SURFACE DRAINAGE.
November 19, 1901, a report on a System of Surface Drains, together with its estimated cost, was submitted to the Board of Aldermen. The total amount of this esti- mate, exclusive of any improvements in the main brook from Ell Pond to the Malden line, was $334,610.00. This report was accepted, the System as outlined adopted, and on July 9, 1901, the Board of Aldermen passed Order No. I279, appropriating $10,000.00 to be expended in construct- ing a portion of said System.
Demands for drainage in the various sections of the city were numerous, the amount of the appropriation small. In- vestigations and estimates were made with a view of giving relief to as many as possible. After thoroughly consider- ing the various needs and requests, it was decided to give partial relief to many rather than entire relief to a few; consequently the money was expended in making partial improvements in various sections of the city, but all work done is of a permanent nature, and a part of the System as outlined in said report. Following is a brief description of the work done in the different sections of the city.

Botolph Street and West Hill Avenue.
This work consisted in extending the 15 inch drain, laid by the Board of Sewer Commissioners (from Franklin street through land of Shepard, Maine and Crawford to Botolph street ) west in Botolph street, to West Hill avenue, and a 12 inch pipe laid up West Hill avenue to Chaska ave- nue, building 3 manholes and 5 catch-basins.
In this work provisions were made for future extensions in Botolph street to York terrace, and if necessary up York terrace. Its estimated cost was $1,261.92, while its actual cost was only $1, 154.13.
Cedar Park.
The old drain leading from Cedar park across the B. & M. R. R. to the Essex street drain was abandoned and a new 20 inch pipe laid from Vine street, through Essex street, across the B. & M. R. R. tracks to the angle in Cedar park, where it was intended to connect it with the pipe in Cedar park leading from Vinton street. Upon investiga- tion this pipe was found to be entirely filled with roots and deposit; it was therefore decided to abandon this 10 inch pipe and to relay in its place an 18 inch pipe. Owing to the fact that in order to give the pipe across the railroad tracks a temporary outlet into the 10 inch pipe in Essex street, its grade had to be raised 2 feet from what was origi- nally planned; this, of course, brought the end at the angle in Cedar park also 2 feet higher, and, in fact, within 8 inches of the surface of the ground. To have laid an 18 inch earthen pipe with only 8 inches of cover would have been unsafe, therefore a 16 inch cast iron pipe was substituted and the rate of grade increased sufficient to give it the same capacity as the 18 inch on the grade originally planned.
Laurel Street Drain.
The construction of this drain started at a point in the land of Mabel Damon about 100 feet west of Lebanon street, and continued to and across Lebanon street, 30

inches in diameter, built of brick; at this point the brook which flowed between Foster and Laurel streets was taken in, an 18 inch inlet left for future extension to and up Foster street, and a ·24 inch drain continued south in Leba- non street, to Laurel street; a 12 inch pipe laid from Laurel street to Grove street and a 20 inch pipe up Laurel street to Gooch street, and through Gooch street to Grove street.
The estimated cost of constructing all of the drains with- in this area is $15,751.00, the cost of the drains built is $3,495.II, from which it will be seen that $12,255.89 is required to complete the drain within - this section. So much of these drains, as are for the relief of the upper end of Grove street, should be constructed the coming season, the estimated cost of which is about $2,000.00.
Dell Avenue Brook or " Leonard's Drain."
The drainage improvements made in the vicinity of Leba- non, Laurel, Gooch and Grove streets would naturally tend to increase the rapidity of the flow in the stream or brook into which they discharged. Anticipating this. Mr. Henry A. Leonard, through whose land this brook flowed, wrote me the following letter :
MELROSE, Oct. 29, 1901.
W. DABNEY HUNTER, EsQ .:
DEAR SIR : After repeated efforts on our part to have you, or the city which you represent, do something about the drain and surface water, which empties into and over our land, we have come to this decision, (after taking legal advice ) that if some satisfactory arrange- ment in the matter is not made with us within ten days from this date, we shall proceed at once to stop up said drain, that we may be able to build our street and not be obliged to submit to this nuisance any longer.

