VOTED: That all items to which no objection was made in the Finance Commission's report be raised and appropriated.

Article 3. VOTED: That the Town vote to author- ize the Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1st 1950, and to issue a note or notes therefor, payable within one year, and to renew such note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, of the General Laws.


Article 4. VOTED: That the Town vote to author- ize the Selectmen to take charge of all legal proceedings for or against the town.

Article 5. VOTED: That the Town vote to choose Mrs. Lillian Luby as Director of County Aid to Agricul- ture in accordance with the provisions of Chapter 128, of the General Laws.


Article 6. VOTED: That the Town vote to author- ize the Selectmen to sell any or all real estate owned by the Town by reason of the foreclosure of tax titles there- on, and to execute, acknowledge and deliver a proper deed or deeds therefor, authority therefor to terminate March 1st 1950.


Article 7. A motion was made and seconded that the sum of $50,000.00 be appropriated from available funds under the Excess and Deficiency Account for use by the Board of Assessors in fixing the tax rate for 1949.


An amendment to the motion was made to strike out the sum of Fifty thousand ($50,000.00) dollars and sub- stitute free cash available. The question then came upon the amendment and it was VOTED: That the Town vote to appropriate from available funds under the Excess and Deficiency Account free cash available for use by the Board of Assessors in fixing the tax rate for 1949.


Article 8. VOTED: That the Town vote to fix the salary and compensation of all elective officers of the Town as provided by Section 108 of Chapter 41, General Laws, as amended and such salary and compensation be made effective from January 1, 1949:

Article 18. VOTED: That the Town vote to author- ize the Selectmen to name the square formed by the inter- section of Fells Avenue and Purchase Street, as the Pres- ton E. Peaslee Square.


Article 19. VOTED: That the Town vote to raise and appropriate the sum of Forty-one hundred forty-four ($4144.00) dollars for the construction of a sidewalk on Lawrence Street from South High Street to the end of Lawrence Street.


Article 20. VOTED: That the Town vote to raise and appropriate the sum of Sixteen hundred ($1600.00) dollars for the purpose of preparing and publishing a valuation book covering valuations of all real and personal estates in the town, the same to be expended under the jurisdiction of the Board of Assessors, copies thereof to be issued to the public at a cost of not less than Fifty (50ยข) cents for each book.


Article 21. A motion was made and seconded that the Town vote to raise and appropriate the sum of Thirty- two hundred ($3200.00) dollars for the purpose of resur- facing Maple Street.

A motion was made and seconded to pass over the ar- ticle and it was so voted.


Seven (7) persons having stood to doubt the vote a standing vote was taken by the Monitors and there were 67 in favor and 67 opposed to passing over the article therefore the Moderator ruled the motion to "pass over" was lost, and it was


VOTED: That the Town vote to raise and appro- priate the sum of Thirty-two hundred ($3200.00) dollars for the purpose of resurfacing Maple Street.


Article 22. VOTED: That the Town vote to trans- fer from the Parking Meter Collection Account to the Po- lice Department, Parking Meter Maintenance and Opera- tion Account, the sum of Three thousand ($3000.00) dol- lars for the purpose of salaries.


A motion was made and seconded to reopen Article 2. A standing vote being necessary the Monitors took a standing vote and there being 136 in favor and 9 opposed to re-opening Article 2 it was


VOTED : To take up Article 2.


It was moved and seconded that the item of Police Salaries and Wages be raised to $47,198.00 instead of $44,198.00.


A motion was made to pass over Article 2 and the motion was declared lost by the Moderator.


It was moved by Mr. Nelson to reconsider Mr. Fitz- patrick's motion that had been voted.


A standing vote being necessary to reconsider, the Monitors took the vote and there being 126 in favor and 10 opposed it was


VOTED: To reconsider action taken on Mr. Fitz- patrick's motion.

An amendment was offered that the report of the Finance Committee pertaining to Salaries and Wages in the Police Department be accepted, which amendment was carried.


A motion was made and seconded to pass over the article and it was so voted.


Mr. Cenedella made a motion that the Town Counsel be directed by the meeting to prepare a motion limiting the "passing over" rule and present such motion at the next meeting and it was so voted.


A motion was made and seconded to adjourn the meeting to Monday at 8 P. M. and it was so voted.


The meeting was dissolved at 10:30 P. M.

ADJOURNED TOWN MEETING, MARCH 21, 1949


The Moderator called the meeting to order and the Monitors checked the list, and 156 persons being present a sufficient number to constitute a quorum the meeting was opened.


The Town Counsel, Mr. Visconti, presented a rule for adoption.

It was moved and seconded that we establish at this meeting that the rule to "pass over" an article be debat- able.


It was moved and seconded to amend the motion that the Rule, if adopted, become effective immediately. The amendment was accepted and the Chair so declared it. It was


VOTED: That the meeting establish at this meeting that the Rule to "pass over" an article be debatable and this to become effective immediately.


