Annual Report of the Board of Selectmen
Your Board organized on March 3rd. Mr. John P. Pyne was elected Chairman. Meetings were held on Monday evenings. Numer- ous other meetings were held throughout the year.
The year 1959 was a remarkable year for the town in that over $1,250,000 in municipal building construction was completed. The new Memorial Elementary School located on a section of the Town Park was completed and turned over to the School Com- mittee in the month of September. This twenty classroom building, representing a capital expenditure of $900,000, will house. 700 chil- dren from pre-primary to the fifth grade. This building will also serve as the polling place for Precinct 5 in all future elections.
Also completed in the year 1959 was the $360,000 addition to the Sewage Disposal Plant. The plant is presently in use and pro- vides the townspeople with sewage disposal facilities of the most modern kind.
During the year the Board directed the Town Counsel to draft new Traffic Rules and Regulations to replace the ones now in effect which were accumulations of rules and orders from previous boards over the past 35 years. The new rules, approved by the Department of Public Works, became effective on November 11, 1959 and satis- fied a much needed recodification which was long overdue.
One of the great problems confronting the inhabitants is the lack of a definitive zoning law. We are just entering what many people are calling the "fabulous sixties" with predictions by respon- sible groups that Milford lies within the path of the move westward and that we can expect substantial population shifts and growth in the next 10 years. It is disturbing to have to report that we face these possibilities with a zoning by-law without lot-size require- ments, without front, side, or back yard setback requirements, without prohibition against the use of trailers in residential areas, without prohibition against the stripping of top soil and without the requirement for the construction of sidewalks in newly devel-

oped projects. Our zoning by-law is by comparison with the codes in Framingham, Natick, Westboro and other towns the most liberal in the area.
By virtue of these liberal provisions, and because we have neither a building nor a plumbing code, we could experience the construction of many hundreds of low-cost dwellings by outside real estate speculators whose customers would come from the Framingham-Natick area where this type of construction is not possible. This type of growth, if it occurred in a short period of time, would bring with it many problems-educational facilities would be further strained, sewer facilities would have to be extended, provisions would have to be made for police and fire protection, and large expenses would have to be borne for highway and sidewalk construction and maintenance.
Your Board does not recommend the type of zoning or plumbing by-laws which would make it too expensive for the person of ordinary means to build his home here. What your Board does recommend is that when real estate speculators submit plans for developing an area that there is no overcrowding, and that proper provisions are made for sewage disposal, sidewalk construction, and playground facilities.
One of the great problems still facing the Board is the matter of the flood control program for the lower Central Street area. Because the Town was unable to obtain release for land damages from one of the property owners over whose land the project is planned, this portion of land must be taken by eminent domain. This is a town meeting matter and it will be placed on the warrant for the next annual Town Meeting.
Finally a word about requests for new capital projects. To spend and so tax in excess of the taxpayers ability or willingness to pay is dangerous to the general welfare and prosperity of the Town. It is obvious that the Town of Milford is not in a position financially to provide and pay for all requests for capital improve- ments, regardless of their desirability.
It is recommended that a firm policy be established whereby all future expenditures for capital improvements be so planned and

scheduled as to provide for gradual reduction of the more than one million town debt with a development of a pay-as-you-go policy --- barring exceptional growth and increase in the future tax base.

Town Counsel's Report
To the Honorable Board of Selectmen:
Gentlemen:
I herewith submit my report to you for the year 1959:
During the year I brought suit on behalf of the Town for recovery of $10,373.00, money paid by the Welfare Board for assistance. I also brought suit for the recovery of abated taxes for the years 1942 through 1955. This case was appealed to the Supreme Judicial Court and resulted in a decision for the Town amounting to $1,183.00.
This decision was noted by the State Bureau of Local Taxa- tion as being of vital importance in the collection of taxes in the 351 cities and towns in the Commonwealth.
I have entered my appearances on behalf of the Board of Assessors in two Tax Appellate Board matters involving the refusal by the Assessors to abate two parcels of Main Street real estate. I expect that both these cases will end in favorable decisions for the Town.

I have also filed an Answer in the Middlesex Superior Court at Cambridge in a suit in contract for $10,000 brought by a Newton firm for damages which they allege they incurred in not being awarded a sub-contract for the construction of the sewage disposal plant.
The nine land damage cases resulting from the reconstruction of Dilla Street were heard last November by Judge Edward Pecce of the Superior Court sitting at Worcester. At the writing of this report no decision has been received.
I believe it noteworthy to report at this time that the land takings and easements involved in the reconstruction of this street could have resulted in 65 claims against the Town. However, the Town has had to answer for only nine claims.

All of the personal injury cases settled except one were of the minor kind. The one case not considered minor was caused by a sidewalk defect resulting in a very serious injury to a female citizen of this Town. The defect was investigated a few hours after it was reported by the Highway Surveyor and Sgt. Raymond Cross of the Police Department. Photos and measurements of the defect were also obtained.
There are yet outstanding four claims for personal injuries received for alleged sidewalk defects. There are two suits against the Town for land damages due to the reconstruction of Freedom Street.
At your suggestion I have appeared before the Department of Public Utilities, the State House and at the Department of Public Works on several occasions. I have also during the year rendered to the different Boards and public officials and employees of the Town of Milford legal advice and opinions in accordance with my duties under our by-laws.
Late in the year I finished the project of recodifying the By- Laws, Rules and Regulations of the Town. These are now embodied in accordance with your directions in an eighty-two page pam- phlet which is now ready for limited distribution. This is the first time in almost twenty years that this project has been undertaken.

Report of Animal Inspector
December 15, 1959
To the Honorable Board of Selectmen Milford Town Hall
Milford, Massachusetts
Gentlemen:
I hereby submit my report as Animal Inspector for the Town of Milford for the year ending December 31, 1959.
There were 58 cases of dogs investigated and quarantined for having bitten people, however, no sign of Rabies was reported in any of the cases.
As required for the Commonwealth of Massachusetts, and in accordance with Section 19, Chapter 129 of General Laws all barns and livestock in the Town were inspected and found to be satis- factory.
In conclusion I wish to thank the Board of Health and the citizens of Milford for their cooperation during 1959.