Being unable to comply with Mr. Leonard's request, he caused a dam to be placed across this brook at the west end of the culvert under Dell avenue. I was immediately assailed with requests to have the same removed. Having submitted the matter to the city solicitor and receiving from him the advice to take no action in the matter until

such time as the damming of the water should in my judg- ment endanger travel upon the public highway, there was nothing to be done but to wait for either one of two things to take place, viz : for the board of aldermen to take certain rights in the land of Leonard, or until the rise of the water should endanger the public travel; the latter took place first.
On December 15, 1901, the water rose to such height as to cause the street to cave in and become dangerous to travel. Instructions were immediately given to remove this dam with as much care as possible, and to place all materi- al taken therefrom, carefully upon Mr. Leonard's land, which was done about noon of the same day.
On December 26, 1901, the board of aldermen passed Order No. 1435, which reads as follows :
Be it ordered : That acting under the provisions of law applicable thereto, a main drain either open or covered, shall be laid or con- structed in the following described right of way as hereinafter set forth, viz :
Beginning at a point on the westerly side of Lebanon street eighty- seven and fourteen and one half one hundredths (87.14-}) feet north- erly from a stone bound on said westerly line of Lebanon street nearly opposite the center of Laurel street; thence running south 65° 38' 13" west, one hundred ninety-eight and twenty-five one hundredths (198.25) feet to an angle; thence south, 83º 36' 08" west three hun- dred eighty-three and thirty-one one hundredths (383.31) feet to a point in Dell avenue; thence north 86° 23' 52" west one hundred eighty-nine and seventy-two one hundredths (189.72) feet to an angle- thence south 82° 58' 58' west five hundred forty-two and forty- two one hundredths (542.42) feet to an angle; thence north, 69º 25' 22" west seventy-eight (78) feet more or less to the easterly side of Ell Pond brook as laid out by the county commissioners. The above description is intended to conform to plans drawn by W. Dabney Hunter, engineer and superintendent of public works, hereto annexed and made a part of this order; that the treasurer be and hereby is authorized to pay the expense therefor in an amount not exceeding $750.00 and that the city treasurer be and hereby is given authority to issue note or notes of the City of Melrose not exceeding in the aggre- gate the sum of $750.00 payable in one year from the date thereof at a rate of interest not exceeding 4 per cent. per annum. It is hereby ad- judged that the said drain is a necessity for the public convenience and health; that the City of Melrose acting under the authority of the Public Statutes, and also under all other provisions of law and every

other power it hereto enabling, has taken and hereby does take for the purposes of constructing and maintaining a main drain in the pri- vate lands as hereinbefore specified for the sole use and benefit of the said City of Melrose the following lots and parcels of land situated in said Melrose, in said County of Middlesex, viz: A certain lot situ- ated on the westerly side of Lebanon street, supposed to be owned by Mabel M. Damon, bounded and described as follows :- Beginning at a point on the westerly line of Lebanon street ninety-four and sixty- four and one half one hundredths (94.64-}) feet northerly from a stone bound on said westerly line of Lebanon strcet nearly opposite Laurel street ; thence south 65° 38' 13" west one hundred forty-nine and forty-seven one hundredths (149.47) feet to land of Chas. L. 86° 23' 52" east one hundred seventy-five and eighty-six one hundredths (175.86) feet to the said westerly side of Dell avenue; thence along said westerly side of Dell avenue north 2º 29' 28" east fifteen (15) feet to the point of beginning, containing eleven thousand five hundred sixty-two and sixty-seven one hundredths (11,562.67) square feet.
A certain other lot of land situated on Grove street, supposed to be owned by Justus Geist, bounded and described as follows :- Beginning at a point on the dividing line of land of said Geist and Henry A. and Caroline J. Leonard; thence along said dividing line north 00° 49' 38" east fifteen and ninety-four one hundredths (15.94) feet; thence north 69° 25' 22' west twenty-one and twenty-three one hundredths (21.23) feet more or less to Ell Pond brook; thence along Ell Pond brook south 36° 04' 38' west fifteen and fifty-seven one hundredths (15.57) feet more or less ; thence south 69º 25' 22' east thirty and seventy- seven one hundredths (30.77) feet more or less to the point of begin- ning, and containing three hundred and ninety (390) square feet.