Article 23. VOTED: That the Town vote to trans- fer from the Parking Meter Collection Account to the Po- lice Department, Parking Meter Maintenance and Opera- tion Account, the sum of Two thousand ($2,000.00) dol- lars, for the purpose of maintenance.


Article 24. VOTED: To pass over the article.


Article 25. VOTED: That the Town vote to author- ize the Chief of the Fire Department to sell any obsolete apparatus or equipment, owned by the Town and present- ly controlled by the Fire Department.


It was moved and seconded to reconsider Article 13. A standing vote being necessary for reconsideration, the Monitors took the check and there were 109 persons in favor of reconsidering and 17 opposed so therefor the motion to reconsider was successful.


A motion was made and seconded that the Selectmen of the Town of Milford be authorized to petition the Gen- . eral Court for authority to sell or lease a tract of land of the Milford Town Park as described under Article 13 of the Town Warrant.


An amendment to the motion was made by Mr. Ma- ressa that the words "to sell" be struck out.


An amendment to the motion was made by Mr. Maressa to strike out the words "to Sell" and authorize

the Selectmen to petition the Legislature to "lease" a piece of land on Town Park.


Mr. Egan made an amendment to the amendment that the question of selling or making any alterations to Town Park be put on the ballot at the next town election. The amendment to the amendment was seconded. A voice vote was taken on the amendment and it was declared lost.


An amendment to the amendment was made and seconded that the Board of Selectmen be instructed to petition the General Court for authorization to use a tract of land on Milford Town Park for the purpose of constructing a World War II Memorial Building.


The motion was lost by a voice vote. Seven (7) persons having stood to doubt the vote a standing vote was taken by the Monitors and there were 67 in favor of the amendment to the amendment and 45 opposed the amendment to the amendment was carried.


Article 26. VOTED: That the town vote to raise and appropriate the sum of Twenty-five dollars and nine- ty ($25.90) cents for the payment of unpaid bills of the Old Age Assistance Account of Public Welfare.


VOICE VOTE: Unanimous.


Article 27. VOTED: That the Town vote to raise and appropriate the sum of Two thousand four hundred and seventy-four dollars and thirty-four cents ($2,474.34) for the payment of unpaid bills of the General Welfare Account of Public Welfare.


VOICE VOTE: Unanimous.


Article 28. VOTED: That the Town vote to raise and appropriate the sum of Three hundred sixty-seven dollars and seventy-two cents ($367.72) for the payment of unpaid bills of the Town Infirmary Account of Public Welfare.


VOICE VOTE: Unanimous.

Article 29. A motion was made that the Town vote to raise and appropriate the sum of Thirty-two hundred ($3200.00) dollars for the construction of a sidewalk on So. Main Street beginning at the inter- section of Fruit and So. Main Streets a distance of approximately 600 feet and also continuing from the Nobel Ray property to the Grafton R. R. crossing a distance of approximately 210 feet.


Thirteen (13) persons having stood to request a ballot vote the Moderator appointed the following persons to supervise the election :


Bernard J. Keenan, John N. Morcone and John C. Usher.


The Monitors distributed the yes and no ballots and the voting was done by precincts with the monitors checking off each voter as ballot was deposited in ballot box.


The result of the ballot was announced and 93 persons having voted in the affirmative and 58 persons having voted in the negative it was


VOTED: That the Town vote to raise and appro- priate the sum of Thirty-two hundred ($3200.00) dollars for the construction of a sidewalk on So. Main Street be- ginning at the intersection of Fruit and So. Main Streets a distance of approximately 660 feet and also continuing from the Nobel Ray property to the Grafton R. R. cross- ing a distance of approximately 210 feet.


Article 30. VOTED: That the Town vote to res- cind the action taken under Article 29 at the adjourned Town Meeting held March 15, 1948.


Article 31. It was moved and seconded to disburse with the reading of Article 31.

VOTED : That the Town vote to authorize the Select- men to sell two parcels of land off Hayward Field and to execute and deliver instruments therefor, as described under Article 31.

VOTED: That the Town vote to author- ize the transfer of the sum of Two thousand ($2000.00) dollars from the Sale of Cemetery Lots and Graves Ac- count for the purpose of paving cemetery roads at Vernon Grove Cemetery, said work to be done under the super- vision of the Vernon Grove Cemetery Trustees.


Article 33. VOTED: To pass over the article.


Article 34. VOTED: That the Town vote to raise and appropriate the sum of Two thousand ($2000.00) dollars for the construction of Madden Avenue, from the end of the present construction to the end of the accept- ed street, a distance of 450 feet.


Article 35. VOTED: That the Town vote to raise and appropriate the sum of Fifteen thousand three hun- dred and twenty-five ($15,325.00) dollars for use by the Milford Athletic Field Committee to complete the con- struction and facilities of Fino Athletic Field.


Article 36. VOTED: That the Town vote to raise and appropriate the sum of three hundred ($300.00) dol- lars for general expenses and construction of the Town Forest, to be expended under the direction of the Town Forest Committee.
