Voted: That the Town grant to Massachusetts Electric Com- pany the rights and easements for the construction, maintenance and operation for the transmission of electricity, lines of buried cables and cables installed in underground conduits together with the necessary manhole openings across, through and under a por- tion of its land situated on the northerly side of Central Street in the Town of Milford.


Said easement being a strip of land 30 feet in width beginning on the northerly side of Central Street and extending in a northerly direction to the land of Annibale Sciarillo and shown as "shaded" on a plan entitled: "NEW ENGLAND POWER SERVICE COM- PANY PART OF NEW ENGLAND ELECTRIC SYSTEM, BOS- TON, MASS. PLAN SHOWING EASEMENT ACROSS LAND IN MILFORD, MASSACHUSETTS TO BE CONVEYED TO MASSACHUSETTS ELECTRIC COMPANY BY TOWN OF MILFORD SCALE 1"=60' DATE: MAR. 5, 1962 L-7404," and to seal, acknowledge and deliver an easement deed in the name and behalf of the Town of Milford to Massachusetts Electric Company. Such deed to be in such form as the Selectmen may deem proper.

Article 52. To see if the Town will vote to raise and appro- priate the sum of Seven hundred ($700.00) dollars to reconstruct the bridge on Mellon Street in conjunction with the Town of Hope- dale. Said money to be expended under the supervision of the Board of Selectmen, or take any action in relation thereto. (High- way Dept. )

Article 53. That the Town adopt a By-Law reading as fol- lows: Every Town-owned motor vehicle, except a vehicle designed specifically for snow removal or construction purposes, shall display prominently on each side the seal of the Town with the words TOWN OF MILFORD in large block letters above the seal and the name of the Department in large block letters below the seal. The requirements of this by-law may be varied or suspended with regard to any motor vehicle with the consent of the Selectmen if it is shown to be not practical to comply with the requirements of the by-law with respect to such vehicle, or take any action in relation thereto. It was moved and seconded to pass over the article. The Chair declared the motion lost. The following persons stood and doubted the vote: William F. Fitzpatrick, A. Raymond Cross, Bernard Hickey, Edward Casey, Peter Costanza, John DePaolo, Ernest Bilsbury and James Curley.


A standing vote was taken on "passing over Article 53." 82 per- sons voted in the affirmative and 75 persons voted in the negative, the motion to "pass over" was carried.


It was moved and seconded to reconsider Article 49. The fol- lowing persons stood to have the vote taken by "written ballot": Anthony Allegrezza, Marco Balzarini, George Belforti, Pasquale Macchi, Dewey Zacchilli, Charles Abrahamson and Carlo Pagucci.


It was moved the "previous question" and was so voted by a % majority.


The question now came on the motion for reconsideration to be taken by a "written ballot". The result of the ballot was an- nounced by the Moderator. 102 persons voted in the affirmative and 95 persons voted in the negative, the motion was carried.


The question now came on the motion as previously submitted, the vote on same to be taken by written ballot. It was moved and seconded to "pass over the article".


The following persons stood and requested a written ballot on the motion "to pass over Article 49": Anthony Allegrezza, George Belforti, Carlo Pagucci, Francis Byron, Albert Luby, Evelyn Alle- grezza and Aldo Allegrezza.


Question now came on passing over Article 49 and the result of the ballot showed 137 persons voted in affirmative and 62 persons voted in negative, the vote to "pass over the article" was carried.


