Sold to Andrew Peeters a piece of swamp lyeing next to Ens. Steven Johnson two acres of swamp above goodman Blanchards Farm he paying for what shall appear.


Granted liberty to Sgt. William Lovejoy to change about half an acre of land lying on the southwest corner of his land where he swelleth for about So much land lying on the east end of his land by the way that goeth to Capt. Osgoods.


Granted to Abraham Foster an allowance of land to make him satisfac- tion for the country road that goeth to Boston the land granted to him in exchange, lyeth at the northeast end of the meadow his father bought of goodman Allen, reserving the wood for the use of the town, the lot layers to lay it out and make return of what they do herein to the clerk of the tomm, and whereas there was a grant formerly for the above said premises to be noted.


Granted to Stephen Parker three acres of land to plant for seven years and at the end, to sow the same with English hayseed, the land lyeth on the north side of Lt. John Osgood land and on the south side of the great hill.


On the 10th of April 1698 at a lawful townmeeting there, Capt. Christopher Osgood was chosen moderator for this meeting. Voted that a committee be chosen to receive the new records of the town lands according to what papers may be found that have been upon record before, our town records being taken away by the enemy Indians.


Voted that Col. Dudley Bradstreet, Capt. Christopher Osgood, & Mr. Andrew Peeters are the committee appointed for ye abovesd work.

Andover the 2nd January 1698-9 at a lawful tom meeting, Christopher Osgood was chosen moderator for this meeting.


Ordered that all those that have taken in any of the highway and im- proved for their profit, or any that have taken any land out of the common it shall be thrown up and a person or persons shall be appointed to see this done and said persons to be paid for their pains.


Ensign John Aslbee and Sgt. Ephraim Stevens are appointed to look af- ter the matter above said.


Sold to Joseph Osgood a quarter of an acre of land joining to his own land on the north side, beginning at his upper barrs and so to his lower barrs, the lot layers to lay it out, he paying after the rate of 30s per acre.


Granted liberty to Sgt. Ephraim Stevens to make a ditch wall on the outside of his fence of the land which was formerly Thos. Poors upon the southerly part of sd land.


Granted to Joseph Emery a parcel of land on the southeast of the land he now has, part of which he bought of the town, he paying 30s per acre ac- cording to the usual price and according to what it shall appear.


Sold to John Frye two acres and a half of swamp land, lying upon the southwest corner of his home meadow, the lot layers to lay it out, he having paid 30 shillings per acre for the same.


Granted liberty to Copl. John Stevens to lay down fifteen acres of land which he purchased of John Russ which was layed to said Russ his great division of four score acres and lay the said fifteen acres on the southwest side of a swamp said Stevens bought of the town.


Sold to John Faulkner half an acre of land joining upon the land formerly John Tylers upon the east side not damnifying any way, he having paid fifteen shillings in money for the same.


Granted liberty to Samuel Stevens to change an acre of land or so much as shall appear, which land was bought of Joseph Stevens and to lay so much on the south of the way leading to Ipswich.

At a lawful town meeting the 6th of March 1698-9, Capt. James Frye was chosen moderator for this meeting.

Capt. Christopher Osgood, Capt. James Frye and Ensign John Aslbee Sgt. George Abbott and John Abbott was chosen selectmen for the year ensuing.


Mr. Andrew Peeters was chosen town treasurer for the year ensuing.


Joseph Emery was chosen one of the constables for the year ensuing and also Jonathan Blanchard was chosen constable for the year ensuing.


Sgt. Ephraim Stevens, quartermaster Moses Tyler, Timothy Osgood, Francis Dane, Sgt. George Abbott and Henry Holt are chosen surveyers for the year en- suing.


Henry Chandler, Abraham Foster Sr. Thomas Russell and Nehemiah Abbott are chosen tithing for the year ensuing.


Sgt. Samuel Osgood, Capt. Samuel Ingalls, Walter Wright Sr. and Corpl. Hooker Osgood are chosen fence viewers for the year ensuing.


Sgt. Ephraim Stevens is chosen clerk of the market for the year ensuing.


