The Finance Committee recommends the approval of the Article.
Article 41. To see if the Town will vote to discontinue as a Town way or private way, any such way that may exist extending Easterly and Northeasterly from a point near the intersection of Claypit Hill Road and Adams Lane to land of Middlesex Real Estate Investment Company, Inc., formerly of Roland F. Gammons, and being located approximately as shown in dotted lines over land of Ruth B. Dickson on the Town of Wayland Assessors' Plans of 1947; or take any action relative thereto.
A large number of acres lying north of Claypit Hill Road and east of Draper Road are in the process of being developed for house lots. The older Town maps show in sketchy form a right of way with indeterminate boundaries over a part of the area. The owners of the property would like to clear up their title, in connection with which it is desirable to discontinue such Town way or private way as may exist of record. The Town has never used the road and it has no interest in it. Under the circumstances, there is no reason why this Article should not be approved.
The Finance Committee recommends the approval of this Article.
Article 42. To see if the Town will vote to grant to the owners of Lots A1, A2, and 2, as shown on a plan entitled, "Plan of Land in Way- land, Massachusetts," dated October 20, 1952, by Everett M. Brooks Company, C. E.'s, recorded with Middlesex South District Deeds as plan No. 2175 of 1952 in Book 8006, Page 253, an easement of passage over the entire length and breadth of Parkland Drive; or take any action relative thereto.
At the time the right-of-way for Parkland Drive was given to the Town in connection with the Town's acquisition of the bathing beach on Lake Cochituate, the then owner reserved a right-of-way over the

lot for all lots in his ownership. One piece of land not owned by him faces on no road other than Parkland Drive and therefore has no right-of-way except by tolerance of the Town over Parkland Drive. In order to give the property a marketable title, it seems entirely equitable that the Town should grant the owners of the lots mentioned in the article on which there is but a single residence, the right here requested.
The Finance Committee recommends the approval of the Article.
Article 43. To see if the Town will vote to appropriate a sum of money for necessary drainage to lower the water table in the area of Rich Valley Road by lowering the culvert under Rich Valley Road; or take any action relative thereto.
The Drainage Committee appointed at the last Annual Meeting has gone into the details of the request here made and has come to the conclusion that, if a second concrete drain line were laid under Rich Valley Road at this point, the full responsibility of the Town would be met with respect to bringing water from one side of the road to the other and it does not feel that the Town should be requested to make further extensive rearrangement of the drainage. Adequate funds have been provided for in the Highway Department Budget to do the work suggested by the Drainage Committee.
The Finance Committee, therefore, does not feel that any addi- tional funds are necessary and does not recommend the approval of the article.
Article 44. To see if the Town will vote to install a storm drain system and necessary appurtenances to conduct surface waters from the easterly side of Cochituate Road, opposite the end of Pequot Road, under Cochituate Road and down Pequot Road a distance of about 450 feet to connect with the existing storm drain pipe located in Pequot Road and to raise and appropriate a sum of money to cover the cost of installing said drainage system; or take any action relative thereto.
At the last annual Town meeting, a special Drainage Committee was appointed. It was directed to try to develop a policy with respect to the Town's responsibility to be applied to the various drainage proposals, as they might from time to time be made. A full report of that committee is being made to the Town. All the details with respect to this project were reviewed by that committee. Some 350 feet of piping would be necessary in Pequot Road and the total cost involved would come to about $2,000. The Drainage Committee has come to the conclusion that this is not a project for which the Town has any responsibility.
The Finance Committee, therefore, does not recommend the approval of the article.
Article 45. To see if the Town will vote to appropriate and assess a sum of money for the payment of unpaid 1956 bills; or do or act.
The Finance Committee is advised by the Board of Health that it has two unpaid items. One is for the collection of garbage, -

