said money to be available even if the State should cut its allotment, or take any action in relation thereto.


Article 12. To see if the Town will vote and appro- priate the sum of Eight hundred ($800.00) dollars for Chapter 90 Maintenance, said money to be used in con- junction with any money which may be allotted by the State or County for said purpose, said money to be avail- able even if the State should cut its allotment, or take any action in relation thereto.


Article 13. To see if the Town will raise and appro- priate the sum of Three hundred and fifty ($350.00) dol- lars to continue the program of installing street signs throughout the Town of similar design as those placed in 1937, 1938, and 1939 or take any action in relation thereto.


Article 14. To see if the Town will appropriate from available funds under the excess and Deficiency Account a sum of money for use by the Board of Assessors in fixing the tax rate for 1940, or take any action in relation thereto.


Article 15. To see if the Town will vote to raise and appropriate the sum of Four hundred dollars ($400.00) to install and maintain electric lights along Main Street, during the Christmas Holiday Season, under the Direc- tion of the Inspector of Wires or take any action in rela- tion thereto.


Article 16. To see if the Town will vote to accept and allow the report of the Selectmen on the laying out of Mayhew Slip.


Article 17. To see if the Town will assume liability in the manner provided by section 29 of Chapter 91 of the General Laws and Chapter 513 of the Acts of 1939, for all damages that may be incurred by work to be per- formed by the Department of Public Works of Massa- chusetts in rivers and streams of the town in accordance with the provisions of said Chapter 513, and authorize the Selectmen to execute and deliver a bond of indem- nity therefor to the Commonwealth.


Article 18. To see if the Town will vote to raise and appropriate the sum of Fifteen hundred ($1500.00) dol- lars to be used in conjunction with a W.P.A. Project for

construction of section of Concrete Bleachers and ap- proaches on Town Park, or take any action in relation thereto.


Article 19. To see if the Town will vote to raise and appropriate the sum of Five hundred ($500.00) dollars to be used for piping and materials in conjunction with a W.P.A. Project in piping brook in section of Town Park, or take any action in relation thereto.


Article 20. To see if the Town will vote to raise and appropriate the sum of twenty-five hundred ($2500.00) dollars for continuance of the Sewerage from the Hobo- ken Citizens' Club to Alden Street, thence on Alden Street to end of said Alden Street, a distance approximately ten hundred and fifty yards (1050), or take any action in relation thereto.


Article 21. To see if the Town will vote to raise and appropriate the sum of Fourteen thousand dollars ($14,- 000.00) for the purpose of purchasing a Junior Aerial Ladder truck for the Fire Department, or take any ac- tion in relation thereto.


Article 22. To see if the Town will raise and appro- priate a sum of money for the purpose of developing and constructing an inclosed Athletic Field, with suitable bleachers, apparatus, and other equipment upon premises formerly owned by the Milford Iron Foundry and land adjacent thereto owned by the Town, in co-operation with the Works Progress Administration or other Gov- ernmental Agencies; or take any action in relation thereto.


Article 23. To see if the Town will accept the recom- mendations of the Zoning Board appointed by the Select- men under Article 14 of the Annual Town Meeting, 1937, in accordance with G. L. (Ter. Ed.) Chapter 40, Sections 25-30A (inserted by Statute 1933, Chapter 269) as amended, for the purpose of originally establishing the boundaries of the districts and the regulations and re- strictions to be enforced therein, and adopt such ordi- nances or by-laws with respect thereto as may be con- tained in said recommendations; or take any other action in relation thereto,

Article 24. To see if the Town will authorize the Selectmen to sell the premises located on the southerly side of Central Street at or near Beach Street Extension, formerly known as the "Hoboken" School, and to execute, acknowledge and deliver a proper deed or deeds therefor ; or take any action in relation to the same.


Article 25. To see if the Town will authorize the Selectmen to sell the premises located on the easterly side of Beaver Street formerly known as the "Bear Hill School," and to execute, acknowledge and deliver a proper deed or deeds therefor; or take any action in relation to the same.


Article 26. To see if the Town will authorize the Selectmen to sell a portion of the premises now owned by the Town as part of the Cedar Swamp Pond Develop- ment, bounded and described as follows:


A certain parcel of swamp land described as follows:


Commencing at the northwesterly corner of land of one Casassanta and the northeasterly corner of land of one Diotalevi; thence in a curved line easterly and north- erly along the shores of Cedar Swamp Pond, 220 feet more or less on the northerly side of land of one Casas- santa, 30 feet more or less by the westerly side of land of one Delledonna, and 140 feet more or less by the west- erly side of land of one DeGregorie; thence westerly 130 feet; thence southerly 190 feet more or less to the point of beginning, and containing about 31,500 square feet.


Said premises are shown on a plan of Swamp Land, Rear Hayward Field, May 12, 1939, Joseph A. Visconti, C. E .; and to execute, acknowledge and deliver a proper deed or deeds therefor; or take any action in relation to the same.