Article 54. To see if the Town will vote to purchase from Domenic Bozzini all or part of the premises located on the northerly side of West Fountain Street as described in the deed of John C. Ripley to John C. Ripley and Francis E. Larkin, dated February 29,

1960 and recorded with the Worcester District Deeds Book 4152, Page 249; and for said purposes to raise and appropriate or appro- priate by transfer from available funds, a sum of money for the purchase of the same. (Domenic Bozzini)


Voted: That the Town vote to raise and appropriate the sum of Nine thousand ($9,000.00) dollars for the purpose of purchasing from Domenic Bozzini land with the buildings thereon, located on the Northerly side of West Fountain Street in Milford, Massachu- setts, bounded and described as follows:


Beginning at a drill hole in a stone at the southeasterly corner of the granted premises on said West Fountain Street at land now or formerly of one Macuen;


Thence N. 2° 30' E. by said Macuen land, as the wall now stands, 296.50 feet to a drill hole in a stone at other land of said Macuen;


Thence N. 89º 12' W. by said Macuen land, 378 feet to other land of said Macuen;


Thence S. 30° 35' W. by last mentioned land, 88 feet to said Fountain Street;


Thence S. 69º 45' E. by said street, 243.50 feet to an angle in said street;


Thence N. 80° 40' E. by said street, 154 feet to the point of beginning.


Being all and the same premises as described in the deed of John C. Ripley to John C. Ripley and Francis Larkin, dated Febru- ary 29th, 1960, and recorded with the Worcester District Deeds Book 4152, Page 249.


Standing vote-91 voted in the affirmative and 23 voted in the negative.


Article 55. To see if the Town will amend the By-Laws of the Town of Milford by adding thereto rules and regulations and a schedule of fees concerning Transient Vendors under Mass. Gen- eral Laws, Chapter 101, Section 5, or take any action in relation thereto. (Downtown Milford Merchants )


Voted: That the by-laws of this town be amended by adding the following:


"In accordance with Chapter 101, Section 5, every transient vendor before making sales of merchandise in this town, shall be required to make application to the Police Department stating the names and residences of the owners or parties in whose interest said business is to be conducted, and that upon Police Department ap-

proval said transient vendor shall apply to the Board of Selectmen and file with them a true statement, under oath, of the average quantity and value of the stock of merchandise kept by him for sale. Said Selectmen shall then submit this statement to the Assessors of the Town of Milford for examination and inquiry. Thereupon the Selectmen shall authorize the Town Clerk, upon payment to the Town of Milford by the applicant of a fee equal to the taxes assessable under the last preceding tax levy, to issue a license for sale of such merchandise.


This by-law shall specifically exclude permanently located sea- sonal businesses normally assessed and taxed by the Town of Milford."


Voice vote unanimous.


Article 56. To see if the Town will raise and appropriate or transfer from available funds in the Treasury a sum of money to the Stabilization Fund established by vote of the Town Meeting of 1961 Article 40, or take any action in relation thereto. (Finance Board)


Voted: That the Town vote to transfer from the Excess and Deficiency Account to the Stabilization Fund established by vote of the 1961 annual Town Meeting the sum of $56,000.00.


Article 57. To see if the Town will vote to raise and appro- priate the sum of Seven hundred sixty-two ($762.00) dollars for the purpose of erecting a fence at Tomaso Field, or take any action in relation thereto. (Park Department )


Voted: That the Town vote to raise and appropriate the sum of Seven hundred sixty-two ($762.00) dollars for the purpose of erecting a fence at Tomaso Field.


Article 58. To see if the Town will vote to raise and appro- priate the sum of $25,000.00 for the construction of a relief sewer from main sewer to Charles Street Pumping Station and to deter- mine whether the money shall be provided for by taxation, or by appropriation from available funds in the treasury, or by borrowing under authority of Chapter 44 of the General Laws, as amended or take any action in relation thereto. (Sewer Dept.)

Article 61. To see if the Town will vote to raise and appro- priate the sum of $18,000.00 for the installation of a pumping sta- tion on Depot Street and to determine whether the money shall be provided for by taxation, or by appropriation from available funds in the terasury, or by borrowing under authority of Chapter 44 of the General Laws, as amended, or take any action in relation thereto. (Sewer Dept. )


Article 62. To see if the Town will vote to raise and appro- priate the sum of $26,000.00 for the removal of a temporary meas- uring flume and the installation of a permanent flume and com- minutor equipment and to determine whether the money shall be provided for by taxation, or by appropriation from available funds in the treasury, or by borrowing under authority of Chapter 44 of the General Laws, as amended, or take any action in relation thereto. (Sewer Dept.)