$1.000. This apparently is the result of a mix-up between the con- tractor's billing and the Town paying, the contractor assuming that the Town was regularly paying a month late. The full amount was appropriated in both 1955 and 1956, but there was a balance left in 1955 which should have been paid to the contractor in that year. The second item is the School Dental Clinic, - $156. The basis and arrangement for payment for the Dental Clinic was apparently revised in 1956 without there being adequate funds available for the purpose.
The Finance Committee recommends the approval of the article and the appropriation of the amount necessary.
Article 46. To see if the Town will vote to raise and appropriate a sum of money for the installation of equipment to add a fluoride com- pound to the public water supply in amounts and by such methods as are recommended by the Massachusetts Department of Public Health; or take any action relative thereto.
This article is inserted by the committee appointed by the Town to study the matter of fluoridation of the public water supply. If adopted, it would involve the adding of an additional now non-existing service to the Town. By the time of the meeting, the Town will have received a full report from the Special Committee and in its ultimate adoption should be guided by the report. The Finance Committee feels that while the fluoridation of water may be desirable, in view of a number of items calling for new services in the present articles, it feels this matter may well be deferred to a later date. The immediate cost would be about $4,500 for equipment and thereafter about $700 a year to operate.
The Finance Committee therefore does not recommend the approval of the article this year.
Article 47. To see if the Town will vote to accept the provisions of General Laws (Tercentenary Edition), Chapter 54, Section 103A, providing for voting by absent voting ballot at Town elections.
This Article was inserted in the Warrant by a fairly long list of citizens. Its approval would provide for absentee voting in Town elections in the same fashion as absentee voting is now permitted in State and National elections, under the same procedures and safe- guards.
The Finance Committee recommends the approval of the Article.
Article 48. To see if the Town will vote to amend the Zoning By-Laws and the Zoning Map by making the following changes in District boundaries; or take any action relative thereto:
Change from Business District A and Residence District Thirty Thousand (30,000) square feet, One Hundred Fifty (150) foot front to Business District B, the land bounded and described as follows:
NORTHERLY by State Road West and the Southerly Boundary line of land now or formerly of Wayland Motors, Inc. at present in Business District A;

This article, and the following nine, deal with the matter of amending the Zoning By-Laws one way or another. The Planning Board will have held public hearings and will make a report to the Town at the time of the Annual Meeting.
This article has been submitted by the Planning Board and is along the lines of a similar article which was submitted last year, except that the area involved has been reduced from 9 acres to about 51/2 acres, all of which is now under single ownership. A portion of the area is in a residential district and the rest of it is in Business District A. The article seeks to put it in Business District B. The land is located on State Road West, west of the Catholic Church, and runs through to Pelham Island Road.
The Finance Committee recommends that the Town be guided by the recommendations of the Planning Board.
Article 49. To see if the Town will vote to amend the Zoning By-Laws as follows:
To change from Residential District thirty thousand (30,000) square feet, one hundred fifty (150) foot frontage to Business District A that portion of land bounded on the

This article seeks to change from a Residential District to a Business District A about 50,000 sq. ft. of land, consisting of three lots on which three houses are now located. The property faces the center of the Town, opposite the savings bank and the Post Office and is completely surrounded by Town property.
The Finance Committee feels that the Town should be guided by the recommendations made by the Planning Board.
Article 50. To see if the Town will vote to amend the Zoning By- Laws and Zoning Map by changing from a Residential Zone, Forty Thousand (40,000) square feet, One Hundred Eighty (180) foot frontage to a Business District A any or all of the parcel of land situated on State Road East bounded as follows:

Under this article, it is proposed to change from a residential to Business District A about 2 acres of land on the south side of State Road East. The property involved is now occupied by the Westway Orchard Stand, which is directly opposite the Higgins Ice Cream stand.

Article 53. To see if the Town will vote to amend the Zoning By-Laws and the Zoning Map as follows:
To change from Residence District Twenty Thousand (20,000) square feet, One Hundred Twenty (120) foot front, to Business District A the land situated on the northerly side of West Commonwealth Road, bounded and described as follows:
SOUTHERLY by West Commonwealth Road 93 feet;
WESTERLY by land now or formerly of Ellen B. Ferguson 117 feet, 9 inches;
NORTHERLY by land now or formerly of Bernice W. Gerald 93 feet; and

Under this article it is sought to transfer from a residential district to Business District A an area of about 10,000 sq. ft. of land on which there is now located a 2-family house. The land has about 93 ft. of frontage on the north side of Commonwealth Road West and extends behind some of the stores facing on Main Street. About half of the Johnson property is already in Business District A. This article covers only that portion not already in Business District A.
The Finance Committee recommends that the Town be guided by the recommendations of the Planning Board.
Article 54. To see if the Town will vote to amend the Zoning By-Laws and Zoning Map by making the following changes in district boundaries; or take any action relative thereto;
To change from Residence District Twenty Thousand (20,000) square feet, One Hundred Twenty (120) foot front, to Business District A, the land now or formerly of Bernice W. Gerald bounded and described as follows:

