REPORT OF CEMETERY COMMITTEE.
Under the superintendency of Mr. R. A. Leavitt a gradual but permanent improvement in the appearance of the cemetery goes on from year to year. Early in the season we found it necessary to issue rules and regulations for the better government of the property, in which we asked the co-operation of all proprietors in keeping the grounds in as beautiful and attractive condition as possible. This request has met with a cordial response. Looking forward a year or so, it is hoped that there may be completed three important improvements which will add wonderfully to the attractive appearance of the grounds, namely, the widening of Sylvan street easterly from the main entrance, the drain- ing and grading of the swamp near the entrance, and the laying out of the entrances from the present cemetery to the Pratt farm, a part of which must necessarily soon be used for burials. It is thought that the widening of Sylvan street can be accomplished without the alteration of the present northerly boundary of the ground except at a point near the entrance and extending easterly something over one hundred and fifty feet. This will necessitate no change in existing lots as none are laid out immediately east of the entrance, but any other changes of existing boundaries should be carefully guarded against so to avoid disturbing existing lots and graves.
The improvement of the swamp has long been looked forward to, but lack of any appropriations by the city has rendered this work extremely slow as we are practically limited to our receipts each year. It is unfortunate that we can do such a small amount each season.
The entrances to the Pratt farm must however be laid out by a landscape gardener without delay, if we are to look forward to the future as we should, and to having the new part of the cemetery in accordance with modern ideas of the best equipped cemeteries in this vicinity.

GENTLEMEN : It becomes my duty to announce the death of a member of your honorable board, Mr. Jonathan C. Howes, which occurred at his home this morning. Recognizing his faithful and · efficient services both as a city and town official, I have called you to- gether that appropriate action may be taken by your honorable body. The following action was taken by the Board:
Voted, That the mayor and members of the board, with the ex-mayor and the aldermen of the year 1900, attend the funeral services of our late member, Jonathan C. Howes. The following resolutions were adopted:
RESOLUTIONS ON THE DEATH OF JONATHAN C. HOWES.
WHEREAS, It is with feelings of profound sorrow that we realize that God, in his infinite wisdom, has summoned our late associate, Alderman Jonathan C. Howes to close his earthly career, and cross the river, therefore :
Resolved, That forty-five years of business and social relations caused him to be widely and favorably known ; and his high charac-

ter, his long and honorable acquaintance and connection with the affairs of our town and city made him a wise counsellor, and insured him a foremost place in the confidence of his fellow citizens.
Resolved, That in our intercourses with him in official and friendly relations, from his constant courtesy and charm of manner, we came not only to have a high opinion of the sterling qualities of his charac- ter, but to admire him as a friend and as a man, and his genial and kindly presence was ever welcome.
Resolved, In the many offices of trust which he filled in town and city, he was ever faithful and diligent. His knowledge and judgment in matters was sound and reliable. He was outspoken and fearless for the right, honest of purpose, upright in action, pleasant in his social life, a kind husband, a faithful friend, an honest man. Such was Jonatha . C. Howes.
Resolved, That from a sense of personal loss and as a token of our admiration and esteem, these resolutions be entered upon the records of the board of aldermen, as a tribute to his memory ; and that an en- grossed copy thereof be sent to the family of the deceased.

PUBLIC HEARING APRIL 22, 1901, CITY AUDITORIUM, CITY HALL.
Meeting called to order at 7.45 p. m. President John G. Robinson in the chair. Roll call showed twenty members present.
President Robinson read the returns of the special elec- tion held April 2, 1901 for the election of an alderman-at- large to fill the vacancy occasioned by the death of Alder- man-at-large Jonathan C. Howes, from Ward 4, President Robinson also read a protest filed by Judge Charles J- Noyes against seating Mr. George E. Berry, who had received the largest number of votes at the special election, because he did not come from Ward 4, as required by the city charter. Judge Charles J. Noyes also filed a petition for the seat of Jonathan C. Howes, on behalf of Charles W. H. Frederick, he having received the largest number of votes of any candidate coming from Ward 4, as required by the city charter.

President Robinson then declared the hearing open and Judge Charles J. Noyes presented the case on behalf of Charles W. H. Frederick, George E. Berry presenting his own claim to the seat, having received the largest number of votes for the position at the special election. Both claimants or their attorney having spoken, that part of the hearing was closed at 9.45 o'clock p. m. Alderman Barton presented the following motion: "That the certificate be awarded to George E. Berry, he having received the largest number of votes." Alderman Barton addressed the board on his motion, and Aldermen Carrie, Small, Shepard and Marshall spoke in favor of Frederick. Alderman Small offered the following amendment: "That the name of Charles W. H. Frederick be substituted for the name of George E. Berry in the original motion." Alderman Bar- ton called to the chair, and President Robinson addressed the board in favor of George E. Berry; Alderman Burnett moved the previous question. Alderman Carrie was called to the chair; voted to strike out that part of the motion where it says, "He having received the largest number of votes." On question of substituting the name of Charles W. H. Frederick for the name of George E. Berry in the original motion, roll call was ordered, resulting as follows: Yes, 13; No, 7. Amendment carried. President Carrie then stated the original motion as amended, "That the certificate of election be awarded to Charles W. H. Freder- ick as alderman-at-large to fill the vacancy in the board of aldermen occasioned by the death of Jonathan C. Howes." Roll call was ordered by the president, resulting as follows:
