ARTICLE 55. To see if the Town will vote to raise and ap- propriate the sum of $20,000.00; for the continuation of improving the town office facilities in the Town House, and authorize the Board of Selectmen to call for bids and award contracts.


Upon motion duly seconded, it was VOTED to raise and ap- propriate the sum of $10,500.00, with the unexpended bal- ance of $5,892.29, for the continuation of improving the town office facilities in the Town House, and authorize the Board of Selectmen to call for bids and award con- tracts.


ARTICLE 56. To see if the Town will vote to change from Single Residence A District to Business District the fol- lowing described parcel of real estate:

ARTICLE 57. To see if the Town will vote to amend Section IX of the Zoning By-Laws by adding to Paragraph I of said section as most recently amended, the following:


"or if upon a proposed subdivision of a lot existing at the time this By-Law is adopted, each resulting lot will be as large in area as the largest lot front- ing on the same street, and in the same block, and will have a frontage equal to that of the lot having the least frontage on the same street, and in the same block, at the time this By-Law is adopted. "


so that Paragraph I of Section IX will be as follows:


I. £ Land subdivided after the adoption of this By-Law shall provide in Zone A for lot frontages of not less than 115 feet and for lot areas of not less than 15,000 square feet which Zone is shown on zoning map of revised Residence Districts in the Town of Andover, Mass., January 20, 1955, on file with the Town Clerk, Provided however, that the Board of Appeals may permit land to be subdivided with lot frontages and, or lot areas, less than said requirements if two or more dwell- ings are located on an existing lot at the time this By-Law is adopted or, if upon a proposed subdivision of a lot existing at the time this By-Law is adopted, each resulting lot will be as large in area as the largest lot fronting on the same street and in the same block, and will have a frontage equal to that of the lot having the least frontage on the same street and in the same block at the time this By-Law is adopted, on petition of Karl C. Killorin and others.

ARTICLE 58. To see if the Town will vote to amend Section IX of the Zoning By-Laws by adding to Paragraph 4 of said section as most recently amended, after the words: "exist- ing lots" in the first sentence of said paragraph the words: " or lots resulting from approval of a subdivision of an existing lot by the Board of Appeals," so that said paragraph 4 will read as follows:


At each side of every dwelling there shall be a side yard not less than 15 feet in clear width, between the side of the house and the side lot line, except in specific cases when existing lots or lots resulting from a sub-division of an existing lot by the Board of Appeals are less than the minimum width prescribed by this By-Law. In such cases a side yard not less than ten feet in width may be permitted by the Board of Ap- peals. On corner lots no part of any building shall extend within twenty feet of the street line, on peti- tion of Karl C. Killorin and others.


Article 58 was withdrawn.


It was decided to combine and act on Articles 59 through 65.


ARTICLE 59. To see if the Town will vote to accept as a Public Way and name Arthur Road as approved by the Board of Survey, and laid out by the Board of Selectmen, as shown on plan No. 2548 recorded in the North Essex Regis- try of Deeds, filed with the Planning Board, and made by Ralph B. Brasseur, engineer, Haverhill, Massachusetts, a copy being on file in the Town Clerk's office, on petition of William C. Schmidt and others.


Upon motion duly seconded, it was VOTED unanimously to accept Article 59 as printed.


ARTICLE 60. To see if the Town will vote to accept as a Public Way and name Lockway Road from Carmel Road norther- ly to Walnut Avenue as shown on a plan entitled Street Ac- ceptance Plan made December 1952 by Clinton F. Goodwin, Engineer, Haverhill, Mass., as approved by the Board of Survey and laid out by the Board of Selectmen. Both the plan and the description referred to being on file at the Office of the Town Clerk, on petition of Phillips B. Mars- den, Jr., and others.


Upon motion duly seconded, it was VOTED unanimously to accept Article 60 as printed.

ARTICLE 61. To see if the Town will vote to accept as a Public Way and name Howell Drive as approved by the Board of Survey, laid out by the Board of Selectmen and shown on a plan entitled Subdivision and Acceptance Plan of Howell Drive dated May, 1957, Andover Engineers Inc., Andover, Mass. Both plan and description referred to be- ing on file at the office of the Town Clerk, on petition of Fred E. Cheever and others.


Upon motion duly seconded, it was VOTED unanimously to accept Article 61 as printed.


ARTICLE 62. To see if the Town will vote to accept as a public way, and name Karlton Circle, a way about 1440 feet long extending from the westerly end of Forbes Lane to a point about 150 feet from the easterly end of Forbes Lane; the said way being shown on a plan entitled: "Subdivision Plan of Karlton Field" made by Fred W. Stowers, Registered Surveyor, Methuen, Mass., and recorded as Plan No. 2571 in the North Essex Registry of Deeds, on petition of Karl C. Killorin and others.