Article 27. To see if the Town will vote to instruct the Selectmen to appoint a committee of five citizens for the purpose of investigating the advisability of amending the Traffic Rules and Regulations with respect to limited time parking on certain streets; or take any action in relation thereto.


Article 28. To see if the Town will raise and appro- priate a sum of money for the purpose of repairing Fells Avenue, or take any action in relation thereto.

Article 29. To see if the Town will vote to raise and appropriate a sum of money for the erection of a new Police Station and Courthouse upon premises owned by the Town in cooperation with the Works Progress Ad- ministration or other Governmental Agencies; or take any action in relation thereto.


Article 30. To see if the Town will vote to raise and appropriate a sum of money for the purpose of installing street electric lights from the intersection of Granite and Sumner Streets, thence running easterly to a right of way at the Cedar Swamp Development, thence northerly and easterly along the right of way and across the dam, and thence southerly along the easterly side of the chan- nel to E. Main Street," or take any action in relation thereto.


Article 31. To see if the Town will vote to raise and appropriate the sum of Four hundred thirty-seven dollars and sixty-three cents ($437.63) to the Board of Health for care of patients at Worcester County Sanatorium from December 1st through December 31st 1939, or take any action in relation thereto.


Article 32. To see if the Town will raise and appro- priate the sum of Five thousand ($5,000.00) dollars for the purpose of making general repairs upon certain school buildings in the Town, in co-operation with the Works Progress Administration or other governmental agencies ; or take any action in relation thereto.


Article 33. To see if the Town will vote to raise and appropriate the sum of Seven thousand five hundred dol- lars ($7,500.00) for repairs at the Plains Primary School, or take any action in relation thereto.


Article 34. To see if the Town will vote to raise and appropriate the sum of Six hundred dollars ($600.00) to repair the Town Park Bleachers, or take any action in relation thereto.


Article 35. To see if the Town will vote to elect at the next Annual Town Meeting to be held in 1941, one Select- man for one year, one for two years, and one for three years, and thereafter elect one Selectman each year for a three-year term, or take any action in relation thereto.

Article 36. To see if the Town will vote to accept on the laying out as a Public Way, a private way known as Hamilton Avenue, running from E. Main Street to Cedar Street, or take any action in relation thereto.


Article 37. To see if the Town will vote to raise and appropriate a sum of One hundred fifty dollars ($150.00) for the purpose of laying out Hamilton Avenue as a Public Way, or take any action thereto.


Article 38. To see if the Town will vote to raise and appropriate One thousand dollars ($1000.00) to be used for care and maintenance of Cedar Swamp Pond Develop- ment Property, now owned by the Town, or take any action in relation thereto.


Article 39. To see if the Town will vote to authorize and direct the Selectmen to petition the General Court for legislation authorizing the Town to establish a de- partment of Public Works to exercise the duties of the highway department, including the superintendent of streets, the Park Commissioners, the Sewer Commission- ers, Cemetery Commissioners and Tree Warden as now constituted, or take any action in relation thereto.


Article 40. To see if the Town will vote to raise and appropriate the sum of One thousand five hundred dollars ($1,500.00) for drainage and repair of John Street, or take any action in relation thereto.


Article 41. To see if the Town will vote to raise and appropriate a sum of money for the installation of elec- tric plugs in the Town Hall, or take any action in relation thereto.


The polls will be open from seven A. M. until eight o'clock P. M.


And you are hereby directed to serve this Warrant by publishing at least seven days before said meeting an attested copy of this warrant in the Milford Daily News, a newspaper published and having a general circulation in the Town of Milford, and by posting at least seven days before said meeting attested copies of this warrant in five or more public places located in said Milford.

ANNUAL TOWN MEETING, MARCH 13, 1940

Milford, March 13, 1940.


At a legal meeting of the inhabitants of the Town of Milford qualified by law to vote in Town Affairs held in Town Hall on the thirteenth day of March, 1940, the said inhabitants proceeded as follows :


The meeting was called to order by Moderator, John T. McLoughlin, at 8 P. M.


The following monitors were appointed by the Modera- tor to check the lists of Town Meeting Members and Members-at-Large:

Precinct 1-J. Frank Cahill


Precinct 2-Angelo Barbadoro


Precinct 3-William J. Moore


Precinct 4-Alfred E. Daigle


Precinct 5-Charles W. Gould


George F. Grayson was appointed to fill the vacancy in Members-at-Large incurred by the absence of Mr. Adams.


The following were appointed by the Moderator to check the voting lists :


George W. Billings, John J. Best, William E. Moore.


The Monitors checked the lists and the result was:


At Large, 15; Precinct 1, 33; Precinct 2, 30; Precinct 3, 31; Precinct 4, 26; Precinct 5, 39.


A quorum present the Town Clerk read the warrant and the Officer's Return thereon.


Article 1. Voted: To accept the report of all Town Officers as printed in the Annual Town Reports.


Article 2. Myron Morey, Secretary of the Finance Committee, presented the following report of the Finance Committee :