Voted: That the Town vote to appropriate the sum of $50,000.00 of which $6,000.00 shall be for replacement of a pump at the Charles Street pumping station (Article 59); $18,000.00 shall be for the installation of a pumping station on Depot Street ( Article 61); and $26,000.00 shall be for the removal of the temporary measuring flume at the sewage plant and the installation of a permanent flume and comminutor equipment and to meet this appropriation the sum of $6,000.00 be raised by taxation in the current year and that the Treasurer, with the approval of the Select- men, be authorized to issue $44,000.00 bonds or notes of the Town payable within 30 years under Chapter 44 of the General Laws, as amended.

Article 60. To see if the Town will vote to raise and appro- priate the sum of $92,000.00 for the construction of an outgall force main from Charles Street pumping station to the Sewage Treatment Plant and to determine whether the money shall be provided for by taxation, or by appropriation from available funds in the treasury, or by borrowing under authority of Chapter 44 of the General Laws, as amended, or take any action in relation thereto. (Sewer Dept. )

Article 63. To see if the Town will vote to raise and appro- priate the sum of $10,000.00 for acquisition of land and easements required in the proposed work on the Sewerage System for the year 1963, or to act on anything relating thereto. (Sewer Dept.)

Article 70. So see if the Town will vote to raise and appro- priate the sum of $15,000.00 for the extension of a sewer on the upper end of Central Street from Alden Street to a distance of 1250 feet, or take any action in relation thereto. (Joseph R. Manella )

Article 71. To see if the Town will appropriate a sum of money to establish a recreation program for physically handicapped children under Mass. General Laws, Chapter 69, Section 29D, or take any action in relation thereto. (Handicapped Children's Association )


Voted: That the Town vote to raise and appropriate the sum of $1,000.00 to establish a recreation program for retarded children under Mass. General Laws, Chapter 69, Section 29D.


Article 72. To see if the Town will vote to raise and appro- priate the sum of $4,000.00 for the construction of a sidewalk on the northerly side of Florence Street a distance of 650 feet, or take any action in relation thereto. (John H. Besozzi, Jr.)

Article 73. To see if the Town will vote to accept Chapter 749 as passed by the 1962 Legislature and act on all matters re- lating thereto. This act if accepted by the Town of Milford, Upton and Hopkinton, would restore the boundary lines at North Pond to about where they were before the change of boundary in 1907, and restore Spindle Island to the Town of Upton, or take any action in relation thereto. Voted: That the Town vote to accept Chapter 749 as passed by the 1962 Legislature. Voice vote unanimous.


Article 74. To see if the Town will vote to raise and appro- priate the sum of $2,000.00 to be used by the Board of Health to spray the Town for mosquito control, or take any action in relation thereto. ( Board of Health)


Voted: That the Town vote to raise and appropriate the sum of $2,000.00 to be used by the Board of Health to spray the Town for mosquito control.


It was voted to reconsider Article 66. A standing vote showed 65 persons voted in the affirmative and 47 persons voted in the negative, the motion carried.


Article 66. Voted: That the Town raise and appropriate the sum of $4200.00 for the construction of a sewer on northerly side of Rogers Street from easterly side of Woodland Avenue to a distance of 350 feet.

Article 75. To see if the Town will vote to raise and appro- priate the sum of $14,000.00 to be used in conjunction with $39,000.00 already appropriated by Article 49 of the warrant for the annual Town Meeting of 1962, the total, or any part of said appro- priations, to be used for reconstruction, renovation, purchase of filter, circulation system, or other equipment for the swimming pool facility at Fino Field; and to determine whether said money shall be provided for by taxation, by appropriation from available funds in the Treasury, or by borrowing under authority of Chapter 44 of the General Laws, as amended, or take any action in relation thereto. Voted: That an additional sum of $14,000.00 be appropriated for the reconstruction and renovation of the swimming pool facility at Fino Field and that to meet said appropriation $8,100.00 be transferred from the Archer Rubber Land Fund and that $5,900.00 be appropriated from the excess and deficiency fund. Said sum to be expended under the jurisdiction of the Board of Selectmen.


