Voted that Capt. John Chandler, Lt. George Abbott, Sgt. Samuel Ffrie, Ens. William Lovejoy, Quartermaster Moses Tyler be a committee to agree with workmen and Laborers and for teams and what shall be necessary for the carrying on the building and finishing of our new meeting house, for which vote there was 81 in number; and that the Town will furnish them with money for the carrying on of said work, which money shall be raised at three or four payments as the major part of the Town shall agree for the time and sum: this particular vote had in Number 84 and (?) it was voted that 100 pounds in or as money shall be raised on the inhabitants out of this cropp in this first year for which vote there was numbered 84.


At a lawful town meeting warned by order from the Selectmen on the 24th of December 1707, upon the occasion of ye coming up of ye gentlemen appointed by ye honored General Court as a committee to hear the allegations made by the Town and the petitioners in regard of the difference between the petitioners and the Town concerning ye place for setting the new meeting house: Capt. John Chandler was chosen Moderator for said meeting. Capt. John Chandler, Capt. Christopher Osgood, John Abbott Sr. and Ensign William Lovejoy: Sgt. Samuel Ffrie, Henry Holt, Capt. Nehemiah Abbott, Sgt. Francis Dane, are chosen and appointed by ye Town to manage the difference with the gentlemen of the committee in the Town's behalf and so attend the gentlemen in viewing the places proposed for ye setting of ye meeting house in answer to the allegations that shall be made by ye petitioners.

At a lawful town meeting legally warned by order (torn) Town the 3rd day of September 1707, according to the vote (tom) Capt. John Chandler was chosen Moderator for said meeting. At this meeting, there was offered a paper of discentors from a vote of a former meeting which they desired to be entered in the records in this place and they continued their discent at this meet- ing, which is here entered as followeth:


Andover, September the 15th, 1707. We whose names are hereunto subscribed being a certain number of the Town aforesaid, being qualified according to law to vote in Town Meetings, do herein enter our contrary decents against the Town's actings any further about the setting, building or erecting of a meet- ing house on ye place on the westwardly end of George Abbott's land where the place was last voted: by some of our Town of Andover aforesaid at a Town Meeting, held at Andover on Tuesday, the ninth day of this instant September in the year 1707, which vote entered in our Town Book as we understand. There- fore, we, the subscribers, are against the setting of the meeting house on the place aforesaid for the several reasons following:


The place that is voted where the meeting house is to stand is the Proprietor's Common and there is no leave of them that it shall stand there, which should have been first known that they give or sell land to the Town for that use.


1st. 2dly The place voted to set the meeting house on is so far from the parsonage that the Town hath settled Mr. Barnard upon that he cannot, with any conveniencey, go constantly to it to preach. Neither can the whole Town remove him except he pleaseth. And the Town in reason cannot think that he will be willing con- sidering the remoteness of the place and therefore, Mr. Barnard's mind should have been known by the Town in that matter whether he would be pleased to re- move yea or no.

The place voted for the meeting house to stand on is much besides the greater part of our inhabitants for the bulk of the tom that live near to- gether in the town: and where it was first placed, and not in the center as it is inhabited the way they must go to meeting.

We, the subscribers, are much of the opinion that the last vote that past and is entered in our Town Book is not legal for this reason. In that said vote was obtained by many voting in the meeting aforesaid that was not qualified according to law: neither had many of those persons that estate ratable to the value of 20 pounds to a single rate besides the pole which qualifications all persons must have before that they can vote in the choice of any town offices; and if so sure they had need be as well qualified for the choice of a place to set the meeting house on, it being a thing of so great weight.

We, the proprietors for ourselves, that have hereunto subscribed being interested in all and every part and parcel of common and undivided land in the tom aforesaid, do herein forbid the granting or laying out any of the common in that place there by George Abbott's land where the meeting house shall stand for that use for some of the reasons already mentioned.

