Annual Town Meeting


February 8, 1941


Annual Town Meeting assembled in the Auditorium of the High School at one o'clock P.M. according to the call of the Warrant, which was read by the Town Clerk, and under


Article 1. To choose two or more Fence Viewers, and two or more Field Drivers.


William H. Lester and James W. Cesan were chosen as Fence Viewers.


William S. Halladay and George H. Reed were chosen as Field Drivers.


Article 2. To hear and act upon the reports of the Town Officers.


Voted: To accept reports as printed, errors and omissions excepted.


Article 3. To see what method the Town will adopt for the support of Public Welfare for the ensuing year.


Voted: To leave support of Public Welfare in the hands of the Board of Public Welfare.


Article 4. To see if the Town will appropriate a sum of money for the proper observance of Memorial Day, and provide for its expenditure.


Voted: To appropriate the sum of $150. for Memorial Day, to be spent in the usual manner.


Article 5. To see if the Town will appropriate a sum of money for the payment of a proper charge of an Insurance Company for acting as surety on the official bond of its officers.


Voted: To appropriate the sum of $650. for Surety Bonds.

Article 6. To see if the Town will appropriate a sum of money for Liability Insurance of its employees.


Voted: To appropriate the sum of $750. for Liability Insurance.


Article 7. To see if the Town will appropriate a sum of money for employment of a District Nurse.


Voted: To appropriate the sum of $2,350. for employ- ment of a District Nurse.


Article 8. To see if the Town will appropriate a sum of money for enforcement of the Dog Law.


Voted: To appropriate the sum of $200. for enforcement of the Dog Law.


Article 9. To see if the Town will appropriate the sum of $100. to be expended in the Town of Agawam by the Hampden County Trustees for Aid to Agriculture in accordance with the provisions of the laws of the Commonwealth.


Voted: To appropriate the sum of $100. to be expended in Town by the Hampden County Trustees for Aid to Agri- culture.


Article 10. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time, in anticipation of the revenue of the financial year beginning January 1, 1941 and to issue a note or notes therefore, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44 of the General Laws.


Voted: That the Town Treasurer with the approval of the Selectmen be and hereby is, authorized to borrow money from time to time, in anticipation of the revenue of the financial year beginning January 1, 1941, and to issue a note or notes therefore, payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with section 17, Chapter 44 of the General Laws.

Article 12. To see if the Town will vote to appropriate money for the numbering of any streets in Town.

Article 13. To see if the Town will authorize its Select- men to petition the Director of Accounts for a yearly audit of Town Accounts.

Article 14. To see if the Town will appropriate the sum of $2500. to be expended for installation of an oil burner in the Agawam Center School.

Article 15. To see if the Town will adopt the Health Laws relating to Plumbing as presented at the Special Town Meeting held June 10th last.

Article 16. To see if the Town will assume Liability in the manner provided by section 29 of Chapter 91 of the General Laws and Chapter 513 of the Acts of 1931, for all damages that may be incurred by work to be performed by the Depart-

ment of Public Works of Massachusetts in rivers and streams of the town in accordance with the provisions of said Chapter 513, and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth.


Voted: That the Town assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws and Chapter 513 of the Acts of 1931, for all damages that may be incurred by work to be performed by the Department of Pub- lic Works of Massachusetts in rivers and streams of the town in accordance with the provisions of said Chapter 513, and authorize the Selectmen to execute and deliver a bond of in- demnity therefor to the Commonwealth.


Article 17. To see if the Town will appropriate the sum of $700.12 providing the State and County each appropriate the sum of $600. for repairs to the Agawam bridge.


Voted: To appropriate and raise the sum of $700.12 for repairs to Agawam Bridge, providing the State and County each appropriate the sum of $600.


Article 18. To see if the Town will vote to raise and appropriate a sum of money for the improvement of Pine Street, said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose; or take any other action in relation thereto.


Voted: To appropriate and raise the sum of $2,500. for permanent construction of Pine Street under provisions of Chapter 90, State and County contributing the sum of $7,500.


Article 19. To see if the Town will vote to raise and appropriate a sum of money for the improvement of Spring- field Street, said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose; or take any other action in relation thereto.


Voted: To appropriate and raise the sum of $2,500. for maintenance of Springfield Street under provisions of Chapter 90, State and County contributing the sum of $7,500.

