VIII Section 19. Duties of the Personnel Board

Upon motion duly seconded, it was VOTED to accept the recommendation of the Personnel Board that the maximums of the annual salary schedule and the Police-Fire annual salary schedule included in the Personnel By-Law, exclud- ing single rate classifications, be increased by 22% rounded off to the nearest dollar and that the steps from the minimums to the maximums of the Compensation Grades in the various classifications shall be the same in dollar amounts as those originally established in the Personnel By-Law adopted at the 1958 annual Town Meeting and also the recommendation of the Personnel Board that the maximums of the hourly wage schedule included in the Personnel By- Law, excluding single rate classifications, be increased by 22% rounded off to the nearest cent and that the steps from the minimums to the maximums of the Compensation Grades in the various classifications shall be the same in cent amounts as those originally established in the Per- sonnel By-Law adopted at the 1958 annual Town Meeting.


ARTICLE 7. To see if the Town will vote to continue for the further period of one (1) year a committee of three (3) to study and revise the Town By-Laws and Zoning By-Laws, appointed by the Selectmen for that purpose under Article 17 passed at the 1957 Annual Town Meeting, such committee to report at the next Annual Town Meeting.


Upon motion duly seconded, it was VOTED to accept Arti- cle 7 as printed.


ARTICLE 8. To see if the Town will vote to raise and ap- propriate or transfer from available funds, the sum of $2500 for the purpose of revising and re-drafting the Zoning Bu-Laws of the Town, such revision to be under the general supervision and responsibility of a committee of three (3) appointed by the Selectmen for that purpose un- der Article 17 passed at the 1957 Annual Town Meeting.


Upon motion duly seconded, it was VOTED to transfer $2,500.00 from available funds under Article 8.


ARTICLE 9. To see if the Town will raise and appropriate, under Chapter 40, Section 5B of the General Laws, the sum of THREE THOUSAND DOLLARS ($3,000.) for the purpose of establishing a 10-Year Revaluation Fund.


Article 9 was withdrawn.


ARTICLE 10. To see if the Town will raise and appropriate the sum of TWO THOUSAND DOLLARS ($2,000.) for the purchase of office furniture, equipment, and accessories to be used in the Town Hall.

Upon motion duly seconded, it was VOTED to transfer $2,000.00 from available funds under Article 10.


ARTICLE 11. To see if the Town will raise and appropriate the sum of TWELVE THOUSAND DOLLARS ($12,000.) for the pur- pose of establishing a Town Manager's Salary, additional clerical assistance that he may deem necessary, and office Supplies for his department.


Upon motion duly seconded, it was VOTED to transfer $12,000.00 from available funds under Article 11.


ARTICLE 12. To see if the Town will vote to raise and appropriate the sum of $3000.00 for the purchase of two new automobiles for the Police Department and use the trade-in value of one 1958 Ford Station Wagon and one 1958 Ford Sedan as part of the purchase price.


Upon motion duly seconded, it was VOTED to transfer $3,000.00 from available funds under Article 12.


ARTICLE 13. To see if the Town will raise and appropriate the sum of $11,065.00 for the purpose of increasing the Police Department to the extent of three more patrolmen and two more crossing attendants and uniforms.


Upon motion duly seconded, it was VOTED to transfer $11, 065.00 from available funds under Article 13.


ARTICLE 14. To see if the Town will vote to raise and appropriate or transfer from available funds, the sum of $24,000.00 for the purchase of a new 750 gallon per minute, Class A, Pumping Engine (fully equipped) for use in the Fire Department.


Article 14 was withdrawn.


ARTICLE 15. To see if the Town will vote to raise and appropriate $2450.00 to purchase a car for the use of Chief of Fire Department and use the trade-in value of a 1955 DeSoto as part payment.

ARTICLE 16. To see if the Town will vote to raise and appropriate or transfer from available funds, the sum of $9690.00 to provide for the salaries, uniforms and pro- tective clothing for three additional permanent employees to be used at the Central Fire Station.

ARTICLE 17. To see if the Town will vote to instruct the Moderator to appoint a committee of five members; one to be a representative of a local fire insurance agency, one an architect, one a construction engineer, one a real estate dealer and the fifth member to be the Chief of the Fire Department; to study the need of, the site for, and the building, equipping and manning of a fire station in the West Andover area and report their findings to the next Annual Town Meeting.