THE PARTICULAR GRANTS OF LAND AND MEDDO!7 GRANTED TO NATHAN PARKER


Granted to him a 4-acre houselot bounded on the south with the lot of John Stevens; on the north with the lot of Daniel Poore; on the west with the street; on the east the swamp, the which he sold to Daniel Poore.


Granted to him one acre of land to build upon where his orchard now stands. Granted to him four acres of land for two acres of his houselot lying on the north of his orchard; bounded on the east with the fence and on the northwest with a great oak; on the south with a dead apple; and on the west with a fence.


Granted to him three acres of swampy land for one acre of his houselot on the west of his other land and bounded on the north and west with a brook that runs from John Lovejoy's and on the south with a road that runneth between them both and the fence of William Chandler /(might be farm)


Granted to him the swamps that lie on the south of his orchard for one acre that he bought of Daniel Poore that lay on the and it bounded on the west with a maple that has three trees out of the stump which doe part him and William Chandler; and on the southwest with a staump of a tree; on the south with the fence and a great on the southeast and the land of John Stevens on the east.


Granted to him a small parcel of land adjoyning to the east side of his barn; bounded on the east with the land of John Stevens; and on the north with the fence.


Granted to him the swamp that doth lie on the east side of his house and land for his street division and bounded as now the fence doth stand and a smale goore more of land for his street division on the west side of the brook that runs from John Lovejoy's spring, bounded from a great oak that stands on the northwest corner of his land to a great white oak that stands on the west of his piece of land and from there to a maple standing on the side brook that hath two bodies.


Granted to him three acres of meadow in the west part of meadow and a parcel more of meadow for three acres, be it more or less, lying be- tween meadow and the meadow of John Stevens and all the bit of meadow that doo lie on both sides of the brook that doo run out of a meadow called "Shoue Meadow" to John Osgood's meadow.


Granted to him the Flaggy Meddow on the southeast end of the Bald Hill or an acre and a half, be it more or less.


Granted to him a parcel of meddow on the west side of the Hill for an acre, be it more or less.

Granted to Daniel Poore a fouer-acre houselot bounded on the south with the land of Nathan Parker that hee bought of him and doe now enjoy; bounded on the north with the land of John Aslet and the street on the left and the east with a swamp.


Granted to him a parcel of land below the false over Shawsheen for 2 acres, be it more or less; bounded on the east with the land of Richard Barker; on the north with Merrimac; on the west with a swamp and the land of John Frie on the south.


Granted to him 7 acres of land on the west side of Shawsheen River and bounded on the east with the river; on the north with a spring; on the west with the hills and on the south with the foord. Granted to him 7 acres for his Shawsheen Division and


Granted to him 14 acres of land on the plain that is above Joseph Parker's meadow; bounded on the west with the land of Solomon Martin; on the south with the land of John Stevens; on the east with the land of Richard Barker; and John Aslet's land; and a swamp on the north, 2 acres of which granted him for 2 acres of his houselot and the other 12 for his division land.


Granted to him in the neck, 8 acres of land bounded on the north and west with Shawsheen River; on the south with a swamp; and on the east with John Rush's and William Ballard's lands and the way that goes to Shawsheen.


Granted to him a parcel of land for an acre that is on the west of that land that was granted to Mr. Benjamin Woodbridge; bounded on the south with a swamp; on the west with Shawsheen River; and on the north with his own land.


Granted to him for fencing all the wast land in the new field on the south side of the highway that goes to Shawsheen Field that was not granted out. Granted to him 5 acres of meadow in Wades' Meadow on the west side of Mosquito River, bounded on the north with the meadow of Richard Barker; on the southeast with a that out of the river; on the south with the meadow of Nathan Parker and a stake on the southwest and the island on the west.


Granted to him a meadow about Shawsheen Field for 3 acres, be it more or less, with a slipp of meadow that lies southeast of the other.


Granted to him 2 acres and a half of meadow lying on the north side of the pond that is above the meadow of John Frie and John Lovejoy; bounded on the south with the pond; on the west with the upland; on the north with a white oak and maple.

Granted to him two xxxxx of street division, one before his house, bounded as it is now fenced; the other next to the street lands of Mr. Francis Dane, having the highway on the east and north.