This article seeks to change from a residential district to Business District A about 21,800 sq. ft. of land on the north side of Common- wealth Road West, on which a house and barn are located. The property has a frontage of 91 feet and extends back about 224 feet from the street. It lies behind stores on Main Street and is contiguous to the land covered in the previous two articles.
The Finance Committee recommends that the Town be guided by the recommendations of the Planning Board.
Article 56. To see if the Town will vote to amend Zoning By-Laws by striking out sub-section "d" of Section 5 and substituting in place hereof the following sub-section; or take any action relative thereto:

"d" 1. Schools, Public Libraries, Fire Stations, Art Museums, Churches, Parish Houses, Sunday School Buildings, Telephone Buildings, Parks, Water Supply Reservations, Soldier's and Sailor's Memorial Buildings.
2. The buildings of Membership Clubs devoted to outdoor sports and social and recreational buildings and premises, except those a chief activity of which is one customarily carried on as a gainful business, provided a special permit is obtained from the Board of Appeals as provided in sub-section "r" of Section 5.
This article calls for an amendment to the Zoning By-Laws with respect to the buildings of Membership Clubs. It would require that Membership Clubs, such as day camps, obtain a special permit from the Board of Appeals where none is now necessary.
The Finance Committee recommends that the Town be guided by the recommendations of the Planning Board.
Article 57. To see if the Town will vote to amend the Zoning By- Laws by striking out subsection "m" of Section 5 and substituting in place thereof the following subsection; or take any action relative thereto:
"m" No accessory building, including trailers and similar vehicles, shall be occupied for residential purposes, except an upper floor, garage or stable may be occupied by an employee or the owner or tenant of the premises.
This article proposes a change in the Zoning By-Laws by which trailers and similar vehicles would be treated as accessory buildings.
The Finance Committee recommends that the Town be guided by the recommendation of the Planning Board.

This article would provide for a drainage easement from the outlet of Dudley Pond to the Happy Hollow School site at Pequot Road. In general, the easement would follow the bed of the brook and would be wide enough to permit equipment to be used to clean out and deepen the brook. The route of the easement has been arranged so as to involve a minimum of damage. Since the easement would be of benefit in the drainage of all the lots through which the brook passes, it is felt that the amount of damage should be very small.
The approval of the article is recommended by the Drainage Committee and the Finance Committee concurs in their recommenda- tions.

Article 59. To see what sum, if any, the Town will vote to transfer from available funds to meet any of the appropriations made under the foregoing articles.
The Finance Committee will make its recommendations on this article at the time of the Annual Meeting.
And you are required to serve this Warrant by posting copies thereof, attested by you, at the Town Hall, at each Post Office in Town and at the Legion Hall, in Cochituate, seven days, at least, before the time of holding said election.
Hereof fail not and make due return of this Warrant with your doings thereon to the Town Clerk on or before March 4, 1957.

REPORT OF THE FINANCE COMMITTEE
The Finance Committee regularly reports to the Town on its use of the "Reserve Fund" for the previous year. The 1956 appropriation of $15,000 was expended as follows: Selectmen-Civil Defense - $1,550.05; Town Offices - Salaries - $1,500; Police Dept. - Expense $1,275.84; Fire Dept. - Expense - $2,603.61; Dutch Elm Disease - Expense - $500; Highway Dept. - Maintenance - $3,000; Veterans' Benefits - Expense - $590.96; 20 other accounts of less than $500 each - $3,485.18, leaving an unexpended balance of $494.36.
The Finance Committee wishes to point out to the Town that the amount recommended in the overall budget for 1957 comes to $1,397,000 as against $1,079,000 in 1956, a net increase of some $318,000. The two principle items of increase are the School Department Budget at $625,000, up from $491,000, and $98,000 of additional interest and debt payment directly attributable to the school system.
The articles recommended by the Finance Committee in 1957 come to $32,000, as against $39,000 a year ago. In addition, the 1957 tax rate will have to carry about $19,000 for snow removal overdraft and better- ments voted last year, after the tax rate was set. Part of these increases will be offset by increased contribution assistance from the School Build- ing Assistance Commission, from the increase in property valuation and from miscellaneous additional revenues. But even with these credits, it appears inevitable that there will again be a very substantial increase in the tax rate.