Upon motion duly seconded, it was VOTED to accept Arti- cle 17 as printed.


ARTICLE 18. To see if the Town will authorize the Board of Selectmen to grant to the Andover Housing Authority, its successors and assigns, an easement over a strip of land thirty feet in width running from Chestnut Street in said Andover in a southerly direction to the so-called Playstead area; and thence continuing in an easterly direc- tion along the northerly side of said Playstead area to land now owned by said Andover Housing Authority; to be used by the said Andover Housing Authority, the Inhabit- ants of the Andover Housing Authority and the Inhabitants of the Housing for the Elderly for all purposes for which streets or ways are commonly used in the Town of Andover.


Upon motion duly seconded, it was VOTED to authorize the Board of Selectmen to grant to the Andover Housing Authori- ty, its successors and assigns, an easement over a strip of land thirty feet in width running from Chestnut Street in said Andover in a southerly direction to the so-called Playstead area; and thence continuing in an easterly direc- tion along the northerly side of said Playstead area to land now owned by said Andover Housing Authority; to be used by the said Andover Housing Authority, the Inhabit- ants of the Andover Housing Authority, and the Inhabitants of the Housing for the Elderly for all purposes for which streets or ways are commonly used in the Town of Andover.


A standing negative vote was taken first, then a stand- ing affirmative vote, showing an overwhelming majority which the Moderator stated was well over the 2/3 vote as required. A quorum was present.


ARTICLE 19. To see if the Town will vote to authorize the School Committee to continue to maintain State-Aided Vocational Education in accordance with the provisions of Chapter 74, General Laws, and acts amendatory thereto, or dependent thereon, and further raise and appropriate the sum of $2,470.00 therefor.

Upon motion duly seconded, it was VOTED to transfer the sum of $2,470.00 from available funds under Article 19.


ARTICLE 20. To see if the Town will vote to raise and/or appropriate $240,000.00 for alterations and additions to the present Memorial Hall Library in the following manner :


That the Town raise and appropriate the sum of $73,230.00 through taxation for interior alterations and expansion of the present Memorial Hall Library Building; and to raise the sum of $166,770.00 in the following manner: $10,770.00 to be raised by taxation: $156,000.00 to be raised by bond issue, or by appropriation, or a transfer from avail- able funds, for a one-story addition to the front with sidewalk level entrance and a two-story addition to the west, including original equipment and furnishings of these additions, on petition of the Trustees of the Memo- rial Hall Library.


Upon motion duly seconded, it was VOTED to transfer the Sum of $112,161.00 from available funds for interior al- terations and expansion to the present Memorial Hall Library Building through a two-story addition to the west, including original equipment and furnishings of the addi- tion.


ARTICLE 21. To see if the Town will vote to raise and appropriate the sum of $665 for the purpose of purchasing a 5HP lawn mower to replace a mower 12 years old.


Upon motion duly seconded, it was VOTED to transfer the sum of $665.00 from available funds under Article 21.


ARTICLE 22. To see if the Town will vote a By-Law rela- tive to authorizing the Board of Selectmen and/or the Town Manager to charge a fee for all elevator inspections and to enact the following By-Law:


A Fee for inspection of an elevator by either the Building Inspector and/or some one designated by the Building Inspector shall be charged for the inspection of any elevator.


Upon motion duly seconded, it was VOTED unanimously to authorize the Board of Selectmen or the Town Manager to charge a fee for all elevator inspections and to enact the following By-Law:


A Fee for inspection of an elevator by either the Building Inspector or some one designated by the Building Inspector shall be charged for the in- spection of any elevator.


A quorum was present.

ARTICLE 23. To see if the Town will vote to accept the following amendments to the Building Code recommended by the Building Code Committee.


Section 7: To add the following paragraphs to Section 7 which will be known as 7 A, B, & C.


APPROVAL BY STATE OFFICIALS


7A. A certificate of approval from the Commissioner of Public Safety of the Commonwealth of Massachusetts Shall be furnished to the Building Inspector at the time of application for a permit for construction of a theater, hall, or other place of assemblage, or any schoolhouse, or any other building or structure for which the laws of the Commonwealth of Massachu- setts require plans or details to be filed with the Dept. of Public Safety.