Capt. Benjamin Barker was chosen pound keeper for the year ensuing.


Capt. Ingalls and Capt. Benjamin Barker are chosen to look after Cochichawicke River for the free passage of the fish (called alewives) into the great pond in the season of them and they are to be discharged for their pains by the selectmen, they giving an account of their labor therein and no inhabitant or strangers shall be suffered to stop or catch any of said fish till after they come to the old mill which was formerly Joseph Parkers. This is meant only while they are going up to Spawn, and any that shall break this order shall pay five shillings fine to be gathered by the overseers abovesd by order from the selectmen.


That for the future that all representatives of the town shall bring a note from the clerk of the court for the time they hath served, or else to lose their pay.

Voted and passed the Yeoman Act of the town of granting twenty shillings in pay for each wolves head catched in Andover to be paid by the treasurer by order from the selectmen, be continued two years longer from the date hereof.


Granted to William Barker, Lawrence Lacy and Ephraim Foster sixteen acres of land upon the south end of Jacks Hill to improve for seven years and then to sow it with English hayseed and then throw it up to the town, they using no cher hade (?) to fence it with than not (?) grows upon the land.


At a lawful tom meeting January Ist 1699-1700, Capt. Christopher Osgood chosen moderator for this meeting.

Granted to the widow Eleanor Chandler six acres of land upon the right hand of the way to goodman Blanchards, between William Ballards and William Johnsons, not prejudicing the way to Crane meadow swamp. This land was given in considera- tion of cost in her estate.


Voted and passed that whereas Abraham Foster had formerly a grant of land to make him satisfaction for the country road that goeth through his land and he not being satisifed with said land, the town hath now given him one acre more of swampland joining on the southeast end of his farm, not running above twenty rods in length with which he hath declared himself fully satisifed for the road is to be open and without gates.


Granted liberty to William Chandler to lay down an acre of land on the northeast side of his land between William Abbotts and his house, and to take up an acre on the south side of the land, not prejudicing any highway.


Whereas there was granted to Sgt. Ingalls, liberty to take up three acres and an half of land in Shawsheen which land he hath not yet taken up, liberty is now granted unto Deacon Joseph Stevens on his behalf to take up an acre and half of it joining to the land of John Stevens which he bought of Samuel Marble, half an acre joining to John Guttersons land and an acre and half to be layed on the south side of Mr. Guttersons house.


Voted and passed that the returns of Capt. John Osgood and Sgt. Henry Ingalls, chosen as a committee appointed to lay out the half moon meadow belonging to Mark Graves Sene shall be counted good and valid.


Voted and passed that Lt. John Barker be joined with to the committee for looking after encroachments upon the common and said committee are to make report of their actions to the town next town meeting.

Granted to John Ballard and others that join with him, sixteen acres of land upon Sutton Plain on the south side of the way that goes to William Chandlers meadow to improve for seven years and then to be thrown up to the towns use, this land not to prejudice any way, but to be fenced with the timber that grows upon it and sown with English hayseed.

Voted and passed that Sgt. Ephraim Stevens shall have satisfaction made him for damages he sustained by the lot layers, in the laying out of land which he bought of the town which was formerly Thomas Poors, he having so much as was wanting in his measure, to be layed out to him at the north end of the swamp called the head of the rocky swamp.


Granted unto Ensign John Aslbee five or six acres of land on the west hand of the way as you go to Salem upon woodchuck Plain to improve for seven years and then sow it with English hayseed and throw it up to the towns use.


Voted and passed that John not prejudice the watering place.

Granted liberty to Samuel Stevens to improve five acres of land on the woodchuck plain on the right hand of the way leading to Salem to improve for seven years and then to sow it with English hayseed and throw it up to the town.


Granted unto John Granger liberty to improve five acres of land upon the right hand of the way leading from Thomas Abbotts to the head of the pond to improve for seven years and to throw it up to the town, sowing it with English hayseed.


Granted liberty to John Johnson to improve two acres of land on the east side of Jobs Folly on the right hand of the way leading to Topsfield to improve for seven years and then throw it up to the town.