Article 20. To see if the Town will vote to raise and appropriate a sum of money for the improvement of Suffield Street, said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose, or take any other action in relation thereto.

Article 21. To see if the Town will appropriate a sum of money for installation of a traffic signal on Main Street near the junction of School Street.

Article 22. To see if the Town will appoint a com- mittee to consider the advisability of the construction of a Town Office Building and report with suggestions as to loca- tion and amount of cost at a special Town Meeting to be held not later than May 15.


Voted: That a committee of five be appointed by the Moderator to consider thoroughly the needs and advisability of the construction of a Town Office Building, and report to a Special Town Meeting to be held not later than May 15, with suggestions as to location and probable cost.

Special Town Meeting


May 8, 1941


Article 1. To see if the Town will vote to construct, equip and furnish a Town Office Building as outlined by plans presented by a Special Committee to investigate the needs of such a building, purchase a lot upon which to erect the same, raise and provide money therefor, either by borrowing, by taxation or by transfer from available funds in the Treasury.


Voted: That a Town Office Building together with neces- sary Garage facilities, be constructed, equipped and furnished, and a parcel of Real Estate known as the Oliver property at 34 Main Street, containing two acres or more, be purchased upon which to erect the said buildings; and that the sum of $102,500. be and hereby is appropriated to be spent in said construction under the direction of a building committee hereinafter designated, along general plans recommended by a special committee appointed at the last annual town meet- ing: that to meet such appropriation, thereby raised during the current municipal year, by taxation, the sum of $2,500. and the Treasurer with the approval of the Selectmen, be and is hereby authorized to borrow the sum of $100,000., and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Chapter 44 of General Laws and acts in amendment or in addition thereto, so that the whole loan shall be paid in not more than twenty years from date of issue of the first bond or note or at such earlier dates as the Treasurer and Selectmen may determine.

Voted: That a committee of five be appointed by the Moderator to be known as a building committee to carry into effect the foregoing vote.


Article 2. To see if the Town will accept Witheridge Street and continuation known as Norwood Street as public streets.

Voted: That the sum of $600. be transferred from the Water Department all other account to the Water Department Construction Account.


Voted: That the Moderator appoint a committee of five citizens who shall consider the need of Building Laws and Regulations so-called and if it is found desirable, this com- mittee shall have the power to draw up a suitable set of By- laws covering this subject and shall present the same to a Town Meeting to be held not later than Oct. 15, 1941.

Special Town Meeting


October 15, 1941


Article 1. To hear the report of a committee appointed at the last special town meeting to present a set of Building By-laws, take any action thereon and appropriate a sum of money for any expense the Committee may have incurred.


The committee for building by-laws reported at length a set of By-laws covering building regulations. After much discussion it was voted to recommit the whole question to the committee for further report at the next annual town meeting.


Article 2. To see if the Town will take any action author- izing the sale of land acquired by Land Court decree.


Voted: That we amend the vote of the Town under Article 3 of the Warrant for the Town Meeting held on the 10th day of June 1940, by inserting in the seventh line on the records after the word acquire, the words "or have already acquired" so that the vote shall read as follows: That the Board of Selectmen be and hereby are authorized to sell and convey at public auction or by private sale in the name and behalf of the Town at such prices and under such terms and conditions as the said Board of Selectmen and the Finance Committee and Town Treasurer may determine, the whole or any part of any parcel of land which the Town may ac- quire or have already acquired by the foreclosure of Tax Titles, and any resident of the Town shall be given the pref- erence in such sales if the best interests of the town are served thereby.


Article 3. To see if the Town will appropriate a sum of money for purchasing snow removal machinery, from Road Machinery Fund Account to Road Equipment account.


Voted: To appropriate the sum of $700 for the purchase of snow removal machinery, said sum to be transferred from the Road Machinery Fund to the Road Equipment account.

Article 4. To see if the Town will appropriate the sum of $800. or any other sum for the Water Department All Other account, and provide for raising said sum.


Voted: To transfer the sum of $232.66 from Water Con- struction Account to Water All Other Account, and the sum of $57.53 from Water Contract Account to Water All Other Account.


Article 5. To see if the Town will appropriate any sum of money for betterment of Cooper Street, and provide for raising said amount.