POSTING OF PERMIT CARD


7B. The permit card issued by the Building Inspector must be displayed at all times in a conspicuous place on the premises where the work is carried on and must not be removed until all of the work has been complet- ed and approved by the Building Inspector.


CERTIFICATE OF OCCUPANCY


7C. No person shall occupy any building or structure hereafter constructed, altered, or placed unless a certificate of occupancy for the same shall have been granted.


The owner or representative of the owner of any building or structure for which a permit for construc- tion, alteration or placing has been granted shall, upon completion of the work authorized by the permit, notify the Building Inspector thereof. The Building Inspector, promptly after receipt of such notice, Shall inspect the building or structure. If the work authorized by the permit has been properly com- pleted and the permit carries the signatures of the other Inspectors involved, the Building Inspector Shall issue a certificate of occupancy to the owner specifying that the building or structure may be occupied for the purpose stated in the permit. The use to which any building or structure now or here- after existing shall be put, shall not be changed unless a certificate of change of use permitting the proposed use has been obtained from the Building Inspector. The Building Inspector, upon application

for such a certificate by the owner, shall issue it to him if the proposed use is in conformity with the law.


Section 10: To add the following sentence to Section 10 of definitions.

Structure: means a combination of materials to form a construction that is safe and stable; including among others, buildings, stadiums, tents, reviewing stands, platforms, stagings, observation towers, radio towers, water tanks and towers, trestles, piers and wharves, sheds, coal bins, shelters, fences and walls, and dis- play signs : the term structure shall be construed as if followed by the words "or part thereof."


Section 10: To eliminate the definition of dwelling house and replace it with the following:


Dwelling House: means a house in which not more than two families dwell independently and in which no part is used for business purposes, nor was originally construct- ed as a vehicle of locomotion.


Upon motion duly seconded, it was VOTED unanimously to accept the following amendments to the Building Code re- commended by the Building Code Committee.

ARTICLE 24. To see if the Town will vote to raise and ap- propriate or transfer from available funds in the treasury the sum of $18,000.00 for the purpose of renovating and making safe the building known as the "Richardson School" located in Shawsheen Village, which will result in estab- lishing a meeting place in Shawsheen Village for the vari- ous Civic and Community groups and provide better facili- ties for the "rainy-day" operation for the playground situated in Shawsheen Village. And to see if the Town will vote to accept $4,500 from the Citizens of Shawsheen Village to be used as part of the amount stated above and for the same purpose as stated above, on petition of Thayer S. Warshaw and others.


Article 24 was withdrawn.


ARTICLE 25. To see if the Town will authorize the Board of Public Works to repair and build sidewalks, construct highway fences and guard rails and raise and appropriate the sum of $10,000.00 therefor.


Upon motion duly seconded, it was VOTED to transfer the sum of $10,000.00 from available funds to authorize the Town Manager to repair and build sidewalks, construct highway fences and guard rails.


ARTICLE 26. To see if the Town will vote to raise and appropriate the sum of $2,017.00 to purchase one tractor with a front end loader and the price allowed for one old tractor used as part payment at the request of the Board of Public Works.


Upon motion duly seconded, it was VOTED to transfer the sum of $2,017.00 from available funds to purchase one tractor with a front end loader and the price allowed for one old tractor used as part payment.


ARTICLE 27. To see if the Town will vote to raise and appropriate from available funds and/or by taxation the sum of $36,000.00 for Chapter 90 Highway Construction, the Town to be reimbursed 50% by the State, 25% by the County upon completion of work at the request of the Board of Public Works.

ARTICLE 28. To see if the Town will authorize the Board of Public Works to purchase a power sweeper for the High- way Dept. and raise and appropriate the sum of $12,000.00

ARTICLE 29. To see if the Town will vote to raise and appropriate $5,000.00 from unappropriated available funds in the treasury for improving certain portions of high- ways, by securing easements, by gift, by purchase, by re- lease or by seizure by right of eminent domain upon the recommendation of the Board of Public Works and as ap- proved by the Town Counsel on the following streets; Woburn Street, Sunset Rock Road, Salem Street, River Street, Reservation Road and Argilla Road as shown on various plans.