Granted to him twoe parcels of land in Shawsheen Field lying for seven acres, be it more or less; one parcel of it having the land of Mr. Simon Bradstreet on the east and the land of Nicholas Holt on the west, the river on the north and the highway on the south; the other parcel bounded on the east with the lands of Nicholas Holt, on the west with the land of Nathan Parker, a ridge of land on the south, and a clay(?) bank on the north.

Granted to him half the meddow lying above the mill for two acres bounded on the southeast with the meddow of Joseph Parker.


Granted to him five acres of meddow lying on both sides of Mosquito River bounded northward with the meddow of John Aslet and on the east with the meddow of John Stevens.


Granted to him the sponge of meddow for John Stevens his meddow on both sides of Mosquito Brook for two acres, having the meddow of John Osgood on the east, and Daniel Poore's on the south.

At a lawful town meeting the 3rd of February 1661, it is ordered that all the firstcomers of inhabitants that have been at the charges of purchas- ing the plantation and building the minister's house, the mill and the meet- ing house for and in consideration thereof are allowed one acre and a half for every acre houselot of low and swamp land and every other inhabitant that have been at the charges of building the meeting house and mill is to be allowed one acre to every acre houselot and this land is to lie appertenant to the lots.

AT A GENERAL TOWN MEETING THE 24TH OF NOVEMBER 1662


It is ordered and granted that for every acre of houselot there shall be laid out to it twenty acres of upland to be taken up and chosen the same way and order that hath been used in divisions of land according to the times of men coming to the tom, which land may be taken up in any place beyond Shawsheen River within the bounds or in any place this side of the river provided that no part of that on this side of the river be within four miles of the meeting house; provided also that ixxxxxkakt have meddow granted on the further side of the Shawsheen River may take their land next to their meddow, and no cher shall disappoint them thereof, though it be their liberty to choose before them, and everyone is to make choice of his place where to be as soon as possible may be, especially those that are to choose first, so that all divisions may be laid out by the first of May next and furthest and whomsoever hath not by that time made choice of his place shall lose his liberty of choice and he that cometh next may take up his alottment and so others afterward as they can find their places.


Joseph Earker, Thomas Chandler, Nathan Parker and John Lovejoy are chosen and appointed as lotlayers to lay out and measure the several lots, all which they are to lay of four-square or long squares not exceeding twice the length at the breadth of every lot contain and are to mark trees or set stakes or hoops of stones at every corner which they are to enter and record in a book with the length and breadth thereof and to give ye parties it concerns a transcript thereof unto their hands, as they are to do for all other lands that at any time they shall lay out and it is agreed that there shall be two of ye four lotlayers at the laying out of this or of any other land granted by ye town and for the laying out of these alottments there shall be allowed six shillings a day to those two lotlayers that shall be employed to be paid by him or them that sets them to work and if they can dispatch that which they are called forth to do in less time than a day, yet no part of their said allowance shall be abated and for the lay- ing out of meddow ground, they shall be allowed twopence an acre or six shillings a day at the choice of the lotlayers and for such houselots as hath been alienated or sold by the first grantor and so remains doubtful for whom division of land belongs. The said lotlayers are to forbear lay- ing forth any land as ki belonging thereunto til the controversy be decided or have further tkaxtaxxx direction therein from the town.

Granted to him eight acres for a houselot bounded with the street on the west end, and forescore rods in length, and bounded with a swamp on the south and southeast side and with Daniel Poore's land that was Nathan Parker's on the north side.


Granted on the south side of the swamp by his house an acre and half to answer(?) xxxx other grants in the tom and exchanged one acre and three- quarters at the east end of his houselot for one acre and three quarters next his acre and a half next that granted to Solomon Martin and him and little parcel twixt them that is his land lying betwixt the land of Solomon Martin and his house.


Granted in Shawsheen Field eight acres, Mr. Bradstreet's land on the east end of it, John Osgood's land at the west end of it, the way on the north side and the meddow on the south side of part of it.