Upon motion duly seconded, it was VOTED unanimously to accept Article 62 as printed.


ARTICLE 63. To see if the Town will vote to accept as a public way and name Kirkland Drive for the entire length as shown on a plan which has been approved by the Planning Board and laid out by the Board of Selectmen, and is on record at the Registry of Deeds and recorded with the Town Clerk, on petition of Alice E. Batcheller and others.


Upon motion duly seconded, it was VOTED unanimously to accept Article 63 as printed.


ARTICLE 64. To see if the Town will vote to accept as a Public Way, an additional part of Lucerne Drive continuing generally in an easterly direction from part already ac- cepted at the Town Meeting of March, 1957, as approved by the Board of Survey, and laid out by the Board of Select - men; and shown on Plan 4 entitled: "Subdivision and Accept- ance Plan Pine Acres", made July 1955 by Ralph Brasseur, Engineer, Haverhill, Massachusetts. Both plan and descrip- tion referred to are filed at the Town Clerk's office, on petition of Joseph O. Smethurst and others.


Upon motion duly seconded, it was VOTED unanimously to accept Article 64 as printed.


ARTICLE 65. To see if the Town will vote to accept as a public way, a private way now known as Marion Avenue, off Central Street, and intersecting Henderson Avenue, as

shown on a plan by Ralph Brasseur, Engineer, Haverhill, and dated February 1954, both plan and description to be on file at the Town Clerk's Office, on petition of Alexan- der H. Henderson and others.


Upon motion duly seconded, it was VOTED unanimously to accept Article 65 as printed.


ARTICLE 66. To see if the Town will vote to accept as a public way and name Marilyn Road as approved by the Ando- ver Planning Board and laid out by the Board of Selectmen as shown on a plan entitled "Plan of a Portion of Marilyn Road for Acceptance, dated January, 1958 and drawn by Ralph B. Brasseur, Engineer, Haverhill, Massachusetts" for a distance of Six Hundred Forty-Two and Ninety-One one hundredths (642.91) feet easterly from Arthur Road to Mary Lou Lane. Both plans and description referred to being on file at the Town Clerk's office, on petition of Maurice S. Close and others.


Upon motion duly seconded, it was VOTED unanimously to accept as a public way and name Marilyn Road as approved by the Andover Planning Board and laid out by the Board of Selectmen as shown on a plan entitled "Plan of a Portion of Marilyn Road for Acceptance, dated January, 1958 and drawn by Ralph B. Brasseur, Engineer, Haverhill, Massachu- setts" for a distance of Nine Hundred Twenty-Four and Ninety-One one hundredths (924.91) feet easterly from Arthur Road to and to include the turn-around. Both plans and description referred to being on file at Town Clerk's Office.


It was decided to combine and act on Articles 67 through 71.


ARTICLE 67. To see if the Town will vote to accept as a Public Way and name Mary Lou Lane as approved by the Board of Survey, and laid out by the Board of Selectmen, as shown on plan No. 2966 recorded in the North Essex Regis- try of Deeds, filed with the Planning Board, and made by Ralph B. Brasseur, Engineer, Haverhill, Massachusetts, a copy being on file in the Town Clerk's Office, on petition of William C. Schmidt and others.


Upon motion duly seconded, it was VOTED unanimously to accept Article 67 as printed.


ARTICLE 68. To see if the Town will vote to accept as a Public Way and name Old South Lane running from the wester- ly side of Central Street to and including a turn around for a distance of 732.73 feet, as approved by the Planning Board and laid out by the Board of Selectmen; and as shown

on a plan entitled, "Plan of Land of C. Lincoln & E. Jan- ice Giles, Lupine Road, Andover, Mass., October 5, 1956, A. R. Nicholson, Engr." and recorded with North Essex Registry of Deeds as Plan No. 3363, a copy of said plan being also on file with the Town Clerk for the Town of Andover, on petition of C. Lincoln Giles and others.

ARTICLE 69. To see if the Town will vote to accept as a public way Robandy Road, as approved by the Board of Sur- vey and laid out by the Board of Selectmen, as shown on the plan made by Clinton F. Goodwin, Engineer, Haverhill, Mass. and dated December, 1950, both plan and description being on file at the Town Clerk's office, on petition of Gordon L. Freeman and others.


Upon motion duly seconded, it was VOTED unanimously to accept Article 69 as printed.