Upon motion duly seconded, it was VOTED unanimously to transfer the sum of $5,000.00 from available funds for improving certain portions of highways, be securing ease- ments, by gift, by purchase, by release or by seizure by right of eminent domain upon the recommendation of the Town Manager and as approved by the Town Counsel on the following streets; Woburn Street, Sunset Rock Road, Salem Street, River Street, Reservation Road and Argilla Road, as shown on various plans.


ARTICLE 30. To see if the Town will authorize the Board of Public Works to purchase one new dump truck to replace the 1951 Mack Truck, one new dump truck to replace the 1947 Diamond T truck, one new light truck to replace the 1950 Studebaker, and raise and appropriate the sum of $13,500.00 therefor and the price allowed for trade-in of the old trucks used as part payment.


Upon motion duly seconded, it was VOTED to transfer the Sum of $11,000.00 from available funds to authorize the Town Manager to purchase two new large dump trucks, plus trade-in of old trucks used as part payment.


ARTICLE 31. To see if the Town will vote to raise and appropriate by taxation and/or by transfer from available funds and/or by bond issue the sum of $80,000.00 for im- provements to the water system as hereinafter described; and authorize the Board of Public Works to install water mains which are not less than six inches and not more than sixteen inches in size from Elm Street to Haverhill Street and to authorize the Board of Public Works to acquire the necessary easements by gift, by purchase or by seizure by right of eminent domain. All work to be done under the Supervision of the Board of Public Works with the approval

of the Finance Committee and the Board of Selectmen.


Upon motion duly seconded, it was VOTED unanimously to transfer the sum of $80,000.00 from available funds for improvements to the water system as hereinafter described; and to authorize the Public Works Department to install water mains which are not less than six inches and not more than sixteen inches in size from Elm Street to Haver- hill Street as shown on a plan on file in the Public Works Department, and to authorize the Town Manager to acquire the necessary easements by gift, by purchase or by seizure by right of eminent domain. All work to be done under the supervision of the Town Manager with the approval of the Finance Committee and the Board of Selectmen. A quorum was present.


ARTICLE 32. To see if the Town will vote to raise and appropriate the sum of $245,820.00 for the purpose of con- structing a relief trunk sewer from the Riverina Road sew- age pumping station to Essex Street; and then to the in- terceptor on Essex Street; and transfer from available funds or raise by taxation $35,820.00 and instruct the treasurer with the approval of the Selectmen to issue and sell bonds in the amount of $210,000.00 and authorize the Board of Public Works to acquire the necessary easements by gift, by purchase or by seizure by right of eminent do- main. All work to be done under the supervision of the Board of Public Works with the approval of the Finance Committee and the Board of Selectmen.


Article 32 was withdrawn.


ARTICLE 33. To see if the Town will vote to raise and appropriate by taxation or transfer from available funds the sum of $10,000.00 for the purpose of making necessary changes to the water and sewer systems due to changes in the locations of route 110 and 125. All work to be done under the supervision of the Board of Public Works.


Article 33 was withdrawn.


ARTICLE 34. To see if the Town will vote to raise and appropriate $4,000.00 for the purpose of completing a study of the low level water system under the supervision of the Board of Public Works.


Upon motion duly seconded, it was VOTED to transfer the sum of $4,000.00 from available funds for the purpose of completing a study of the low level water system under the supervision of the Town Manager.


ARTICLE 35. To see if the Town will authorize the Board

of Public Works to purchase one utility truck with equip- ment for the use of the water and sewer department and raise and appropriate the sum of $4,000.00 therefor.


Article 35 was withdrawn.


ARTICLE 36. To see if the Town will vote to change the method of sewer installation assessment for the Town from 25% for the Town and 75% for the abuttors as determined by the vote of the Annual Town Meeting of March 7, 1898 in acceptance of Chapter 386 of the Acts of 1895, and amend- ments thereto, which is an Act to authorize the Town of Andover to establish a system of sewerage, to 33 1/3% for the Town and 66 2/3%for the abuttors.


Upon motion duly seconded, it was VOTED to change the method of sewer installation assessment for the Town from 25% for the Town and 75% for the abuttors as determined by the vote of the Annual Town Meeting of March 7, 1898 in acceptance of Chapter 386 of the Acts of 1895, and amend- ments thereto, which is an Act to authorize the Town of Andover to establish a system of sewerage, to 33 1/3% for the Town and 66 2/3% for the abuttors.
