plans on file with the Town Clerk, and raise and appropriate a sum of money to provide for construction of the same, or act thereon. -Selectmen.


VOTED: That the Town accept the layout of the Selectmen of Mary's Lane, so-called, and a part of Boardman Avenue as Town Ways, in accordance with plans on file with the Town Clerk and raise and appropriate the sum of $1,740.00 to cover the cost of construction. -Unanimous vote.


ARTICLE 46


To see if the Town will accept the layout of the Selectmen as it extends Mitchell Avenue from its present terminus near the Minot Fire Station to connect with Pond View Avenue in accordance with plans on file at the Town Clerk's office, and raise and appropriate a sum of money for the construction of said extension, or act thereon. -Selectmen.


VOTED: That the Town accept the layout of the Selectmen as it extends Mitchell Avenue from its present terminus near the Minot Fire Station to connect with Pond View Avenue as a Public Way in accordance with plans now on file with the Town Clerk and raise and appropriate the sum of $1,200.00 for the purpose of constructing the same. -Unanimous vote.

ARTICLE 47


To see if the Town will accept the layout of the Selectmen of a way running southerly from Ann Vinal Road starting at a point near the residence of Harry H. Hardcastle and running in a southerly direction to a point near the right of way of the Old Colony Railroad, all as laid out on a plan on file at the office of the Town Clerk, and raise and appropriate a sum of money to cover the cost of construction of said way, or act thereon. -Selectmen.


VOTED: That the Town accept the layout of the Selectmen of a way running Southerly from Ann Vinal Road starting at a point near the residence of Harry H. Hardcastle to a point near the Right of Way of the Old Colony Railroad as a Town Way in accordance with plan on file with the Town Clerk and raise and appropriate the sum of $1,500.00 to cover the cost of construction.


-Unanimous vote.


ARTICLE 48


To see if the Town will accept the layout of the Selectmen, of a way starting near the building on Union Street formerly known as the old Webb. store and running in a Northerly direction to and into the land of John S. Fitts, in accordance with plans now on file at the office of the Town Clerk, and raise and appropriate a sum of money to cover the costs of land damage and construction, or act thereon. -Selectmen.


VOTED: That the Town accept the layout of the Selectmen of a Public Way starting near the bulding on Union Street formerly known as the Old Webb Store and running in a Northerly direction into the land of John S. Fitts in ac- cordance with plan on file with the Town Clerk and raise and appropriate the sum of $1,600.00 to cover the cost of construction and land damage.

ARTICLE 49


To see if the Town will accept the layout of the Selectmen at the Easterly end of Greenfield Lane in accordance with plans now on file at the office of the Town Clerk, and raise and appropriate a sum of money to cover the costs of land damage and construction, or act thereon. -Selectmen.


VOTED: That the Town accept the layout of the Selectmen widening Green- field Lane at its Easterly terminus as on file with the Town Clerk and raise and appropriate the sum of $200.00 to cover cost of construction and land damage.


ARTICLE 50


To see if the Town will raise and appropriate the sum of $200.00 to grade the bank in front of the residence of Walter C. Piper. This work made necessary on account of the regrading of Crescent Avenue, or act thereon. -Selectmen. VOTED: To raise and appropriate $200.00.


ARTICLE 51


To see if the Town will accept the layout of the Selectmen as it widens Old Oaken Bucket Road at the curve near the residence of the late Davis Damon, in accordance with plans on file in the office of the Town Clerk, and raise and appropriate the sum of $40.00 to cover the cost of land damage, or act thereon.

ARTICLE 52


To see if the Town will accept the layout of the Selectmen at the intersection of Turner and Tilden Roads and the widening of Tilden Road on the Westerly side near said intersection in accordance with plan on file at the office of the Town Clerk, and raise and appropriate a sum of money to provide for the costs of construction and land damage, or act thereon. -Selectmcn.


VOTED: That the Town accept the layout of the Sclectmen at the inter- section of Turner and Tilden Roads and the widening of Tilden Road on the Westerly side near said intersection in accordance with plans on file with the Town Clerk, and raise and appropriate the sum of $1,075.00 to cover cost of construction and land damage. -Unanimous vote.


ARTICLE 53


To sec if the Town will raise and appropriate the sum of $200.00 for the improvement of the Minot Parking Space, or act thereon. -Selectmen.

ARTICLE 54


To see if the Town will vote to establish a Road Machinery Account, to which shall be credited all receipts received for the use or rental of road machinery, the proceeds to be appropriated as voted by the Town for road machinery pur- poses, or take any action relative thereto. -- Selectmen.

ARTICLE 55

ARTICLE 56

Otis and running in a Northerly direction to a point near the Old Lincoln Mill, so-called, on said Mordecai Lincoln Road, or act thereon? -Mark Googins, et al.