Sold unto Capt. Frye twenty six rods on the south side of the land he bought of Ensign Ballard and twenty six rods on the west side of the land which land he hath formerly fenced in, he paying the usual price.


Granted liberty to Ensign Joseph Ballard and John Russ to exchange one half of the twenty acres of land granted by the town to the mill upon Shaw- sheen river for so much land on the westerly side of sd river on which good- man Russ hath built the obligation in all respects which belonged to said land to be layed upon the land so exchanged and in lieu thereof the easterly part of half of said land granted to the mill on which end Ensign Ballard hath built, shall be confirmed to him as a free grant from any obligation.


Lt. John Chandler and Sgt. George Abbott to lay down, the one to the torn and to deliver the other to Ensign Joseph Ballard for the towns use.


At a lawful town meeting the 13th day of May 1700, Lt. John Osgood was chosen moderator, and Christopher Osgood was chosen clerk for sd meeting. Voted that a committee be chosen consisting of five men to settle the setting of the meeting house in the gallerys, and below what is needful and to attend the following instructions given to direct them in that affair. The committee chosen are Capt. Chandler, Christopher Osgood, Capt John Osgood, Capt. Ephraim Stevens, and Sgt. Samll Frye. The instructions given are to make one rule out of allotments rates, age and dignity.

Voted and passed that a leanto shall at the towns charge be forthwith built to the parsonage house.


Voted and passed that Mr. Barnard shall have liberty granted him to enlarge the ministers wives pew the breadth of the gallery.


At a town meeting at Andover Feb. 3rd, 1700-01 Lt. John Chandler was chosen moderator for this meeting.


Voted and passed that a convenient school house be erected at the parting of the ways by Joseph Wilsons, to be twenty foot long and sixteen foot wide.


Capt. James Frye, Ltd. John Osgood, Sgt. Ephraim Stevens are appointed for a committee to agree with a carpenter to take care that sd school house be forthwith erected.


The above persons are likewise appointed a committee to take care and agree with workmen to build and finish the parsonage leanto which was granted the last town meeting day.


Voted and passed that the selectmen from timt to time shall take care that a suitable school master be provided for the town.


Voted and passed that Ephraim Foster be chosen to take care that John Eams or other encroach not upon the town common but to make report to the tomm of any that so do.


Voted and passed that Lt. John Osgood and Ens. John Aslbee be added to the committee appointed April 10th 1698 for to take care for the restoring the tom records.


Voted and passed that the committee appointed for to repair the town records, are a committee for to bring into the next town meeting a list of those who have an interest in the town common.


At a lawful town meeting the 3rd day of March 1700-1, Ens. John Aslebee was chosen moderator for that day.


Christopher Osgood was chosen town clerk for the ensuing year.

Voted and passed that the list of commons which was drawn up by the committee chosen for that affair and offered to the town for their accept- ance, that the said list be entered upon record and that no common shall be disposed of by gift or sale but by those that are so recorded and such as they shall so reason successfully to accept in as proprietors with them.


Voted and passed that for time to come the inhabitants of the town shall come together in the first Monday of April yearly at (?) 8 of the clock in the morning to give in an of their ratable estate, to the defraying of town charges.


At a lawful town meeting in Andover the 5th day of January 1701-2, Lt. John Osgood was chosen moderator for (?) the day.


Voted and passed that those that send scholars to the public school shall pay into the town treasurer two pence per week for reading and four pence per week for writing and ciphering, and this to remain as a matter till the town see reason to alter.


Voted and passed that in consideration of the uncomfortableness of the season for (?) doing of public business, have nulled and dissolved said annual meeting for time to come on the first Monday in January.

Granted liberty to John Johnson to exchange two acres of land with the town which he bought of Mr. Barnot which he laying down to the use of the town, hath liberty to take up two acres in the lieu thereof on the east end of the land which was formerly Francis Faulkners.


Granted liberty to Edward Phelps for the conveniency of a highway for the neighbor- hood, he laying down so much land as shall be convenient on the north side of his land, shall have liberty to take up so much in the lieu thereof on the west end of his land.