ARTICLE 70. To see if the Town will vote to accept as public ways, Brookfield Road, Fox Hill Road, Rock Ridge Road and Woodcliff Road, as approved by the Planning Board and laid out by the Selectmen, as shown on Subdivision Plan No. 18975B filed with Certificate of Title No. 3996 recorded in Book 27, Page 185 with the records of regis- tered land in the North Registry District of Essex County , a copy of which is on file at the Office of the Town Clerk, on petition of Braeland Associates.


Upon motion duly seconded, it was VOTED unanimously to accept Article 70 as printed.


ARTICLE 71. To see if the Town will vote to accept as a public way and name, Stevens Circle, a way off Summer Street, as approved by the Planning Board January 18, 1955 and laid out by the Board of Selectmen as shown on the plan made by Clinton F. Goodwin, Engineer, Haverhill, and dated December 10, 1954, both plan and description being on file at the Town Clerk's Office, on petition of William A. Rus- sell and others.


Upon motion duly seconded, it was VOTED unanimously to accept Article 71 as printed.


ARTICLE 72. To see if the Town will vote to authorize the School Committee to continue to maintain State-Aided Voca- tional Education in accordance with the provisions of Chapter 74, General Laws, and acts amendatory thereto, or dependent thereon, and further raise and appropriate the sum of $2,470.00 therefor.

ARTICLE 73 .- To see if the Town of Andover will vote to grant permission and authority to the United Syrian Society Cemetery Corporation to use or convert the following des- cribed parcel of land for burial purposes as a cemetery or extension of an existing cemetery, in accordance with the Statutes in such cases made and provided: --


The following described land situated in said Town of Andover, and being Parcel B" and that portion of Parcel "A" as shown on a Plan of Land entitled "Plan of Land Be- longing to Samuel T. Luscomb et als, dated January 11, 1958, Vincent J. Marino, C. E.". Said Plan being recorded in Essex North District Registry of Deeds as Plan No.3611. Said Parcel being more particularly bounded and described as follows:


Beginning at a point on the northeasterly corner of land owned by the Roman Catholic Archbishop of Boston. Said point being on the west side of Corbett Road 485.5 feet, more or less south of the center line of Sylvester Street in Lawrence; Thence running N 890 - 49' - 40"W, 745.14 feet along said land of the Roman Catholic Arch- bishop to an iron post and lands of the Congregation Tem- ple Emmanuel of Lawrence. Thence turning and running along said land of the Congregation Temple Emmanuel N 1º- 34' -40" W, 333.62 feet to a stake and the Andover-Law- rence Boundary and land retained by grantor in Lawrence, being a portion of Parcel "A" as shown on aforementioned plan, thence turning and running along said boundary S 88° - 50' -27" E, 756.01 feet to the westerly side of Corbett Road; Thence turning and running S 50 - 31' -26"E, 127.63 feet along the west side of Corbett Road to a point, thence continuing along said road S 4º -14' -57" W, 193.94 feet to the point of beginning. ARTICLE 74. To see if the Town will vote to accept Chapter 41, Section 38A, of the General Laws and provide that the collector of taxes shall collect under the title of town collector, all accounts due the town.

ARTICLE 77. To see if the Town will vote to accept Gener- al Laws, Chapter 40, Section 6F, relative to making of repairs on private ways by municipalities as regulated by said Section 6F.

ARTICLE 78. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time after January 1, 1959, in anticipation of the revenue of the financial year begin - ning January 1, 1959, in accordance with Section 4, Chap- ter 44, General Laws and to issue a note or notes there- for, payable within one year, and to renew any note so issued for a period of less than one year, in accordance with Section 17 of said Chapter 44.

Upon motion of Mr. Harold Haller, a rising vote of thanks was given the Finance Committee for the splendid work they had done in preparing the Finance Committee Re- port.


Upon motion by George A. Noury and duly seconded, it was VOTED to authorize the Andover Housing Authority to appoint a committee to be known as the Urban Redevelopment Committee. The purpose of this committee will be to study the desirability of requesting Federal Funds as provided under the Federal Housing Act, for urban renewal projects, and for the undertaking of surveys and plans for such development.

Special Town Meeting


OCTOBER 6. 1958


Agreeably to a Warrant signed by the Selectmen, Septem- ber 25, 1958, the Inhabitants of the Town of Andover, qualified to vote in Town Affairs met and assembled in the Memorial Auditorium on Bartlet Street on Monday, the sixth day of October, 1958 at 7:30 o'clock P. M.


The check lists were used at entrance and showed 470 voters admitted to the meeting.


Secret ballots were on hand to be used if so voted.


The meeting was called to order by Charles G. Hatch, Moderator, at 7:40 o'clock P. M.


Unanimous consent was voted to admit seven persons (non- voters) .


Opening prayer was offered by Rev. Frederick B. Noss.


Salute to the flag was led by Selectman Stafford A. Lindsay.