Article 76. To see if the Town will raise and appropriate a sum of money for the installation of an elevator at the Milford Public Medical Home, and add to the present one story building a second story for use as an all-purpose room, and to determine whether the money shall be provided for by taxation, by appro- priation from available funds in the treasury or by borrowing under authority of Chapter 44 of the General Laws, or take any action in relation thereto. (Welfare Board)


Voted: That the Town vote to raise and appropriate the sum of Forty thousand ($40,000.00) dollars for the installation of an elevator at the Milford Public Medical Home and add to the present one story building a second story for use as an all-purpose room, and to meet the said appropriation the amount of Ten thousand ($10,000.00) dollars be raised in the tax levy of the current year, and that the treasurer be authorized to borrow a sum not to exceed Thirty thousand ($30,000.00) dollars and to issue bonds or notes to be payable in accordance with the provisions of Chapter 44 of the General Laws; the whole loan shall be paid in not more than ten years (10) or at such a period of time as may be determined by the Town Treasurer with the approval of the Select- men. Standing vote unanimous.

To see if the Town will vote to raise and appro- priate the sum of Eleven thousand two hundred ( $11,200.00) dollars to be used to construct a permanent band shell, completely equipped, in Town Park, said band shell to be used as a stage and facility for outdoor civic events, or take any action in relation thereto. SPECIAL TOWN MEETING, AUGUST 28th, 1963


The meeting was called to order by Moderator Curran at 8 P.M. The Monitors reported 120 members present, a sufficient number for a quorum.


Moderator Curran requested and received unanimous consent to permit WMRC to broadcast the meeting.


The members were informed by the Moderator that Chapter 320 of the Acts of 1963 relative to secret ballots was now in effect and the act was read by the Moderator.


Article 1. To see if the Town will vote to transfer the sum of Five thousand ($5,000.00) dollars from the Chapter 90 Congress Street Account to the Maintenance of Streets and Sidewalks Ac- count of the Highway Department, or take any action in relation thereto.


Voted: That the Town vote to transfer the sum of Five thousand ($5,000.00) dollars from the Chapter 90 Congress Street Account to the Maintenance of Streets and Sidewalks Account of the Highway Department.


Article 2. To see if the Town will vote to transfer the sum of Three thousand five hundred ($3,500.00) dollars from the Chapter 90 Highland Street Account to the Maintenance of Streets and Sidewalks Account of the Highway Department, or take any action in relation thereto.

To see if the Town will vote to transfer the sum of Three thousand five hundred ($3,500.00) dollars from the Chapter 782-State Aid Account to the Chapter 90-Highland Street Ac- count, the same to be expended under the supervision of the Board of Selectmen, or take any action in relation thereto.


Voted: That the sum of Three thousand five hundred ($3,500.00) dollars be transferred from the proceeds to be received from the State under provision of Chapter 782 of the Acts of 1962 to meet the Town's share of the cost of Chapter 90 Highway Construc- tion of Highland Street, for 1963. Said money to be expended under the jurisdiction of the Board of Selectmen.


Article 5. To see if the Town will vote to appropriate from available funds in the treasury, a sum of money to the Department of Veterans' Services-General Expense Account, or take any action in relation thereto.


Voted: That the Town vote to appropriate through transfer from available funds in the Treasury, the sum of $12,000.00. Said money to be used in the Department of Veterans' Services General Expense Account.


Article 6. To see if the Town will vote to raise and appro- priate, transfer from available funds in the treasury, or transfer from the construction of Band Shell Account, a sum of money for the purchase of a mobile outdoor stage Band Shell, fully equipped, or take any action in relation thereto.
