Town Counsel's Report
To the Honorable Board of Selectmen :
During the year 1949, five new claims for personal injuries and one new claim for property damage were made against the town. Of these six claims, two have been settled; one suit was brought and is now pending in the Worcester Superior Court; the remaining three are now in the process of settlement.
As to the old claims which had not been settled at the time I assumed the duties of Town Counsel, one was set- tled in the Superior Court and the other two are still pending in the same Court. Of the pending claims in Court, it appears that none will be settled.
Two actions were brought by the City of Worcester against the Town of Milford on matters pertaining to the Department of Public Welfare. It is more than likely that both will be settled to the satisfaction of both municipal- ities.
In the action of Comba vs. The Inhabitants of the Town of Milford in the matter relating to the Public Li- brary which was tried in the Worcester Superior Court, a verdict for the town was directed after the completion of all the evidence. The Plaintiff, however, has taken excep-

tions to the Court's ruling and, as a result, final deter- mination of the case may have to be made by the Supreme Court.
Various instruments and deeds were made out for different departments during the year which have been recorded in the Worcester District Deeds.
Throughout the year, many opinions, some written and some oral, were given to various Departments and De- partment Heads from time to time. Conferences and con- sultations were held with state officials in matters affect- ing the town's interests and, also, attendance at hearings before the Department of Public Utilities was required.
To all Departments, Department Heads, my sincere thanks for the courtesies and co-operation extended to me the past year.