Granted to him in the new field eight acres lying betwixt the old field and the fence, the land which was Goodman Holt's both sides of it.

Granted to him six acres in the east end of Deer(?) Meddow and exchanged with Nathan Parker for his meddow lying next to his three acres bounded north wards with the old cartway over Shawsheen Meddow Brook and eastwards with two oaks marked by the meddow's side.


Granted to him six acres of meddow near Pole Hill southward of Solomon Martin's meddow, exchanged with Thomas Johnson for all the meddows near Shoue Meddow that was granted to William Ballard, being all the meddows next John Osgood's for three acres and four acres for three of the meddow betwixt Bald Hill and the former meddow.


Granted to him the cutting all the meddow and Shawsheen Field next his land to the cartaay for making some fence, all this land and meddow afore- mentioned was legally granted to John Stevens and his heirs forever February 1, 1659.

THE PARTICULAR GRANTS TO NICHOLAS HOLT


Granted to him fourscore acres of land whereof threescore are for his last division, the other twenty for fxuxatrex three years debt due unto him from the tom, the which land was laid out by John Lovejoy and Thomas Chandler, thirty acres of it laid out upon the plain called Stony Plain being fourscore rods in length from the north to the south. From the east to the west, three score rods. Bounded on the east with a small swamp and on the west with a swamp.


Fivtie acres where his house doth stand running from a swamp below his house having a great red oak marked, running southwest threescore rods marked with a red oak, and to a little swamp, and westward upon the hill 100 rods marked with a atgte) walnut turning again northeast threescore rods having upon the northwest a pine swamp with a pond in the middle of it, turning dom east a hundred rods upon the side of the hill which measures to 37 acres and a half whether more or less; the other 12 acres and a half xxxxxak lies upon the hill on the southeast side of his house bounded with the stony valley upon the southeast, and because his land was stony, the lotlayers did allow him all the stony land lying kexixxtxxx by the side of his lot to the foot of the great hill lying on the north side of his house and running dom to his great meddow.


His great meddow was allowed him for 20 acres, be it more or less.


Granted to him two parcels of meddow, one called Ladle Meddow and the other the Little Meadow, which was for his other division of meddow.

At a meeting of the selectmen of Andover the 19th of June 167, it was ordered and agreed upon that the surveyors of the tom shall have liberty to call forth ye inhabitants of ye tom as many days as they shall judge meet, not exceeding four days and are to improve them in mending ye highways about ye tom and any being legally warned by having a day's notice and not coming shall forfeit three shillings per day for a man and six shillings for a team (unless ilhess present). The said forfeiture to be distreined(?) forwith by ye constable and ye one-half to go to ye use of ye tom and ye other half to ye surveyor that shall so warn them. xxxxxxxxting ***


At a town meeting the 3rd of March 1689/90, the tom voted this order above to stand til it be repealed by the town and have made this addition to it. (viz) That the surveyors shall appoint to appear at ye place they are to wor's at the sun axdxxxxkigxx an hour high with their dinner with them and with such tools as the surveyors shall appoint them to bring, (if they have them and to forfeit sixpence for every hour that they tarry after the above time of sun an hour high, said money to be gathered by the surveyors and to their use of the company that works at that place where the delinquent should have appeared. A rationall allowance for time always .to be allowed for them to travel to the place of work and so for men and what time the surveyors shall spend more than the rest of the inhabitants of the town, the town shall pay them for and if one surveyors squadron works in two or more places at once, he shall have liberty to make a deputy or deputies for those places he cannot be with them himself, who shall have power to punish any delinquent as the surveyor might do. Voted and passed as the above said.

Whereas there was in ye year 1663, 100 acres of land granted to ye minixtry and so forever for and John Frye, Sr. and Richard Barker and their heirs and trusted which the same and Left. Osgood and Ensigne Chandler appointed to lay it out. It was accordingly done the 2nd of 1674 and delivered to the abovesaid John Frye and Richard Barker to be improved for the use aforesaid.