Sold to John Farnum Jun, about 11 or 12 rods of land adjoining to his own land for his conveniency to set a.barn, he making good and feasible the highway from the other side of that way to the neighborhood rational satisfaction and that Sgt. Ephraim Stevens and Deacon Joseph Stevens are appointed to lay out said land.


Sold to Thomas Austin half an acre of land, it being a gore of land on the west side of his land he bought of the town and Mr. Peeters his land, he paying for it ac- cording to usual custom.


Voted and passed for encouragement to any for killing wolves that whosoever shall hence forward kill any grown wolves, shall be allowed out of the town treasury either twenty shillings in pay or 2 thirds in money, and for a young wolf five shillings in money.

Granted liberty to Edward Farrington to exchange with the town twelve acres of land he laying it down on the east end of his land and shall take it up on the west end, not damnifying any highway.


Sold to William Barker for his convenienc of building, half an acre of land joining on the west side of his twenty acre lot, he paying in to the treasury, according to our late custom, fifteen shillings in money for said land.


At a lawful town meeting of the town of Andover on the 3 day of June 1702, Ens. John Aslbee was chosen moderator for sd meeting.


Ensign John Aslbee and Mr. Andrew Peeters were chosen to go down to Boston to manage the concerns of the town against ?


It may be put into the general court by Mr. Benjamin Woodbridge and that company concerned with him and once by the town of Medford. Wherein soever may may thereby endeavor to intrude upon any part of our town rights and privileges and do hereby empower them to council, advise and implore against them in said matter. And also that the town do hereby ingage to bear their charges in the management of the said affair. And are also hereby allowed to see an attorney to assist and join Mr. John Leveret by name if he be not of service engaged against us. If he be another in stead of him or another to assist Mr. Leveret if need require, and further to engage them in the civil law if they proceed against us with any process therein voted and passed by a general vote the day above said.

Voted and passed that the selectmen shall have power to agree with a school master for the year ensuing, and to assess upon the inhabitants as the law directs to raise moneys to defray our ministers rates, a school masters salary and what other necessary charges shall arise for the maintenance of the poor and other necessary charges.


Voted and passed that there be a meeting of the proprietors of the town on the 8 day of inst. March to consult what is needfull to be done in order to the protecting of what is wanting in our original records of the proprietors settlement.


At a lawful town meeting of the inhabitants of Andover the 24th day of May 1703, Lt. John Osgood was chosen moderator for sd meeting.


Proposed and voted that a committee be chosen by the town, of five men so with those proprietors of land in Andover that have not their land yet entered in the new town book of records of land and the next (?) neighbor joining therewith, that they may have the most use (?) and full intelligence of the bounds of such lands, and what the (?) com- mittee shall act and agree upon in settlement of such bound, entering (?) their return of what they do under their hands to the town, and there being accepted shall be accounted authentic to be entered on record, and where any land (?) upon the Town common, the sd committee shall have power to settle all such bounds and make return as above said. And do now appoint the first Tuesday in October next, be a general Town meeting of the in- habitants of the Town to look at the committees return.


The committee chosen for the abovesd affair are John Osgood, John Abbott, Henry Holt, Sen and Deacon Joseph Stevens, John Chandler and any three of them agreeing shall be accounted authentic for the return of abovesd for which service they shall be allowed 2 shillings per diem out of the town treasury.

At a lawful town meeting on the 5th day of October 1703, Lt. John Osgood was chosen mederiator for sd day.


Voted and passed that the committee chosen by the town at a meeting the 24th of May 1703 for the settling of the bounds of such lands that were not yet entered in the new town book of records, that said committee be continued in sd service till the last Tuesday of November next on which day they shall bring in their re- turns of what they shall do in said affair.


And it is voted that the last Tuesday in November next be a general town meeting of the inhabitants at 8 of the clock in the morning to attend sd work, and it is voted that whosoever do neglect the settlement of the bounds of their lands against the day, shall bear the charge of what shall then be restored at (?) their own particular cost.
